REGULAR MEETING OF THE CITY COUNCIL
JULY 17, 1979
The Schertz City Council convened in Regular Session, Tuesday, July 17,
1979 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the
following members present: Mayor Robert C. Bueker, presiding; Richard L.
Howe; Gail Hyatt; Walter F. Schneider; Earl W. Sawyer and Jack M. Stomackin,
Jr. Staff present: Walter W. Hill, Jr., City Manager; June G. Krause, City
Secretary.
#1 APPROVAL OF MINUTES: A. Mr. Schneider moved to accept the minutes
of the Special Meeting of July 2, 1979.
Mr. Howe seconded the motion which carried with the following vote:
AYES: Councilmembers Howe, Schneider, Sawyer and Stomackin.1
NAYS: None
ABSTAINING: Mrs. Hyatt
B. Mr. Howe moved to accept the minutes of the Regular Meeting of July 3,
1979. Mr. Sawyer seconded the motion which carried with the following vote:
AYES: Councilmembers Howe, Schneider, Sawyer and Stomackin.
NAYS: None
ABSTAINING: Mrs. Hyatt.
C. Mr. Schneider moved to accept the minutes of the Special Meeting of July 10,
1979. Mr. Howe seconded the motion which carried with the following vote:
AYES: Councilmembers Howe, Schneider, Hyatt, Sawyer and Stomackin.
NAYS: None
#2 HEARING OF RESIDENTS: Mr. Froboese reserved time for Item #11.
Mrs. Rhee Berg, representing herself and her husband as owners of True Per-
formance, addressed the Council concerning their repairs of city owned vehicles.
She said there seemed to be some controversy about the SAFES ambulance repairs;
that several people had been in her shop checking with the mechanic. She said
they get the feeling that they are being mistrusted. Also although they do not
have a contract with the city, they still go out at all hours and have the
emergency vehicles towed in for repairs and try to help the city in all ways
possible.
Mr. Schneider said that if he saw a city vehicle in their shop he would stop
by and see what was going on. That he would not be muzzled as to who he talked
to in their shop. He also said that he was checking and trying to do his job'land
that he would continue to do it.
Mayor Bueker said that he understood that their company's integrity had been
violated and that as a business person she was entitled to run her business
the way she wanted. Council does have the right to investigate in any manner
open to them; but the shop was their livelihood and they had the right to do
whatever they thought necessary. He also said that he did not feel that the
Council as a body was questioning their integrity but the Council does have
a concern.

Mrs. Berg closed by saying that if anyone had a concern about the work they
are doing to please go to either of the owners and they will work with them
everyway possible.
2. Mr. Roman Froboese expressed concern about the rezoning and tax change of
his property on FM 3009 and Mrs. Pellerin voiced her objection to having any
commercial zoning along FM 3009.
#3 CABLE TV BRIEFING: Missy Goerner, Special Projects Officer for UA
Columbia Cable Television, briefed the Council
on the progress of the Cable Television installation, saying some areas
should have cablevision by September. She explained the different types of
service to be provided and options available.
#4 APPOINTMENT OF AUDITOR: Mr. Hill introduced Mr. Carlos Melick, a
CPA in Universal City, who answered questions
the Council had concerning auditing services.
'Mr. Sawyer moved that Mr. Carlos Melick be appointed to do auditing service
requirements for the City for the coming year. Mr. Schnetder seconded the
motion which carried with the following vote:
AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin.
NAYS: None
#5 SALE OF CITY PROPERTY: The City Manager recommended advertising for
bids on the selling the property now occupied
by SAFES with the bid opening date of August 17, 1979.
Council discussed the sale of just the building or perhaps both the building
and land.
After which, Mr. Schneider moved to authorize the City Manager to go out and
advertise for bids to sell the property where SAFES is now located and go
out for the building by itself and the land itself. Mr. Sawyer seconded the
motion.
Further discussion followed, after which Mr. Sawyer withdrew his second and
Mr. Schneider withdrew his motion. Mr. Schneider then made a motion to
adverti se for bi ds to sen the property where SAFES is now located and go out
for bids for the house, the land and a combination of the house and land.
Mr. Sawyer seconded the motion which carried with the following vote:
AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin.
NAYS: None
#6 ADVERTISEMENT FOR BIDS: Mr. Hill recommended going out for bids
on a basic building for the SAFES vehicles
with alternates for such things as insulation, heating, plumbing.
Mr. Howe moved to authorize the City Manager to advertise for bids on the
ambulance facilities with a basic bid and alternates. Mrs. Hyatt seconded the
motion which carried with the following vote:
AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin.

#7 ORDINANCE: The Mayor introduced the following captioned ordinance
with the City Manager reading the caption. Mr. Schneider
moved to accept the ordinance on water rates changes for a final consideration.
Mrs. Hyatt seconded the motion which carried with the following vote:
AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin.
NAYS: None
AN ORDINANCE
OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCE
CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 19-37 (a) OF
SAID CODE; PROVIDING A UNIFORM MONTHLY RATE FOR THE USE OF C!TY WATER
WITHIN THE CORPORATE LIMITS OF THE CITY; AND PROVIDING AN EFFECTIVE
DATE.

