REGULAR MEETING OF THE CITY COUNCIL
JANUARY 21, 1975
The Schertz City Council convened in Regular Session,
Tuesday, January 21, 1975 at 7:10 P.M. in the Council
Chambers, 401 Oak Street, with the following members
present: Mayor Robert C. Bueker, presiding; Mrs. Nell
G. Funk, Donald J. Seeba, Tom Koole,Robert E. Schwartz
and Mrs. Bobbie L. Koch. Also present were Assistant
City Manager Harold D. Baldwin and City Secretary June G.
Krause.

APPROVAL OF MINUTES: A. Concerning the regular
meeting of January 7,
first paragraph the date was corrected to the

Mr. Seeba moved the minutes of the regular meeting of
January 7, 1975 be approved as corrected. Mrs. Funk seconded
the motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr.Schwartz.
NAYS: Yone
ABSTAINING: Mrs. Koch as she was not present at the
meeting.
#2 HEARING OF RESIDENTS: There were no residents
wishing to be heard.
#3 PLANNING & ZONING COMMISSION MINUTES: A. Mr.
Schwartz
moved to accept the minutes of the P&Z Commission regular
meeting of January 8, 1975 as presented. Mrs. Funk seconded
the motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr. Schwartz
and Mrs. Koch.
NAYS: None
#4 COMMUNITY COUNCIL: Mayor Bueker introduced Mr. D.
Strader Taylor, Executive
Director of the ClJ1l1111unity Council of South Central Texas, Inc.,
who explained the various programs they provide. Mr. Taylor
asked the Council for approval of office space in Schertz.
They will only need room for a desk, phone and one ewployee,
and would furnish and maintain their area. Mr. Taylor said
the Cvwwunity Council would draw up a contract with the City
for a one year period. It was Council decision to have
Mr. Arnold research the available City facilities and come
back to Council with recommendations at a later meeting.
Mr. Schwartz moved to allocate space for the CUll111luuity
Council of South Central Texas for the period of one year.
Mr. Seeba seconded the motion which carried with the
following vote:
AYES: Mr. Funk, Mr. Seeba, Mr. Koole, Mr. Schwartz, Mrs. Koch.
NAYS: None.

Mayor Bueker said the Base Community Council is seeking
qualified people to serve as representatives 01"'. the AACOG
staff in some of the programs Mr. Taylor mentioned. It would
be to our advantage to place people from our area on some of
these committees. Council was requested to be thinking of
names of people who might be qualified and could meet at least
1/2 day each month during work hours.
If5 COMMUNITY DEVELOPMENT: Mr. Darrell Farr, CUlLlllLuni ty
Development Coordinator, briefed
the Council on the progress of the Cuulluuni ty Development applica-
tion, including the results of the Housing Survey and review with
the Council the priorities of objectives.
If6 ORDINANCE: The Mayor introduced the following captioned
ordinance which was read in full. Mr. Schwartz
moved that said ordinance be considered by the Council. Mrs. Funk
seconded the motion which was carried by the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr. Schwartz and
Mrs. Koch.
NAYS: None.
The following captioned ordinance was then discussed and fully
considered by the Council:
AN ORDINANCE REGULATING THE KEEPING OF JUNKED VEHICLES
AND ABANDONED MOTOR VEHICLES WITHIN THE CITY LIMITS OF
THE CITY OF SCHERTZ, TEXAS; MAKING PROVISIONS FOR THE
REMOVAL OF JUNKED VEHICLES AND ABANDONED MOTOR VEHICLES
THAT CONSTITUTE A PUBLIC NUISANCE; PROVIDING FOR A HEAR-
ING TO DETERMINE WHETHER A NUISANCE EXISTS; PROVIDING
A PENALTY FOR VIOLATIONS OF THIS ORDINANCE; AND MAKING
CERTAIN OTHER AND FURTHER FINDINGS AND PROVISIONS PERTI-
NENT TO THE SUBJECT
Whereupon Mr. Schwartz moved that said ordinance be further
cOIEidered at the next regular meeting of the City Council to
be held on the 4th day of February, 1975, which motion was
seconded by Mrs. Funk and which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr.Schwartz and
Mrs. Koch.
NAYS: None
#7 GENERAL DISCUSSION:
A. Mayor Bueker read a letter

for damages during the erection

Mrs. Koch moved to authorize the Mayor to sign a letter to (;J 0"' '1.:::-
GVEC holding them harmless for damages incurred in the erection
of an antenna tower at the Schertz Police Department. Mr. Seeba
seconded the motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Koole,Mr Schwartz and
Mrs. Koch.
NAYS: None

B. Mayor Bueker stated he had had several calls from citizens
w~!.o would like to know how far the inspector can go in the
inspection and entering vacant homes in the City without
violating the citizen's rights. Council would like to get
a legal opinion from Attorney Harris on this.
C. Mr. Funk referred to the Newsletter, the last item of
which states the newsletter can be obtained at City Hall.
Council agreed their intent was for the newsletter to be
published in the newspapers and placed at strategic points
throughout the City.
D. The Fire Marshall has requested the Council to consider
the approval of the Southern Standard Fire Prevention Code,
1974 edition. Mr. Rusch is to be asked to explain the need
for the adoption of this code at the next meeting.
E. Mr. Johnson reported the contractor was to begin repairing
the roof of the Council Chamber the following day.
F. Mr. Schwartz reported the street lighting is cv~pleted
along Highway 78 and invited the Council to inspect them.
If8 PREVIOUSLY TABLED SUBJECTS: Under item 2 - Annexa-
tions, Mayor Bueker said he had talked with the Mayor of Garden
Ridge who stated some people in Schertz ETJ had requested to be
included in Garden Ridge. The Mayor suggested Schertz should
prepare an ETJ map and send copies to Garden Ridge and Selma
and the residents in the area in order to aviod the conflict
in the letters of intent.
It was Council decision to request Mr. Gaddis to proceed with
the annexation to the southern most extremity of Homecraft
subdivision.
#9 ADJOURNMENT: Mr. Koole moved to adjourn at 9:02 P.M.
Mrs. Funk seconded the motion which I
carried unanimously.
