MINUTES
REGULAR SESSION
APRIL 17, 2007
The Schertz City Council convened in Regular Session on Tuesday, April 17, 2007 at 6:30 p.m.
in the Municipal Complex Council Chambers, 1400 Schertz Parkway Building #4, Schertz,
Texas. The following members were present: Mayor Hal Baldwin presiding, Mayor Pro Tern Jim
Fowler, Councilmembers David L. Scagliolia, Tony Wilenchik and Michael Carpenter. Absent:
Councilmember Reginna Agee and City Manager Don Taylor. Also present were Assistant City
Managers John Bierschwale and David Harris, City Secretary Judy Tokar and City Attorney
Michael Spain.
#1 CALL TO ORDER.
Mayor Baldwin called the meeting to order at 6:30 p.m.
#2 PLEDGES OF ALLEGIANCE TO THE UNITED STATES AND STATE OF
TEXAS
Both pledges were recited.
#3 RECOGNITION of Steven White for his service to the Schertz Economic
Development Corporation and the City of Schertz.
Mayor Baldwin presented Mr. White a trophy for his service as Interim Executive and Projector
Director of Schertz Economic Development.
Mayor Baldwin thanked and extended appreciation to Mr. White for his great work and
assistance with the Schertz Economic Development Corporation and the Foundation since their
inception.
#4 HEARING OF RESIDENTS.
Frances RushinlZ. Chamber President, announced the following chamber events; April 27 -
monthly luncheon, May 4 - reception for Sharon Pennington, May 9 - Meet the Candidate forum
and May 10- monthly mixer.
#5 INTRODUCTION OF NEW EMPLOYEES: Finance and Facility Maintenance
Departments.
Juan Santoya, Director of Finance introduced Rene Zarate, Staff Accountant.
Mayor Baldwin opened the public hearing at 6:40 p.m.
#6 PUBLIC HEARING:

Hold a public hearing upon a request to zone 37.029+ acres from Pre-Development
District (PD) and Single-Family Residential-2 District (R-2) to General Business (GB).
The tract is situated out of the Toribio Herrera Survey No. 68, Guadalupe County,
Schertz, Texas. The property is generally located at the southeast corner ofFM 1518 and
Maske Road. Applicant: Harry Jewett, Harry Jewett Associates. (C. Gabbard)
Chris Gabbard, Planner I, said Planning and Zoning Commission voted unanimously to
recommend approval to zone 37.029+ acres to general business.
Mr. Harry Jewett said the proposed development was a soccer complex on Maske Road.
There were questions from Robert Brockman regarding the City's participation in the
project and Earl Hertzog asked if the property was in the ACUIZ. Mr. Jewett responded
that the there no City participation and the property was in the ACUIZ.
Mayor Baldwin closed the public hearing at 6:50 p.m.
(A) ORDINANCE: Discussion and action on an ordinance amending the Unified
Development Code (UDC) Ordinance 96-S-28 by rezoning 37.029+ acres out of the

Councilmember Carpenter made a motion, seconded by Councilmember Wilenchik, to
approve first reading of an ordinance amending the Unified Development Code (UDC)
Ordinance 96-S-28 by rezoning 37.029+ acres out of the Toribio Herrera Survey No. 68,
Guadalupe County, Schertz, Texas from Pre-Development District (PD) and Single-
Family Residential-2 District (R-2) to General Business (GB); providing an effective
date; and providing a repealing clause. The motion carried 4 to 0 and the vote was:
AYES: Councilmembers Fowler, Scagliola, Wilenchik and Carpenter.
NAY: None.
#7 CONSENT AGENDA:
The following items may be acted upon in one motion. No separate discussion or action
is necessary unless requested by the Mayor or a Councilmember, in which event those
items will be pulled for separate consideration:
(A) Approve Regular Session minutes of March 20,2007.

