Regular meeting of the Schertz City Council held at the City Hall 93
in Schertz, Texas, October 3, 1968.
Mayor Roy W. Richard called the meeting to order with the follrning
named Aldermen present: Malford C. Koch, Jimmie V. Dunham, Raymond G.
Koym, Leonard J. Kazben and Edgar T. Marx.
Also present C. C. Cross, W. Schertz, Russell and Fred Rowell,
A. Woodtvard and Elgin Beck and ~1rs. B. Koch and Mrs. G. Bennett and
several citizens.

KNOW ALL MEN BY THESE PRESENTS:
HHEREAS there are more than ISO elderly persons of
age 6r; and older now living in Schertz and many of these
persons are of modest ne ans; and
]i ... WHEREAS Schertz being located on the fringe of San
Antonio and the community is growing significantly each year
wi th more elderly persons moving in residence; and
WHEREAS rental housing units are in severe shortage
in Schertz to the extent that only one or two vacancies exist
from ti me to ti me; and
ltJ1.l'EREAS many of the elderly citizens though living
in their own hone s at this time, but gradually. finding

housekeeping responsibilities for a large residence to be burden-
some and beyond their economic ability; and
!'JHEREAS these elderly persons living by themselves are
lacking in social activities and fellowship, thereby causing
loneliness and a longing for the company of other elderly persons;
NOW BE IT RESOLVED that the Citizens Advisory Committee of
the City of Schertz recommends to the City Council to instigate
a low-rent public housing program directed exclusively for the
use of elderly persons; and
BE IT FlJRTHER RESOLVED that this community deems a
project of fifty units to be of proper size for the alleviation
of the housing shortage and better living accommodations far
our senior citizens.

Mr. Schertz asked the Council to consider new tires for the Fire Truck.
Mr. Kazben asked why sonething is not being done on the Drainage 8mlnnel
now that the contract has been let.

to do on Schertz projects?
Send letter to GVEC to fix street in Lone Oak. Cite last three
paragraphs on page 6 of Standard Specifications for construction of

Heeting called for the purpose of checking bids submitted October
4th and decide on awarding contracts.
:Mr. Cross recommended lCM bid of Southwest Tank and Supply Co.
be accepted. Motion by Mr. Koym seconded by Mr. Kazben same be
. accepted at $25,990.00. Hotion unanimously carried.
Mr. Cross stated that the 100 bid on the pump submitted by Southern
Engine and Pump Co. not be accepted due to some errors made and also
using Japanese ~ipe. :Mr. RO\'lell indicated he would recommend Crane Sw)ply
Co. whose bid was $e,~j2.00. Mr. Koch made a motion seconded by Mr. Marx ~o,,(pg
which unanimously carried to award the contract to Crane Co.
Mr. Cross stated low bid on the Supply Lines was $lc2,4~3.00
submitted by utilities Consolidated Co. Inc. :Hr. ROhrell recommended
accepting bid of $189,100.UO by Howard Stich Co. after checking and a
thorough discussion on type of wark material, etc. A motion by
Hr. Dunham seconded by Mr. Koym the contract be awarded to Howard Stich
Co. Motion unanimously carried.

A Report by Mrs. .Bennett to lVlr. Durkin on Community Action Program
Aid to low income families. After talking to Attorney Saegert about
obtaining food SUP9lies Mrs. .Bennett will work from that way of obtaining
aid. The Mayor Complemented Mrs. Bennett for the fine work she is doing.
Firemens pay for October approved.
Mr. Davis of GVEC presented a resolution by his Co. with a proposition
for installing street lights in return for the City to grant a long term
Franchise with not more than a 2~ gross rental. Same was tabled until a
later date.

The regular meeting of the Schertz City Council was held at the City
Hall in Schertz, Texas on November ~, 1968.
Mayor Roy W. Richard called the meeting to order with the following
named Aldermen present: Raymond G. Koym, Malford C. Koch; Leonard J. Kazben,
and Jimmie V. Dunham. Absent; Edgar T. Marx.
Mr. Arthur Tnoillo explained the need for a Low Rent Housing Project,
~ow it operates, md the whole program in general.
~ A motion by Mr. Kazben to pass and adopt a resolution finding and
"~J declaring that there exists a need for the Housing Authority of the City of
Schertz to function. Seconded by Mr. Dunham and unanimously carried.
The following listed persons were appointed to the Housing Authority
Board: Arthur L. Siskey, Chairman; Edward C. Brinkman, Vice-Chairman; and
'James E. Stephens, Robert T. KueChler, and James.H. Brawn as members.
This board will meet with FHA next l.Jednesday at 3: 00 P. M. in San
Antonio.
The Board members were sworn in and signed Oath of Office.

