The Schertz City Council, Citizens Advisory Committee and Planning and I
Zoning Commission held a Public Hearing jointly Tuesday, December 7, 1976
at 7:00 P.M. in the Council Chambers, 401 Oak Street with the following
members of the Council present: Mayor Pro Tem Donald J. Seeba, presiding;
Richard L. Howe, Walter F. Schneider, and Gail Hyatt. Absent: Mayor Robert
C. Bueker and Ed L. Sharpe.
The purpose of the public hearing, as explained by Mayor Pro Tem Seeba,
was to receive citizen input pertaining to city problems for the formula-
tion of 1977 Community Development application. Mr. Seeba also reiterated
the first and second year activities for those present and explained the
priorities as previously requested by the Council and public, as follows:
1. Site Improvements - Westland Park, Lone Oak and Rio Vista subdivi-
sions have streets which are substandard.
2. Drainage Improvements - continue to improve the storm drainage
system.
3. Parks - acquiring 2.5 acres of land to serve as toddler parks for
Westland Park, Val Verde, Parkland, Greenfield, Deerhaven,
Oak Forest, Village 3 and 4 and Rio Vista.
4. Auxillary Fire Station
5. Site Improvements - Traffic Channelization markers on all streets.
6. Code Enforcement Program:
7. Water & Sewer Program - Develop a Municipal Water & Sewer Pollution
Contra 1 Program
There were nineteen citizens present who participated in the discussion,
after which the above listed priorities were agreed upon in the order listed.
The next public hearing was announced for December 21, 1976.
Mayor Pro Tem Seeba pronounced the public hearing closed at 7:45 P.M.

REGULAR MEETING OF THE CITY COUNCIL
DECEMBER 7, 1976
The Schertz City Council convened in Regular Session, Tuesday, December 7,
1976 at 7:45 P.M. in the Council Chambers, 401 Oak Street with the following
members present: Mayor Pro Tem Donald J. Seeba, presiding; Richard L. Howe,
Walter F. Schneider, and Gail Hyatt. Absent: Mayor Robert C. Bueker and
Ed L. Sharpe. Also present were City Manager Denny L. Arnold and City Sec-
retary June G. Krause and City Attorney Richard L. Harris.

APPROVAL OF MINUTES: Mr. Schneider moved the minutes of the Regular
Meeting of November 23, 1976 be approved as

#2 HEARING OF RESIDENTS: Mr. Dick Chambless, member of the Cibolo
Creek Municipal Authority Board, addressed
the Council concerning a problem CCMA is having in the Mendoza addition,
which is outside the Schertz city limits. They are having to pave Aztex
Lane in order to have access to their lift station and in order to repave
this street, the water lines must be lowered. Mr. Chambless ~skedif these
water lines belong to Schertz and if so will the City lower these lines.
Mr. Arnold asked if he understood that CCMA is going to pave a county road
and was told by Mr. Chambless that they were. Mr. Seeba suggested that CCMA
should present a formal request to the City through the City Manager.
#3 PLANNING & ZONING MINUTES: Mr. Howe moved the minutes of the Planning
and Zoning Commission regular meeting of
November 24, 1976 be accepted. Mrs. Hyatt seconded the motion which carried
with the following vote:
AYES: Mr. Seeba, Mr. Howe, Mr. Schneider and Mrs. Hyatt.
NAYS: None
#4 CITIZEN ADVISORY COMMITTEE MINUTES: Mr. Arnold asked this item be
passed over as the minutes of
the CAC meeting of November 18, 1976 were not presented for acceptance.
#5 ORDINANCE: Mayor Pro Tem Seeba introduced the following captioned
ordinance, which has been read and considered at the last
regular meeting of the City Council on the 23rd day of November, 1976. It was
determined that the City Secretary had caused a short synopsis of said ordinance
to be published in the official newspaper after its consideration at the last
regular meeting of the City Council and prior to this meeting.
Whereupon said ordinance was discussed and further considered by the Council.
Thereupon it was moved by Mrs. Hyatt and seconded by Mr. Howe that said ordin-
ance be finally passed and adopted. The Mayor Pro Tem put the motion to a vote
of the members of the Council and the ordinance was passed and adopted by the
following vote:
AYES: Mr. Seeba, Mr. Howe, Mr. Schneider and Mrs. Hyatt.
NAYS: None

ORDINANCE NO. 76-F-9
AN ORDINANCE DETERMINING AND FIXING THE MAXIMUM
SCHEDULE OF RATES TO BE CHARGED BY ENTEX, INC.
ITS SUCCESSORS AND ASSIGNS, IN THE CITY OF SCHERTZ,
TEXAS, FOR NATURAL GAS AND NATURAL GAS SERVICE FUR-
NISHED BY IT TO RESIDENTIAL AND COMMERCIAL CONSUMERS
CONTAINING DEFINITIONS, FIXING THE EFFECTIVE DATES
OF GAS RATES PRESCRIBED IN THIS ORDINANCE, MAKING
MISCELLANEOUS PROVISIONS AND REPEALING ALL ORDINANCES
IN CONFLICT

