JOINT MEETING OF THE SCHERTZ CITY COUNCIL
AND THE PLANNING & ZONING COMMISSION
January 12, 1977
The Schertz City Council convened in a joint meeting with the Planning and
Zoning Commission Wednesday, January 12, 1977 at 7:30 P.M. in the Council
Chambers, 401 Oak Street with the following members of the Council present:
Mayor Robert C. Bueker, presiding; Donald J. Seeba, Richard L. Howe, Walter
F. Schneider and Gail Hyatt. Absent: Ed L. Sharpe. The following members
of the Planning & Zoning Commission were present: Johnny Wise, Chairman,
Earl Sawyer, John Linebarger, Chuck Sharp, Adolph Aguilar, Ray Stanhope.
Also present were Assistant City Manager Harold D.Baldwin and City Secretary
June G. Krause and City Staff member Joe Garza.
Mayor Bueker explained the purpose of the joint meeting was to consider
a request by the Good Shepherd Catholic Church and the City of Schertz to
rezone three parcels of land located on Live Oak Road from a R-a Single
Family District to O.P. Office and Professional District.
Mr. Garza stated the City had received a letter from the church agreeing to
the rezoning of the church property along with the city property. Also he
said the property owners within a 300 foot radius of the property to be
rezoned had been notified of a public hearing on this request for January
26, 1 977 .
Mr. Linebarger moved to authorize the calling of a Public Hearing for Janaury
26, 1977 for rezoning from R-2 to O.P. the 10 acre tract, described as
follows: a 2 acre tract of land out of a 10 acre tract being out of the G.
Malpaz Survey No. 67, Abstract #221; a 3 acre tract of land out of a 10 acre
tract of land being out of the G. Malpaz Survey #67; and a 5 acre tract of
land out of a 10 acre tract of land being out of the G. Ma1paz Survey #67,
Abstract #221. Mr. Sawyer seconded the motion which carried unanimously.
There being no further discussion on the above request, Mayor Bueker declared
the joint meeting closed at 7:55 P.M.

REGULAR MEETING OF THE CITY COUNCIL
JANUARY 18, 1977
The Schertz City Council convened in Regular Session, Tuesday, January 18,
1977 at 7:00 P.M. in the Council Chambers, 401 Oak Street with the follow-
ing members present: Mayor Pro Tem Donald J. Seeba, presiding; Walter F.
Schneider and Ed L. Sharpe. Also City Manager Denny L. Arnold, City Secre-
tary June G. Krause and City Engineer Howard W. Gaddis.

#1 APPROVAL OF MINUTES: A. Mr. Sharpe moved to approve the minutes
of the Public Hearing of Janaury 4, 1977
as presented. Mr. Schneider seconded the motion which carried with the follow-
ing vote:
AYES: Mr. Schneider, Mr. Seeba and Mr. Sharpe
NAYS: None
B. Mr. Sharpe moved to approve the minutes of the Regular Session of Jan-
uary 4, 1977 as presented. Mr. Schneider seconded the motion which carried
with the following vote:
AYES: Mr. Schneider, Mr. Seeba, and Mr. Sharpe
NAYS: None
C. Concerning the minutes of the Special Meeting of Janaury 11, 1977, Mr.
Schneider requested they be corrected to show that Mr. Schneider rather than
Mr. Howe (as shown), asked the City Manager to investigate having the buttons
on FM 78 at Mill Street changed to allow for a left turn onto Mill Street going
west, in item #4 of these minutes.
'Mr. Schneider moved the minutes of the Special Session of January 11,1977 be
approved as corrected. Mr. Sharpe seconded the motion which carried with the
following vote:
AYES: Mr. Schneider, Mr. Seeba, and Mr. Sharpe.
NAYS: None
D. Mr. Schneider moved to approve the minutes of the Joint Meeting of January 12,
1977; but later withdrew his motion as Mr. Sharpe was not present at that meeting
and could not vote on the motion.
MR. HOWE ARRIVED AT 7:05 P.M.

and Zoning Commission of January 12, 1977. Mr. Howe seconded the motion which
carried with the following vote:
AYES: Mr. Schneider, Mr. Howe, and Mr. Seeba.
NAYS: None
ABSTAINING: Mr. Sharpe, he was not present .at this meeting.
#2 HEARING OF RESIDENTS: Mr. Willman asked if the citizens would be
able to declare Homestead exemption at the
time the County Tax Assessor/Collector's staff will be in Schertz selling
license plates. Mr. Baldwin, Schertz A/C said he inquired and was told you
can sign request then and the rendition statement will be mailed to you.

#3 PERSONNEL BOARD MINUTES: Mr. Howe moved to accept the minutes of the
Personnel Board Meeting of January 10, 1977.

AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe.
NAYS: None
#4 PLANNING & ZONING MINUTES: The minutes of the Planning and Zoning
meeting of January 12, 1977 were not
received for approval.
#5 BID AWARD: Mayor Pro Tem Seeba explained the bids for the "Street
Improvements, Buffalo Valley South" project had been
opened at the last regular meeting of the Council. Mr. Gaddis presented tabu-
lation sheets showing all bids received were correctly tabulated. The New
Paving Compdny of Seguin was the low bidder on the project. Mr. New explained
that his company had been in business 4~ years and have a State project in
Pearsall as well as two other projects at this time. Mr. Gaddis had contacted
three or four places where this company had done work and could find no one that
had anything bad to say about the company. He also said that Mr. New is quali-
fied to bid on Texas Highway projects and has to have good financial background
and good equipment to even bid on these projects.
Mr. Gaddis also said they would like to start on the drainage at the same time
as the streets, but still need to get signed easement from Dr. Mays.
Mr. Farr, Community Development Coordinator, said he had talked with the Entex
Gas Company representatives and they had started lowering gas lines in this
project but had to stop on account of rain. They promised him they would get
two crews in and finish the job in about two weeks of good weather.
Mr. Schneider moved to award the contract to New Paving Company of Seguin in
the amount of $184,556.00, for the "Street Improvements, Buffalo Valley South
, City of Schertz, Texas" project. Mr. Sharpe seconded the motion which
carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe.
NAYS: None
#6 PLANNING AND ZONING APPOINTMENT: The appointment of Mrs. Betty L. Wise
of Mobile Villa Estates, to the Plan-
ning and Zoning Commission was delayed until the next. meeting ,in order for the
Council to have an opportunity to examine her resume.
#7 RESOLUTION: Mr. Arnold read Resolution No. 77-R-l, explaining that
this resolution should have been passed prior to sub-
mitting our application for Public Works monies but through oversight was not.
Mr. Howe moved to adopt Resolution No. 77-R~1. Mr. Sharpe seconded the motion
which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe

RESOLUTION NO. 77-R-1
A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION
FOR LOCAL PUBLIC WORKS CAPITAL DEVELOPMENT AND INVEST-
MENT PROGRAM MONIES, AND AUTHORIZING AN APPOINTMENT OF
AN OFFICIAL REPRESENTATIVE OF THE APPLICANT.

#8 RESOLUTION: Mayor Pro Tem introduced the following captioned reso-
lution which was read in full by the City Manager. Mr.
Sharpe moved to adopt Resolution No. 77-R-2. Mr. Howe seconded the motion
which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe.
NAYS: None
RESOLUTION NO. 77-R-2
A RESOLUTION ACCEPTING THE LOCAL PUBLIC WORKS CAPITAL
DEVELOPMENT AND INVESTMENT PROGRAM MONIES IN THE AMOUNT
OF FIVE HUNDRED THIRTY SIX THOUSAND FIVE HUNDRED DOLLARS
($536,500) .
Mr. Howe wanted to know if there are any strings attached to the Public Works
monies and was told by both Mr. Arnold and Mr. Gaddis only so far as the con-
struction was concerned and nothing after that.
#9 RESOLUTION: This item on the dedication of streets in Mobile Villa
Estates was again passed to the next meeting as the
City still has not received the signed papers from the owners.
#10 ORDINANCE: The Mayor Pro Tem introduced the following captioned
ordinance which was read in full by the City Manager.
Mr. Schneider moved that the ordinance be considered by the Council. Mr.
Sharpe seconded the motion which carried with the following vote:

The following captioned ordinance was then discussed and fully considered by
the Counc i 1 .
AN ORDINANCE AUTHORIZING THE USE OF PARKS AND RECREATION
AREAS OWNED AND CONTROLLED BY THE CITY OF SCHERTZ, TEXAS
NAMING THE TRACTS OF LAND DESIGNATED AS CITY PARKS; REGU-
LATING POSSESSION AND CONSUMPTION OF ALCOHOLIC BEVERAGES
IN SUCH PARKS; STATING THE POLICIES AND REGULATIONS GOVERN-
ING THE USE OF SUCH AREAS; AND PROVIDING A PENALTY FOR
VIOLATION OF THIS ORDINANCE.
Whereupon Mr. Schneider moved that said ordinance be further considered at the
next regular meeting of the City Council to be held on the 1st day of February
1977, which motion was seconded by Mr. Sharpe and which carried by the follow-
ing vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe

#11 GENERAL DISCUSSION: A. Mr. Howe said he had been contacted by a
: , citizen concerning a film shown by the
Jaycees that should have not been shown. As Mr. Arnold knew nothing of the
meeting or film, Mayor Pro Tem Seeba asked him to investigate and brief the
Council.
B. Mr. Sharpe asked if something cound be done to clear up the malfunctioning
crossing arm and lights at the railroad track crossing on FM3009. One recent
day the flashing lights were on all day. Chief Schoonover said he would con=
tact Gene Sparks of the Highway Department to see if something can be done to
correct this.
C. Mr. Schneider asked the status of the fence problem at Mr. Jupe's in Deer
Haven. Mr. Arnold reported Mr. Jupe had met with the Assistant City Manager
and City Inspector, with no new information, except he asked to meet with the
Council one more time. Mr. Arnold suggested he meet with the Council at the
next meeting when the City Attorney could be present.
D. Mr. Seeba asked the Chief of Police to check with the Highway Department
to see if anything could be done about the intersection of FM 78 and FM 1518.
In the late afternoon heavy traffic, people are making a u-turn on FM 1518 .
tripping the light and causing the traffic to back up unreasonably. Chief
Schoonover is to investigate.
E. Mr. Carrol Johnson and David Dennis of CCMA were present to address the
Council. Mr. Johnson congratulated the City staff on the well prepared appli-
cation and getting the grant for the new Municipal Complex under the Public
Works Act. Mr. Dennis asked to come to the 1st meeting in February to present
his report on the census tract.
F. Mr. Seeba asked if the ba11fields were in good condition and ready for the
new season of play. Mr. Graham, Park Supt. reported that he had just started
work on the fields.
G. In answer to Mr. Seeba questions concerning the parking lot for the swimming
pool, Mr. Arnold said he hoped to add this item to the end of the current
street contract.
#12 ADJOURNMENT: Mr. Schneider moved the meeting be adjourned at 8:25
P.M. The motion was seconded by Mr. Howe and carried
unanimously.
