Schneider, presiding; Richard L. Howe, Gail Hyatt, Earl W. Sawyer and Earl Johnson. Absent: Mayor Robert C. Bueker. Staff Present: City Manager Walter W. Hill, Jr.; Asst. City Manager Hal Baldwin, and City Secretary June G. Krause. #1 WORKSHOP: The Council discussed various workshop items. #2 ADJOURNMENT: On a motion by Mrs. Hyatt, duly seconded and unanimously carried, the meeting adjourned at 9:06 P.M. Bueker, presiding; Richard L. Howe, Gail Hyatt, r, Earl W. Sawyer and Earl Johnson. Staff present: City Manager Walter W. Hill, Jr., Asst. City Manager Hal Baldwin and City Secretary June Krause. #1 APPROVAL OF MINUTES: A. Mr. Sawyer moved the minutes of the Regular meeting of November 21, 1978 be approved. Mr. Johnson seconded the motion which carried with the following vote: AYES: Councilmembers Howe, NAYS: None ABSTAINING: Mrs. Hyatt. , Sawyer and Johnson B. Mr. Howe moved to approve the minutes of the Special Joint Meeting of Novem- ber 28, 1978. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, NAYS: None J Sawyer and Johnson. #2 HEARING OF RESIDENTS: There were none to be heard. 217 #3 KIWANIS CLUB BRIEFING: Mr. Rollins representing the Greater Randolph Area Kiwanis Club gave a film and tap presenta- tion on organized crime. He explained that if any other group in the area was interested in the presentation, he would be glad to show it again. ~ ;:\1 ...... , '- _....J ... ~"1 ......; :..u #4 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 21st day of November 1978. It was deter- mined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council. Thereupon it was moved by Mr. Sawyer and seconded by Mrs. Hyatt that said ord- inance be finally passed and adopted. The Mayor put the motion to a vote of the members of the Council and the ordinance was finally passed and adopted by the fo 11 owi ng vote: AYES: councilmembers Howe, Hyatt" , Sawyer and Johnson. NAYS: None *** See below for caption of ordinance #5 RESOLUTION: The City Manager introduced a resolution as outlined in the above mentioned ordinance, contracting for an official newspaper for fiscal year 1978-79. He explained that we had been un- able to obtain pertinent information from one of the local papers. After discussion by the Council, Mr. Sawyer moved to hold this resolution in abeyance until complete information on both papers could be obtained. () t>3 - ?'/ *** ORDINANCE NO. 78-M-22 AN ORDINANCE SETTING OUT THE PROCEDURE FOR DESIGNATION OF AN OFFICIAL NEWSPAPER AND ORDERING AN ANNUAL REVIEW. #6 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by Administrative Assistant Richard Nash. Mr. Johnson moved that said ordinance be considered by the Council. AYES: Council members Howe, Hyatt, NAYS: None #7 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by Administrative Assistant Richard Nash. Mr. Johnson moved that said ordinance be considered by the Council. Mr. Howe seconded the motion which was carried by the following vote: AYES: Councilmembers Howe, Hyatt, and Johnson. NAYS: Mr. Sawyer. The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE ADOPTING THE SrUTHERN STANDARD PLUMBING CODE 1975 EDITION AS REVISED IN 1976-77 AND 1978, AS A PLUMBING CODE OF THE CITY OF SCHERTZ, TEXAS, AS HEREIN MODIFIED AND REPEALING ALL PRESENT ORDINANCES IN DIRECT CONFLICT WITH THIS ORDINANCE. Whereupon Mr. Johnson moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 19th day of December 1978, which motion was seconded by Mr. Howe and which carried by the following vote: AYES: Councilmembers Howe, Hyatt and Johnson NAYS: None #8 RESOLUTION: The Mayor introduced the following captioned resolution which was discussed by the Council. Mr. Howe moved that said resolution be passed and adopted. Mr. Sawyer seconded the motion which carried by the following vote: AYES: Councilmembers Howe, Hyatt, Sawyer and Johnson. NAYS: None #9 P&Z RECOMMENDATION: The City Manager presented the recommendations of the Planning and Zoning Commission in which they recommended