Mayor Roy W. Richard called the meeting to order with the following
named Aldermen present: Raymond G. Koym, Malford C. KOCh, Leonard J.
Kazben, Jimmie V. Dunham and Edgar T. Narx.
A motion by Mr. Koym seconded and unanimously carried to reappoint ~ q-~~
}~. C. C. Cross for a two year term effective December 21, 1968 to
December 21, 1970 on the Plumbing Appeals Board and Bo~rd of Adjustments
and Jppeals, as required by theWouthern Standard Building Code 196r;
Edition. See City Ordinance No. 1~2, dated December 21, 1966.
Mr. Henry Guiterrez, Alvin Schuster and Carlton Anderson were present
to ask that the City consider awarding a franchise for garbage and trash
collection. Mr. Guiterrez briefed the Council on some collection charges
and per cent paid to the city.
The Mayor instructed the Council members to study this over and some
action will be taken at a later date.
A letter from the Community Council inviting all to attend an Open
House in Seguin, Saturday December 14 and hear a lecture about the OEO
Program.
It was moved by Mr. Marx seconded by Mr. Koym and unanimously carried 7D-~f?
not to award a new franchise to Southwestern Bell Telephone Co. at this
time. It was also moved, seconded and carried to notify them by letter and
suggest a meeting in the near future.
A motion by Mr. Kazben, seconded by Mr. Marx and unanimously carried 7 j-t,'1
to apDoint Mr. Russell and Fred Rowell as Assistant Inspectors for the
City of assist Mr. Sturrock.
Mr. Kazben suggested the City Dog Pound be improved and that this
will be taken care of at once.

Mayor Roy W. Richard called the meeting to order with the following
named Aldermen present: Raymond G. Koym, Leonard J. Kazben Malford C.
Koch, Jimmie V. Dunham and Edgar T. Marx.
The firemens pay for the month of December was approved.
Mr. Cook and Mr. Pfeiffer, personnel from SARA, showed maps and a
master plan for sewerage disposal for Universal City and Schertz,
A special meeting is set for Monday, January 6. Mr. H. P. Thulemeyer
will have Mr. William M. Parham here to go over the entire insurance
coverage for the city and explain the same.
An Ordinance was read by Mr. Saegert, City Attorney, for restoring
all streets and walkways to their original specifications. The discussion
was tabled until further notice.

\ Building Application to Urban Renewal.
Fire Chief Woodward reported the old tires from the Fire Truck
were sold to Mr. H. Classen for $40.00 and the check was turned over to
the city.

Hall in Schertz, Texas on January 6, 1969.
Mayor Roy 1'1. Richard called the meeting to order with the foLlowing
named Aldermen present: Raymond G. Koym, Malford C. Koch, Leonard J.
Kazben, Jinmie V. Dunham and Edgar T. Marx. Also presnet was H. P. Thulemeyer,
William M. Parbam, Fred Rowell and T~Tal ter A. Schertz.
The minutes of the meetings for December r; and December 12, 1968
were approved as read.
Mr. Parham gave a thorough briefing on all insurance policies and
coverages now in effect with the city. He explained how certain changes
cbuld be made affording more protection and a savings to the city by
combining all under one policy to becone due at one date.
A Js tter was read from the Urban Renewal Agency, Schertz, Texas with
an up to date Planning Report on the Buffalo Valley r~neral Neighborhooi
Renewal Plan.
There was a short duscussion regarding the telephone rates, service
and condition of streets after the company has made the repairs.
The secretary was instructed to notify Mr. Charles Cross to be present
at the January 13 meeting in order to clarify necessary deeds, easements
and all things in general pertaining to the new water well.
A motion to adjourn by Mr. Koch and seconded by Mr. Koym. Motion

easements except the Katy. He expects to receive this soon.

Mayor sign all easements and return them to their origins immediately.
All field notes for the drainage canal have been iaken to
Louis Saef!ert, City Attorney.

