SPECIAL SESSION OF THE CITY COUNCIL
JULY 2, 1979
The Schertz City Council convened in Special Session, Monday, July 2, 1979
at 7:01 P.M. in the Council Chambers, 1400 Live Oak Road, with the following
members present: Mayor Robert C. Bueker, presiding; Richard L. Howe, Walter
F. Schneider, Earl W. Sawyer and Jack Stomackin, Sr. Absent: Gail Hyatt.
Staff present: City Manager Walter W. Hill, Jr., City Secretary June G. Krause.
#1 JOINT MEETING WITH THE PERSONNEL BOARD: Council discussed with the
Personnel Board their
recommendations on the Personnel Policiy and Pay Plan.
#2 WORKSHOP: Council had a short workshop session and discussed two
requests for annexation and services, and the proposed
move of the SAFES people to the Community Center offices.
#3 ADJOURNMENT: On a motion by Mr. Sawyer, seconded by Mr. Howe and
unanimously carried, the meeting adjourned at 9:06 P.M.

REGULAR MEETING OF THE CITY COUNCIL
JULY 3, 1979
The Schertz City Council convened in Regular Session, Tuesday, July 3, 1979
at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following
members present: Mayor Robert C. Bueker, presiding; Richard L. Howe; Walter'
F. Schneider; Earl W. Sawyer and Jack Stomackin, Sr. Absent: Gail Hyatt.
Staff present: City Manager Walter W. Hill, Jr., City Secretary June G.
Krause and City Attorney Richard W. Harris.
#1 APPROVAL OF MINUTES: A. Mr. Howe moved the minutes of the Special
Meeting of June 18, 1979 be approved.
Mr. Sawyer seconded the motion which carried with the following vote:

B. Mr. Howe moved the minutes of the Regular Meeting of June 19, 1979 be
approved. Mr. Sawyer seconded the motion which carried with the following vote:

C. Mr. Schneider moved to accept the minutes of the Workshop Session meeting
of June 23. Mr. Howe seconded the motion which carried with the following vote:
AYES: Councilmembers Howe, Schneider, Sawyer and Stomackin
NAYS: None
D. Mr. Sawyer moved to accept the minutes of the Special Session of June 26,
1979 as written. Mr. Howe seconded the motion which carried with the following
vote:

#2 HEARING OF RESIDENTS: There were no residents wishing to speak on
agenda items.
Mr. Ron Rakowsky addressed the Council saying that he was moving from Schertz
but that as an observer of the political scene for several years he thought
this Council has been a good Council and urged them to keep up the progressive
work. He also stated he thought they had an excellent City Manager in Walter
Hill and urged the Council to keep him.
#3 ORDINANCE: The Mayor introduced the following captioned ordinance
with the City Manager reading the caption and briefly
described the ordinance as taking off the declining rates on the water rate
scale. He recommended the new rates become effective October 1, 1979.
Mr. Stomakcin moved that said ordinance be considered by the Council. Mr.
Sawyer seconded the motion which carried with the following vote:

The following captioned ordinance was then discussed and fully considered by
the Council:
AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT
THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED
BY REVISING SECTION 19-37 (a) OF SAID CODE; PROVIDING A
UNIFORM MONTHLY RATE FOR THE USE OF CITY WATER WITHIN THE
CORPORATE LIMITS OF THE CITY.
Whereupon Mr. Stomakcin moved to approve the first reading of the ordinance
and making the rate charge change effective October 1, 1979. Mr. Sawyer
seconded the motion which carried with the following vote:

#4 ORDINANCE: The Mayor introduced the following captioned ordinance
with the C~ty Manager reading the caption and explaining
the need for the ordinance. Mr. Schneider moved that said ordinance be
considered by the Council. Mr. Saywer seconded the motion which carried
with the following vote:

The following captioned ordinance was then discussed and fully considered by
the Council:
AN ORDINANCE ESTABLISHING A POLICE RESERVE FORCE AND SETTING
FORTH THE CONDITIONS REGULATING SUCH POLICE RESERVE FORCE
AND ITS ACTIVITIES; AND REPEALING ALL ORDINANCES IN CONFLICT.
Whereupon Mr. Schneider moved that said ordinance be accepted on the first
reading and be further considered at the next regular meeting of the City
Council to be held on the 17th of July, 1979, which motion was seconded by
Mr. Sawyer and carried by the following vote:

