10-01-1974 1{)2 REGULAR MEETING OF THE CITY COUNCIL OCTOBER 1, 1974 The Schertz City Council convened in Regular Session, Tuesday, October 1, 1974, at 7:05 P.M. in the Council Cham- bers, 608 Live Oak Road, with the following members present: Mayor Robert C. Bueker, presiding; Councilmembers Mrs.Nell G. Funk, Donald J. Seeba and Tom Koole. Absent: Mrs. Bobbie L. Koch and Robert E. Schwartz. Also present City Manager Denny L. Arnold and City Secretary June G. Krause. #1 APPROVAL OF MINUTES: A. Mr. Seeba moved for approval of the minutes of the Public Hearing of September 17, 1974 on the Budget as submitted. Mrs. Funk seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba and Mr. Koole. NAYS: None B. Mr. Koole moved to accept the minutes of the Public Hearing of September 17, 1974, as presented. Mr. Seeba seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koole. NAYS: None C. Mr. Seeba requested the vote on Item #6, page 147 of the minutes of the Regular Meeting of September 17, 1974, be corrected to read: "the ordinance was finally passed and adopted by the following vote: AYES: Mrs. Funk, Mr. Seeba and Mr. Schwartz. NAYS: Mr. Koole and Mrs. Koch." Mrs. Funk moved the minutes of the Regular Meeting of the City Council of September 17, 1974, be approved as corrected. Mr. Seeba seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba and Mr. Koo1e. NAYS: None. #2 HEARING OF RESIDENTS: 1. Mr. Harold Christian addressed the Council con- cerning the excessive fuel adjustment charges on the citizen's electric bills. Mayor Bueker read a letter Mr. Arnold had written GVEC requesting information on the fuel adjustment costs along with several other pertinent matters concening citizen's questions and explained that as soon as the City receives a reply to this letter he will inform the citizens. Mr. Christian also wanted to know what could be done about the loud motorcycle noises, speeding on Randolph Avenue and the feet that school kids do not stop at the stop sign at the corner of Randolph and Aero Avenues. Chief Schoonover ex- plained his department is doing its best in both areas but will make a concerted effort to alleviate both these problems. l~') a~) 2. Ms. Peggy Jackson, Chairman of the Mission Action CVllllui ttee of the First Baptist Church requested the Council consider their request for a building in which to operate a Thrift Shop two days a week. The money to be used for medical and dental assistance to the needy of Schertz. The Thrift Shop to be established by the women of the Baptist Church but the other churches of the City have been contacted and have expressed their willingness to help operate it. Mr. Arnold will work with the committee to find suitable space for the thrift shop and will keep the Council informed of progress. 3. Mrs. Murphy again appeared before the Council to seek answers to questions she has about her electric bill for August. Mayor Bueker suggested the Council invite the General Manager of GVEC to a Council meeting to answer some of these citizen questions as well as some the Council has asked and at that time, Mrs. Murphy will be answered. #3 POLICE RESERVE: Chief Schoonover introduced Donna Kaye Marcrum, who lives in Live Oak and has graduated from the Police Reserve School. Schoonover said she has worked with the Schertz Police and feels she will be an asset to the Department; there fore asked Council approval of her appointment to the Police Reserve. Mrs. Funk moved to approve the appointment of Donna Kaye Marcrum / 5 ~ I FI as a Police Reserve Officer of the City of Schertz. Mr. Seeba seconded the motion which carried with the following vote: AYES: NAYS: u 1f4 ORDINANCE: Mrs. Funk, Mr. Seeba and Mr. Koole None Mayor Bueker introduced the ordinance to adopt the 1974 National Electric Code; establishing licensing procedures; setting permit rates; and approving an oper- ating agreement with GVEC to accomplish electrical inspections in the City. After Council consideration, Mr. Koole moved to table any action on this item until such time as the General Manager of GVEC is present to discuss this proposed ordinance, especially the rates under Sec- tion 7, with the full Council present. Mrs. Funk seconded the motion which carried with the following 'Note: AYES: NAYS: Mrs. Funk, Mr. Seeba and Mr. Koo1e. None Mayor Bueker asked the Council to deviate from the agenda at this time and skip to Item No. 15. #15 ZONING ORDINANCE: Larry Burnside, Administrative Assis- tant to the City Manager, spoke on the proposed zoning ordinance setting out the recommendations made by the Planning and Zoning Cvulluission. Council was requested to study this proposed ordinance and send their recommendations to Mr. Arnold, in order for the ordinance and map to be presented for approval at an early date. 154 (1 ~ ~A \ \5 rp\' /,6/ 1.... 