A motion was made by Mr. Kazben, seconded by Hr. Marx and carried .3-1. 9
unanimouSly to relieve M~s. Jennie E. Bennett from the Citizens Advisory
Committee and appoint her as City Helfare Director.
Let it be known in the minutes this day that the City Council
in no way is connected with Hrs. Bennett I s teaching of the two girls in
her home.

unanimously to allow a $200.00 clothing allowance for Mr. Cox and:

as a consUltant to aid the City of Schertz in preparing an Application

Mayor Roy W. Richard called the meeting to arder with the following

residents of Schertz.

The Firemens pay for January was approved.
The notice of the Election to be held April 5, 1969 was read.
Mr. George Gesche inquired about water service on some of his land.
Mr. Woodward announced the First Aid class to be held.
Mr. Wayne Davis informed the City Council that he is farced to resign
as chairman of the Citizens Advisory Board due to change in hours on his
\J '\job. A motion by Mr. Kazben, seconded and carried that the resignation be
V accepted and Joseph Moore, Bonnie Anderson and Orie Davis be appointed to
the board and the entire board be appointed to serve another year 1969.
A letter from the San Antonio River Authority, was read in reference to
a sewerage plan.
Mr. Herberer wants to be sure that Mr. Wuest is satisfied on the
easements and after the discussion Mr. Marx made a motion seconded by
",~Mr. Koch to permit Mr. Wuest to hook on to the water line in case of emergency.

located in the area.

Mayor Roy W. Richard called the meeting to order with the follCJN"ing

Ed Mok, Arthur Troilio and eleven residents.
A letter from Senator Ralph W. Yarborough was read that he will report
deficiencies of our Buffalo Valley North Project to the Departrr~nt of
Housing and Urban Development and send the City further information.
Mr. Mokand Iv'Jl'. Troilo explained the Low Rent and Low Income Housing C'
Program. A Resolution was read Arthorizing publication of the intent to
enter into a cooperation agreement with the Government.

1969, by and between the Housing Authority of the C ty 0 che,rtz
Texas (herein Called the "Local Authority") and the City 01' ::>Chertz,
therein called the "Municipality"), WITNESSETH:
In consideration of the mutual covenants hereinafter set
forth, the parties hereto do agree as follows:
1. Whenever used in this' Agreement:
(a) The term "P"!"oject" shall mean any low-rent housing
hereafter developed as an entity by the Local Authority
with financial assistance of the United States of
America (herein called the "Government"), pursuant
to the United States Hpusing Act of 1937, as amended,
and the Department of Housing and Urban Development
Act; excluding, however, any low-rent housing project
covered by any contract for loans and annual
contributions entered into between the Local
Authori ty and agen cie s of the Government pri or to

(b) The term "Taxing Body" shall mean the State or any
political subdivision or taxing unit thereof in which
a Project is si tuat8d and which would hav8 auth:y''';+ ~0
;Jssess or levy real or pe rsonal property taxes or to
certify such taxes to a taxing body or public officer to
be levied for its use and benefit with respect to a
Project ii' it were not exempt from taxation.
(c) The term "Shelter Rent" shall mean the total of all
charges to all tenants of a Project for dwelling rents and
nondwelling rents (excl uding all other income of such
Project), less the cost to the Local Authority of all
dwelling and nondwelling utilities.
(d) The term "Slum'l shall mean any area where dwellings
predominate which, by reason .).t:' ('j lapidation, overcrowding,
faulty arrangement or design, lack of ventilation, light
or sanitation facilities, or any combination of these
factors, are detrimental to safet~, health or morals.
2. The Local Authority shall endeavor (a) to secure a
contract or contracts with the Government for loans and annual
contributions covering one or more Projects comprising
approximately 80 units of low-rent housing and (b) to develop
and administer such Project or Projects, each of which shall be
located 1rri thin the corporate limits of the Hunicipality. The
obligations of the parties hereto shall apply to each such Project.
3. (a) Under the constitution and statutes of the State of
Texas all Projects are exempt from all real and Dersonal
property taxes and special assessnents levied or imposed
by any Taxing Body. With respect to any Project, so long
as either (i) such Project is owned by a public body or
governmental agency and is used for low-rent housing
. purposes, or (ii) a rw contract bet,..reen th~ Local Authority
and the Government for loans or annual contribution,
or both, in connection with such Project remains in force
and effect, or (iii) any bonds iSf:l.1ed in connection with
such Project or any monies due to the Government in
connection with such Project remain unpaid, whichever
period is the longest, the Ifunicipality agrees that it
will not levy or impose any real or per.::onal property
taxes or special assessments upon such Project or upon
the Local Authority with respect thereto. During such
perine, the Local Authority shall make annual payments
(herein called nPaynents in Lieu of Tax'3sl1) in lieu of
such taxes and special assessments and in payment for
the Public services and facilities furnished from time
to time without other cost or charge for or with respect
to such Project.
(b) Each such annual Payment in Lieu of Taxes shall be
made after the end of the fiscal year established for
such Project, and shall be in an amount equal to either
(i) ten percent (10~) of the aggregate Shelter Rent
Charged by the Local Authority in respect to such Project
during such fiscal year, ar (ii) the amount permitted
to be paid by applicable State law in effect on the
date such payment is made, whichever amount is the lower.
(c) The Local Authority shall distribute the PayTll'nts

