REGULAR MEETING OF THE CITY COUNCIL

The Schertz City Council convened in Regular Session, Tuesday, March 1,
1977 at 7:10 P.M. in the Council Chambers, 401 Oak Street with the follow-
ing members present: Mayor Robert C. Bueker, presiding; Richard L. Howe,
Donald J. Seeba, Walter F. Schneider and Ed L. Sharpe. Absent: Gail Hyatt.
Also present City Manager Denny L. Arnold, City Attorney Richard W. Harris
and June G. Krause, City Secretary.
#1 APPROVAL OF MINUTES: Mr. Howe moved the minutes of the Regular
meeting of February 15, 1977, be approved
as presented. Mr. Schneider seconded the motion which carried with the

AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe
NAYS: None

#2 HEARING OF RESIDENTS: Mr. Dick Wright requested time for Item #5,
#6 and #7. Mr. Mays and Mr. Sohm requested
#3 P&Z MINUTES: Mr. Schneider moved to accept the minutes of the P&Z
meeting of February 23, 1977 as presented. Mr. Sharpe
seconded the motion which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe
NAYS: None
#4 BID AWARD: Mr. Arnold briefed the Council on the Bid Opening
held at 2:00 P.M. this date for the construction of a
Community Activity Center, in accordance with the procedures as approved by
the Council previously. Bids were tabulated as follows:

Mr. May of Hesson & May Architects, explained the four deductive alternates
as bid.
Mr. Sharpe moved to accept the low bid of O.A. Fessenden, Inc. in the amount of
$170,887.00 deleting alternates No.1 and 2 with the provision that Alternate
1 be kept open for an adequate period of time to be able to coordinate the

roofs of this and the Municipal Complex buildings. Mr. Schneider seconded
the motion which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe
NAYS: None
At this point Mayor Bueker recognized Harold Knowles of the Chamber of
Commerce who introduced Buz Sawyer, owner and Sam Hensley, Assistant
Coach of the Texas Thunderbirds, who will be bringing semi-professional
football to this area.
#5 RECREATION AGREEMENT: Mr. Arnold explained the proposed agreement
between the City and BVYA for summer youth
activities. Mr. Wright of BVYA was present to answer questions concerning
the agreement. Mr. Seeba moved to accept the agreement with BVYAfor summer
youth activities as amended. Mr. Howe seconded the motion which carried
with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe
NAYS: None
#6 BALLFIELD USAGE: Mr. Seeba moved to approve the schedule of bal1fieJd
usage for the 1977 season as presented. Mr. Howe
seconded the motion which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider, and Mr. Sharpe
NAYS: None
#7 LEASE RENEWAL: Council discussed the proposed renewal contract for
concession stand usage. Mayor Bueker suggested the
foll owi ng be added to Arti cl e I: "with the excepti on that the City of Schertz
reserve the right to designate imposed restrictive sales in connection with
common special events."
Mr. Seeba moved the City renew the lease agreement with BVYA for operation of
the concession stand in the City Park as amended. Mr. Sharpe seconded the
motion which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider, and Mr. Sharpe
NAYS: None
#8 CONTRACT RENEWAL: Mr. Sharpe moved the City renew the contract for
office space for the Community Council of South
Central Texas. Mr. Seeba seconded the motion which carried with the following
vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider and Mr. Sharpe
NAYS: None
#9 CIBOLO WATER CONTRACT: Council discussed with the City Attorney
the City of Cibolo.s proposal for purchasing
water from the City of Schertz. This proposal included among other items,
that Cibolo would be allowed to purchase water as a wholesale consumer from
the City for a term of up to five years at the price rate charged to other
wholesale consumers. Council agreed the term should be renegotiable after
one year. After further discussion, the City Manager and City Attorney were
instructed to work this out and bring it back to the Council.

MRS. HYATT ARRIVED AT 8:40 P.M.
#11 FIRE DEPARTMENT APPOINTMENTS: Mr. Sharpe moved to appoint
Archie Woodward Fire Chief and
Fritz Rusch as Fire Marshal for the year 1977. Mr. Seeba seconded the
motion which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None

#12 PERSONNEL: Mayor Bueker recessed the Regular Meeting of the
City Council in order to call an Executive Session
under Article 5262-17, Section 2 (g) of Vernons Civil Statutes, at 8:55 P.M.
The Mayor reconvened the Regular Session of the City Council at 9:19 P.M.
#13 POLICY LETTER: Mr. Sharpe moved to approve Policy Letter No.
77-P-1 for distribution and sale of Municipal Codes.
Mr. Schneider seconded the motion which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
#14 PAYMENT AUTHORIZATION: Mr. Seeba moved to authorize final engin-
eering fee payments to Howard Gaddis
for the Swimming Pool Porject in the amount of $4,065.21 and the Southside ~I
Water Improvements project, in the amount of $1,365.77.. Mrs. Hyatt seconded I
the motion which carried with the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
#15 COST OF LIVING: Mr. Arnold presented figures showing the City of
Schertz to be 3.5% behind the rate of inflation.
He also had data showing the effect a 5% cost-of-living increase would have
on the current budget as well as projection of the increase on the next fiscal
year budget.
Mr. Sharpe moved to grant a 5% Cost of Living increase to employees. Mr. Seeba
seconded the motion. Further discussion followed, after which the Mayor called
for a vote on the motion, which carried as follows:
AYES: Mr. Seeba, Mr. Sharpe and Mrs. Hyatt.
NAYS: Mr. Schneider, as he did not think the City Manager should be
included in the increase.
ABSTAINING: Mr. Howe, who felt he did not have sufficient information.
#16 CCMA BRIEFING: Mr. David Dennis briefed the Council on 208 Planning
status. He asked the Council to study the information
given them and he would be glad to answer questions at a later meeting.

#17 ENTEX RATE REQUEST: Council discussed the request received from
Entex for a 12~ per month per customer rate
adjustment.
Mr. Howe moved to adopt the following captioned resolution. Mr. Schneider
seconded the motion which carried by the following vote:
AYES: Mr. Howe, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
A RESOLUTION REFUSING TO ACCEPT AN AUTOMATIC l2~ PER MONTH
PER CUSTOMER RATE ADJUSTMENT FROM ENTEX AND REQUIRING AN
ENTEX REPRESENTATIVE TO SHOW PROOF TO THE CITY FOR THE NEED
OF SUCH AN INCREASE.
#18 NEWSLETTER REVIEW: Council unanimously approved the proposed
newsletter for the month of February with the
addition of articles on the following subjects: City Election, Southside
Project; congratulations to the Buffettes and the SAFES volunteer of the
month.
#19 GENERAL DISCUSSION: Mr. Sharpe discussed with the Council his feelings
concerning the manner in which the Judge conducts
Municipal Court. There was extensive disucssion of observations made by
all iCouncil members. Mr. Sharpe suggested the Council consider a change in
Judge. Mr. Arnold was requested to meet with the Chief of Police and Attorney
and make recommendations to the Council.
#20 ADJOURNMENT: Mrs. Hyatt moved the meeting be adjourned at 11 :06 P.M.
The motion was duly seconded and carried unanimously.
