PZ 3-10-2021 minutesPLANNING AND ZONING MINUTES March 10, 2021 The Schertz Planning and Zoning Commission convened on March 10, 2021 at 6:00 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. Present: Glen Outlaw, Chairman; Ernie Evans, Vice Chairman; Richard Braud, Commissioner; Ricky Haynes, Commissioner; Ken Greenwald, Commissioner; Gordon Rae, Commissioner; Earl Platt, Commissioner; Jimmy Odom, Commissioner- Not Seated Absent: Judy Goldick, Commissioner City Brian James, Assistant City Manager; Emily Delgado, Senior Planner; Megan Harrison, Staff: Planner; Jimmy May, Planner; Tiffany Danhof, Administrative Assistant; John Nowak, Engineer 1. CALL TO ORDER Chairman Mr. Outlaw called the meeting to order at 6:00 P.M. 2. SEAT ALTERNATE TO ACT IF REQUIRED No Alternate was seated. 3. HEARING OF RESIDENTS Residents who choose to watch the meeting via live stream, but who would like to participate in Hearing of Residents, should email their comments to the Planning Division, atplanning@schertz.com by 5:00p.m. on Tuesday, March 9, 2021, so that the Planning Division may read the public comments into the record under the hearing of residents. In the body of the email please include your name, your address, phone number, agenda item number if applicable or subject of discussion, and your comments. This time is set aside for any person who wishes to address the Planning and Zoning Commission. Each person should fill out the Speaker's register prior to the meeting. Presentations should be limited to no more than three (3) minutes. Discussion by the Commission of any item not on the agenda shall be limited to statements of specific factual information given in response to any inquiry, a recitation of existing policy in response to an inquiry, and /or a proposal to place the item on a future agenda. The presiding officer, during the Hearing of Residents portion of the agenda, will call on those persons who have signed up to speak in the order they have registered. There were no residents who spoke. 4. CONSENT AGENDA: A. Minutes for the February 10, 2021 Regular Meeting. The consent agenda was not pulled for discussion. Motioned by Commissioner Gordon Rae to approve the consent agenda, seconded by Commissioner Earl Platt Vote: 7 - 0 Passed 5. PUBLIC HEARING: The Planning and Zoning Commission will hold a public hearing related to zone change requests and replats within this agenda. The public hearing will be opened to receive a report from staff, the applicant, the adjoining property owners affected by the applicant's request, and any other interested persons. Upon completion, the public hearing will be closed. The Commission will discuss and consider the application, and may request additional information from staff or the applicant, if required. After deliberation, the Commission is asked to consider and act upon the following requests and make a recommendation to the City Council if necessary. A. ZC2019 -008 Hold a public hearing, consider and make a recommendation on a request to rezone approximately 25 acres of land from General Business District (GB) and General Business II District (GB -2) to General Business II District (GB -2), generally located north -east of the intersection of FM 3009 and FM 78, also known as 200 FM 3009, also known as Guadalupe County Property Identification Numbers 153960, 164035, 67453, City of Schertz, Guadalupe County, Texas. Mrs. Delgado provided a presentation on ZC2019 -008. Jerry Rodondo- 2902 Hillcrest- Representing the owner of Storage company explained the proposes of bring the property into compliance. Don Clauson- 100 N Castiano, San Antonio, TX- Thanked staff for processing public hearing item and explained the proposed item will give a consistency to the community and adding more landscaping. Mr. Outlaw opened the public hearing at 6:09 P.M. No one spoke. Mr. Outlaw closed the public hearing at 6:10 P.M. There was a lengthy discussion between the Planning and Zoning Commissioners, City Staff, and the applicant to include discussions on the following topics: The development of the current Storage company e Impervious coverage *Nonconforming uses * Future land use map- parks, and open space *Proposed zoning request to General Business District II - GB -2 Motioned by Commissioner Gordon Rae to recommend approval of ZC2019 -008 to the City Council , seconded by Commissioner Ricky Haynes Vote: 7 - 0 Passed B. SUP2020 -002 Hold a public hearing, consider and make a recommendation on a request for a Specific Use Permit to allow Mini - Warehouse / Public Storage on approximately 25 acres of land generally located north -east of the intersection of FM 3009 and FM 