PUBLIC HEARING

The Schertz City Council, Citizens Advisory Committee and Planning and Zoning
Commission held a Public Hearing jointly Tuesday, January 4, 1977 at 7:00 P.M.
in the Council Chambers, 401 Oak Street with the following Council members
present: Mayor Robert C. Bueker, presiding; Donald J. Seeba, Richard L. Howe,
Walter F. Schneider and Ed L. Sharpe. Absent: Gail Hyatt.
The purpose of the Public Hearing, as explained by Mayor Bueker, was to
receive citizen input pertaining to city problems for the formulation of the
1977 Community Development application. The Mayor also explained that the fol-
lowing two projects had been added to the list as discussed at the public hear-
ing of December 7, 1976: #8 Purchase and demolition of land at Highway 78 and
First Streets, and #9 Parking lots for ballfields and pavilion.
After extensive discussion as to the priority of an auxi11ary fire station versus
the need of improving projects already in existence, (i.e. parking lots for the
ba11fields and pavilion) the following are the agreed upon priorities for the
1977 application for Community Development Funds.
1. Site Improvements - Westland Park, Lone Oak and Rio Vista subdivi-
sions have streets which are substandard.
2. Drainage Improvements - continue to improve the storm drainage system.
3. Parking lots - for ba11fields and pavilion.
4. Parks - acquiring 2.5 acre of land to serve as toddler parks for
Westland Park, Val Verde, Parkland, Village 3 and 4 and Rio Vista.
5. Auxiliary Fire Station and equipment.
6. Site Improvements - Traffic Channelization markers on all streets.
7. Code Enforcement Program
8. Water & Sewer Program - develop a Municipal water and sewer pollution
control program.
9. Purchase and demolition of land at FM 78 and First Streets.
Gail Hyatt arrived at 7:27 P.M.
There were 17 citizens present to participate in the discussion of the above
listed priorities.
Counc~l discussed the problem of the Buffalo South Project running over the
estimates. Mr. Arnold explained the main reason for this being the lack of records
of water lines, gas lines etc. in the project.
Mayor Bueker declared the Public Hearing closed at 7:35 p.M.

The Schertz City Council convened in Regular Session Tuesday, January 4,
1977 at 7:35 P.M. in the Council Chambers, 401 Oak Street, with the follow-
ing members present: Mayor Robert C. Bueker, presiding; Donald J. Seeba,
Richard L. Howe, Walter F. Schneider, Ed L. Sharpe and Gail Hyatt. Also
present City Manager Denny L. Arnold, City Attorney Richard W. Harris and
City Secretary June G. Krause.
#1 APPROVAL OF MINUTES:
A. Mr. Schneider moved to approve the
minutes of the Public Hearing of
Mr. Howe seconded the motion which carried
December 21, 1976 as presented.
with the following vote:
AYES: Mr. Seeba, Mr. Howe, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
B. In the minutes of the Regular Meeting of December 21,1977, Mayor Bueker
requested the second paragraph on page 454 be corrected to read as follows:
IIIn answer to Mr. Howe's query concerning the noise zone on FM 78, Mayor
Bueker said the residents who have sold their property had received notice
they were to be out by April 15, 1977, but no other information had been received.
Mr. Sharpe moved the minutes of the regular meeting of December 21,1977 be
approved as corrected. Mr. Howe seconded the motion which carried with the
following vote:

ABSTAINING: Mr. Seeba, as he was not present at this meeting.
#2 HEARING OF RESIDENTS: A. Mr. Ervin Jupe of 909 Antler Drive, Deer
Haven Estates, addressed the Council to
see if something could be resolved concerning the fence and gate across the
road easement at his property, before further legal action is taken. Mr.
Harris said a suit has been filed and is pending at this time, since the
Council had taken the position of protecting public rights. There had been
some discussion in the past of possibly acquiring alternate site for this
road easement.
Mayor Bueker recommended that Mr. Jupe meet with Mr. Arnold and city staff to
di scuss hi s grei vances as we 11 as the ci ty' s to see if somethi ng can .be worked
out.
B. Mr. Willman asked the status of having the business sign removed from the
property at Randolph and Mitchell Avenues. Mr. Arnold reported a letter had
been sent and stated that he would follow up on this matter.
c. Mr. Willman also asked if it were possible to have the fire department
burn the weeds along Cibolo Creek or in some way remove them before the
next year's growth. Mayor Bueker asked Mr. Arnold to check if controlled
burning by the Fire Department could be done under the Air Pollution Act.

