ccreg-01-02-1979 ~~ij REGULAR MEETING OF THE CITY COUNCIL JANUARY 2, 1979 The Schertz City Council convened in Regular Session, Monday, January 2, 1979 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Robert C. Bueker, presiding; Richard L. Howe, Walter F. Schneider, Earl W. Sawyer and Earl Johnson. Absent: Gail Hyatt. Staff present: City Manager Walter W. Hill, Asst. City Manager Hal Baldwin and City Secretary June G. Krause. #1 APPROVAL~OF MINUTES: A. Mr. Schneider moved the minutes of the Joint Meeting of December 18, 1978 be approved. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Schneider, Sawyer and Johnson. NAYS: None B. Mr. Howe moved to approve the minutes of the Regular Meeting of December 19, 1978. Mr. Johnson seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Schneider, and Johnson. NAYS: None ABSTAINING: Earl Sawyer C. Mr. Schneider moved to approve the minutes of the Special Workshop meeting of December 27, 1978. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Schneider, Sawyer and Johnson. NAYS: None #2 HEARING OF RESIDENTS: There were no residents wishing to be heard. #3 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance which has been read and considered at the last regular meeting of the City Council on the 19th day of December 1978. It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meet- ing and prior to this meeting. Whereupon the ordinance was discussed and further considered by the Council. Thereupon it was moved by Mr. Schneider and seconded by Mr. Johnson that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the memebers of the Council and the ordinance was finally passed and adopted by the following vote: 1.lq AYES: Councilmembers Howe, Schneider, Sawyer and Johnson. NAYS: NONE ORDINANCE NO. 79-H-l AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE~OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTIONS 4-35 AND 4-37; PROVIDING THAT DOMESTIC ANIMAL LICENSES SHALL BE ISSUED AT NO CHARGE TO THE OWNER OF SAID ANIMAL. 22'1 MRS. HYATT ARRIVES AT 7:05 P.M. #4 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance which was read in full by the City Manager. Mrs. Hyatt moved that said ordinance be considered by the Council. Mr. Johnson seconded the motion which carried by the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None ".1)1 ~ N ~ , ,.:J ~"" - UJ The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE ADOPTING THE SOUTHERN STANDARD BUILDING CODE, 1976 EDITION WITH 1978 REVISIONS, AS THE BUILDING CODE OF THE CITY OF SCHERTZ, TEXAS, AS HEREIN MODIFIED; AND REPEALING ALL ORDINANCES IN CONFLICT. Whereupon Mrs. Hyatt moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 16th day of January 1979, which motion was seconded by Mr. Johnson and carried by the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None :3 . ',I I #5 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by the City Manager. Mr. Sawyer moved that said ordinance be considered by the Council. Mr. Howe seconded the motion which carried by the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None 1 ~?q The following captioned ordinance was then discussed and fully considered by the Counci 1 : AN ORDINANCE ADOPTING THE SOUTHERN STANDARD PLUMBING CODE 1975 EDITION AS REVISED IN 1976-77 AND 1978, AS THE PLUMBING CODE OF THE CITY OF SCHERTZ, TEXAS, AS HEREIN MODIFIED; AND REPEALING ALL PRESENT ORDINANCES IN CONFLICT. Whereupon Mr. Sawyer moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 16th day of January 1979, which motion was seconded by Mr. Howe and carried by the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None #6 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by Intern Richard Nash. Mrs. Hyatt moved that said ordinance be considered by the Council. NAYS: None f:, - 1'1 ~.~~ '1- ~~ g-?4 q. ?~ The following captioned ordinance was then discussed and fully considered by the Counci 1 : ATTORNEY RICHARD HARRIS ARRIVED AT 7:17 P.M. AN ORDINANCE SETTING PROCEDURES FOR REGISTRATION AND PERMITS FOR PEDDLERS, SOLICITORS AND ITINERANT MERCHARTS; SETTING FEES; EXCLUSIONS AND PENALTIES; REPEALING ALL ORDINANCES IN CONFLICT. Whereupon Mrs. Hyatt moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 16th day of January 1979, which motion was seconded by Mr. Sawyer and which carried with the follow- ing vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None #7 RESOLUTION: The City Manager introduced a resolution establishing and outlinging a street assessment program, after which Council discussed the pros and cons of such a program. Mr. Harris gave a brief explanation of the state statutes and said that he feels this is the fairest and most equitable program for street assessment. Mr. Howe moved to approve this resolution on street assessment program with the amendment that the program is set forth in Article 1105 b of state statutues. Mr. Schneider seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None A RESOLUTION ESTABLISHING AND OUT- LINING A STREET ASSESSMENT PROGRAM. #8 RESOLUTION: Mr. Hill explained that the City does not at present have a policy on tenure or forfeiture of membership for our various boards and committees, and this resolution follows the rules set for the Council. Mr. Howe moved to adopt the following captioned resolution establishing a policy for the forfeiture of membership on various boards, commissions and committees. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None A RESOLUTION ESTABLISHING A POLICY FOR THE FORFEITURE OF-MEMBERSHIP ON THE CITY'S VARIOUS BOARDS, COMMISSIONS AND COMMITTEES. 2'29 #9 BID AUTHORIZATION: Mr. Hill explained he had talked with some of the property owners involved in the water line to the Industrial Park and they seemed interested but would like to see the outcome of the bids before making commitments. Also the bids would be opened on January 30th; and at Council suggestion, a Worsh6p was scheduled for February 5th to include Chairmen of those committees involved in a project of this nature. ~ :-J ~ .~ ......- :., ~ Mr. Schneider moved to approve authorization to advertise for bids on water line to serve the property described in ZC-21. Mrs. Hyatt seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Hyatt, Schneider, Sawyer and Johnson. NAYS: None 'r-. "Q ./ l ,". I -, #10 NEWSLETTER: Council reviewed the proposed newsletter for December adding items of interest to residents. #11 EXECUTIVE SESSION: Mayor Bueker requested this item be passed over at this time in order not to inconvenience the audience. #12 CITY MANAGER'S REPORT: Mr. Hill had nothing to add at this time. #13 ITEMS BY MAYOR: Mayor Bueker had none. #14 ITEMS BY COUNCIL: A. Mrs. Hyatt asked if the last summer problems at the swimming pool had been ironed out, and was told by Mr. Hill that those problems were being worked on at this time. Mrs. Hyatt also thanked everyone for the holiday party which was a success. B. Mr. Schneider asked if we had a volunteer waiting fn order to fill a vacancy on the Board of Adjustments. Mr. Hill informea he there was and he would be informed. #11 Executive Session: Mayor Bueker recessed the regular meeting at 7:55 P.M. and called an Executive Session under Section 2 (g) of Article 6252-17 of Vernon"s Texas Civil Statutes. The meeting was reconvened at 8:46 P.M. #15 ADJOURNMENT: On a motion by Mr. Howe, seconded by Mrs. Hyatt and unanimously carried, the meeting adjourned at 8:47 PM.