(B) ORDINANCE: Discussion and action on final reading of an ordinance amending
the Unified Development Code (UDC) Ordinance 96-S-28 by granting a Specific Use
Permit for 1.00+ acres out of the Toribio Herrera Survey Abstract No. 153, Guadalupe
County, Schertz, Texas for Commercial Use in the Air Installation Compatible Use Zone

Councilmember Wilenchik made a motion, seconded by Councilmember Carpenter, to
approve consent agenda items 7 A&7B. The motion carried 4 to 0 and the vote was:
AYES: Councilmembers Fowler, Scagliola, Wilenchik and Carpenter.
NAY: None.
#8 Discussion and action on presentation by KeD Mun9z Architects on the
LibrarylRecreation facilities. (L. Truitt)
Mr. Ronnie Biediger, Kell Munoz Architects, said the charge from City Council was to
investigate the feasibility to place both the library and recreation center on the 8 acres at the
corner of Schertz Parkway and Elbel Road. Geoffrey Edwards, Kell Munoz Architects, presented
a slide presentation explaining different arrangements for the library and recreation center on the
property. They showed each facility alone on the property with parking, and the library and
recreation center together with parking and an outdoor swimming pool. The conceptual drawing
showed the library and recreation center capacity for possible future expansion.
There was discussion by Councilmembers regarding how the bonds were sold to the citizens
stating the library would be located on one location and the recreation center at a different
location.
Councilmember Wilenchik made a motion, seconded by Mayor Pro Tern Fowler, to authorize the
architectural firm to proceed to place the library and recreation center on the same piece of land.
The vote was 2 to 2 with Mayor Baldwin voting aye to break the tie and the vote was as follows:
AYES: Councilmembers Fowler, Wilenchik and Mayor Baldwin
NA YES: Councilmember Scagliola and Carpenter
#9 Update and discussion by Don McCrary & Associates on the Schertz Parkway and
Doerr Lane projects.
Don McCrary with McCrary & Associates briefed the Council on the expansion project for
Schertz Parkway south of Live Oak Road to the railroad tracks. The project entailed widening,
landscaped median, and traffic signal at Schertz Parkway and Elbel Road. The project is
scheduled to start early July. The road will remain open and functional while under construction.
#10 Discussion and action to consider erecting a portion of a fence along Country Club
Boulevard (Northcliffe Subdivision) with City participation in funding. (Mayor
Baldwin)
Councilmember Scagliola made a motion, seconded by Mayor Pro Tern Fowler, to fund a portion
of the wooden and rock columned fence along Country Club Boulevard, not to exceed $8,000.00.
The vote was 2 to 2 with Mayor Baldwin voting aye to break the tie and the vote was as follows:

#11 EXECUTIVE SESSION: Called under Chapter 551 Texas Government Code, Sub-
section 551.087 Deliberation regarding Economic Development Negotiations.
An Executive Session was held from 8: 1 0 p.m. to 8:30 p.m.
No action was necessary on the executive session.
#12 RESOLUTION: Discussion and action on a resolution requesting CPS Energy to fund
an electrical infrastructure project. (S. White)
Councilmember Wilenchik made a motion, seconded by Councilmember Carpenter, to approve a
resolution requesting CPS Energy to fund an electrical infrastructure project. The vote carried 4
to 0 and the vote was as follows:
AYES: Councilmember Fowler, Scagliola, Wilenchik and Carpenter.
NA YES: None
#13 Items by City Manager Taylor and Staff
General Announcements
· David Harris, Assistant City Manager said there is a meeting tomorrow night to discuss
infrastructure and drainage south of FM 78 with the residents in the City's
extraterritorial jurisdiction.
#14 Items by Council
General Announcements
Mayor Pro- Tem Fowler
· Spoke with Mr. Truitt on designing a flowchart to show the entire platting process.
· As Council Liaison to the Schertz Economic Development Corporation, he expressed
appreciation to Mr. White.
Councilmember Scagliola
· Referred to TxDOT letter received by the City regarding our resolution opposing the
extension ofFM 3009.
Councilmember Wilenchik
· Reported on Doggie Dash fundraiser.

· Reported on Guadalupe County Commissioner's Court meeting that he attended. Since
the City of Schertz has 44% of the population in the County, staff recommended
information from the Commissioners meeting be included in the Schertz Tales.
Councilmember Carpenter
· Asked to have a staff member at the 50th Anniversary Committee meeting on Thursday,
April 26th to assist the committee and unlock City Hall. Mr. Harris said Erin Matlock
is the staff liaison.
· Asked the Council to discuss off-premise signs; he said that company vehicles parked
in front of businesses along the road were unsightly.
· Requested discussion on extension of the overlay district on Schertz Parkway to FM 78.
#15 Items by Mayor
· Reminded Council of Schertz-Seguin Local Government Corporation meeting
Thursday at 1 :30 p.m. in Seguin and the Historical Committee meeting Thursday at
6:30 p.m.
· Asked that we encourage TxDOT to extend FM 1103 not FM 3009 to IH 10.