#3 PLANNING & ZONING MINUTES: Mr. Sharpe moved the minutes of the
Planning & Zoning Commission meeting
of December 29, 1976 be accepted. Mrs. Hyatt seconded the motion which carried
with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
#4 RESOLUTION: There was still no reply from the owners of Mobile
Villa Estates concerning dedication of streets.
Mayor Bueker asked the Council to consider a general discussion item at this
time - Mr. Hesson,of Hesson and May Architects, was present to discuss the
new Municipal Complex.
Mr. Hesson explained that the soil tests had proved that it would be entirely
too costly to have a basement for the Police Department in the new complex.
He recommended, after discussing the matter with City staff, adding the
Police Department to the side of the original building. However, this presented
the problem of fitting the building on the site. Mr. Farr had contacted HUD
and they had no objection to widening the 2 acres of Municipal Complex property
in the front and giving Community Development the like amount of land in the
rear. He then showed the Council the general theme of the plan for this type
construction, stating he needed approval to proceed and refine the plans with
City Staff. He also said that in order to stay within the budget grant, he
would go out for alternate bids. After further discussion, Council approved
the overall design of both police and city office facilities.
#5 SPECIFIC USE PERMIT: Mayor Bueker explained that the First Baptist
Church had requested a Specific Use Permit to
allow building of a sanctuary on their property at Randolph and Aero Avenues;
and had requested a variance to the Zoning Ordinance regarding property line
setback.
Mr. Sharpe moved to grant to the First Baptist Church a variance to the Zoning
Ordinance and a Specific Use Permit as recommended by the Planning and Zoning
Commission in their minutes of the Special Session of December 29, 1977. Mr.
Schneider seconded the motion which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
#6 PARK POLICY: Council reviewed the proposed ordinance for park usage
and regulation policies.
It was Council decision to rewrite Section II of the ordinance and delete such
items from Attachment uBu as season dates, hours of operation and certain regu-
lations. These items to be put in a policy rather than the ordinanc itself.
#7 NEWSLETTER: Council approved items on the following subjects for
the December 1976 newsletter: 1. Animal Control
2. Engraver information by Police. 3. An article on the Municipal Complex
and Community Activity Center and 4. the selling of license plates by the
County Tax Assessor-Collector during the month of February in Schertz.

#8 GENERAL DISCUSSION: A. Council discussed the status of the
Cibolo Water contract, with no new
information. The Cibolo Council has agreed verbally to the conditions
of the contract and has agreed to pay all back water bills but so far
nothing official has been received from them.
B. Concerning the City's request for City Public Service Board in San
Antonio to work out an agreement with Guadalupe Valley Electric Cooperative
for GVEC to service all of Schertz customers, an unfavorable response had
been received from CPSB. Mayor Bueker said this needed more study.
C. The City still has not received a definite date for beginning to lower
the gas lines in the South Schertz project from Entex.
D. Answering Mr. Howe's question concerning the higher telephone rates for
portions of the City, Mayor Bueker stated this problem needed to be taken
up with the Public Utility Commission. The theory of tiers is sound but
seemingly the Telephone Company is not following the tier system.
E. Mayor Bueker said he had talked with Mayor Staudt of Converse concerning
the unpaid SAFES ambulance bills in that City, and the City of Converse will
pay these bills but at the moment they are having attorney problems.
#9 ADJOURNMENT: Mrs. Hyatt moved the meeting be adjourned at 11:02
P.M. which motion was seconded by Mr. Sharpe and
unanimously approved.
