1972 No. 255- Streets/Driveway/Curbs ORDINANCE # 255 AN ORDINANCE REGULATING THE \.iU.l.J..l.lm OF l.;u.n..oS FOR PRIVATE DR.1. v .l!irlAYS INTO THE PUBLIC ST.tU!iJ!lrS OF THE CITY OF SCHERl'Z, GUADALUPE COUNTY, TEXAS, .AND REGULATING T HE CONSTRUCTION OF SIDEWALKS AND DRIVEWAYS IN SAID CITY. BE IT ORDAINED BY THE \.iJ.:'1~ COUNCIL OF THE .....l.U OF SCHERTZ, TEXAS: 1. No person shall construct, reconstruct, alter or repair, remove or re- place any sidewalk, curb, driveway or any other work on any public property within the city without tirst obtaining from the City Secretary a permit to do so. 2. .All. Sidewalks, .........1.s, and driveways built within the city shall be built in conformity with the standard specifications tor such work as published by the City Engineer. :3. There shall be a tee charged tor inspections and/or other engineering se1"9'ices performed by the City Engineer or his authorized representative to be paid by any person doing any work as provided herein. The tee required shall be paid at the time ot application tor a permit and shall be in the amount ot $.s.ao. 4. Every permit issued under the provisions ot this ordinance shall be deemed can- celled it active work is not commenced within sixty (60) days trom the date ot issuance of such permit. It the permit shall be cancelled, all fees paid tor such permit shall be retained by the city. 5. Curb cuts tor residential driveway aprons shall be not les8 than ten (10) feet in width, and not more than twelve (12) feet in width for a single driveway aPrOn nor more than twenty-four (24) feet in width for a double driveway apron. Curb cuts will be permitted only tor driveway aprons providing access to a garage, carPOrt, or hardstand. Not more than one curb cut will be permitted for each residential parcel of land. 6. Curb cuts tor commercial driveway aprons shall not exceed thirty (:30) teet in width ~ the aggregate width of all curb cuts shall not exceed ti.tty (50) per cent' of the parcel trontage . 7. Where multiple driveway aprons are used tor commercial PrOperty, the curb cuts shall be at least twenty (20) feet apart. 8. For parcels of commercial PrOperty with less than one hundred (100) teet ot the trontage, a maximum of two (2) curb cuts will be permitted. 9. For parcels of commercial ~.. ~ ~ ~,rty, no curb cut will be permi. tted for any park- ing tacility which requires vehicles to enter street in reverse. . 10. No curb cut in curb returns will be permitted. ll. Where tm city council at said City finds that extraordinary hardship may result trom strict compliance with the regulations prescribed by this ordinance, it may vary the regulations so that substantial justice may be done and the public interest secured, provided that such variation will not have the eftect ot nul- 11ty1ng the intent and purpose ot this ordinance. In granting variances and modifications, the City Cotmcil may require such conditions as will, in its judgment, se.........:. substantially the objective ot the standards or requirements so varied or modified. 12. Any person, firm, or corporation violating any of the terms, conditions, or provisions of this ordinance shall be guilty of a misdemeanor and fined no more than $200.00 for each such offense. Every day any such violation shall exist shall be deemed to constitute a separate offense under the teras ot this ordinance. 13. If any phrase, word., sentence, section or portion of this ordinance shall be held to be void, unconstitutional, illegal, or un_enforceable, such holding shall not affect the validity of any other portion of this ordinance and it is the intention of the counc11 that each and every word, sentence, section, or clause ot this ordinance would have been adopted regardless wether or not any other word, phrase, clause, or section has been held unconstitutional, void, illegal, or un-enf'orceable. 14. Whenever it appears that any person, firm, or corporation is violating or threatening to violate any of the provisions of this ordinance, the City of SChertz, Guadalupe County, Texas may bring suit against the person, tirm, or corpontion violating or threatening to violate such ordinance in a district court in the county in which the violation or threat of violation occurs, to restrain the person, firm, or corporation from continuing the violation or ca......,:J1g out the threat of violation.
