The Schertz City Council convened in Special Session on Monday, September 15,
1980 at 7:00 P.M. in the Conference Room of the Municipal Complex, 1400 Live
Oak Road with the following members present: Mayor Jack M. Stomackin, presid-
ing; Jeff Duffield; Barbara Taylor; Richard L. Howe; Earl W. Sawyer and Jacqueline
Lawler. Staff were City Manager Jimmy G. Gilmore and City Secret~ry June G.

Courcil. The discussion included the types of industries and businesses wanted;
the City's position on annexation and disannexation, utility extension; cost
sharing, tax relief; the development and adoption of a master plan.
Cou~ci1 concensus was that they wanted only clean - non polluting - industries;
they would consider disannexation if requested on a case by case basis; also
they woul d cons i der gi vi ng a moratori urn for tax purposes. In di scuss i ng de=
annE~xation the City Manager recommended setting a price limit rather than size

Mr. Sawyer again brought up the need for a City water line extension policy,

Mr. Gilmore informed Council he had been contacted regarding a business
that want to start immediate construction on FM 2252 close to the railroad
tract. They treat lumber to make it fire retardant and to keep it from
decaying and want to start construction the first of October. It is a clean
industry. The only problem is that at the present time it is zoned PD
and and it normally takes 60 to 90 days to rezone property. However, since
this company had contacted the City prior to passage of the current ordinance,
he asked Council permission to issue a permit for non-conforming use.
Concensus of the Council was for the City Manager to proceed.
Mayor Stomackin recessed the meeting at 9:45 P.M and reconvened the meeting
at 9:53 P.M.
#3 MOBILE VILLA WATER: Mr. Clayton Fifield of Mobile Villa Estates
addressed Council concerning excessive and non-
understandable water billings residences are receiving. ;~e said that these
billings are beyond the point of being ridiculous. He asked Council help
saying that he and perhaps others from Mobile Villa would be willing to
pay a pro rata shar to have the City run water lines in their development.

people of Mobile Villa.
#4 PERSONNEL: Mr. Sawyer moved to increase the City Manager's compensa-
tion to the amount discussed at the last Executive Session.
Mrs. Lawler seconded the motion which carried with the following vote:

#5 WORKSHOP: A. Council briefly discussed water rate increase as
it would pertain to bonding payments for water
improvements. It was agreed to act on the water rates at the next regular
meeting.
#6 GENERAL DISCUSSION: Mr. Gilmore brought the Council up to date on
the requirements necessary under the new Tax
law "Truth in Taxation" in order to set a tax rate for the coming budget.
It will be necessary to reestablish the tax rate at $1.00/$100, requiring
a public hearing and vote.
B. Mr. Gilmore called attention to the fact that First and Dowman streets
are sinking, caused by improper base material and tapping, causing a dangerous
situration. Council suggested that if it can be done in-house, it would be
much cheaper and probably a better job.
C. The City Manager then informed Council that the Municipal Judge has
requested his salary be increased since it has become necessary to have two
courts a month. He was just bringing it to Council attention as it would
require ,~ budget amendment.
D. Mr. Gilmore then made the following announcments: (a) the city picnic
to be September 20th in the park (b) Sam Boswell is working on water line
priorities (c) newspaper bids are coming up shortly and (d) the valve on
3009 is in and completed, giving a 60# pressure.

~3 ORDINANCE: The Mayor introduced the following captioned ordinance
on an emergency basis, with the City Manager reading the

LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE DISANNEXATION
OF A TRACT OF LAND CONTAINING 3 ACRES OF LAND MORE OR LESS
OUT OF GUADALUPE COUNTY
Mr. Sawyer moved this ordinance be accepted on an emergency basis. Mrs. Taylor
secmded the motion.

Mr. Duffield asked the City Attorney if the City could control the building
on the property, with Mr. Harris explaining the City could control.pnly as
any other property in the ETJ, which concerns plat approval. Mr. Howe
asked if the water charges would be the same as others outside the city limits
which is 150% of that charges within the limits and was told yes it would be.
