SPECIAL SESSION OF THE CITY COUNCIL
MARCH 8, 1978
The Schertz City Council convened in Joint Meeting with the Planning and
Zoning Commission Wednesday, March 8, 1978 at 7:00 P.M. in the Council
Chambers, 1400 Live Oak Road with the following Councilmembers present:
Mayor Pro Tern Richard L. Howe, Merwin G. Willman, Walter F. Schneider,
Earl W. Sawyer and Earl Johnson. Also City Manager Walter W. Hill Jr.
and City Secretary June Krause. P&Z members present were: Chairman
Adolph Aguilar, presiding; John Linebarger, Betty Wise, Charles Sharp
Ray Stanhope and Jack Stomackin.
#1 Chairman Aguilar opened the meeting by explaining the purpose of
the Joint Meeting as being to hold a public hearing to receive
citizen input on the request by Mr. Coy Simmons to rezone a 2.092 acre
tract of land situated in the Martin and Waler Survey No. A-245 (frontage
along FM 3009 in the Oak Forest Subdivision).
Mr. Simmons gave a presentation as to his reasons for requesting the re-
zoning from R-l Single family dwelling district to OP Office and Professional
District.
After his presentation the following people spoke against the rezoning of
this land: Don Scott, Clarence Banks, Stan Spurkowsky, Fred Martin,
Jerrell Brown, Harvey Land, Mr. Hensley, A.J. Miller, Norman Smith, J. L.
Stewart and Leroy Muenchow. All said they were against the rezoning and
had been told upon purchase of their property that this land would be
park area.
Mr. Simmons then answered some of the questions raised.
As there were no further questions on the request, Mr. Aguilar closed
the public hearing at 8:32 p.M.
#2 REZONING REQUEST BY MR. GEORGE BARNARD. The two groups discussed
the request of Mr. George
Barnard to rezone Lot 21, Block 45, Aviation Heights Subdivision from R-2
Single Family Dwelling District to R-3 Two and Four Family Dwelling
District. Both groups agreed this request meets the criteria of the
Zoning ordinance.
There being no further business for the Joint Meeting, Mr. Aguilar declared
the meeting closed at 8:37 P.M.

REGULAR MEETING OF THE CITY COUNCIL
MARCH 21, 1978
The Schertz City Council convened in Regular Session Tuesday, March 21,1978
in the Council Chambers, 1400 Live Oak Road with the following members pre-
sent: Mayor Robert C. Bueker, presiding; Merwin G. Willman; Walter F. Schneider
Earl W. Sawyer and Earl Johnson. Absent: Mayor Pro Tern Richard L. Howe. Also
present were City Manager Walter W. Hill Jr. and City Secretary June G. Krause.
and Assistant City Manager Hal Baldwin.
#1 APPROVAL OF MINUTES: Mr. Sawyer moved to approve the minutes of the
Regular Session of March 7, 1978 as presented.
Mr. Schneider seconded the motion which carried with the following vote:

Mr. Schneider moved to approve the minutes of the Special Session of March 8,
1978 as presented. Mr. Willman seconded the motion which carried with the
following vote:
AYES: Councilmen Willman, Schneider, Sawyer and Johnson
NAYS: None
#2 HEARING OF RESIDENTS: There were no citizens wishing to be heard.
#3 BID AWARD: Mr. Hill explained that after review and tabulation of
bids received, that he recommended Schertz Bank and Trust
be designated as the City Depository.
Mayor Bueker read bids received from the Schertz Bank and Trust, the Cibolo
State Bank and the Randolph Field National Bank.
Mr. Schneider moved to designate the Schertz Bank and Trust as City depository.
Mr. Willman seconded the motion which carried with the following vote:
AYES: Councilmen Willman, Schneider, Sawyer and Johnson.
NAYS: None

#4 ORDINANCE: The Mayor introduced the following captioned ordinance
which was read in full by the City Manager. Mr. Johnson
moved that said ordinance be considered by the Council. Mr. Willman seconded
the motion which carried by the following vote:
AYES: Councilmen Willman, Schneider, Sawyer and Johnson.
NAYS: None

The following captioned ordinance was then discussed and fully considered
by the Council:
AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS PROVIDING
THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, BE
AMENDED BY REVISING SECTION 2-47 (a) (3) OF SAID CODE

Whereupon Mr. Johnson moved that said ordinance be further considered
at the next regular meeting of the Council to be held on the 4th day
of April, 1978, which motion was seconded by Mr. Willman and carried by
the following vote:
AYES: Councilmen Willman, Schneider, Sawyer and Johnson.
NAYS: None