approving the rezoning of a 16.34 acre tract of land out of the T. Herrera Survey, which contains 104.5 feet of frontage on IH 35 south and abutts the Hardin Subdivision on the west, Mobile Villa Estates Unit One on the east and abutts Mrs. Bertha Oberkampt's property on the north, from Pre-development to M-l Industrial District Performance Standard A (Light Industrial) District. Mr. Howe moved to accept the recommendations of the P&Z Commission and rezone the above described property from Pre-Development to M-l Light Industrial District. Mr. Sawyer seconded the motion which carried with the foll owing vote: AYES: Councilmembers Howe, Hyatt, Sawyer and Johnson NAYS: None 219 #10 PAYMENT ESTIMATE: Mr. Hill said that the contract has been completed for the construction of a radio tower and the payment request is the amount bid. Mr. Sawyer moved to authorize payment to Tower Service of San Antonio for the construction of a radio twoer in the amount of $8,276.80. Mrs. Hyatt seconded the motion which carried with the following vote: AYES: councilmembers Howe, Hyatt, Sawyer and Johnson. NAYS: None " b -?? ~ #11 BID REQUEST: Howard Gaddis, City Engineer, presented maps of the ~ swimming pool area showing the placement and type of ~ construction for shade covers in that area. . '"' ~...) :.:; (jJ After discussion, Mr. Howe moved to authorize the advertising for bids on these covers. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Sawyer and Johnson. NAYS: None ?II-1)i The Engineer estimated the cost for these to be approximately $2100 each. #12 EXECUTIVE SESSION: Mayor Bueker called an executive Session under Article 6252-17, Section 2 (e) of V.T.C.S. as amended, at 8:00 P.M. The Mayor reconvened the regular meeting of the City Council at 8:27 P.M. #13 NEWSLETTER: Council made suggestions for the monthly newsl etter. #14 CITY MANAGER'S REPORT: Mr. Hill advised the Council the need to get people to the Public Hearing of the Citizen Participation and Improvement Committee and the need for new members for this committee. #15 ITEMS BY MAYOR: None #16 ITEMS BY COUNCIL: Mrs. Hyatt asked if a price had been obtained for a pool bubble and Mr. Hill said the athletic director of the school had not gotten back to him but he would initiate a meeting soon. Mr. Johnson asked if anything was in the mill to return the flagpole at the park to its original height. Mr. Hill was not aware of it being shortened and said he would check. Mr. Johnson also asked about the plans to paint the pavilion. Mr. Hill said it was budgeted and that the Public Works Director was working on it at this time. ~~~J Mr. Howe asked if the Public Works Department was fully staffed and Mr. Hill said they were short 2 or 3 but were in the hi-ring process at this time. Mayor Bueker suggested introducing new employees at the annual City party in December. #17 ADJOURNMENT: On a motion by Mrs. Hyatt, duly seconded and unani- mously carried, the meeting adjourned at 8:47 P.M. Bueker, Gail Hyatt, Walter W. Schneider, Earl W. Sawyer and Earl Johnons. Absent: Richard L. Howe. Staff present: City Manager Walter W. Hill, Jr., Asst. City Manager Hal Baldwin, and City Secretary June Krause. l.- #1 PUBLIC ZONING HEARING: Chairman Linebarger of the Planning and Zoning Commission, explained the purpose of the public hearing was to consider two rezoning requests. A. ZC-20 Request by Mr. Jim Brunson to rezone a portion of Tract "A" Mobile Villa Estates, Unit 1 from N. S. Neighborhood Services District to MH MObile Home District. Mr. Brunson spoke for the rezoning, explaining the lot is not suited to commer- cial but he does have a prospective buyer for a mobile home lot. Mr. Joe Potempa - 5310 Irola, and Paul Warmock, 5318 Irola were both for the rezoning. They were the only ones present for this part of the publ~c hearing. B. ZC-21 Request to rezone the remaining portion of a 92.472 acre tract of land out of the John Saladin Survey Abstract #299 from PD Pre-development to M-l