#6 RESOLUTION: This item was also deferred until "a later date as
the City Manager had not received the signed agree-
ment to dedicate the streets in Mobile Villa Estates back from the owners.
#7 ORDINANCE: The Mayor Pro Tem introduced the following captioned
ordinance which was read in full by the City Manager.
Mrs. Hyatt moved that said ordinance be considered by the Council as an
emergency measure, which motion was seconded by Mr. Schneider. Whereupon
said motion was fully discussed and considered. The Mayor Pro Tem then
put the motion to consider said ordinance as an emergency measure to the
members of the City Council and said motion was approved and adopted by the
following vote:
AYES: Mr. Seeba, Mr. Howe, Mr. Schneider and Mrs. Hyatt.
NAYS: None
ORDINANCE NO. 76-M-10
AN ORDINANCE AMENDING ORDINANCE NO. 76-M-7 IN
ACCORDANCE WITH THE CITY CHARTER AND STIPULATING
EMERGENCY ADOPTION.
#8 PAYMENT AUTHORIZATION: The City Manager did not receive the
anticipated request for payment to R & R
Construction Company for water line improvement in the Buffalo South Project.
#9 HOLIDAY SCHEDULE: Mr. Seeba suggested the City follow the Federal
government policy in regard to holidays,as we
observe all Federal holidays.
~rs. Hyatt moved City offices be closed December 24 and 31 for the holiday
season and amend the policy letter on holidays to include that if a holiday
falls on Saturday, the preceding Friday be observed; and if the holiday falls
on Sunday, the succeeding Monday be observed. Mr. Schneider seconded the
motion which carried with the following vote:
AYES: Mr. Seeba, Mr. Howe, Mr. Schneider and Mrs. Hyatt.
NAYS: None
#10 NEWSLETTER: Council reviewed and approved the newsletter as pre-
sented with the addition of items on the following
subjects: Christmas for the underpriveleged - citizens making contributions
to the Welfare Director; Fire Safety for the holidays and the upcoming
public hearing on Community Development program.

I I #11 ORDINANCE: The Mayor Pro Tem introduced the following captioned
ordinance which was read in full by the City Manager.
Mr. Howe moved that said ordinance be considered by the Council. Mrs. Hyatt
seconded the motion which was carried by the following vote:
AYES: Mr. Seeba, Mr. Howe, Mr. Schneider and Mrs. Hyatt.
NAYS: None
AN ORDINANCE
ADOPTING AND ENACTING A NEW CODE OF ORDINANCES OF
THE CITY OF SCHERTZ, TEXAS; ESTABLISHING THE SAME;
PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT
INCLUDED THEREIN; PROVIDING FOR THE EFFECTIVE DATE
OF SUCH CODE AND A PENALTY FOR THE VIOLATION THEREOF;
PROVIDING FOR THE MANNER OR AMENDING SUCH CODE:
AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
Whereupon Mr. Howe moved that said ordinance be further considered at the
next regular meeting of the City Council to be held on 21st day of December,
1976 which motion was seconded by Mrs. Hyatt and which carried with the
following vote:
AYES: Mr. Seeba, Mr. Howe, Mr. Schneider and Mrs. Hyatt.
NAYS: None
#12 GENERAL DISCUSSION: 1. Mr. Harris, City Attorney, said he had
been unable to resolve the dispute con-
cerning the fence put up by Mr. and Mrs. Jupe in Deerhaven and has prepared
a suit to be filed. The plat will require the courts interpretation.
2. Mrs. Hyatt suggested it is time to begin working on the plans for the
July 1977 celebration.
3. Mr. Schneider asked the status of lowering of gas lines in the South
Schertz project. Mr. Arnold explained both he and Mr. Farr have talked with
Entex representatives explaining the City's deadline and have been assured
Entex will lower the gas lines. However, they had prior commitments which
they considered more important. Mr. Arnold assured the Council he will con-
tinue his efforts to get the work done prior to letting of bids for street
work.
4. Mr. Schneider also asked how the new computer is working out for water
billing. Mr. Arnold said we are having problems and he feels that Burroughs
has Violated their contract with the City. He will meet with them to get
all the problems worked out to our satisfaction.
5. Mr. Howe asked how often the Council get reports on contingency spending
and was told by Mr. Arnold it should be once a month but the bookkeeper is
behind because of the closing of the year end books. Mr. Howe suggested

this money should not be spent without Council approval and Mr. Arnold
reminded him that four years ago the Council, at that time, gave the
City Manager authority to spend up to $500 of these funds in an emergency.
#13 ADJOURNMENT: Mrs. Hyatt moved the meeting be adjourned at
8:57 P.M., which motion was duly seconded and
approved unanumiously.

PUBLIC HEARING
The Schertz City Council and the Planning and Zoning Commission of the
City of Schertz, Texas held a Public Hearing, Tuesday, December 21,1976
at 7:00 P.M. in the Council Chambers, 401 Oak Street with the following
members of the Council present: Mayor Robert C. Bueker, presiding; Richard
L. Howe, Walter F. Schneider, Ed L. Sharpe and Gail Hyatt. Absent: Donald
J. Seeba. Planning & Zoning Commission members present: Earl Sawyer and
Adolph Aguilar. Absent: Chairman Johnny Wise, Ray Stanhope, Chuck Sharp
and John Linebarger.
Mayor Bueker explained the purpose of the Public Hearing was to consider
a request for a Specific Use Permit which would allow the First Baptist
Church (the ow~er) to enlarge their present church facility, at the
southeast corner of Randolph and Aero Avenues.
City Staff member, Joe Garza and church representative Mr. Koppin presented
the plans and specifications of the work to be done and explained the
variances requested.
There were no citizens present to present their views of this request.
Mayor Bueker declared the public hearing closed at 7:26 P.M.
