M. in the Counci 1 Chambers, 1400 Li ve Oak Road with the fo 11 owi ng mem~ers present: Mayor Jack M. Stomackin, Sr., presiding; Richard L. Howe; Bar~ara Taylor; Jeff Duffield; Earl W. Sawyer and Jacqueline Lawler. Staff prefent: City Manager Jimmy G. Gilmore and City Secretary June G. Krause. I #1 APPROVAL OF MINUTES: A. Mrs. Lawler moved to accept the minutes of the Special Meeting of August 18, 1980. Mr. Sawyer moved the minutes of the Special Meeting of August 26, 1980 be acc~pted. Mrs. Lawler seconded the motion which carried with the following vote: IAYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler. NAYS: None I #2 HEARING OF RESIDENTS: Mr. Dick Chambless advised the Council that he was seriously thinking of injoining the City on the tax increase as he did not think they followed the Charter or Vernons. 2. Mr. Harry Gordon, Chairman of SAFES organization, advised that their organi- zation felt it necessary to express their feelings and set the record straight as to the money received from the County Revenue Sharing funds. Although they had asked for more, they received $12,000 and are happy with the amount. The monry was requested to help payoff the new ambulance and that is what it will be ~sed for and they do not want to see the money put in jeopardy. 3. Mr. Pingenot requested to speak on item No.6 or 7. 4. Mrs. Walter Schneider of 111 Zuehl Road asked about spending city money on i personal gift. She referred to the replacement of a watch to a patrolman who lost the watch in the line of duty (as explained by Mayor Stomackin). On luestioning where the money would come from, she was told petty cash and that she would be given a copy of the receipt. Bef)re continuing with the regular agenda items, Mayor Stomackin asked former Cou1cilman Walter Schneider to come forward. The Mayor presented Mr. Schneider with a plaque for his faithful service to the community during his 5 year tenure on the City Council. 206 Mr. Schneider thanked the City Council for giving him the plaque and wished the Council well in the future. #3 PUBLIC HEARING: Mayor Stomackin opened the public hearing at 7:15 P.M. and explained the purpose of the hearing was to allow citizens to be heard on the proposed disannexation of 3 acres of land out of Guadalupe County. As there were no citizens wishing to be heard and Council had no questions, the public hearing was declared closed at 7:16 P.M. #4 ORDINANCE: The Mayor introduced the following captioned ordinance with the City Manager reading the caption. ORDINANCE NO. 80-A-19 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 34.032 ACRES OF LAND MORE OR LESS, OUT OF GUADA- LUPE COUNTY. /3S-cfCJ Mr. Howe moved to accept the final reading and pass this ordinance. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler NAYS: None ,- #5 ORDINANCE: The Mayor introduced the following captioned ordinance and pointed out on the map the location of the property involved. NAYS: None #6 ORDINANCE: The Mayor introduced the following captioned ordinance and pointed out on the map the location of the proposed annexation. Mr. Gilmore read the caption as follows: ORDINANCE NO. 80-A-21 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 207.9 ACRES OF LAND MORE OR LESS IN THE C.M. GAHAGAN AND JOHN NOYES SURVEYS OUT OF COMAL COUNTY. I' I ~ 207 ..i Mr. ! Sawyer moved this 207.9 acres out of Coma1 County be approved on final rea~ing of the ordinance. Mr. Howe seconded the motion. He then explained for! those in attendance that if this be farm land, it will remain farm land and! the annexation is just to control the I 35 and keep San Antonio from ann~xing. He went on to say that Schertz will get very little tax money fro~ this annexation, but merely want to control the type of businesses that go in there. MaYI)r Stomackin reemphasized the above as well as stating that in the event a p~rson wants to sell their land in this annexation the proper zoning would inc~ease the value of the land. He then called for a vote on the motion, whi,:h carried as follows: AYES: Councilmembers Duffield, Howe, Sawyer and Lawler NAYS: Councilmember Taylor #7 RESOLUTION: Mayor Stomackin called on Mr. Hilmer Pingenot, who , said he was representing Martin Sada, who owns land in ~he area on I 35 considered for annexation. It was determined that he really referred to the annexation completed in item No.6. Mr. Martin was objecting to the annexation as he would be paying taxes and getting no services for his tax money. Mr. Pingenot asked that the Council reconsider