12-03-1974 183 REGULAR MEETING OF THE CITY COUNCIL DECEMBER 3, 1974 The Schertz City Council convened in Regular Session, Tuesday, December 3, 1974 at 8:53 P.M. in the Council Chamber, 401 Oak Street with the following members present: Mayor Robert C. Bueker, presiding; Mrs. Nell G. Funk, Donald J. Seeba, Robert E. Schwartz, Tom Koo1e and Mrs. Bobbie L. Koch. Also present were City Manager Denny L. Arnold and City Secretary June Krause. In APPROVAL OF MINUTES: A. Mr. Schwartz moved the minutes of the regular meeting of November 19, 1974 be accepted as presented. Mrs. Funk seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koo1e, Mr. Schwartz and Mrs. Koch. NAYS: None B. Mrs. Funk mDved to accept the minutes of the Public Hearing of November 19, 1974 as presented. Mr. Seeba seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr. Schwartz and Mr:i. Koch. NAYS: None #2 HEARING OF RESIDENTS: There were no resid~~ts to be heard at this time. #3 PLANNING & ZONING MINUTES: Mr. Schwartz moved to accept the minutes of the Planning & Zoning Special Meeting of November 20, 1974 as written. Mr. Seeba seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr. Schwartz and Mrs. Koch. NAYS: None #4 CITIZENS ADVISORY COMMITTEE MINUTES: The minutes were not available for review. #5 BID AWARDING: After careful consideration of the recul111uendations of the City Manager, Chief of Police and Street Superintendent, the following bids were awarded: Mrs. Koch moved to award the bid for the Police cars to Jack Rieger Plymouth. Mr. Seeba seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koo1e, Mr. Schwartz and Mrs. Koch. Mrs. Funk seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr. Schwartz and Mrs. Koch. NAYS: None #6 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 19th day of November, 1974. It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon it was moved by Mr. Seeba and seconded by Mrs. Koch that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ordinance was finalLy passed and adopted by the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koo1e, Mr. Schwartz and Mrs. Koch. NAYS: None gRDINANCE NO. 74-A-49 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF ONE (1) CERTAIN TRACT OF LAND CONTAINING 85.474 ACRES OUT OF COMAL COUNTY, TEXAS In ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by the City Manager. Mr. Koo1e moved that said ordinance be considered by the Council. Mr. Seeba seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koo1e, Mr. Schwartz and Mrs. Koch. NAYS: None The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ TEXAS BY THE ANNEXATION OF ONE (1) CERTAIN TRACT OF LAND CONTAINING 71.046 ACRES OUT OF GUADALUPE COUNTY, TEXAS. Whereupon Mr. Koole moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 17th day of December, 1974, which motion was seconded by Mr. Seeba and carried with the following vote: Ib5 AYES: Mrs. Funk, Mr. Seeba, Mr. Koo1e, Mr. Schwartz and Mrs. Koch. NAYS: None ',+ Q ~,', ) (J- #8 GENERAL DISCUSSION: (1) Mrs. Funk moved that Mrs. Gail Hyatt be appointed to the Ci tizens Advisory CVl1LLui ttee. Mr. Seeba seconded the motion which carried with the following vote= AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr. Schwartz and Mrs. Koch. NAYS: None (2) Mr. Schwartz requested the Council contact the Texas High- way Department concerning the placing of a barrier at the rail- road crossing at the intersection of FM '3009 and FM 78. Mayor Bueker said the Citizens Advisory Committee had sent the Council a letter endorsing this suggestion and requesting the Council contact both the Texas Highway Department and the Southern Pacific Transportation Company concerning the placing of barriers at this location. Mr. Schwartz moved the Mayo r wri te ale t te r to the Texas I Q .t/ II ~- State Highway Department, attaching the letter from the CAC, G strongly recommending the placing of arm barriers at the rail- road crossing at FM 3009 and FM 78, with a copy of the letter going to the Southern Pacific Transportation Company. Mrs. Funk seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr, Koole, Mr. Schwartz and Mrs. Koch. NAYS: None (3) Mayor Bueker had a proposal from Mr. Jesse Graham, General Manager of Cibolo Creek Municipal Authority. When the sewer line is placed to the Doby School does the Council wish to put in a 6" main instead of the 4" as planned. The larger size would only cost the City about $600 to $700 more and could be utilized later as a gravity flow line. The Council asked for an engineering proposal of the cost and the certainty that the line can be gravity flow. #9 PREVIOUSLY TABLED SUBJECTS: (9) After discussion and comparisons of I ) sewer rates assessed in other cities in the area, Mr. Seeba / ~oved to leave the sewer rates for the Schertz Schools as they are. Mr. Koole seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koo1e, Mr. Schwartz and Mrs. Koch.
