ccreg-07-01-1980 179 REGULAR MEETING OF THE CITY COUNCIL J UL Y 1, 1 980 Th~ Schertz City Council convened in Regular Session, Tuesday, July 1, 1980 at 17:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Jack M. Stomackin, Sr., presiding; Mayor Pro Tern Richard L. Howe; Barbara Taylor; Walter F. Schneider; Earl W. Sawyer and Jacquelin Lawler. Staff present were City Manager Jimmy G. Gilmore and City Seqretary June G. Krause. #1 APPROVAL OF MINUTES:A,Mr. Schneider requested that the vote on item #3 of the minutes of the Regular Meeting of June 10, 1980 reflect that he voted Aye on the second motion. Mrs. Taylor requested that the vote on the 1st motion in item No. 3 of the mirlutes of the meeting of June 10, 1980 be reversed to show the vote as foll ows: "AYES: NAYS: Mr. Howe and Mr. Sawyer Mrs. Taylor and Mrs. Law1 er" Mr. Howe made a motion to accept the minutes of the regular meeting of June 10 19l:0 a's corrected. Mr. Schneider moved to accept the minutes of the Workshop Session of June 16, 1980 as presented. Mrs. Lawler seconded the motion which carried with the following vote: AYES: Councilmembers Schneider, Taylor, Howe, Sawyer and Lawler NAYS: None c.1 Mr. Howe moved to approve the minutes of the Regular Meeting of June 17, 19~0. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Counci1members Schneider, Taylor, Howe, Sawyer and Lawler. NAYS: None #2 HEARING OF RESIDENTS: Mr. Dick Chambless discussed with the City I Council the low water pressure the City is exweriencing and the reasons for the shortage or low pressure. Mr~ Tom Harm addressed the Council regarding his concern that the City only has one police officer on duty during the daytime and sometimes at night. He said he would even not mind a tax increase if that is what it would take to have a larger force. Mr. Don Grainger again addressed the Council concerning what in his opinion is excessive charges for swimming lessons. His theory was to lower the rates an~ have more children involved in the lessons and the City would come out with the same amount of money. 180 Mayor Stomackin advised all three gentlemen that the matters discussed would be looked into. #3 ORDINANCE: The Mayor introduced the following captioned ordinance with the City Manager reading the caption: AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO FIRE ANY GUN THAT DISCHARGES A BULLET, PELLET OR MISSILE BY MEANS OF COMPRESSED AIR, OR ANY OTHER COMPRESSED GAS OR A SPRING; TO SELL, GIVE OR PLACE IN ~ THE POSSESSION OF ANY PERSON UNDER THE AGE OF 17 YEARS ANY GUN WHICH DISCHARGES A BULLET, PELLET OR MISSILE BY MEANS OF COMPRESSED AIR, SPRING, OR COMPRESSED GAS OR ANY KIND; TO SECL, GIVE, OR PLACE IN POSSESSION OF ANY PERSON UNDER THE AGE OF 17 YEARS A GUN, TOY GUN, CANNON CAPABLE OF DISCHARGING A MISSILE BY MEANS OF ANY EXPLOSIVE CAP OR CARTRIDGE OF ANY DESCRIPTION AND PROVIDING A PENALTY FOR VIOLATION THEREOF. Attorney Harris advised that the penalty clause should read~ in a sum not to exceed $200.0011. /()V/~( Council discussed at length the content of this ordinance, stating that they felt it too restrictive; that this ordinance would make it illegal to even give a child a suction cup type missile. Mr. Sawyer moved this ordinance be given to Richard Harris to be studied and rewritten to not be so restrictive. Mrs. Lawler seconded the motion which carried with the following vote: AYES: Counci1members Schneider, Taylor, Howe, Sawyer and Lawler NAYS: None I I #4 ORDINANCE: The Mayor introduced the following captioned ordinance with the City Manager reading the caption as follows; ~N ORDINANCE REGULATING THE MASSAGE BUSINESS, MASSEURS AND HEALTH SPAS, PROVIDING FOR PERMITS; ESTABLISHING HEALTH AND SANITATION REQUIREMENTS; ESTABLISHING HOURS OF OPERATION; PROVIDING FOR A PENALTY FOR ANY VIOLATION BY FINE OF NOT MORE THAN $200.00 AND BY SUSPENSION OR REVOCATION OF ESTABLISHMENT'S OPERATING PERMIT; AND PROVIDING FOR SEVERABILITY. Mr. Schneider moved to accept the first reading of this ordinance. Mrs. Lawler seconded the motion which carried with the following vote: / /0/16 AYES: Councilmembers Schneider, Taylor, Howe, Sawyer and Lawler NAYS: None #5 RESOLUTION: Mayor Stomackin introduced the following captioned resolution with the City Manager reading the caption: RESOLUTION NO. 80-R-2 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, EATABLISHING A SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (S.T.E.P.) WITH PARAMETERS OF OPERATION AND UNDERSTANDING. 181 Mrs. Lawler moved this resolution be accepted that established a S.T.E.P. program in the City of Schertz. Mrs. Taylor seconded the motion which carried with the following vote: AYES:' Councilmembers Schneider, Taylor, Howe, Sawyer and Lawler NAY?: None #6 RESOLUTION: The Mayor introduced the following captioned resolution which was read in full by the City Manager. II/-/?0 RESOLUTION NO. 80-R-3 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING PURSUANT TO THE PROPOSED ANNEXATION OF 207.9 ACRES OF LAND MORE'.OR LESS IN THE C.M. GAHAGAN AND JOHN NOYES SURVEYS OUT OF COMAL COUNTY. Mr~ Schneider moved to accept this resolution as presented. Mr. Sawyer seqonded the motion which carried with the following vote: AYES: Counci1members Schneider, Taylor, Howe, Sawyer and Lawler NAYS: None //.:~ V/' #7 RESOLUTION: The Mayor introduced the following captioned resolution which was read in full by the City Manager. RESOLUTION NO. 80-R-4 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING PURSUANT TO THE PROPOSED ANNEXATION OF 74.99 ACRES OF LAND, MORE OR LESS OUT OF BEXAR COUNTY. Th~ City Manager pointed out on the map the locations of these resolutions. Mr'l Sawyer moved to approve this resolution as written. 