#8 ORDINANCE: The Mayor introduced the following captioned ordinance
with the City Manager reading the caption. After dis-
cussion, Mr. Stomackin moved to accept the final reading of an ordinance
on Police Reserves. Mr. Sawyer seconded the motion which carried with the

ESTABLISHING A POLICE RESERVE FORCE AND SETTING FORTH THE
CONDITIONS REGULATING SUCH POLICE RESERVE FORCE AND ITS
ACTIVITIES; AND REPEALING ALL ORDINANCES IN CONFLICT.

#9 ORDINANCE: The Mayor introduced an ordinance on traffic engineer
designation and parking prohibitions. The City Manager
advised the Council that although the ordinance was passed on the first
reading, the Charter says the final consideration is to take place at the
next regular meeting of the Council. However, as the Council has asked the
Citizen Participation and Improvement committee to study the sign designations
in the City, and they have not finished their study or have recommendations
at this time, The City Manager suggested this ordinance be denied at this
time to be taken up again after the study is completed.
Mr. Howe moved to kill the ordinance designating the traffic engineer and
regulating parking at this time. Mrs. Hyatt seconded the motion which carried
with the following vote:

#10 HOUSING AUTHORITY REQUEST: The City Manager said that again we
have not received the input from the
Housing Authority and recommended tabling this item.

Mrs. Hyatt moved this item be tabled. Mr. Howe seconded the motion which
carried with the following vote:
AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin.
NAYS: None

#11 RESOLUTION: The Mayor introduced a resolution on agricultural and
timber land taxes. He then asked Tax Assessor Collector
Hal Baldwin to brief everyone on the changes brought about by HB 1060 and
SB 621.
Mr. Baldwin said that SB621 establishes a single appraisal district for each
county. The five member board for this office will be elected in November 1979
to set in motion the procedures for planning and organizing the appraisal
district office. The county clerk by September 30 must ascertain the total
property tax levy of each municipality and school district having property in
the county to obtain the percentage of the voting entitlement of each juris-
diction. Then jn the November election, all taxing units will vote on members.
All taxable property will, on January 1, 1982, become appraisable by the
Appraisal District office.
Mr. Baldwin explained that HB 1060 provides that for 1979 only the governing
body of any jurisdiction may prescribe by resolution that the provisions of
Articles 1 and 2 shall not apply until the 1980 tax year. He recommended that
the Council pass this resolution to delay until tax year 1980 the implementation
of the new appraisal methods for Agricultural and Timber Use Valuation.
After discussion, Mr. Schneider moved to approve the following captioned
resolution. Mr. Sawyer seconded the motion which carried with the following
vote:

RESOLUTION NO. 79-R-8
A RESOLUTION PROVIDING THAT ARTICLES 1 AND 2 OF HOUSE BILL 1060
SHALL NOT APPLY TO 1979 CITY OF SCHERTZ TAXES.
#12 NEWSLETTER: The Council reviewed and approved the August newsletter
with the addition of items on the Open Space Land laws
and the Property Tax Code changes as well as requesting citizen participation
for the committees street sign study.
#13 EXECUTIVE SESSION: Mayor Bueker called an Executive Session at 8:54
P.M. under Article 6252-17 Vernon's Texas Civil
Statutes, Section 2 (g).
The Regular Session was reconvened by the Mayor at 9:23 P.M.

#14 CITY MANAGER'S REPORT: The City Manager gave the Council an
up-date on the agenda supplement items.
#15 ITEMS BY MAYOR: Mayor Bueker asked staff to take under consider-
ation the appointment of an alternate member to
the Board of Equalization designating someone that has agricultural inter-
ests.
#16 ITEMS BY COUNCIL: Mrs. Hyatt referred the the appointment of the
auditor and suggested that when the audit is
completed there be a workshop whereby the auditor can go into the audit in
detail with the Council.
#17 ADJOURNMENT: On a motion by Mrs. Hyatt, seconded by Mr. Sawyer and
unanimously carried, the meeting adjourned at 9:30 P.M.

SPECIAL MEETING OF THE CITY COUNCIL
JULY 24,1979
The Schertz City Council convened in Special Session, Tuesday, July 24, 1979
at 7:00 P.M. in the Conference Room of the Municipal Complex, 1400 Live Oak
Road with the following members present: Mayor Robert C. Bueker, presiding;
Richard L. Howe; Gail Hyatt; Walter F. Schneider; Earl W. Sawyer and Jack M.
Stomatkin. Staff present; City Manager Walter W. Hill, Jr. and City Secretary
June G. Krause.
#1 ADMINISTRATIVE PUBLIC HEARING: The City Manager explained the purpose
of the Administrative Public Hearing
was to receive input and discuss the uses of the 1979-80 Revenue Sharing Funds.
His recommendations were: $25,000 for seal coating; $12,000 for two police
vehicles; $1,500 for backstops for A-4 ballfield and $1,000 for an asphalt
kettle
There were no citizens present; however one who was unable to attend sent
some suggestions such as: the need for repairs and painting of the small
pavilion; tree trimming. Council suggested perhaps another small pavilion
near the pool with mounted tables and benches.
