Bueker, presid- ing; Richard L. Howe. Walter F. Schneider, Gail Hyatt; Earl W. Sawyer and Jack M. Stomackin. Staff present were City Manager Jimmy G. Gilmore, Assistant City Manager Hal Baldwin and City Secretary June G. Krause. #1 WORKSHOP: Council met in Workshop Session to discuss varied items including their guidance as to what they expected of the new City Manager. #2 ADJOURNMENT: On a motion duly made, seconded and unanimously carried, the meeting adjourned at 10:32 P.M. ./ l!:. Bueker, presiding; Richard L. Howe, Gail Hyatt, Walter F. Schneider, Earl W. Sawyer and Jack Stomackin. Staff present: City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 APPROVAL OF MINUTES: A. Mr. Schneider moved to accept the minutes of the Regular Meeting of September 4~ 1979 Mrs. Hyatt seconded the motion which carried with the following as wri tten . vote: AYES: NAYS: Council members Howe, Hyatt, Schneider, Sawyer and Stomackin. None B. Mr. Schneider moved to accept the minutes of the Special Session of September 11, 1979 as written. NAYS: None 68 #2 HEARING OF RESIDENTS: Mr. Craig Kibler requested time for Item 7 #3 RESOLUTION: The Mayor introduced the following captioned resolution and read it in its entirety. Mr. Howe moved to adopt the resolution as read. Mrs. Hyatt seconded the motion which carried with the following vote: /6,-t)Q AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin. NAYS: None Mayor Bueker then called Patrolman Stewart Rowell forward and presented him with a Certificate of appreciation for devoted and valuable services rendered above and beyond his regular duties. RESOLUTION NO. 79-R-14 A RESOLUTION TO RECOGNIZE STEWART R. ROWELL FOR EXEMPLARY PERFORMANCE OF DUTY. #4 ORDINANCE: The Mayor introduced the following captioned ordinance which was read by the City Manager. Mayor Bueker then pointed out on the map the location of the property being proposed for annex- ation. I 01?1 Mr. Schneider moved to approve the ordinance on the first reading for the proposed annexation of approximately 300 acres of land out of Guadalupe and Coma 1 Counties. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin. NAYS: None AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDAY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING APPROXIMATELY 300 ACRES OUT OF GUADALUPE AND CO MAL COUNTIES. #5 ORDINANCE: The Mayor introduced the following captioned ordinance which was read by the City Manager. Mayor Bueker then pointed out on the map the location of the property proposed for annexation. Mr. Schneider moved to accept the first reading of an ordinance on the proposed annexation of approximately 2.016 acres out of Bexar County. NAYS: None AN; ,ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 2.016 ACRES OF LAND OUT OF BEXAR COUNTY. I~- 69 #6 ORDINANCE: Mayor Bueker introduced the following captioned ordinance which was read by the City Manager, who stated this is a petition annexation as was the one in item #5. Mayor Bueker then again pointed out the location of the proposed annexation on the map. Mr. Howe moved to accept the first reading of an ordinance on the proposed annexation of approximately 0.912 acres out of Bexar County. Mr. Schneider seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin. NAYS: None J~1~J1 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 0.912 ACRES OUT OF BEXAR COUNTY. #7 RESOLUTION: Mayor Bueker introduced the following captioned reso- lution contracting for the FY 1979-80 official news- paper, after which the resolution was read in full by the City Manager. Mr. Kibler, who had reserved time, said he only reserved the time to answer any questions the Council might have. Council discussed some of the problems incurred during the last year with legal notice errors with the Herald Paper. Mrs. Hyatt moved to adopt the resolution naming The Valley News as the official newspaper for fiscal year 1979-80. Mr. Sawyer seconded the motion which carried :with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin. NAYS: None l~o~1~ Mr. Schneider suggested in all future years a run-down be kept of the problems encountered during that year, to be presented at time of redesignation. RESOLUTION NO. 79-R-15 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CONTRACTING FOR THE FISCAL YEAR 1979-80 OFFICIAL NEWSPAPER. #8 BID AWARD: Mayor Bueker explained that two bids were received for insurance needs for fiscal year 1979-80; (1) from Muehl & Koebig for a total amount of $20,437.95; (2) from Len Boyd Associates ir the total amount of $24,422.00. The Mayor asked Mr. Brewer of Muehl & Kbebig to explain the differences in the bids. Mr. Brewer said that every company can give its own deviation amount. Mr. Howe moved to accept the bid of Muehl & Koebig Insurance Company in the amount of $20,437.95, based on one year amounts for Automobile and Comprehen= sive General Liability and 3 year amounts for Employee Blanket Bond and Fire & Extended Coverage. Mr. Schneider seconded the motion which carried as follows: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin. NAYS: None I ~ r. flq 70 #9 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by the City Manager, who ex- plained the functions of the 1979 edition of the Southern Standard Building Code. Mr. Schneider moved to accept the first reading of the ordinance adopting the 1979 Edition of the Southern Standard Building Code, as amended. NAYS: None AN ORDINANCE ADOPTING THE SOUTHERN STANDARD BUILDING CODE, 1979 EDITION, AS AMENDED, AS THE BUILDING CODE OF' tHE CITY OF SCHERTZ, TEXAS, AS HEREINuMODIFIED AND REPEALING ALL ORDINANCES IN CONFLICT. #10 NEWSLETTER: Mrs. Krause listed the four items to be included in the newsletter; namely (1) Meeting dates (2) Immuni- zation Clinic (3) Community Center (4) water rates as of October 1. Council suggested item on the new water line. Mr. Schneider moved to give approval of the October newsletter. Mrs. Hyatt seconded the motion which carried with the following vote: I & j ~1 i AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin NAYS: None City Manager Gilmore gave an update of the agenda supplement items. He also stated after talking with the auditor, he withdrew his interim billing and will send a statement after completion of the audit. The audit is about 40% complete at this time. Mr. Gilmore also presented a letter from AACOG in which they asked for pay- ment of the annual dues in advance. After Council discussion as to the reasons for this request, it was concensus of the Council to pay these dues when presented with billing in January. #11 EXECUTIVE SESSION: There was no need at this time. #12 CITY MANAGER'S REPORT: Mr. Gilmore had a letter from Mrs. Peek requesting something be done about the bad condition of Maske Road, as well as Live Oak Road from the Municipal offices on. Council discussed these two roads agreeing they are in bad condition. It was suggested staff obtain a cost study on both. Perhaps the County Commissioner could help on Maske as to frequency of working gravel roads. #13 ITEMS BY MAYOR: Mayor Bueker first read a proclamation designating the week of September 24 through 30th as "Kiss Your Baby Week" urging all citizens to join with the Cystic Fibrosis Foundation in learning the signs of lung-damaging diseases in children. ,~- 71 The Mayor also notified the Council of an invitation to the First Annual Celebration from the NCO at Randolph on October 7, 1979. He thanked Mr. Kramer for the plaque presented to the City of Schertz by the Business Club. Mayor Bueker then discussed with the Council the industry wishing to get a moratorium on a proposed site in the Industrial Park. The representatives of the industry did not accept the Council proposal of a 4-year moratorium with consideration of an additional 3 years, as they said it would be almost one year before commencing, then take two years to get the bugs out, which would really leave them only one year. As to the consideration of an additional three years, they felt the Council at that time might not agree with this Council. ' Mr. Howe said he had done some telephoning to other cities and found we are the only ones considering a moratorium so he is against giving a moratorium. Mr. Schneider, after considerable discussion by the Council, said he would be willing to give a 4 year moratorium with an option for three additional years. Mrs. Hyatt said if they would go for the 4 year with option for 3 more years, it was okay with her; but if they still would not accept that she was willing to give the 7 year moratorium. Both Mr. Stomackin and Mr. Sawyer said they were for the 7 year moratorium. Staff was asked to set up a workshop with the City Attorney and representatives of the industry to meet with the Council. Lastly, Mayor Bueker asked if the Council had any items to place before the Community Council, which he would be chairing in October. It was suggested the question of the FM 78 By Pass and the possibility of all surrounding cities working together on different types of maintenance contracts be placed on the agenda for Community Council discussion. #14 ITEMS BY COUNCIL: A. Mr. Howe asked if a nominee had been selected for the County Advisory Board. Mr. Baldwin said he thought Mr. McClure might be pursuaded to be nominated. Council was to call him on this subject. Mr. Howe also questioned the survey crew fees on the bill from the Comprehen- sive Design. This was to be checked against the contract. B. Mr. Schneider suggested contacting the property people to see if the weeds could be cut along Aviation Blvd. under the railroad overpass. He also asked something be done about the blind corner, because of trees, weeds etc. in Schertz. Co' Mr. Stomackin asked if the $133 refund on the ambulance warranty work was the total to be received and how much of the warranty work was refunded. The City Manager said he would check this out. D. Mr. Sawyer asked what was wrong with the light on FM 78 at First Street. Mr. Gilmore said it was struck by lightening and the Highway Department had to order a part but it was expected to be back in service the first week in October.
