ccreg-12-19-1978 ~~~ REGULAR MEETING OF THE CITY COUNCIL DECEMBER 19,'1978 The Schertz City Council convened in Regular Session, Tuesday, December 19, 1978 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the follow- ing members present: Mayor Robert C. Bueker, presiding; Richard L. Howe, Walter F. Schneider, Earl Johnson. Absent: Gail Hyatt and Earl W. Sawyer. Staff present: City Manager Walter W. Hill, Jr.; City Secretary June G. Krause. #1 APPROVAL OF MINUTES: A. Mr. Schneider moved to approve the minutes of the Workshop Session of December 4, 1978. Mr. Howe seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Schneider and Johnson. NAYS: None B. Mr. Howe moved to approve the minutes of the Regular Meeting of December 5, 1978. Mr. Johnson seconded the motion which carried with the following vote: AYES: Councilmembers Howe and Johnson. NAYS: None ABSTAINING: Mr. Schneider. C. Mr. Schneider moved for approval of the minutes of the Joint Public Hearing of December 12, 1978. Mr. Johnson seconded the motion which carried with the fo 11 owi ng vote: AYES: Councilmembers Schneider and Johnson NAYS: None ABSTAINING: Mr. Howe "--' #2 HEARING OF RESIDENTS: There were no residents wishing to be heard. #3 PUBLIC HEARING: Mayor Bueker explained the purpose of the public hearing was to identify needs, problems, obtain views for proposals on Community Development Program housing needs and priorities. Mr. Hill briefed the Council on a previous meeting of the Citizens Participation and Improvements Committee in which they recommended the following items for consideration: A. The Mobile Villa water system - estimated at $78,100. B. Sidewalks from Elderly Housing Project to Curtiss Avenue - $1,290. C. Entrance to Mobile Villa - City's share $5,100. Council recommended that some of the drainage problems be also considered for these monies. 21'J.~ ?~ Mr. Howe made a motion to wait on setting priorities so that the Committee could meet again and take another look at some of the drainage problems. Mr. Johnson seconded the motion which carded with the following vote: AYES: Councilmembers Howe, Schneider, and Johnson NJWS: None ---1 n 2 (j'" Z ..l Mayor Bueker closed the public hearing at 7:11 P.M. #4 AUDIT: Mr. Bill Havens presented the audit for the fiscal year 1977- 78, giving some of the high lights. On a motion by Mr. Schneider, seconded by Mr. Johnson, the audit was accepted as presented, for the fiscal year 1977-78, by the following vote: AYES: Councilmembers Howe, Schneider and Johnson NAYS: None "1 I ~. )"', C? .." ~ :..l #5 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the Council on the 5th day of December 1978. It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. ..... '-? ~ UJ Whereupon said ordinance was discussed and further considered by the Council. Mr. Johnson moved that said ordinance be finally adopted by the Council. How- ever motion died for lack of a second. After further discussion Mr. Howe moved that both item #5 Building Code Ordinance and #6 the Plumbing Code ordinance be sent back to Worshop session for further discussion. Mr. Schneider seconded the motion which carried with the following vote: AYES: Councilmembers Howe and Schneider and Johnson NAYS: None "~!li :'C' c;,~' r #7 RESOLUTION: The Mayor introduced the following captioned resolution which was read in full by the City Manager. After Council discussion, Mr. Schneider moved to designate the Weekly Herald as the City's official newspaper for the fiscal year 1978-79. Mr. Howe seconded the motion which carried by the following vote: AYES: Councilmembers Howe and Schneider NAYS: Mr. Johnson ;J15''Jt'{ RESOLUTION NO. 78-R-14 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS CONTRACTING FOR THE FISCAL YEAR 1978-79 OFFICIAL NEWSPAPER. #8 P&Z RECOMMENDATIONS: Mayor Bueker explained to the Council why the rezoning request AC-20 was not in the best interest of the City. Mr. Schneider moved the Council reject the request of Mr. Brunson's to rezone the Mobile Villa lot commonly known as iC-20. Mr. Howe seconded the motion which carried by the following vote: AYES: Councilmembers Howe, Schneider and Johnson NAYS: None g)1f.,-1~ iJiJ~;. Mr. Schneider seconded the motion which carried by the following vote: AYES: Councilmembers Howe, Schneider and Johnson NAYS: None #9 ORDINANCE: The Mayor introduced the following which was read in full by the City moved that said ordinance be considered by the Council. the motion Which was carried by the following vote: captioned ordinance Manager. Mr. Howe Mr. Schneider seconded AYES: Co~ncilmembers Howe, Schneider, and Johnson NAYS: None The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTIONS 4-35 AND 4-37; PROVIDING THAT DOMESTIC ANIMAL LICENSES SHALL BE ISSUED AT NO CHARGE TO THE OWNER OF SAID ANIMAL AND REPEALING ALL ORDINANCES IN CONFLICT. Whereupon Mr. Howe movea that said ordinance be further considered at the next regular meeting of the City Council to be held on the 2nd day of January 1979, which motion was seconded by Mr. Schneider and which carried by the following vote: AYES: Councilmembers Howe, Schneider and Johnson NAYS: None #10 CONTRACT: Mr. Howe moved to authorize the Mayor to sign a contract for relocation of water lines in the Randolph area clear zone in the amount of $933.50. Mr. Johnson seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Schneider and Johnson NAYS: None #11 EXECUTIVE SESSION: There was no need for an executive session. #12 CITY MANAGER'S REPORT: Mr Hill announced a 208 hearing for Thursday December 21. #13 ITEMS BY MAYOR: None at this time. #14 ITEMS BY COUNCIL: Mr. Howe said he was pleased to hear the City is working on inventory and purchasing procedures. He also said that since they are spending tax dollars, he felt both the Fire Department and SAFES should furnish audits to the City. Mr. Hill explained that Mr. White, one of the owners of the property rezoned in the Industrial site on 135, was present and wished a short work shop with ~ the Council to discuss water situation for that site. Bueker, presiding; Richard L. Howe; Walter F. Schneider; Earl W. Sawyer and Earl Johnson. Absent: Gail Hyatt. Staff present: City Manager Walter W. Hill, Jr., City Secretary June G.
