REGULAR MEETING OF THE CITY COUNCIL

I The Schertz City Council convened in Regular Session, Tuesday, September 1,
1981 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the follow-
ing members present: Mayor Jack M. Stomackin, Sr., presiding; Richard L.
Howe; Barbara Taylor; Jeff Duffield; Earl W. Sawyer and Jacqueline Lawler..
Staff present were City Manager Jimmy G. Gilmore and City Secretary June G.
Krause.
#1 APPROVAL OF MINUTES: A. Mrs. Lawler moved to approve the minutes
of the Workshop Session of August 17,
1981. Mr. Howe seconded the motion which carried with the following vote:
AYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler
NAYS: None
B. Mr. Howe moved to approve the minutes of the Regular Session of August 18,
1981. Mr. Sawyer seconded the motion which carried as follows:
AYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler
NAYS: None
#2 HEARING OF RESIDENTS: None
#3 P&Z RECOMMENDATIONS: The Mayor called attention to the P&Z recom-
mendation that Mr. Clayton McMahan and Mr.
William Courtney be appointed to serve as members of the P&Z.
Mr. Howe moved to accept the P&Z recommendations and appoint Mr. Clayton
McMahan and Mr. William Courtney as members of the Planning and Zoning
Commission. Mr. Duffield seconded the motion which carried as follows:
AYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler .,;f

#4 ORDINANCE: The Mayor introduced an ordinance adopting the 1979
edition of the Southern Standard Fire Prevention Code
and adopting the 1980 edition of the National Fire Code and read the caption
as follows:
AN ORDINANCE
OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE
OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY
REVISING SECTION 7-1 OF SAID CODE TO REFLECT THE
ADOPTION OF THE 1979 EDITION OF THE SOUTHERN STANDARD
FIRE PREVENTION CODE AND AS SAID CODE IS HEREINAFTER
REVISED AND/OR AMENDED; PROVIDING FOR THE ADOPTION OF
THE 1980 NATIONAL FIRE CODE AND AS SAID CODE IS HERE-
INAFTER REVISED AND/OR AMENDED; AND BY PROVIDING AN
EFFECTIVE DATE.
Mrs. Lawler moved to accept the first reading of this ordinance. Mr.
Sawyer seconded the motion which carried as follows:

At this point, Mayor Stomackin called both Mr. McMahan and Mr. Courtney
forward and introduced them to the Council and audience as the newly
appointed members of the P&Z.
#5 ORDINANCE: The Mayor introduced, as an emergency measure, an
ordinance establishing rentals to be paid by public
or private utility companies, and read the caption as follows:

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
ESTABLISHING RENTALS TO BE PAID BY TELEGRAPH, SEWER, TELEPHONE,
ELECTRIC, WATER, GAS OR ANY FORM WHATSOEVER OF PUBLIC OR PRI-
VATE UTILITY ASSOCIATIONS, ORGANIZATIONS, COMPANIES OR CORPOR-
ATIONS, OR INDIVIDUAL OWNED OR OPERATED SERVICE PROVIDING
UTILITIES OF ANY FOR WHATSOEVER, FOR THE PRIVILEGE OF USING
THEIR POLES, WIRES, CABLES, CONDUITS, PIPES, FIXTURES, OR
ANY OTHER MEANS OF CONVEYANCE OF THEIR SERVICE, IN, OVER AND UNDER
THE PUBLIC STREETS, AVENUES, ALLEYS, HIGHWAYS AND BOULEVARDS,
EASEMENTS, PARKS AND PUBLIC GROUNDS WITH THE CITY OF SCHERTZ,

Mr. Sawyer moved this ordinance be considered as an emergency measure
and approved effective immediately. Mr. Howe seconded the motion which
carried with the following vote:

#6 ORDINANCE: The Mayor introduced, as an emergency measure, an
ordinance providing that all utility companies file
rate charges with the City, and read the caption as follows:
ORDINANCE NO. 81-F-25
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
PROVIDING THAT ALL WATER, TELEPHONE, TELEGRAPH, ELECTRIC AND
GAS ASSOCIATIONS, ORGANIZATIONS, COMPANIES AND CORPORATIONS
SHALL FILE WITH THE CITY OF SCHERTZ, TEXAS, A LIST OF ALL RATES
CHARGED USERS FOR THEIR SERVICE; PROVIDING A PENALTY FOR
VIOLATION; REPEALING ORDINANCE NO. 61 OF THE CITY OF SCHERTZ;
AND DECLARING AN EMERGENCY.
Mr. Sawyer moved this ordinance be considered as an emergency measure,
and be passed immediately. Mrs. Lawler seconded the motion which carried
with the following vote:

#7 EXECUTIVE SESSION: None needed at this time.