78, also known as 200 FM 3009, also known as Guadalupe County Property Identification Numbers 153960, 164035, 67453, City of Schertz, Guadalupe County, Texas. Mrs. Delgado Provided a presentation on SUP2020 -002. Mr. Outlaw opened the public hearing at 6:28 P.M. No one spoke Mr. Outlaw closed the public hearing at 6:29 P.M. There was a lengthy discussion between the Planning and Zoning Commissioners, City Staff, and applicant to include discussions on the following topics: Impervious coverage The property in the front area The proposed expansion at the rear of the property *The Comprehensive Land Use Plan designation • The future FM 3009 extension, and the potential impacts to the existing business o Storm water management plan Motioned by Commissioner Earl Platt to recommend approval of SUP2020 -002 to the City Council, seconded by Commissioner Gordon Rae Vote: 7 - 0 Passed 6. ITEMS FOR INDIVIDUAL CONSIDERATION: A. WA2021 -001 Consider and act upon a request for approval of a waiver request regarding on- site - sewage facilities for the preliminary plat of 9.36 Acres on Koehler Road, a roughly 9.36 acres tract of land generally located approximately 3,200 feet from the intersection from Green Valley Road and Koehler Road. Mrs. Harrison provided a presentation on WA2021 -001. There was a brief discussion between the Planning and Zoning Commissioners and City Staff to include discussions on the following topic: e Closest available sewer connection *Explanation on the property location within the ETJ, and the City of Schertz platting authority Motioned by Commissioner Ricky Haynes to approve WA2021 -001, seconded by Commissioner Richard Braud Vote: 7 - 0 Passed B. WA2021 -002 Consider and act upon a request for approval of a waiver regarding Rough Proportionality in relation to the construction of the street improvements adjacent to the proposed preliminary plat of the 9.36 Acres on Koehler Road, an approximate 9.36 acre tract of land generally located 3,200 feet from the intersection of Green Valley Road and Koehler Road. Mrs. Harrison provided a presentation on WA2021 -002. There was brief discussion between the Planning and Zoning Commissioners and City Staff to include discussions on the following topics: * The dedication of right -away along the properties frontage Roadway impact fees . Explanation on the property location within the ETJ, and the City of Schertz platting authority Motioned by Commissioner Earl Platt to approve WA2021 -002, seconded by Commissioner Ricky Haynes Vote: 7 - 0 Passed C. PC2021 -006 Consider and act upon request for approval of a preliminary plat of the 9.36 Acres on Koehler Road, an approximately 9.36 acre tract of land general located 3200 feet south of the intersection of Green Valley Road and Koehler Road, located in Schertz Extraterritorial Jurisdiction, Guadalupe County, Texas. Mrs. Harrison provided a presentation on PC2021 -006. There was brief discussion between the Planning and Zoning Commissioners and City Staff to include discussions on the following topic: Zoning regulations in relation to lot width Explanation on the property location within the ETJ, and the City of Schertz platting authority Motioned by Commissioner Richard Braud to approve PC2021 -006, seconded by Commissioner Gordon Rae Vote: 7 - 0 Passed 7. REQUESTS AND ANNOUNCEMENTS: A. Requests by Commissioners to place items on a future Planning and Zoning Agenda There were requests from Commissioner Platt on a briefing the homeowner association rules and regulations. B. Announcements by Commissioners *City and community events attended and to be attended Continuing education events attended and to be attended There were no announcements by commissioners. C. Announcements by City Staff. • City and community events attended and to be attended. • NEW SITE PLAN APPLICATIONS: There were no new site plan applications submitted to the Planning and Community Development Department between February 6, 2021 and March 5, 2021. • CITY COUNCIL RESULTS: The following development applications were recommended for final action to the City Council: • Ord. 21 -S -06: Saddlebrook 229 acre Zoning to PDD Recommendation of denial at the January 27, 2021 P &Z Meeting (5 -2) • Approved via first reading at the Febbruary 23, 2021 CC Meeting (5 -1) • Approved via final reading at the March 2, 2021 CC Meeting (5 -2) • Ord. 21 -S -08: Crossvine PDD 4th Amendment- Zoning to PDD • Recommendation of approval at the February 10, 2021 P &Z Meeting (5 -2) • Tentatively schedule for first reading at the March 23, 2021 CC Meeting There were announcements by City Staff including the introducing of new Planner, Jimmy May. 8.
