ccss-08-28-1979 61 SPECIAL SESSION OF THE CITY COUNCIL AUGUST 28, 1979 The Schertz City Council met in Special Session, Tuesday, August 28, 1979 at 7:00 P.M. in the Conference Room of the Municipal Complex, 1400 Live Oak Road with the following members present: Mayor Robert C. Bueker, presiding; Richard L. Howe; Gail Hyatt; Earl W. Sawyer and Jack M. Stomakcin, Sr. Staff present: Acting City Manager Hal Baldwin, City Secretary June Krause and City Inspector Bill Hamm. #1 JOINT MEETING WITH THE PLANNING AND ZONING COMMISSION: Mayor Bueker explained the purpose of the joint meeting was to discuss cluster versus strip commercial zoning, specifically along FM 3009. Mr. Aguilar, Chairman of the P&Z Commission, reiterated the Commission1s reasoning behind their recommendation to the City Council. He said that after citizens from Greenfield met with them, they went back and made the zoning along FM 3009 more restrictive, by requiring a special use permit before anyone could put in a so-called undesirable type business. Mr. Sharpe, Commission member, said that they felt if the zoning was not controlled on FM 3009, it would turn into another Pat Booker Road. After further discussion, Mr. Howe said that his motion was misunderstood at the last City Council Meeting. He intended his motion to only withdraw the commercial zoning from Webster back to Elbel Road - not to within 350' of FM 78 as interpreted by everyone else. Mayor Bueker declared the joint meeting closed at 8:05 P.M. and announced the City Council would recess for an Executive Session under Article 6252-17 Vernons Texas Civil Statutes, Section 2 (g). The Special Session was reconvened at 9:08 P.M. with the Mayor asking to move immediately to Item No.4 on the agenda. #4 APPOINTMENT OF CITY MANAGER: Mrs. Hyatt moved the Council hire Mr. Jimmy G. Gilmore from Waco as City Manager at a salary of $18,500 and at the end of six months, his salary would go to the $20,700 allowed in the budget for City Manager; that the City would pay his moving expenses as to household goods with the proviso that should he quit before one year, the moving expenses would be reimbursed to the City. Mr. Sawyer seconded the motion which carried with the following vote: AYES: councilmembers Howe, Hyatt, Schneider, Sawyer and Stomakcin. NAYS: None /,/;j 11 #2 ORDINANCE: Acting City Manager Baldwin presented an amendedment to the Animal Control ordinance, explaining why it is necessary in light of the recent dog bite case. After consideration, Mr. Sawyer moved this ordinance be approved by the City Council as written. Mrs. Hyatt seconded the motion which carried with the following vote: ORDINANCE NO. 79-H-16 AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF 62 ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 4-11 OF SAID CODE: PROVIDING FOR CONTROLLING ANIMALS INVOLVED IN BITE INCI- DENTS; AND DECLARING AN EMERGENCY. AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin. NAYS: None rI./ " (l. h1;)~1 . #3 WORKSHOP: Mr. Baldwin had several items he brought to the atten- tion of the Council; namely, (1) a meeting date had not be established for staff and representatives of Northcliffe. (2) the fire truck pump test had to again be postponed as the truck was not ready; (3) Workmens Compensation rates are being increased by 5% beginning September 1, 1979; (4) he had received a resignation from one of the patrol- men; (5) he would include an item on the next agenda requesting to go out for bids for rewiring of pump house in U.C.; (6) he had word from the County that they do intend to participate in the Countywide Appraisal District; (7) County Commissioner Ackermann had called saying he has started on the Dobie School Road (8) he was notified by UA Columbia Cablevision that they will start serving approximately 2000 homes in this area on September 19th; (9) received word from City of Salma that they have done some annexing in what looks to be Garden Ridge ETJ (10) received a letter from the Attorney General they intend to file suit against several cement company for possible overcharging on purchase of cement - Council recommende the City not parti- cipate in this suit. #5 ADJOURNMENT: On a motion by Mrs. Hyatt, seconded by Mr. Stomackin and unanimously carried, the meeting adjourned at 10:05 P.M. ~yor, City of Schertz, Texas ATTEST: Ckt AO JiK~n Cit~cretary, City of Schertz L