#8 CITY MANAGER'S REPORT: A. Mr. Gilmore asked to delete item #4
from the proposed September newsletter.
B. He said he had received several calls from Mobile Villa residents with
regards to their water. He has told them the City will hold a public meeting
September 15th to allow them to ask questions and discuss the proposed pur-
chase by the City of the Mobile Villa Water System.
C. He mentioned that a member of the Housing Authority has resigned and that
we would be looking, along with the Housing Authority Board, for a new mem-
ber. The Housing Authority interviews and recommends to Council for appoint-
ment. If anyone has someone in mind for this appointment, contact Mr. Duncan
and give him the name.
D. Staff is continuing the review of some of the City.s older ordinances
and policies and are trying to update and change those requiring it, in
order to save tjme and money.
Mr. Richard Harris expressed his regret that he was unable to attend the
recent TML Region 7 meeting and thanked the City for inviting him.
#10 ITEMS BY MAYOR: Mayor Stomackin called Council 's attention to
the letter of apology from Mr. Bohan.
#9 ITEMS BY COUNCIL: Mr Howe expressed his gratitute to Mr. Steve
Simonson for the excellent report of the
Housing Authority acitvities he has been supplying the Council.
He also asked the progress of the new well job. Mr. Gilmore said the well
was being tested that day and they should be removing the pump from the
old well and placing in the new one in few days. Mr. Boswell is in the
process of checking everythingtna1 is being done. The antenna portion is
alsmost ready to go also.
Mr. Howe mentioned that, as he promised at the last meeting, he did bring
some aerial maps to Mr. Gilmore. They were not exactly what had been re-
quested but are much more current than any the City now has. The people
will be making an aerial fly over again soon and we will be able to get
more current maps at that time, at no charge to the City. Mr. Gilmore
agreed that the ones brought out are very good maps.
Mrs. Lawler asked if the bicycle lanes could be repainted, especially now
that school has started, as they are very faint.
Mr. Sawyer mentioned that P&Z member Stanhope had asked about the high grass
on the right of way of the Railroad and highways. Mr. Gilmore said both
agencies had been contacted regarding the grass and weeds.
Mrs. Taylor welcomed both Mr. Courtney and Mr. McMahan and thank_them for
volunteering for the P&Z positions. She said she hoped they would be with
the city for several years and looked forward to working with them.

The Schertz City Council convened in Workshop~ession, Monday, September 14,
1981 at 7:00 P.M. in the Confe~ence Room, 1400 Live Oak Road with the follow-
ing members present: Mayor Jack M. Stomackin, presiding; Richard L. Howe;
Barbara Taylor, Jeff Duffield; Earl W. Sawyer and Jacqueline Lawler. Staff
present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause.
#1 WORKSHOP: Mr. Gilmore briefly went over some of the agenda items
for the Tuesday night meeting. He advised that the
meeting with the Mobile Villa residents was just for informational purposes
in order that they may receive answers to any specific questions.

In discussing the proposed ordinance on fire codes, Mr. Sawyer asked if the
City has a reciprocal agreement with Guadalupe County. Mr. Gilmore said that
we do not at this time but he will get what information he can and report back.
Mr. Sawyer also suggested that before the City finalizes on the disannexation
we should get a letter of mutual agreement with Cibolo. Council concurred
that the City Manager should pursue this matter.
The City Manager explained that we are 18 months ahead of the schedule of
billing per capita for SAFES participation by cities. The $1.32 per capita
will be instituted this coming fiscal year. He had talked with our Warrant
Officer and he would be willing to collect unpaid bills for SAFES on a per-
centage basis.
Mrs. Lawler brought to Council attention that with the split day kindergarten,
we have small children crossing Live Oak Road at Curtiss going to their
11:30 A.M. classes and there is no Crossing Guard at that time. During
this particular time, the High School students are out and crossing Live Oak
is very dangerous for the small children. Mr. Gilmore was to have a patrol
there for a few days to help and check the number of citizens involved.
Council concurred to leave this matter to the City Manager's discretion.