'RESOLUTION NO. 80-R-5 A RESOLUTION BY THE CITY COUNCIL OF THE EITY OF SCHERTZ, TEXAS, SETTING A TIME, PLACE AND DATE FOR A PUBLIC HEARING PURSUANT TO THE PROPOSED ANNEXATION OF 42 ACRES OF LAND MORE OR LESS, OUT OF GUADALUPE COUNTY. Mr. Schnei der seconded the moti on wh i ch carri ed as follows: AYES: Councilmembers Schneider, Taylor, Howe, Sawyer and Lawler NAYS: None //"/ Pc' 182 1/5- Jo Ilb/ fo #9 W&S BAD DEBT WRITE-OFF: Mr. Gilmore explained that even though the water and sewer bad debt write-off list comes before the Council at various times during the year for approval, the accounts are still pursued for collection. Mr. Howe moved to write these accounts off to for-bookkeeping records and diligent efforts be made to collect these debts. Mr. Schneider seconded the motion which carried with the following vote: AYES: Councilmembers Schneider, Taylor, Howe, Sawyer and Lawler NAYS: None #10 APPOINTMENT: Mr. Schneider moved to appoint Frederick Martin secretary for the Planning & Zoning Commission. Mr. Howe seconded the motion which carried with the following .,vote: AYES: Counci1members Schneider, Taylor, Howe, Sawyer and Lawler. NAYS: None #n ! EXECUH.VE SESSION: None needed at this time. #12 CITY MANAGER'S REPORT: Mr. Gilmore reported that at the recent quarterly meeting of the Alamo Chapter of the Association of Clerks and Secretaries of Texas, Mrs. Krause was presented a plaque for being the organizer and first president of the Chapter. Also because of the many different parties during the Christmas season, the annual City party has been changed to a summer picnic to be held on the 20th day of September. The City Manager also advised Council of the need for extra security officers for the annual 4th of July Jubilee. Approximately $120 would be needed for four off-duty officers. Council disoussed the availability of money in the budget with Mr. Sawyer and Mr. Stomackin both agreeing to pay half each if the money could not be obtained from the budget. He also advised that because of the extended hot and dry weather, the water situation is deteriorating. The pumps just cannot keep up with the demand of water. He requested the City go on a voluntary odd/even day watering. Council discussed at length the water situation. Mr. Schneider mentioned that three years ago, the then City Manager and Engineer were asked to locate a new well site and drill in order for the City to have enough water. Council concensus was for Mr. Gilmore to get with the engineer and commence this project at once. He reported that Mr. Naylor has come in saying that the original owner of the land that was granted a moratorium has now purchased an additional three acres and wants the same moratorium on these additional acres. Mr. Gilmore recommended that regardless of what Council does with this request, that all future requests for small acreage of this type be brought to Council by the owner not Mr. Naylor. after pr06f of actual purchase. #13 ITEMS BY MAYOR: Mayor Stomackin said he was driving through the park and thinks it beautiful the use the people are making of our park system. 183 #14 ITEMS BY COUNCIL: Mr. Howe mentioned that Schertz has one of the best parks around; and since some of the other cities do not have parks, he feels our citizens are subsidizing them. He feels that park upkeep should be paid by the people that use the parks. Mr~ Sawyer said that during the last two or three weeks, there has been a co~munication problem between the Fire Department, SAFES, etc.; he feels that rather then get an outside committe to study the problems, the city should form a committee of key personnel from each of the groups involved who know the problems. ! At 8:38 P.M. Mayor Stomackin called for a recess of ten minutes in oraer for the Council to move to the Conference Room for a workshop session. #15 WORKSHOP: The meeting was reconvened at 8:45 P.M. Council discussed the proposed 1980-81 budget and ways in which to increase revenues or cut the budget. #,16 ADJOURNMENT: On a motion by Mr. Howe, duly'seconded and unanimously carried, the meeting adjourned at 10:11 P.M. ATlrEST: rJ2..D ~n ~ary, City of Schertz SPECIAL SESSION OF THE CITY COUNCIL J UL Y 8, 1980 The Schertz City Council met in Special Workshop Session, Tuesday, July 8, 19BO at 7:00 P.M. in the Conference Room of the Municipal Complex, 1400 Live Oak Road with the following members present: Mayor Pro Tem Richard L. Howe, presiding; Barbara Taylor; Walter F. Schneider; Earl W. Sawyer and Jacqueline La~ler. Absent: Mayor Jack M. Stomackin. Staff present were City Manager Jilmmy G. Gi 1 more and Ci ty Secretary June G. Krause. #1 WORKSHOP SESSION: Mr. Gilmore advised Council that the Bureau of Census had sent a preliminary report showing a !census count of 6910; however, they did not count Lone Oak Subdivision aSi well as leaving out other areas, such as apartments. We have an addition- al! count of 578 more people, bring the total up to 7488 at the present with more study being done. I Hd also advised of receiving a letter from the Secretary of the Treasury r~garding our last quarter Revenue Sharing allotment being less than antici- pated. He has written a reply asking for an explanation.
