ccreg 03-07-1978 1.23, REGULAR MEETING OF THE CITY COUNCIL MARCH 7, 1978 The Schertz City Council convened in Regular Session Tuesday, March 8, 1978 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Robert C. Bueker, presiding; Mayor Pro Tem Richard L. Howe; Merwin G. Willman; Walter F. Schneider; Earl W. Sawyer; and Earl John- son. Also in attendance were City Manager Walter W. Hill Jr., Assistant City Manager Hal Baldwin, City Attorney Richard W. Harris and City Secretary June G. Krause. ~ :\} ~ '~ ~ ::.u #1 APPROVAL OF MINUTES: Mr. Howe asked that item #1 C of the minutes of February 21,1978, be corrected to reflect that Mr. Johnson seconded the motion rather than Mr. Schneider as stated in these minutes. Mr. Howe then moved the minutes of the Regular Meeting of February 21,1978 be approved as corrected. Mr. Schneider seconded the motion which carried with the following vote: AYES: Councilmen Howe, Willman, Schneider, Sawyer and Johnson NAYS: None #2 HEARING OF RESIDENTS: There were no residents wishing to be heard. #3 POLICE VEHICLE: Mr. Hill explained there had been a misunderstanding between the City and dealer concerning the trade-in when the bid was originally awarded to Dodge House for the police vehicle. Taking this into consideration the low bidder is O. R. Mitchell. Mr. Schneider moved to rescind the bid of February 21, 1978 for the police vehicle and award the bid to O. R. Mitchell of San Antonio in the amount of $5445.00. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmen Howe, Willman, Schneider, Sawyer and Johnson NAYS: None Jj?-')~ #4 COMMUNITY DEVELOPMENT APPLICATION: Mr. Hill requested the Council to set public hearings to re- ceive input for a Community Development Discretionary Grant. Mr. Howe moved to set public hearings for April 4th and April 18th to receive input and set priorities to prepare a discretionary Community Development Grant application. Mr. Schneider seconded the motion which carried with the following vote: AYES: Councilmen Howe, Willman, Schneider, Sawyer and Johnson NAYS: None ~ ~~ 1f #5 CAPITAL IMPROVEMENTS COMMITTEE REQUEST: Mr. Hill explained that Mr. Koch has prepared a report for the Council,at the request of the committee, and presented a 124 4~ -?~ 5l>- 'n ,51 ~?~ ~ ~. ?~ statement of $696.50 for services through the end of December, which was approved by the committee, and another statement for January in the amount of $828.44. He said apparently neither the committee nor Mr. Koch was aware of the $500.00 limitation. Mr. Hill recommended that Council approve payment to Mr. Koch in the amount of $1500, an amount he and Mr. Koch agreed upon. The Committee also has requested the services of an engineer and a geologist to work with them. Mr. Howe moved to pay Mr. Koch the $696.50 on the report he has presented now and to pay the balance when the Council has the final report. Mr. Schneider seconded the motion which carried with the following vote: AYES: Councilmen Howe, Willman, Schneider, Sawyer and Johnson NAYS: None #6 ORDINANCE: The Mayor introduced an ordinance which was read in full by the City Manager. After Council discussion on this ordinance repealing Section 2-47 (a) (3) of the Code of Ordinances, Mr. Schneider moved to not take action on this ordinance and put it back on the next agenda with the correct wording. Mr. Howe seconded the motion which carried with the fOllowing vote: AYES: Councilmen Howe, Willman, Schneider, Sawyer and Johnson NAYS: None #7 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by the City Manager. Mr. Schneider moved that said ordinance be considered by the Council. Mr. Will- man seconded the motion which was carried by the following vote: AYES: Councilmen Howe, Willman, Schneider, Sawyer and Johnson NAYS: None The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING SECTION V OF ORDINANCE NO. 77-M-l Whereupon Mr. Schneider moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 21st day of March, 1978, which motion was seconded by Mr. Willman and carried by the following vote: AYES: Councilmen Howe, Willman, Schneider, Sawyer and Johnson NAYS: None #8 CITY MANAGER'S REPORT: Assistant City Manager Baldwin briefed the Council on the meeting in Austin to review data presented by Mr. Baker on the land fill on the Cibolo Creek request. He said that the formula used showed there will not be any change in water flow and the City Engineer could find no reason to challenge. However, Mr. Baker is in violation of the City Flood Plain ordinance at this time. ~. :\} ...... '..? -~ - :J.J 12,5 B. Mr. Hill presented a purchase order, for Council review, from the Parks Department, for swimming pool aparatus in the amount of $225.00. Mr. Howe asked the City Manager to obtain information from other pools as to how often this diving outfit would possibly be used. Mr. Hill announced that the Personnel Board has had two meetings on the manual and would be requesting to meet with the Council soon. Council reviewed the proposed newsletter for the month of February. #9 ITEMS BY MAYOR: Mayor Bueker advised the Council there had been feelers for industries who want to come into the area and that there would probably be work sessions on these soon. #10 ITEMS BY COUNCIL: Mr. Willman asked about the Library water cooler, and was told that Mr. Graham would have one ready by Friday for them. Mr. Willman also asked the City Manager to find out about the completion of the Mayfield Sidewalk/drainage contract. #11 WORKSHOP: Mayor Bueker recessed the Council at 8:00 P.M. in order for the Council to move to the Conference Room to continue their workshop meeting, inviting the public to stay and join them.