#5 ORDINANCE: The Mayor introduced the hereinafter set forth or-
dinance which has been read and considered at the
last regular meeting of the City Council on the 7th day of March 1978.
It was determined that the City Secretary had caused a short synopsis
of said proposed ordinance to be published in the official newspaper after
its consideration at the last regular meeting of the City Council and
prior to this meeting.
Whereupon said ordinance was discussed and further considered by the Council.
Thereupon it was moved by Mr. Willman and seconded by Mr. Schneider that
said ordinance be finally passed and adopted. The Mayor put the motion to
a vote of the members of the Council and the ordinance was finally passed
and adopted by the following vote:
AYES: Councilmen Willman, Schneider, Sawyer and Johnson.
NAYS: None
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS AMENDING SECTION V OF ORDINANCE
NO. 77-M-l
#6 AUDIT: Mr. Bill Havens of Harris, Havens & Co, auditors, gave
an audit report of the various funds and accounts of the
City of Schertz, Texas for the year ending September 30, 1977. He also
presented their statement, explaining that although 536 hours was expended
on the audit, they had discounted the charges to align with the budgeted
amount for auditing.
Mr. Sawyer moved that, the audit for the year ending September 30, 1977 be
approved. Mr. Will man seconded the moti o'n whi ch ca rri ed with the fo 11 owi ng

#7 RESOLUTION: Mr. Hill explained this resolution is at the request
of the State Department of Highways and Public Trans-
portation, to authorize the Mayor to sign an agreement with them providing
the placing of passive warning devices at public railroad grade crossings.
After discussion, Mr. Schneider moved to postpone this item until further
information can be obtained from the Department of Highways and Public
Transportation and that it be put on the next agenda. Mr. Sawyer seconded

the motion which carried with the following vote:

NAYS: None
#8 OAK FOREST SUBDIVISION: Mr. Coy Simmons, developer of Oak Forest
Subdivision, addressed the Council giving
his reasons as to why the rezoning request before the P&Z Commission should
be allowed and also discussed future plans for this subdivision.
Mayor Bueker said that as he was not present at the meeting where this was
discussed, he would like to further study this subdivision question.

#9 PLANNING & ZONING RECOMMENDATIONS: A. Mr. Sawyer moved that on the
recommendation of the Planning
and Zoning Commission, Mr. Coy Simmons request for rezoning be disapproved.
Mr. Schneider seconded the motion which carried with the following vote:
AYES: Councilmen Willman, Schneider, Sawyer and Johnson.
NAYS: None

B. Mr. Schneider moved to approve the appointment of John W. Marquette to
the Planning & Zoning Commission. Mr. Sawyer seconded the motion which
carried with the following vote:
AYES: Councilmen Willman, Schneider, Sawyer and Johnson.

O. Mr. Schneider moved to appoint Mr. Jack Stomackin as Secretary to the
P&Z Commission. Mr. Johnson seconded the motion which carried with the
following vote:

#10 LESLIE BAKER APPLICATION: The City Manager explained that this item
is to determine the Cityls position on
Mr. Baker's application to the Texas Department of Wate~ Resources for approval
of plans for a levee or other improvements.
Mr. Sawyer moved that the City continue to protest this land fill on the
Cibolo Creek. Mr. Schneider seconded the motion which carried with the follow-
ing vote:
AYES: Councilmen Willman, Schneider, Sawyer and Johnson.
NAYS: None

#11 APPROVAL OF PLANS & AUTHORIZATION TO ADVERTISE FOR BIDS: The City
Manager
showed on plans the proposed paving of Aviation and Mitchell Avenues and the
parking lot at ballfields. There would have to be a slight change in the plans
presented on the parking lot paving. Mr. Hill recommended authorizing the
advertising for bids.

After discussion, Mr. Sawyer moved to press on with the paving of Aviation
and Mitchell Avenues and the parking lots and to open bids on the 25th
of April 1978. Mr. Schneider seconded the motion which carried with the

#12 CITY MANAGER'S REPORT: Mr. Hill reminded the Council about
Students taking over City offices and
Council duties on April 4, 1978. He also passed on an invitation from the
Fire Department for the Council to join them after the meeting for a social.
#13 ITEMS BY MAYOR: Mayor Bueker reminded the Council this was the last
meeting before the election and stated that he
hoped that what had been done in the last two years would continue and that
he hoped to be a member for another two years.
#14 ITEMS BY COUNCIL: Mr. Willman again asked about the water fountain
for the library. Mr. Hill thought the fountain
was already installed but would confirm for him the next day.
Mr. Willman also asked about the Mayfield contract and was told that Mr. Gaddis
City engineer, was to contact the contractor and would get back to th~ council.
#15 ADJOURNMENT: On a motion duly made, seconded and unanimously
carried, the meeting was adjourned at 8:47 P.M.
