REGULAR MEETING OF THE CITY COUNCIL
FEBRUARY 19, 1980
The Schertz City Council convened in Regular Session, Tuesday, February 19,
1980 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the follow-
ing members present: Mayor Pro Tern Earl W. Sawyer, presiding; Richard L. Howe;
Gail Hyatt; Walter F. Schneider and Jack Stomackin. City staff: City Manager
Jimmy G. Gilmore and City Secretary June G. Krause. Absent: Mayor Bueker.
#1 APPROVAL OF MINUTES: Mr. Howe moved the minutes of the Regular
meeting of February 5, 1980 be approved
Mr. Schneider seconded the motion which carried with the following vote:
AYES: Counci1members Howe, Hyatt, Schneider, and Stomackin
NAYS: None
#2 HEARING OF RESIDENTS: Mr. Dave Allen requested time for item #3.
#3 BUSINESS CLUB: As the representati ves were not present, t1r. Sawyer
asked that this item be held in abeyance until later.
#4 ORDINANCE: The Mayor Pro Tem introduced the following captioned
ordinance with the City Manager reading the caption.
Mr. Schneider moved this ordinance on reciprocal fire fighting agreements with
area cities be approved on the final reading. Mrs. Hyatt seconded the motion
which carried with the following vote:

ORDINANCE NO. 80-M-3
AN ORDINANCE AUTHORIZING AND DIRECTING THE FIRE CHIEF AND THE
DULY APPOINTED FIRE DEPARTMENT PERSONNEL OF THE CITY OF SCHERTZ
TO ASSIST AND RECEIVE ASSISTANCE FROM THE FIRE DEPARTMENT PER-
SONNEL OF CONVERSE; RANDOLPH AIR FORCE BASE; CIBOLO; MARION;
UNIVERSAL CITY; BRACKEN; AND NEW BRAUNFELS IN ACCORDANCE WITH
THIS ORDINANCE.

ordinance, with the City Manager reading the caption.
Mr. Howe made a motion to approve the ordinance on calling an April 5, 1980
election on final consideration. Mrs. Hyatt seconded the motion which carri~d

#6 ORDINANCE: The Mayor Pro Tem introduced the following captioned
ordinance with the City Manager reading the caption.
Mrs. Hyatt made a motion to approve the first reading of an ordinance
on the proposed disannexation of approximately 7.50 acres out of Guadalupe
County. Mr. Stomackin seconded the motion which carried with the following
vote:
AYES: Council members Howe, Hyatt and Stomackin
UAYS: Mr. Schneider
Mr. Schneider clarified his no vote by saying that we keep hearing about
the need for more tax base in the city; and here we go ahead and give a
moratoriam on tax break - I just cannot reconcile the b/o items. -
AN ORDINANCE
PROVIDING FOR THE MODIFICATION OF THE BOUrWARY LINES OF THE
CITY OF SCHERTZ, TEXAS, BY THE DISANNEXATIor~ OF A TRACT OF
LAND CONTAINING 7.50 ACRES OF LAND OUT OF GUADALUPE COUNTY.
#7 BID AWARD: Mr. Sawyer explained the city advertised for bids on
the city owned property at 608 Live Oak Road and only
received two bids. Mr. Gilmore read the two bids - one for the house only
from Rumaldo Rodriquez in the amount of $900 and one for the house and land
from John W. Dillon in the amount of $8,500.
Mr. Howe asked if the City had an appraisal on this property before going
out for bids. Mr. Gilmore explained that we had not; however we had found
out that land along this road was selling for about $15,000 an acre. Mrs~
Hyatt was of the opinion that the Council had decided not to sell this land.
After further discussion, Mr. Schneider made a motion to reject any and all
bids received on this property on Live Oak Road. r~r. Howe seconded the
motion which carried with the following vote:

Mr. Baldwin was asked to do an appraisal based on comparables.
#8 PUBLIC SERVICE AGENCIES: Mr. Sawyer introduced this item with the
City Manager explaining that now these
. agencies are scattered throughout the city. The consolidation of these
agencies at one location (Housing Authority Community Center on Pheil Street)
wbu1d allow the agencies to do a better job by assisting each other as well
as being a great help to the citizens. It would also lower the costs by
a small amount.

Community Center on Pfeil Street. Mr. Schneider seconded the motion which
carried with the following vote:

#9 CIBOLO REQUEST: Mayor Pro Tern Sawyer explained that the Mayor
of Cibolo had asked that this item be tabled at
this time.
Mr. Schneider made a motion to table this item #9 until further information
can be obtained. Mrs. Hyatt seconded the motion which carried with the follow-
ing vote:

#10 SAFES REQUEST: Mr. Sawyer introduced this item as a request from
SAFES for a heater for the new building. The
City Manager explained there is no money in the budget for this heater. The
one requested is one they have located that is somewhat less than market and
according to their letter, they do need a heater in this building.
Mr. Howe said he may have one that he will donate to SAFES, or if not he will
buy one for them.
Mr. Howe then moved this item be eliminated.