1f5 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 17th day of September, 1974. It was determined that the City Secretary had caused a short sYnopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council. Thereupon it was moved by Mr. Seeba and seconded by Mrs. Funk that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: AYES: Mrs. Funk, Mr. Seeba and Mr. Koole. NAYS: None ORDINANCE NO. 74-A-37 AN ORDINANCE PROVIDING FOR THE EX~~NSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS BY THE ANNEXATION OF TWO (2) CERTAIN TRACTS O~ PAR- CELS OF LAND CONTAINING 60.606 ACRES AND 25.271 ACRES, RESPECTIVELY. #6 ORDINANCE: Mayor Bueker introduced the hereinafter set forth' ordinance, which has been read and considered at the last regular meeting of the City Council on the 17th day of September, 1974. It was determined that the City Secretary had caused a short synopsis of said pro- posed ordinance to be published in the official City news- paper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council. Thereupon it was moved by Mr. Seeba and seconded by Mr. Koole that said ordinance be finally passed and adopted. ORDINANCE NO. 74-M-39 AN ORDINANCE FIXING THE TIME, PLACE AND DATES FOR HOLDING REGULAR AND SPECIAL MEETINGS OF THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS. #8 ORDINANCE: Mayor Bueker introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 17th day of September, 1974. ORDINANCE NO. 74-D-40 AN ORDINANCE MAKING IT UNLAWFUL FOR ANY DI.{IVER OF A MOTOR VEHICLE TO CAUSE THE WHEELS OF SAID VEHICLE TO SPIN AGAINST THE STREETS OR OTHER PUBLIC PLACE OF THE CITY OF SCHERTZ, TEXAS; DECLARING A VIOLATION OF THE PROVISIONS OF THIS ORDINANCE A MISDEMEANOR AND PROVIDING FOR PUNISHMENT UPON CONVICTION OF A FINE NOT TO EXCEED $200; PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE; AND ENACTING OTHER PROVISIONS INCIDENT AND REALTING TO THE SUBJECT. 156 \\~ ~~ f ~~ .; C\' \!) #9 ORDINANCE: Mayor Bueker introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 17th day of September, 1974. ORDINANCE NO. 74-F-4l AN ORDINANCE GOVERNING CONNECTIONS TO THE SEWER SYSTEM OF THE CITY AND REGULATING THE SAME; ESTAB- LISHING FEES FOR CONNECTIONS TO THE CITY'S SEWERS; PRESCRIBING FEES TO BE PAID TO THE CITY FOR SEWER SERVICES; ALLOWING FOR INSPECTIONS BY THE CITY; PROVIDING FOR THE PAYMENT TO THE CITY WITHIN A CERTAIN TIME LIMIT AND PENALTIES THEREAFTER; RE- PEALING FPlE (5) PRIOR ORDINANCES OF THE CITY, NUMBERED 80, 80B, 95, 159, 75-F-8, AND ALL OTHER CONFLICTING ORDINANCES; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE; CONTAINING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY #10 SCHAEFER kUAD: Mr. Arnold read portions of a letter from Mr. Tom Anderlitch, the City's Financial Advisor, in which he recvw.w.ended the city not pur- chase or operate the Schaefer Road Rural Water Supply District. Mr. Koole moved the City refuse the offer from Schaefer Road Rural Water Supply District to either purchase or operate their water system based on the recommendations of Mr. Ander1itch and Mr. Richard Harris, City Attorney. Mr. Seeba seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koole. NAYS: None. 1fll BOARD OF EQUALIZATION: The Council reviewed the recvlWllendations of the 1974 Board of Equalization and recvw.w.ended their consideration by the Tax Assessor Collector. #12 CIBOLO REQUESTS: On the recommendations of the Utility Superintendent, Marvin Patterson, the Council concurred to draft an agreement between the City of Schertz and the City of Cibolo for Schertz to provide Cibolo '. 157 with water system operation and maintenance on a contract basis. The service to be secondary to the requirements of Schertz. Council also agreed not to provide street sweeper service to the City of Cibo1o as requested, on the recommendations of the street Superintendent, Earl Johnson. 1f13 ATTORNEY FEE: Mrs. Funk moved to authorize the payment 'rt of the City Attorney's annual fees. NAYS: None. 1f14 CAC APPOINTMENTS: Mrs. Funk moved to appoint the ~ " '>' following three people to the lb' Ci tizens Advisory CVll11lli ttee on the recommendations of Chairman Strange: Mrs. Rita Bullock, 402 Pecan Drive; Mr. Richard H. Strain, 820 Maple Drive; and Mr. Floyd F. Deater, 210 Winburn Avenue. Mr. Koole seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba and Mr. Koole. NAYS: None. #16 GENERAL DISCUSSION A. Mr. Seeba wished to person- ally thank Marvin Patterson for doing such a good job while in the employee of the City. B. Mr. Arnold read a request from the Buffalo Valley Youth Association, approved by the SAFES president, to use the con- cession stand building in the park to sell books. Council gave its blessings to the money making venture. #17 PREVIOUSLY TABLED SUBJECTS: 5. Rittimann Water System. Mr. Arnold read a letter from Mr. Crump, attorney for Mr. & Mrs. Ray Rittimann dba Rittimann Water System, offering the system to the City of Schertz for the consideration of $10.00. After discussion by the Council, Mrs. Funk moved to p~rchase the Rittimann Water System for the sum of $10.00.
