REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 20, 1979
The Schertz City Council convened in Regular Session, Tuesday, November 20,
1979 at 7:03 P.M. in the Council Chambers, 1400 Live Oak Road with the follow-
ing members present: Mayor Robert C. Bueker, presiding; Richard L. Howe;
Walter F. Schneider; Earl W. Sawyer and Jack M. Stomackin. Absent: Gail
Hyatt. City staff present were City Manager Jimmy G. Gilmore, Asst. City
Manager Hal Baldwin and City Secretary June G. Krause.
#1 APPROVAL OF MINUTES: A. Mr. Howe moved to accept the minutes of
the Regular Meeting of November 6, 1979.
Mr. Sawyer seconded the motion which carried with the following vote:
AYES: Councilmembers Howe, Schneider, Sawyer and Stomackin
NAYS: None
MRS. HYATT ARRIVED AT 7:04 P.M.
B. Mr. Schneider moved to accept the minutes of the Special Session of
November 15, 1979. Mr. Howe seconded the motion which carried with the follow-
ing vote:
AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin
NAYS: None

#3 RESOLUTION: Mayor Bueker read a resolution, captioned as follows: I I

RESOLUTION NO. 79-R-21
A RESOLUTION RECOGNIZING MRS. ALICE PREVITERA FOR HER
UNTIRING VOLUNTARY SERVICE TO THE CITIZENS OF SCHERTZ,
TEXAS, AS WELFARE DIRECTOR.
He then called Mrs. Previtera forward and presented her with a framed copy
of the resolution as well as a gift in token of appreciation for her devoted
service to the citizen of our city.
#4 BOARD OF ADJUSTMENT: Council discussed the merits of the request
by Mr. and Mrs. Morris, 420 Nell Deane Drive
for a side yard setback variance, BOA Case #11.
Mr. Schneider moved the Board of Adjustment hear case #11 and put it on the
agenda of the December 18, 1979 Council meeting. Mrs. Hyatt seconded the
motion which carried by the following vote:

#5 ORDINANCE:.. Mayor Bueker introduced the following captioned ordinance
which was read by the City Manager, who then pointed out
on the map the location of the tract of land proposed for annexation.
Mr. Sawyer moved to accept the first reading of the ordinance on the proposed
annexation of approximately 335 acres of land out of Guadalupe County. Mr.
Schneider seconded the motion which carried by the following vote:
AYES: Councilmembers Howe, Schneider, Sawyer and Stomackin
NAYS: None
Mrs. Hyatt out of the room when vote taken.

AN ORDINANCE PROVIDING FOR THE EXTENTION OF THE BOUNDARY LINES
OF THE CITY OF SCHERTZ, TEXAS BY THE ANNEXATION OF 335 ACRES
OF LAND MORE OR LESS OUT OF GUADALUPE COUNTY.
#6 ORDINANCE: Mayor Bueker introduced the following captioned ordinance
which was read by the City Manager, who then pointed out
on the map the location of the tract of land proposed for annexation.
Mr. Schneider moved to accept the first reading of an ordinance on the pro-
posed annexation of 324.13 acres of land out of Guadalupe County. Mr. Sawyer
seconded the motion which carried with the following vote:

#7 EXPENDITURE APPROVAL: Mr. Sawyer moved that $421 be expended for
lettering for the SAFES office building.
Mrs. Hyatt seconded the motion which carried with the following vote:

#8 APPOINTMENT: Mr. Gilmore explained that he was told they will
accept a primary and alternate appointee to the Cable
TV Advisory Committee with both being invited to all meetings.
Mr. Schneider moved to appoint Mike Lawler as the primary representative
on theCabae TV Advisory Board and Mr. Gene Riley as the alternate.
Mr. Howe seconded the motion.
Mr. Stomackin brought out that Mr. Lawler as a SAFES member may be unable
to attend and perhaps the appointments should be turned around.
Mr. Lawler said his schedule with SAFES could be changed if necessary.
Mayor Bueker called for a vote on the motion, which motion carried as follows:

#9 TAX APPRAISAL BRIEFING: Tax Assessor/Collector Hal Baldwin
briefed the Council on the needs for
reappraisal showing them comparisons of tax valuations on property versus
fair market value as compared to sales in the last three months, which
showed the 1974 valuations now in use as far too low. He also discussed
the advantages and disadvantages of combining tax offices with the school
district.
After Council discussing the pros and cons, Mr. Schneider moved the City
does not participate in the tax appraisal with the School District as Mr.
Baldwin mentioned. Mrs. Hyatt seconded the motion with carried with the

