Bueker, presiding; Mayor Pro Tem Walter F. Schneider; Richard L. Howe; Gail Hyatt; Earl W. Sawyer and Earl Johnson. Staff present: City Manager Walter W. Hill, Jr.; Asst. City Manager Hal Baldwin; City Secretary June G. Krause. #1 APPROVAL OF MINUTES: Mr. Schneider asked that the minutes of the meeting of October 3, 1978 be corrected to show that Mr. Schneider made the motion on Item #3 B. Mrs. Hyatt then moved the minutes of this meeting be approved as corredted. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson NAYS: None #2 HEARING OF RESIDENTS: Mr. Dick Chambless of 504 Aviation addressed the Council with two complaints: (1) the people living at 501 Aviation are operating a garage from their residence with numerous vehicles parked there at all times arid excessive noise. He said he had reported this to the City offices with no results. Mr. Hill said he would check this out and let Mr. Chambless know the results. (2) Mr. Chambless also requested the Council to consider some type of ordinance that would insure that construction would be completed once begun. He cited the residence at 501 Aviation and the apartments on Live Oak Road. Mr. Hill again said he had talked with the owner of 501 Aviation and understands he has obtained a loan to finish his house and he had an appointment with the con- tractor to discuss the apartments. He has also requested an intern and the Building Official to start working on updating the building codes for the City. ~U4 #3 ORDINANCE: The Mayor introduced an ordinance adopting the latest Fire Prevention Code, appointing officers, etc. Admin- istrative Assistant Richard Nash read the caption of the ordinance and ex- plained the changes being recommended. Council discussed the wording in Sections 7-18, 7-19, 7-37 and 7-40, and decided they would like to have more information before finalizing the ordinance. Mr. Nash then explained the fire limits and showed on a plat the projected limits. Mr. Schneider then moved to postpone any action on this item and requested it be brought back to Council at the next regular meeting. Mrs. Hyatt seconded the motion which carried with the following vote: l~~~')~ AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson NAYS: None #4 COMMUNITY CENTER: Council discussed at length the proposed changes to the Community Center Rules and Regulations in Exhibits I, II, III and IV of Resolution No. 77-R-21. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None #5 CITY MANAGER'S REPORT: Mr. Hill had nothing at this time. #6 ITEMS BY MAYOR: Mayor Bueker gave excerpts from a letter received from the Center Information Officer at Lackland Air Force Base asking area families to extend invitations to trainees to spend Thanksgiving in their homes. It was agreed to give this invitation newspaper distribution and named the city secretary as coordinator. #7 ITEMS BY COUNCIL: Mr. Schneider suggested putting the status report on 911 system, received from AACOG, in our next newsletter. Mrs. Hyatt asked Council to be thinking about an ordinance on noise control. Mr. Howe briefed the Council on the problems Cable TV is having in San Antonio. #8 WORKSHOP: Mayor Bueker declared a short recess before commencing with workshop items, at 8:15 P.M. #9 ADJOURNMENT: On a motion by Mr. Sawyer, seconded by Mr. Howe and unanimously carried, the meeting adjourned at 9:55 P.M. Bueker, Mayor Pro Tem Walter F. Schneider, Gail Hyatt, Earl W. Sawyer and Earl Johnson. Absent: Richard L. Howe. Staff present: Walter W. Hill, Jr., City Manager; Asst. City Manager Hal Baldwin and City Secretary June G. Krause. #1 JOINT PUBLIC ZONING HEARING: The City Council met jointly with the Planning and Zoning Commission to consider ~ :\} ..... ."", ~ '"' jo<~~ ~ :.....J two rezoning requests as follows: A. P&Z Vice-Chairman Linebarger introduced the request by Mr. Graham L. Burris to rezone the remaining portion of Lot 1, Block 1 of Bavarian Village Shopping Business District and to rezone Lot 1 and Lot 3, Block 3 Bavarian Village Shop- ping Center from Pre-development District to General Business District. Mr. Chuck Sharp disqualified himself from the Planning and Zoning discussion or vote on this item as he is part owner of property close by and there could be a conflict of interest. There were five citizens present for this request: Mr. Burris, as owner; Mr. Ira Hecox, 1218 FM 1518; Wilma and Bill Adams, 238 Flintstone; John M. Erb, Ira Street. The sign-in sheet (attached to P&Z minutes) shows only 1 person against the re- zoning, 1 unknown and 3 for the rezoning; however, none of those present wished to speak on this subject. There were no additional questions from either the Councilor Planning and Zoning so this portion of the public hearing was closed. B. Mr. Linebarger introduced the request by Mr. Malford Koch, Mr. Marvin Koch and Mrs. Celeta Dendy, owners, to rezone a portion of three parcels of land, which are situated in the G. Malpaz Survey, along Live Oak Road. They requested portions of the tract zoned R-2, Single Family Dwelling District be rezoned to R-4 Multiple Residence Dwelling District. There were 27 people present for this public hearing, all of which signed the sheet as being against the rezoning. Eleven of these addressed the joint body expressing their sentiments; Aaron Harris, Rick Troberman, Mrs. A. M. White, Eddie Ball, Betty Gardner, Ellis E. Carroll, David Leal, Lawrence Pratt, Lorine Riffel, Tony Aust, Mrs. Aust. Mr. Doug Gary, Guadalupe County Juvenile Proba- tion Officer, also spoke against this rezoning. There being no further discussion, Mr. Linebarger declared the Public Zoning Hearing closed at 8:07 P.M. and called a short recess. #2 JOINT MEETING: Chairman Linebarger called the Joint Meeting to order at 8:22 P.M.. He explained the purpose was to determine if the request of Mr. Oswald Fey and Mr. Robert Fey to rezone a 16.34 acre tract of land out of the T. Herrera Survey (which abutts the Hardin Subdivision on the west, Mobile Villa Unit One on the east and Mrs. Bertha Oberkampf's property on the north) from Pre-development to M-l, light Industrial, meets the four criteria of the Zoning Ordinance. ~1U\1 Joe Garza pointed out on the map the exact location of the property in question. Mrs. Wanda Koch, representing the owners, explained who the prospective buyer of the property is and what he intends doing with it; namely, make an Industrial Park of the area if he is able to obtain additional property. After discussion, both the City Council and Planning and Zoning Commission agreed the provisions of Section 12.2.2 of the Zoning Ordinance have been met and a public hearing was set for November 28, 1978. Chairman Linebarger adjourned the Joint Meeting at 8:50 P.M. #3 Mayor Bueker declared a short recess before reconvening the Council in the Conference Room for Workshop Session. #4 ADJOURNMENT: On amotion by Mr. Schneider, duly seconded and unanimously carried, the meeting adjourned at 10:25 p.M.