their action on this particular annexation. Mr. Gilmore reminded Mr. Pingenot that a public hearing was held on this particular annexation, that Mr. Martin was at that public hearing and that ample time had been given between then, the first and final considerations of the ordinance for Mr. Martin to speak. ).3 ,'I-~) The City Manager then read the caption of the resolution before Council as fo 11 ows : A RESOLUTION BY fHE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF 177.7 ACRES OF LAND MORE OR LESS IN THE C.M. GAHAGAN AND J.F. ZEPEDA SURVEYS OUT OF COMAL COUNTY. Mr. Sawyer moved this public hearing be set for October 7, 1980 at 7:00 P.M. Mrs. Lawler seconded the motion which carried as follows: AYES: NAYS: Counci1members Howe, Taylor, Duffield, Sawyer and Lawler None ;3:, ~ #8 PURCHASE PROCEDURES: The City Manager explained these procedures presented have incorporated all the suggestions made at preceeding meetings. Mr. Howe moved to accept the purchasing procedures as presented and follow them as closely as possible. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Council members Howe, Taylor, Duffield, Sawyer and Lawler NAYS: None /3 '1-J?c 208 #9 EXECUTIVE SESSION: At the request of Mr. Sawyer, Mayor Stomackin called at Executive Session at 7:42 P.M. under Article 6252-17 V.T.C.S., Section 2 (g). The Regular meeting was reconvened at 8:09 P.M. #10 CITY MANAGER'S REPORT: Mr. Gilmore referred to a memo on some proposals on water rates and asked if additional information was desired to let him know. This is just for study at this time. Council briefly discussed water improvements and bonding for same. 2. The City Manager advised that staff had attempted to obtain a copy of the County budget from the County Clerk's office and was told they only had two pencil copies and these could not be reproduced on their machine. He will continue to try to obtain copies or at least go down and review the proposed budget prior to the public hearing. 3. Mr. Gilmore also discussed the negotiations being carried out concerning becoming a part of the county free library system. #11 ITEMS BY MAYOR: Mayor Stomackin said that he had been to Seguin to talk with Judge Fleming about the library and that he does not know if we will be covered this year but feels sure we will in the future. Also Mr. Giles has informed him that sometime after the first of the year he will have one of his employees in Schertz once or so a week to sell license tags. He will continue to work with Seguin for better service to our citizens in Schertz. I ~-' The City Manager said he would like to invite the County Judge to Schertz in October to a meeting to discuss with Council their philosophy on their budgeting process among other things. Council concensus was to invite Judge Fleming for the' October 7th meeting. #12 ITEMS BY COUNCIL: Mr. Duffield asked how the sale of 85% of the Schertz Bank & Trust stock effect the City, since this bank is our depository. Mr. Gilmore said that he would investigate. Mr. Howe said that he had been reading in the papers articles from the Indus- trial Development Committee meetings and it bites at his craw that Mr. Richburgh says the City Council is against growth. He referred to the Municipal building saying the city has grown and grown soundly; the rea1estate people own the land and that the City Council does not have control over real estate property. Mr. Sawyer said it has been a pleasure for him to work with Mr. Schneider for the last 5~ years and thought he had done a darn good job on the Council. Mr. Sawyer also asked if anything had been done on the water line extension policy discussed at a previous meeting. Mr. Gilmore said nothing beyond r-- what we already have. i~ 209" Mrs Lawler told the Mayor she would like to go with him the next time he vis ted with the County Judge, with Mayor Stomackin replying that he would be mos happy for her to go when he knew in advance that he would be going. , #13 ADJOURNMENT: 8:4Q P.M. He showed a briefing chart giving the IDC overview saying they were a tool to be used by Courcil. The discussion included the types of industries and businesses wanted; the City's position on annexation and disannexation, utility extension; cost sharing, tax relief; the development and adoption of a master plan. Cou~ci1 concensus was that they wanted only clean - non polluting - industries; they would consider disannexation if requested on a case by case basis; also they woul d cons i der gi vi ng a moratori urn for tax purposes.
