1997D7- AMENDED BY REVISING SECTION 18-32; 18-76; 18-91 ORDINANCE 11- ])-- 1 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 18-32, STOP INTERSECTIONS; SECTION 18-76, MAXIMUM LIMITS ON SPECIFIC STREETS; AND SECTION 18-91, PARKING PROHIBITED; AND PROVIDING A REPEALING CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION I THAT Section 18-32 of the Code of Ordinances of the City of Schertz, Texas be amended to add the following: "Sec. 18-32 Stop Throuqh Street FM 3009 FM 3009 Savannah Drive Savannah Drive Dimrock Drive Intersections-Designated-Genera1ly. Cross or Stop Street Berry Creek Forest Ridge Inglewood Saratoga Woodland Village Place SECTION I I THAT Section 18-76 of the Code of Ordinances of the City of Schertz, Texas be amended to add the following: Sec. 18-76 Maximum limits on specific streets. Street Extent Speed Limit Savannah Drive 800 Block Between the posted school signs during the posted hours 20 MPH Inglewood 3500 Block Between the posted school signs during the posted hours 20 MPH SECTION I II THAT Section l8-9l, last (b) of the Code of Ordinances be amended as follows: two sentences of paragraph of the City of Schertz, Texas Sec. 18-91 Parking prohibited. Notwithstanding the foregoing, the owner of a recreational vehicle may park such vehicle on a City street for a period not to exceed one (1) day in a calendar month. For purposes of this Ordinance, it shall be prima facia evidence that a recreational vehicle has been parked for a period of one (1) day on a public street if a Schertz Police Officer observes the vehicle, marks the vehicle's position and twenty-four hours later the vehicle has not moved. Parking RE: After reviewing the recommendation to amend the City Code 18-9J(B), allowing a recreational vehicle to park on a public street for one (I) day as opposed to the current structure allowing for three (3) days parking in a calendar month, J have concluded the following: Parking the K V. on a public street for one (1) day indicates a full twenty-four hours in a calendar month. In order to enforce the ordinance, a police officer will have to mark the location of the R. V to determine if the vehicle has been moved during that twenty-four hour period. Should the vehicle be moved for any length of time it will not be feasible for the officer to enforce the or- dinance until another twenty-four hours have passed to ensure noncompliance by remarking the vehicle location. J believe most citizens will comply with the spirit of the law. The exception will be the individu- al(s) who circumvent the ordinance by continually moving the vehicle, but leaving it parked at their residence on the street. I recommend the following language be used in revising the Code: Notwithstanding the foregoing, the owner of a recreational vehicle may park such vehicle on a city street for a period not to exceed one (J) day in a calendar month. For purposes of this ordinance, it shall be prima facia evidence that a recreational vehicle has been parked for a period of one (1) day on a public street if a Schertz police officer observes the vehicle, marks the vehicles position and twenty-four hours later the vehicle has not moved. s 18-91 SCHERTZ CODE (b) Commercial Vehicles in excess of one (1) ton, recreational vehicles, trailer houses, camping trailers, livestock trailers, boats and boat trailers, or other trailers shall not be parked, or stored on any city street, right-of-way, alleyway or easement except for temporary parking by a customer in front of a commercial establishment. This shall not restrict the parking of a commercial vehicle for the purpose of loading and unloading. Notwithstanding the foregoing, the owner of a recreational vehicle may park such vehicle on a city street for a period not to exceed three (3) days in a calendar month. (c) No vehicle or auxiliary system of a vehicle left running shall be parked on any residential street between the hours of 8:00 p.m. and 8:00 a.m. Sec. 18-92. Parked vehicles to leave at least ten feet of roadway available for traffic. No person shall manner or under such ten (10) feet of the of vehicular traffic. park any vehicle upon a street in such a conditions as to leave available less than width of the roadway for the free movement Sec. 18-93. Parallel and angle parking. (a) Except as otherwise provided in this section, the driver of a vehicle shall not park such vehicle on a roadway other than parallel with edge of the roadway, headed in the direction of lawful traffic, and with the curb-side wheels within eighteen (18) inches of the curb or edge of the roadway. (b) It shall be lawful to park vehicles at an angle not greater than forty-five (45) degrees to the line of traffic at such places in the city as the city council shall, by resolution, determine that angle parking shall be permitted and shall cause the same to be marked or signed, and in all places where sidewalks have been set back and provisions made for parking vehicles across or inside of the usual curbline on any street in the city. In leaving an angle parking space, a vehicle shall not be backed into the traffic lane any further than necessary to get straightened out and faced in the proper direction for traffic between such space and the center of the street. *Cross reference-Vehicles parked in violation of ordinance or left on streets unattended for more than 48 hours declared to be nuisance and procedure for abatement thereof, Sec. 10-34 et. seq.
