SPECIAL MEETING OF THE CITY COUNCIL
APRIL 22, 1980
The Schertz City Council convened in Special Session, Tuesday, April 22,
1980 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the
following members present: Mayor Jack M. Stomackin, presiding; Mayor Pro
Tern Richard L. Howe; Barbara Taylor; Walter F. Schneider; Earl W. Sawyer
and Jackie Lawler. Staff present were City Manager Jimmy G. Gilmore and
City Secretary June G. Krause.
#1 PUBLIC ZONING HEARING: Mayor Stomackin opened the Joint Public
Zoning Hearing at 7:01 P.M. and turned the
meeting over to Planning and Zoning Chairman Adolph Aguilar. Mr. Aguilar
explained the purpose of the public hearing, held jointly with the City
Council, was to consider ZC-25 - reclassification of 3 recently annexed
tracts of land currently zoned Pre-development, and receive citizen lnput
concerning the reclassification of these tracts of land.
According to the Zoning Ordinance, newly annexed land is temporarily classi-
fied pre-development; then the Planning and Zoning Commission, within six
months of annexation, will recommend permanent classification to the City
Council; a joint public zoning hearing will be held; then the P&Z has 10
days to make their recommendations to the Council based on the public
heari ng.
Mr. Aguilar showed each tract of land on slides; the first being 79-A-18
a 300 acre tract north of IH 35. The P&Z recommendation is that 750 feet
along IH 35 be zoned General Business (GB) and that the remaining portion
be zoned Industrial District Group A, (M-1). There were no citizen, Council
or P&Z comments on this tract.

The second tract (79-A-23) is 335 acres around the Oak Forest Subdivision.
The recommendation is that 200 square feet of the north side of Green Valley
Road and the east side of FM 3009 be zoned General Business (GB) with the
remaining portion be zoned Single Family lMelling District (R-l). Mrs.
Besch had a question concerning taxation and was told by the City Manager
there would be no change in her taxes until a business goes in. George
and Sylvia Hemphill of 4200 Shady Oak Lane also asked how they could voice
their opinion on the balance of this area along FM 3009 being rezoned GB.
Mr. Aguilar explained they would have the same opportunity as they have
at this public hearing.
The third area (79~A-24) is a 324.13 acre tract kno~as Horseshoe Oak
Subdivision, with the recommendation being that the frontage of the parcel
along FM 3009 be zoned General Business, with the remaining zoned Single
Family lMe11ing District. Unit 1 of this subdivision has previously been
approved on Final Plat.
There being no further questions or comments from either the audience or
Coucni1 or P&Z, Mr. Aguilar closed the public hearing at 7:19 P.M, and
called a short recess in order for,the P&Z to resume their meeting in the
conference room.

Mayor Stomackin reconvened the Special Meeting at 7:28 P.M.
The City Manager read a proclamation proclaiming the month of Mayas FLY
YOUR FLAG MONTH.
The.Council questioned the signing of the proclamation as it was not an
agemda item but the City Manager explained that it was a IIMayor"sll procla-
mation and did not require the direction of the Council to be signed.
#3 ADJOURNMENT: Mr. Howe moved the meeting be adjourned at 7:36 P.M.

#1 APPROVAL OF MINUTES: A. Mr. Howe moved the minutes of the Regular
meeting of April 15, 1980 be approved.
Mr. Schneider seconded the motion which carried with the following vote:
AYES: Counci1members Howe, Taylor, Schneider, Sawyer and Lawler.
NAYS: None
B. Mrs. Lawler moved to approve the minutes of the Special Session of April 22,
1980. Mr. Schneider seconded the motion which carried with the following vote:
AYES: Counci1members Howe, Taylor, Schneider, Sawyer and Lawler.
NAYS: None
#2 HEARING OF RESIDENTS: Betty Miller asked what the citizens could
do to help in regards to the burglaries and
vandalism in Schertz. Mayor Stomackin said he would cover that under item #13.
