04-10-2007-Regular MINUTES REGULAR SESSION APRIL 10, 2007 The Schertz City Council convened in Regular Session on Tuesday, April 10, 2007 at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding, Mayor Pro-Tern Jim Fowler, Councilmembers David L. Scagliolia, Reginna Agee, Tony Wilenchik and Michael Carpenter. Also present were City Manager Don Taylor, Assistant City Managers John Bierschwale and David Harris, Deputy City Secretary Mary Ybarra and City Attorney Michael Spain. #1 CALL TO ORDER. Mayor Baldwin called the meeting to order at 6:30 p.m. #2 PLEDGES OF ALLEGIANCE TO THE UNITED STATES AND STATE OF TEXAS Both pledges were recited. #3 INTRODUCTION OF NEW EMPLOYEES: Economic Development and Library. George Antuna, Economic Development Director read a short biography and introduced new employee Jeff Jewell, Economic Development Specialist. Melissa Uhlhorn, Library Manager also read a short biography and introduced new employees Tammy Maxwell and Tom Enright. #3A HEARING OF RESIDENTS. Frances Rushin&s Chamber President reported on upcoming events: April 12th- monthly Chamber Mixer, April 2th - Schertz Chamber Meeting; May 4th - Sharon Pennington farewell reception and May 9th - "Meet the Candidate" forum. Robert Brockman, 1000 Elbel Road referenced Herald Newspaper articles of March 27th regarding railroad crossings, and City purchase of the Kramer house. #4 Discussion and action to consider erecting a portion of a fence along Country Club Boulevard (Northcliffe Subdivision) with City participation in funding. (Mayor Baldwin) In a brief discussion, the following issues were covered; fence requirements, citizen complaints, fence square footage, and cost of City participation, maintenance, utilization of funds, and the possibility of setting a precedent. Regular Session-04-1 0-07 After discussion, Mayor Baldwin withdrew the request until such time that the City Attorney has an opportunity to review the issue. #5 RESOLUTION: Discussion and action on a resolution authorizing the purchase of public safety communications equipment from Dailey-Wells Communications. (J. Bierschwale and D. Taylor) John Bierschwale, Assistant City Manager briefed Council on funding the purchase of public safety communications equipment, equipment utilization with regional radio system and enhancing coverage throughout service areas covered by emergency service departments. Councilmember Wilenchik made a motion, seconded by Councilmember Agee, to approve a resolution authorizing the purchase of public safety communications equipment in the amount of$691,582.10 and monthly system access and maintenance in the amount of $3,775.00. The motion carried 5-0 and the vote was as follows: AYES: Councilmembers Fowler, Scagliola, Agee, Wilenchik and Carpenter. NAY: None. #6 Discussion and action to terminate and payout first 40 hours of payroll withholding. (D. Harris) /~ Councilmember Wilenchik made a motion, seconded by Mayor Pro-Tern Fowler, to terminate and payout first 40 hours of payroll withholding. The motion carried 5-0 and the vote was as follows: AYES: Councilmembers Fowler, Scagliola, Agee, Wilenchik and Carpenter. NAY: None. #7 Approve Regular Session minutes of March 6, 2007 and March 13,2007. Councilmember Wilenchik made a motion, seconded by Mayor Pro-Tern Fowler, to approve the Regular Session minutes of March 6,2007 and March 13,2007. The motion carried 5-0 and the vote was as follows: AYES: Councilmembers Fowler, Scagliola, Agee, Wilenchik and Carpenter. NAY: None. Discussion Items: #8 ORDINANCE: Discussion on final reading of an ordinance amending the Unified Development Code (UDC) Ordinance 96-S-28 by granting a Specific Use Permit for 1.00+ acres out of the Toribio Herrera Survey Abstract No. 153, Guadalupe County, Schertz, Texas for Commercial Use in the Air Installation Compatible Use Zone (AICUZ), (APZ-l); providing an effective date; and providing a repealing clause. There was nothing new to report and Council will be ready to consider the matter at the next meeting. #9 EXECUTIVE SESSSION: Called under Chapter 551 Texas Government Code, Sub-section 511.072 regarding purchase, exchange, or lease of Real Property. An Executive Session was held from 7:24 p.m. to 7:50 p.m. #10 Action, if any, on the subject ofthe above Executive Session. No action was necessary. #11 Items by City Manager Taylor and Staff General Announcements · Provided an account of wastewater hookups from 1997 (5,200) to the present (9,000 plus); numbers have doubled. · Public meeting will be held April 18th at 6:30 p.m. in Council Chamber to discuss development issues for areas South ofFM78. · CCMA fees to increase. #12 Items by Council General Announcements Mayor Pro- Tem Fowler · Inquired on status of facility maintenance building completion. · Status on Kramer Development. Councilmember Scagliola · Referenced article in the Seguin Gazette regarding "Managed Growth". Councilmember Agee · Reported there wasn't a quorum at scheduled meeting of the Schertz Housing Authority. · Is unable to attend next week meeting. She will be receiving certification on Risk Management. Councilmember Wilenchik · Meeting is scheduled for April 16th to discuss Doggie Dash to be held May 19th. Sponsorship is still needed. · Reported on Commissioners Court meeting. · Passed out Relay of Life packets for the April 27th event and asked that each person try to collect at least $100. He plans to walk the entire time. Assistant Regular Session-04-10-07 City Manager Bierschwale has said that if the City of Schertz raises $75,000, he will shave his head. Let's accept the challenge.