#10 BVYA CONTRACTS: Mr. Gilmore suggested that perhaps he and Mr.
Harm of BVYA coul d get together and workout
some of the changes to the Building contract as recommended at Workshop.
Mr. Harm said he had not had an opportunity to present the proposed contracts
to his Board and would have to get their input before finalizing on a firm
contract.
A. Mr. Sawyer moved that the authorization for the Mayor to sign the contract
with BVYA on building usage be table at this time and Council instruct the
City Manager and BVYA to go over the contract items discussed at Workshop.
Mr. Stomackin seconded the motion which carried with the following vote:

B. Mr. Schneider moved to table this item on the contract for ballfield
usage until the Council meeting of December 18, 1979. Mr. Sawyer seconded
the motion which carried with the following vote:
AYES: Council members Howe, Hyatt, Schneider, Sawyer andStomackin
NAYS: None
#11 POLICE VEHICLE BIDS: The City Manager explained the two alternatives
on police vehicle purchase were (1) purchase
two vehicles with the Council authorizing the expenditure of ftindsifor the
additional costs; or (2) purchase one vehicle and authorize the remaining
monies be spent rehabbing present police vehicles.
Mr. Schneider moved to buy one new police vehicle and use the remaining
Revenue Sharing monies that was allotted for police vehicles to repair
the remaining police vehicles and bring them up to a more servicable
condition. Mrs. Hyatt seconded the motion which carried with the following
vote:
AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Stomackin

Mr. Schneider asked if Mr. Sawyer would add to the motion that the vehicle
would be purchased from Krueger chevrolet in New Braunfels in,the amount of
$7,869.79 - which Mr. Sawyer agreed to and Mrs. Hyatt agreed to the addition
to the motion.
Mayor Bueker called for a vote on the restructured motion, which carried as

#12 COMMUNITY DEVELOPMENT AUDIT: Mr. Gilmore explained that this audit
is the one he requested funds for
from the Council and that it does meet auditing procedures of HUD and does
fulfill obligations on our grant.
Mr. Schneider moved to accept the Community Development Block Grant audit
as of November 7, 1979. Mr. Sawyer seconded the motion which carried with
the following vote:

#12-A PAYMENT AUTHORIZATION: Mr. Schneider moved to pay United Utility
Corporation Payment Estimate #1 on the
20" water line, in the amount of $177,366.60. Mrs. Hyatt seconded the motion
which carried with the following vote:
AYES: Council members Howe, Hyatt, Schneider, Sawyer and Stomackin
NAYS: None

#14 NEWSLETTER: After discussion, Council agreed to remove item #4
on permit requirements from the proposed December
newsletter. Mayor Bueker requested that a recap of the major events for
the year be put in the newsletter.
#15 EXECUTIVE SESSION: There was not a need for one.
#16 CITY MANAGER'S REPORT: Mr. Gilmore asked for and received favorable
consideration on two letters to be sent.
one to TML on costs of Annual Conference and one to GUADCO on water rates.
He also suggested that the second Council meeting of the month include on
the agenda an item providing time for various Committee Chairmen to present
recommendations and requests to the Councll.
#13 INDUSTRIAL DEVELOPMENT COMMITTEE: Mayor Bueker asked to return
to this item as it was inadver-
tently skipped over.
After discussion, .Mr. Sawyer moved to adopt the proposed By Laws as outlined
as tentative agreement until Council can name the people who will be on this
board and approve alternate #2 on the board makeup. Mrs. Hyatt seconded the
motion which carried with the following vote:

For the benefit of the audience, Mayor Bueker asked Mr. Schneider to read
the alternate #2 requirements. They are: The Council would appoint the
Chairman, a manager of utilities; a contractor; a realtor; a banker and
a insurance representative.
#17 ITEMS BY MAYOR: Mayor Bueker had none.
#18 ITEMS BY COUNCIL: Mr. Howe apologized for not making the last
CCMA meeting but assured Council he would either
be at next meeting or ask an alternate to attend.
Mr. Sawyer asked if the City Manager had checked on the water well at the
new industrial site property. Mr. Gilmore said he had not but would.
Mr. Sawyer also asked about the 8" line coming out of the U.C. tank and
connecting to the 20" line. Mr. Gilmore said he would check this but that
under the present grant, it is only for transmission line and anything else
is not eligible. Mr. Sawyer asked that our current engineer check on this.
#19 ADJOURNMENT: On a motion by Mr. Schneider, seconded by Mrs. Hyatt
and unanimously carried, the meeting adjourned at
9:23 P.M.