#5 ORDINANCE: The Mayor introduced an ordinance amending the park
regulations, with the City Manager reading the caption
of the ordinance. Council then discussed and considered the ordinance.
There was discussion concerning the electric charge for the pavilion and
the installation perhaps of a coin operated meter with an override feature
for the use of the kids to practice basketball. After discussion, Mr.
Schneider moved to table this item until the next regular meeting of the
City Council. Mr. Sawyer seconded the motion which carried with the follow-
ing vote:

#6 ORDINANCE: The Mayor introduced the following captioned ordinance
and the City Manager read the caption and briefly
explained the contents.
AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT
THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED
BY REVISING SECTIONS 18-2 AND 18-91 OF SAID CODE; PROVIDING
FOR TRAFFIC ENGINEER DESIGNATION AND PARKING PROHIBITIONS.
After lengthy discussion of the ordinance, Mr. Schneider moved to approve
this ordinance on the first reading and by the second reading (at the next
regular meeting of the City Council) come up with recommendations and policy
and designate the Citizens Participation Committee to review all of the
street ,signs in the city. Mr. Sawyer seconded the motion which carried
with the following vote:

#7 PERSONNEL RECOMMENDATIONS: The City Manager presented the recommend-
ations of the Personnel Board on the
updating of the Personnel Manual. Mr. Howe suggested that Section 11.03
should be changed to reflect that uniforms will be furnished to "permanent"
employees only.

After discussion, Mr. Schneider moved to accept the recommended updating
of the Personnel Manual with the changed in Section 11.03 as suggested by Mr.
Howe. Mr. Howe seconded the motion which carried with the following vote:

B. Mr. Schneider moved to change to TML hospital insurance and all employees
be covered, to be effective 1 August 1979. Mr. Sawyer seconded the motion
which carried with the following vote:

#8 PAYMENT AUTHORIZATIONS: A. Mr. Hill explained that regarding
the payment of these engineering fees,
no payment would be paid until everything is final up to this point.
Mr. Stomackin moved to make payment to Howard Gaddis for engineering fees on
the 20" water transmission line in the amount of $16,296.32. Mr. Howe seconded
the motion. After brief discussion by the Council, Mr. Stomackin withdrew his
motion and Mr. Howe withdrew his second. Mr. Stomackin then moved to pay Mr.
'Gaddis.for: engineering fee for the 20' walter transmission line, upon receipt
of easements and everything is ready to go, in the amount of $16,296.32.
Mr. Sawyer seconded the motion which carried with the following vote:

B. Mr. Schneider moved to pay R. A. Travis Painting, Inc. $5,400 for painting
of G. W. Pickrell Park Pavilion. Mr. Sawyer seconded the motion which carried
with the following vote:

#9 HOUSING AUTHORITY REQUEST: The City Manager presented a request
in letter form from the Housing Authority
offering in dedication all interior streets and adjacent sidewalks within
the Clyde Ford Village project, together with storm and sanitary mains.
Also Mr. Hill brought up the Housing Authority Community Center agreement
whereby they would operate a community center since at the time the city did
not have one; but now that the city has a community center in operation, it
seems they should make payment in lieu of taxes to the city.

Council discussed these items at length.
Mr. Schneider moved to table item #9 until the Council could get more
information and bring back at a later date. Mr. Howe seconded the motion.
Mr. Hill referred the Council to another letter request from the Housing
Authority in which they asked that a speed limit in this project of 5 miles
per hour be considered. This item will be referred to the committee reviewing
the traffic ordinance.
After further discussion, the Mayor called for a vote on the motion which
carried as follows:

#10 EXECUTIVE SESSION: None needed at this meeting.
#11 CITY MANAGER1S REPORT: Regarding the sealcoating work', Council
asked if the balance of the streets needing
this could be done at this time, even if it meant borrowing the money.
Mr. Harris said that on a co~tract that went out for bids, only 25% of the
contract could be added. Mr. Hill was to check with the contractor on this
subject.
Mr. Harris brought the Council up to date on the Jupe case, saying that he
had had disagreements on the judgement but had at last gotten them signed
and they have 30 days to appeal from the date it was signed by the Juage.
#12 ITEMS BY MAYOR: None at this time.
#13 ITEMS BY COUNCIL: Mr. Howe asked about the repairs to the street
where a water line was put in in Deer Haven and
Mr. Hill said the engineer would be over this week to look at it.
Mr. Howe also said he would have the answers to the questions asked the County
Judge this week for the Council to look at.
#14 ADJOURNMENT: On a motion by Mr. Schneider, seconded by Mr. Howe,
and unanimously carried, the meeting adjourned at