#10-B TAX REIMBURSEMENT: Mr. Sawyer explained that the Tax Assessor
made a mistake in not allowing some VA Tax

Mr. Stomackin made a motion this reimbursement of VA tax exemptions be allowed.

Mr. Howe wanted the record to show that there were 33 exemptions to be reimbursed
in the amount of $560.
#3 BUSINESS CLUB: The Mayor Pro Tern asked to return to this item as
it was skipped over.
In the absence of their representative, Mrs. Hyatt explained what the Business
Club had discussed with the Council concerning their request for a temporary
fence at the pavilion on the night of the July 4th Jubilee. They did not
intend to override the idea of a family day of fun for the Schertz citizens;

however, most of the younger children had gone home by 9:00 P.M. when they
hoped to have a named band and charge admission. The two bands in the day
time would still be no charge. They just wanted some way to increase their
profits, which go right back into the community.
At this point, Mr. Kusek, president of the Business Club, arrived and
confirmed what Mrs. Hyatt was explaining.
Mr. Dave Allen again said he felt this should just be a fun day for family
and not grow into a big Wurstfest or rock concert.
Mrs. Hyatt made a motion that in view of Mr. Allen's speach, I would like
to see the Business C1ub's request approved and if it is something that we
cannot handle, not have it next year. Mr. Stomackin seconded the motion
which carried with the following vote:

#11 EXECUTIVE SESSION: None needed at this time.
#12 CITY MANAGER'S REPORT: Mr. Gilmore read letters from Delia J.
Porter of Bexar County Hospital District
to Mr. Fa1dik of the Central Fire Station in Seguin and one from Judge Fleming
of Guadalupe County to SAFES etc. concerning Bexar County's request for
no one to transport any out of county (Bexar) patients to their facility.
Ms. Porter went on to say that if any unit did call in a transport to their
emergency room, they will request that the run be diverted to the nearest
medical facility.
Mr. Gilmore explained that he had contacted the area City Managers larid
Administrators and they have all agreed to assist in any way with the
clerical and mailing request of the Cable TV Advisory Board. Schertz
will handle it the first month with Universal City the second and other
cities will go to their Councils to request permission and feel sure theY.

The City Manager brought up again the need to formulate the membership of
the Industrial Development Committee and asked Council for appointments.
He was given some names to contact and would like to finalize at the next
regular meeting.
#13 ITEMS BY MAYOR: Mr. Sawyer had not items
#14 ITEMS BY COUNCIL: Mr. Howe thought a correction should be requested
from Paul Thompson of the Express-News as he
said the CitY;lof Schertz had paid $953 for 911 service and then turned it down.
Mrs. Hyatt mentioned a basketball net in Greenfield Village that hangs over
the Street. Also asked when work would start on the SAFES ramp and was
told it should be started within the next few days.
Mrs.H~att also wanted to know about the street cuts around manholes allover
town. Mr. Gilmore said that not only are city mains breaking but the Tele-
phone company is putting in large cement boxes at various places.

Mrs. Hyatt also reported she had been calling some of the people along FM1518
and that vacinity and they are not aware of the problem SAFES is having with
being able to transport accident paitents in Bexar County. She said since
these people do not receive either of the weekly papers, she would gladly dis-
tribute flyers to them. She explained to the press the problem of the Bexar
County Sheriff's Department personnel refusing to allow SAFES to transport
patients to the hospital and the long wait for EMS units to arrive.
Mr. Schneider asked the status of the 20" water 1 ine. Mr. Gilmore said that
information has been received from the State Health Department allowing pipe
to be within 9 feet of sewer main. This information has been delivered to
Universal City who is in process of getting information to Schertz so that
we can proceed. Mr. Schneider asked that Mr. Howard Gaddis be present at
the next regular meeting to explain what has happened and why.
#15 ADJOURNMENT: On a motion by Mr. Schneider, seconded by Mrs. Hyatt
and unanimously carried, the meeting adjourned at
8:55 P.M.

SPECIAL SESSION OF THE CITY COUNCIL
FEBRUARY 26, 1980
The Schertz City Council convened in Special Session, Tuesday, February 26,
1980 in the Conference Room of the Municipal Complex, 1400 Live Oak Road at
7:00 P.M. with the following members present: Mayor Robert C. Bueker, presid-
ing; Richard L. Howe, Gail Hyatt, Walter F. Schneider, Earl W. Sawyer and
Jack M. Stomackin, Sr. Staff present were City Manager Jimmy G. Gilmore and
City Secretary June G. Krause.
#1 JOINT MEETING WITH THE CIBOLO CITY COUNCIL: After having each
member of the two City
Council introduce themself, Mayor Bueker explained the purpose of this meet-
ing was to discuss common Extra Territorial Jurisdiction boundaries and
public services.
For those that were not familiar with the beginning of the ETJ discussions
or were not on the Councils at that time, Mayor Bueker gave a brief explana-
tion of the agreement between the two cities. He said there is one area
that needs to be cleared up; namely the small area of overlapping city limits
at the intersection of Wiederstein Road and FM 1103. This area is part of
the Orth property and the people involved do already pay taxes to the City
