SPECIAL MEETING OF THE CITY COUNCIL
APRIL 20, 1981
The Schertz City Council convened in Special Workshop session, Monday,
April 20, 1981 at 7:00 P.M. in the Conference Room of the Municipal
Complex. 1400 Live Oak Road, with the following members present: Mayor
Jack M. Stomackin, Sr. presiding; Richard L. Howe; Barbara Taylor; Jeff
Duffield; Earl W. Sawyer and Jacqueline Lawler. City staff: City Manager
Jimmy G. Gilmore and City Secretary June G. Krause.
#1 WORKSHOP SESSION:
A. Resolution: Mr. Gilmore explained the resolution was acknowledging
the designation of wastewater treatment management agency for the operation
and maintenance of the sewage collection system for the City. Mr. David
Dennis from CCMA was present and further explained the necessity for this
action was in part because the State needed a revised resolution and could
not locate in their files the "Implementation Statement" from 1978. This
action will help if the city every wants or needs to apply for a grant,
as the present resolution is worded, Schertz is not a management agency.
The original one only stated that the City recommends de-designation of the
CCMA portion of the San Antonio 208 Waste Treatment Management Area .and the
inclusion of this area into the State non-designated 208 Planning area.
B. Sewer rates: The City Manager explained that at present the City
sewer rates consist of a base rate for debt service and system depreciation
of $2.50 and a user charge for system operation and maintenance based on
70% of the user's average water consumption as computed for the months of
December, January and February; at $.80 for each 1000 gallons.
This user's charge was set by Council in 1978. The same year CCMA increased
their rate to the City to $.89 per 1000 gallons. In August of 1979, CCMA
again increased this rate to $.92 per 1000 gallons; but the City is still
assessing at the 1978 rate and the increases were absorbed by using a portion
of the base rate charges to offset the increases.
This usage of the base rate income to offset the increases in user charges
damage the City's bond rating. Bond ratings are established on net revenues;
that is, the gross revenues less the cost of operation and maintenance.
He offered Council a table showing six average users and the rate comparison
of the present rate charged by the City, CCMA charge to the City, City
charge if we go to 100% water usage and remain at 80~/1000; CCMA charge to
City when they go to 100% water usage; and the charge if the City increases
user charge to 92~ based on 100% water usage. He said that the only way
the City can maintain the base rate as established by ordinance is to charge
the users the same amount in the user charge as is charged the City by CCMA.
In effect, the City has been violating its' sewer rate ordinance since the
time it was written in 1978.
He recommended, at this time, going to 100% of the winter month average
usage and remain at the 80~/1000 gallons and then within nor more than six
months increase to 92~ per 1000 gallons used.
Council agreed with this recommendation and requested an ordinance be
presented at the May 5th meeting.

C. Rezoning request: Mr. Gilmore said that a rezoning request had been
made by Mr. Von Scheele to rezone the front lot on FM 3009 in Greenfield
Subdivision from R-l to R-5A (Garden Homes). This area was originally
zoned incorrectly as R-l, since the area is not deep enough to conform to
the R-l zoning. It could only be zoned for Garden Homes, multi-family,
business or smaller lot R-2 zoning. The Planning and Zoning has already
recommended a public hearing be called on this rezoning request, which
has tentatively been set for May 5th at Council previous agreement.
D. P&Z Membership: As the P&Z is in need of new members, caused by the
resignation of Chairman Aguilar and the possible resignation of two other
members. Council suggested Mr. William Courtney and Mr. Chuck Piefer and
asked that they be invited to the next workshop meeting for general dis-
cussion.
E. Park Reservation: The City Manager advised that he was working on
revlslng the park reservation ordinance so that all users pay their share
of the upkeep. He recommended that out of town users of the park be charged
a higher fee than our on citizens who are helping to pay for the upkeep by
taxes. Council agreed with this recommendation.
Council also briefly discussed revising the Community Center policy concerning
the use of non-Schertz police officers at large gatherings.
#2 GENERAL DISCUSSION:
The City Manager advised the City has a new Animal Control Officer, Mirisa
Kintaro. Mr. Sawyer asked if new employees could be asked to come to a
workshop meeting in order to meet the Council, when it is convenient for
the employee.
Mr. Gilmore also briefly discussed his recommended budget amendments that
are on the agenda for the meeting of April 21.
