ccss-03-11-1980 138 SPECIAL MEETING OF THE CITY COUi~CIL MARCH 11, 1980 The Schertz City Council convened in Special Session, Tuesday, March 11, 1980, at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Pro Tem Earl W. Sawyer, Richard L. Howe, Gail Hyatt, Walter F. Schneider and Jack Stomackin Sr. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 JOINT PUBLIC ZarlING HEARING: Mayor Pro Tern Sawyer opened the meeting and explained the purpose of the public hearing was to receive citizen input regarding the request by Mr. Don Scheonfe1d, President of Ba1cones Rock Products, Inc., for a specific Use Permit to put in a sand and gravel plant on approximately 209 acres located southwest of the old sewage disposal plant on Bubbling Spring Road. Mr. Sawyer then turned the public hearing over to Mr. Adolph Aguilar, Chairman of the Planning and Zoning Commission. Mr. Aguilar opened the Public Hearing at 7:03 P.M. and said the meeting would follow the procedure of having the person making the request speak first with those citizens having an opportunity to comment with the Council and Planning and Zoning Commission's comments last. He asked the citizens who wished to address the subject to give their name and address prior to commenting. Mr. Don Scheonfeld reiterated his request to put in a sand and gravel plant on the property shown on the map, stating that since the gravel is available at this site, he felt the citizens of Schertz would like to have the tax base. He explained the procedure was a wet process with no blasting or chemicals used. MAYOR BUEKER ARRIVED AT 7:07 P.M. The following people spoke against the request for the sand and gravel plant giving their reasons as too much dust, noise, danger to their children and depreciation of property values. They had presented a petition containing 131 good signatures with 28 signing as Mr. and Mrs. which could not be counted. Mr. Aguilar asked the Planning and Zoning Board if they had questions and they had none. The Council members all expressed their thanks for the large turnout, saying they would take everyone's comments under advisement and have their decision at the next regular meeting of the Council. Mayor Bueker summarized all comments adding that the two boards holding the public hearing were for the express purpose of protecting the rights of citizens. He said there would really be no tax revenues from this project and that in his opinion there would be air pollution and in the past we have had little if any help from the Air Pollution Board. Mr. Aguilar closed the Public Zoning hearing at 8:47 P.M. Mayor declared a short recess in order for the two groups to move to the Conference Room for a joint workshop. The Joint Workshop was reconvened at 9:01 P.M. with the City Manager exp1aini:ng and discussing with the Planning and Zoning Commission and the Council the proposed procedures for the Commission. Mayor Bueker called another recess at 10:30 P.M. with the Council moving to the Council Chambers for a short workshop, and since the Mayor had to leave Mayor Pro Tern Sawyer chaired the workshop session. #3 - A Mr. Howe made a motion to cancel the scheduled workshop on the 17th of March 1980. Mrs. Hyatt seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider and Stomackin NAYS: None B. Building Code Administration policy and Fees. Mr. Sawyer said that since the City has no track record, who not try these fees for a few months. Mr. Schneider moved to accept the present proposed form, with the changes made at previous meetings, for a period of three months. Mrs. Hyatt seconded the motion which carried with the following vote: AYES: Counci1members Howe, Hyatt, Schneider and Stomackin ' NAYS: None s~~ Mr. Gilmore reported he had talked with Mrs. Barnes and she said she would be willing to stay on as Welfare Director if the Council wished her to. Council agreed she should and also discussed updating the name of the Department. Mr. Gilmore reported he had been contacted by a representative who runs the STEP program and will be getting information that may allow us to use five persons over 55 years of age under this program. He also advised that a representative of GUADCO had come to the office and tried to leave a letter and check for their water billing, which said that by accepting the check, the City would agreed to a rate of 57t/1000 for past due as well as future billing. Sawyer, presiding; Richard L. Howe; Walter F. Schneider; and Jack M. Stomackin Sr. Absent: Mayor Robert C. Bueker and Gail Hyatt. Staff present were City t~nager Jimmy G. Gilmore and City Secretary June G. Krause. WORKSHOP: Mayor Pro Tern Sawyer opened the workshop session explaining the owner of the Balcones Rock Company wished to explain his position to the Council concerning his request for a Specific Use Permit which was discussed at the Public Hearing on March 11, 1980. Mr. Schoenfeld briefed the Council on what he had intended doing with the property in question by putting in a gravel pit. He explained that he had an option on the property and since that is where the gravel is and about half of the property is outside the city limits, he could go ahead and put in his plant on that portion. He would like to get along with his neighbors is his reason for coming before the Council but if necessary he would uti1itze the portion outside the city limits. He said his purpose for this meeting was to ask that if he set up outside the city 1i~its was the Council going to fi ght him.
