#13 ITEMS BY COUNCIL: Mr. Howe reported that Deer Run has an excess
of pot holes.
Mrs. Hyatt,referring to the sewer odor in Rio Vista and Lone Oak, said she
haditalked with Mr. David Dennis of CCMA and they are working on the problem.
They were of the opinion this was a Schertz problem and the costs should be
borne by Schertz but Council agreed it is an areawide problem, in that at the
time of purchase they would make efforts to see that no odors was brought
over the City of Schertz. The City Manager was instructed to discuss this
with Mr. Weaver of CCMA.
Mr. Sawyer asked if staff had checked with CCMA concerning their warning
system. Mr. Gilmore said that he had and they have it under contract and it
would be more costly than the proposed system of the City engineer.
Mr. Gilmore notifed the Council that the pipe on the land across from the
Fire Department belonged to the Telephone Company and was there only on a
temporary basis. Also probably some dirt would be hauled in to fill in holes.

unanimously carried, the meeting adjourned at 8:08 PM.

SPECIAL MEETING OF THE CITY COUNCIL
APRIL 8, 1980
The Schertz City Council convened in Special Session, Tuesday, April 8, 1980
at 7:00 P.M.iri the Council Chambers, 1400 Live Oak Road with the following
members present: Mayor Robert C. Bueker, presiding; Mayor Pro Tern Earl W.
Sawyer; Richard L. Howe; Gail Hyatt; Walter F. Schneider; and Jack Stomackin.
Staff present: City Manager Jimmy G. Gilmore and City Secretary June Krause.
Mayor Bueker called the meeting to order and welcomed those present,
asking their indulgence while the City Manager calls the City Attorney to
determine the legality of appointing a recount committee under the ordinance
calling for a canvass of the election.
#1 ORDINANCE: Mayor Bueker introduced an ordinance, as captioned below,
with the City Manager reading the caption. He then
advised Council that Mr. Schneider had filed a Recount Application with him.
As the City Attorney could not be reached, Mayor Bueker recommended the can-
vassing of the Mayor's race be continued until the next night.

Mr. Stomackin moved to proceed with the canvassing wfth Place 1 William
C. Courtney receiving 262 votes, Richard-L. Howe, 455, Lurline Davis-293;
Place 2 Jackie Lawler receiving 417, John Merryman - 136 and Barbara
Taylor 434; the winners being Richard L. Howe, Place 1 and Barbara Taylor,
Place 2. Mr. Sawyer seconded the motion which carried with the following
votes:

Mr. Sawyer then moved to continue with the agenda items but then to recess
the meeting until Wednesday night. Mr. Howe seconded the motion which
carried with the following vote:

After determining the Mayor's race had to be canvassed prior to consider-
ing a recount, Mr. Howe moved to accept the canvassing of the Mayoral votes
the Council was ,presented tonight as conducted by the people at the election
of April 5, 1980, those being Jack Mayor Stomackin, Sr. - 482 and Walter F.
Schneider 469; and Ed Mosher - 30. Mr. Sawyer seconded the motion which
carried with the following vote:
AYES: COUNCILMEMBERS Howe, Hyatt, Schneider, Sawyer and Stomackin
NAYS: None
#2 SWEARING-IN CEREMONY: Mayor Bueker then gave the oath to Mr. Howe ' i

Mrs. Hyatt then stepped down with Mrs. Barbara T~ylortaking her place on
the Counci 1.
#3 MAYOR PRO-TEM SELECTION: Mayor Bueker recommended deferring this
selection until the new Mayor is sworn in.
#4 WORKSHOP: The City Manager introduced the members of the Industrial
Development Committee who were present to the City Council.
Mr. Weaver, ex-officio member for Utilities and Transportation; Mr. Harry B.
Richburg, Site location and Buildings; William D. Dodge, Financing and living
conditions; Charles B. Sharpe, Insurance and Taxation. Mr. Dennis Hailey
representing Construction and zoning was not present. Then Mr. Gilmore
explained the Council would need to appoint someone as a voting member
for utilities and transportation as Mr. Weaver asked to be considered only
an ex-officiao member. Also the selection of the Councilmember representa-
tive would have to be selected.
He explained the members of the committee would be given copies of the
By-laws and asked them to read over and discuss them before meeting with
the Council at a later date.
Counci1members then welcomed the men and thanked them for willingly volun-
teering for this non-paying committee, and offered their help whereever
possible.

Mayor Pro Tern Sawyer then presented a gavel plague to Mayor Bueker for
his long tenure serving the City and wishing him good luck in his future
endeavors.
Mr. Stomackin also had a presentation for the outgoing Mayor. He presented
him with a black flag he had flown in past years when Mr. Bueker won an
election, saying that after knowing him better and working with him closely
for the last year he was retiring the flag.
On a motion by Mr. Howe, seconded by Mr. Sawyer the
meeting was recessed 'at 7:34 P.M. to be reconvened
Wednesday evening the 9th at 7:00 P.M. The motion carried unanimously.
The Special meeting of the City Council was reconvened at 7:00 P.M. on
Wednesday, April 9th, 1980 in the Council Chambers, 1400 Live Oak Road with
the following members present: Mayor Robert C. Bueker, Mayor Pro Tern Earl
W. Sawyer, Richard L. Howe, Barbara Taylor, Walter F. Schneider and Jack
M. Stomackin. Staff: City Manager Jimmy G. Gilmore and City Secretary
June G. Krause.
Mayor Bueker explained this was a continuation of the previous night's
meeting and asked the Council to submit names for consideration for the
Recount Committee. He explained the impartiality referred not to the candi-
dates but the recounting of the votes.
Mr. Sawyer recommended the following four names: Tom Joiner, Rufus Barnes,
Ed Nordmeyer and Douglas Mikus.
Mr. Schneider nominated ,Gene Riley; with Mr. Howe nominating Dr. Peek and
Mayor Bueker nominating Ruth Tienor.
Mr. Howe then moved the nominations be closed. Mr. Sawyer seconded the
motion which carried with the following vote:
AYES: Counci1members Howe, Taylor, Schneider, Sawyer and Stomackin
NAYS: None

The City Secretary then ascertained from the Voter Registration list that
all seven nominations were registered voters.
Mr. Sawyer suggested that since Mr. Riley was Mr. Schneider's recommendation
and Mr. Mikus was Mr. Stomackins, that these men be considered. Then Mrs.
Tienors name was placed next for consideration.
Mr. Schneider moved to appoint Mr. Gene Riley, Mr. Douglas Mikus and Mrs. Ruth
Tienor as members of the Recount Committee. Mr. Sawyer seconded the motion
which carried with the following votes:

Mr. Schneider then moved to appoint Mr. Gene Riley as Chairman of the
Recount Committee, with the committee convening at 9:00 A.M. on Monday
April 14, 1980. Mr. Howe seconded the motion which carried with the
