Mayor Bueker then said he would like for Council to consider the appointment
of an Industrial Committee, to be discussed at the next workshop meeting.
The Committee would serve as a single point of contact and would have those
elements most needed for industries to look at at that point in time and
would function just as other committees.

OCTOBER 2, 1979
The Schertz City Council convened in Regular Session, Tuesday, October 2,
1979 at 6:30 P.M. in the Council Chambers, 1400 Live Oak Road with the
following members present: Mayor Robert C. Bueker, presiding; Walter F.
Schneider; and Jack Stomackin Sr. Absent: Richard L. Howe, Gail Hyatt and
Earl W. Sawyer. Staff Present: City Manager Jimmy G. Gilmore and City
Secretary June G. Krause.
#1 WORKSHOP SESSION: Members present met in Workshop Session to
informally discuss several items on the regular
agenda. Mrs. Hyatt arrived at 6:33 P.M. - Mr. Howe arrived at 6:39 P.M and
Mr. Sawyer arrived at 6:43 P.M.
Mayor Bueker closed the Workshop session at 7:03 P.M. and called the regular
session to order at that time.
#1 APPROVAL OF MINUTES: A. Mr. Schneider requested the motion made
in item #4 of the regular meeting of
September 18, 1979 be changed to read as follows: IIMr. Schneider moved
to approve the first reading of an ordinance for the proposed annexation of
approximately 300 acres of land out of Guadalupe and Comal Counties.1I
Mr. Schneider then moved to approve the minutes of the Regular Meeting of
September 18, 1979 as amended. Mrs. Hyatt seconded the motion which carried
with the following vote:

#2 HEARING OF RESIDENTS: Mr. Tony Cortez and John Steen reserved time
to speak when item #16 comes before the Council.
Mrs. Ruth Tienor addressed the Council saying the Librarian has been working
for two months and has done an excellent job. She has gone into the community
and met other groups and has taken on additional duties not foreseen before.
Mrs. Tienor went on the say the Council could rest assured that the library
is in good hands.
#3 ORDINANCE: The Mayor introduced 'the following captioned ordinance
with the City Manager reading the caption and pointing
out on the map the area proposed in the ordinance for annexation.
Mr. Howe moved to approve the final reading of this ordinance annexing approxi-
mately 300 acres of land out of Guadalupe and Coma1 Counties. Mr. Schneider
seconded the motion, which carried as follows:

Standard Building Code, as amended. Mrs. Hyatt seconded the motion which

TEXAS, AS HEREIN MODIFIED AND REPEALING ALL ORDINANCES IN CONFLICT.
#7 PAYMENT AUTHORIZATION: Mayor Bueker explained this statement from
Comprehensive Design was a corrected
statement and complied with the contract.
Mr. Howe moved to authorize payment to Comprehensive Design in the amount
of $1,282.05. Mrs. Hyatt seconded the motion which carried with the

#8 BID AWARD: Mr. Schneider said that due to the fact that the first
time the city went out for bids on vehicle maintenance,
the only one received was rejected but the party that bid the second time
was in the audience the first time listening to the bid received then.
Mr. Schneider then moved to reject the bid received from True Performance
and not go out for any more bids for vehicle maintenance since this company
is doing the city business now.
Before the second was called for, Mayor Bueker asked the attorney if they
were in procedure and protected in accepting or rejecting bids. Mr. Harris
said yes.
Mr. Howe seconded the motion.
Mayor Bueker said he ~R~ in favor of the contract and thought we had a very
favorable labor rate/W6~ld have emergency preference; however, this company
would not be obligated to these prices and without a contract could raise
rates whenever they wanted.
As the second bidder resubmitted the same bid that was returned unopned
to them after having been received too late for bid opening, Mr. Howe
suggested that all bids be stamped received with the time and date.

Mr. Sawyer pointed out that the reason the first bid was rejected was because
it did not have anything regarding emergency vehicles.
Attorney Harris pointed out that 'if you have a bid that is acceptable and
reject it, then enter into a non-bid contract, you are in trouble.
Mayor Bueker called for a vote on the motion on the floor, said motion
failed by the following vote:

Mrs. Hyatt then moved to accept the bid from True Performance for vehilce
maintenance. Mr. Stomackin seconded the motion, which carried with the

#9 COMMUNITY DEVELOPMENT AUDIT: Mr. Schneider moved to engage Mr.
Carlos Melick, IV to perform Community
Development audit. Mr. Sawyer seconded the motion which carried with the

#10 FIRE TRUCK PAYMENT: The City Manager called attention the Fire
Chief's report of several items missing or
needing repair on the new truck before it is complete. He recommended
accepting the truck with these except.ions and holding back a specified
amount to cover these exceptions.
Mr. Howe moved to retain 10% of the $39,037.00 remaining due on the truck
until we get something signed by the Fire Chief saying the truck is complete.
Mr. Sawyer seconded the motion which carried with the following vote:

out for bids on two police vehicles.

Mr. Gilmore said that staff would check with Universal City to see if it would
be economical to go out for bids with them and modify our bid accordingly.
Mayor Bueker then called for a vote on the motion and motion carried with

#14 ORDINANCE: The Mayor introduced an ordinance to abandon 811 water
line and transferring it to Universal City.

Mayor Bueker suggested adding a paragraph whereby the City of Schertz would
reserve the right to remove any or all parts, primarily valves.
Mr. Harris said he had several questions concerning this proposed ordinance
and asked to delay consideration until he had time to further study it.
After further discussion, Mr. Sawyer said that based on Mr. Harris' comments
in reference to the abandoning of the line to U.C. water well, he moved this
item be tabled until studied by Mr. Harris. Mrs. Hyatt seconded the motion
which carried with the following vote:

#15 LIBRARY FEES: The Mayor introduced a recommendation from the
Library Board setting fees for non-residents
outside the county of $15.00 a year for family and $10.00 a year for
individuals.

the fees so stated. Mrs. Hyatt seconded the motion which carried with the

#16 WATER CONTRACT: Mr. Sawyer moved that in view of the letter
received from GUADCO District #1, this item should
be tabled. Mr. Schneider seconded the motion.
Mr. Tony Cortez, general manager for the water district, addressed the
Council. He said the only point he would clarified was that the original
letter from the city stated the rate increase would go into effect as of
October 1, 1979.
Mr. Sawyer amended his motion to include the statement: "and defer the date
of increase in rates to within 45 days". Mr. Schneider seconded the amended
motion, which carried with the following vote:

#17 EXECUTIVE SESSION: None was necessary at this time.
#18 CONTRACT: Mayor Bueker explained that this was authorization
request for the Mayor to sign contract with the
corporation discussed in Executive Session of September 24, 1979. He
then read the contract, leaving out the name of the corporation.
Mr. Schneider moved to authorize the Mayor to sign the contract with the
corporation discussed in the executive session of September 24, 1979.

#19 CITY MANAGER REPORT: Mr. Gilmore gave an update on some of the
items on the Agenda Addendum list.
#20 ITEMS BY MAYOR: The Mayor requested staff to check the Housing
Authority agreement and have available for
discussion at the next workshop session.
He also brought to Council attention the letter from GVEC on rate structuring.
#21 ITEMS BY COUNCIL: Mr. Stomackin brought to Council attention
the problem that has arisen concerning the
approach ramp needed for the new SAFES building. The building had to
be elevated because of flooding which now makes about a foot drop.
The City Manager said he was not aware of this but would check it out and
advise the Council.