proportion which the real property taxes which would
have been paid to each Taxing Body for such year if
the Project were not exempt from taxation bears to the

to all Taxing Bodies for such year if the Project were
not exempt from taxation; Provided, however, That no
payment for any year shall be made to any Taxing Body
in excess of the amount of the real property taxes
which would have been paid to such Taxing Body for such
year if the Project were not exempt from taxation.
(d) Upon failure of the Local Authority to make any
Payment in Lieu of Taxes, no lien against any Project
or assets of the Local Authority shall attach, nor shall
any interest or penalties accrue or attach on account
thereof.
4. The Municipality agrees that, subsequent to the date of
initiation (as defined in the United States Housing Act of 1937,
as amended) of each Project and within five years after the
completion thereof, or such further period as may be approved by
the Government, there has been or will be elimination (as approved
by the Government) by demolition, condemnation, effective
closing, or compulsory repair or improvement, of unsafe or
insanitary dwelling units situated in the locality or metropolitan
area in which such Project is located, substantially equal in
number to the number of neWly contructed dwelling units provided
by such Project; PrOVided, That, where more than one family is
living in an unsa.fe or insanitary dwelling unit, the elimination
of .such unit shall count as the elimination of units equal to the
number of families accommodated therein; and Provided, further,
That, this paragraph 4 shall not apply in the case oi' (i) any
Project developed on the site of a Slum:cleared subsequent to
July lr;, 1949, and that the dwelling units eliminated by the
clearance of the site of such Project shall not be counted as
elimination for any other Project or any other low-rent housing
project, or (ii) any Project located in a rural nonfarm area.
5. During the period commencing with the date of the acquisition
of any part of the site or sites of any Project and continuing so
long as either (i) such Project is owned by a public body ar
governmental agency and is used for low-rent housing purposes, or
(ii) any contract between the Local Authority and the Government
for loans or annual contributions, or both, in connection with
such Project remains in force and effect, or (iii) any bonds
issued in connection with such Project or any monies due to the
Government in connection with such Project remain unpaid,
whichever period is the longest, the Municipality without cost
or charge to the Local Authority or the tenants of such Project
(other than the Payments in Lieu of Taxes) shall:
(a) Furnish or cause to be furnished to the Local
Authority and the tenants of such Project public services
and facilities of the same character and to the same
extent as are furnished from time to time without
cost or charge to other dwellings and inhabitants in the
Municipality;
(b) Vacate such streets, roads, and alleys within the
area of such Project as may be necessary in the developll1l!!rl t
thereof, and convey without charge to the Local Authority
such interest as the Municipality may have in such
vacated areas, and, insofar as it is lawfully able to
do so without eoat or expense to the Local Authority or
to the Municipality, cause to be removed from such
vacated areas, insofar as it may be necessary, all
public or private utility lines and equipment.
(c) Insofar as the Municipality may lawfully do so,
(i) grant such deviations from the building code of the
Municipality as are reasonable and necessary to promote

economy and efficiency in the development and adminis~Q3
of such Project, and at the same time safeguard health
and safety, and (ii) make such changes in any zoning of
the site and surrounding territory of such Project as
are reasonable and necessary for the development and
protection of such Project and the surrounding territory;
(d) Accept grants of easements necessary for the
development of such Project; and
(e) Cooperate with the Local Authority by such other
la1N"ful action or ways as the Municipality and the Local
Authority may find necessary in connection with the
development and administration of such Project.
6. In respect to any Project the Municipality further
agrees that within a reasonable time after receipt of a written
request therefor from the Local Authority:
(a) It will accept the dedication of all interior
streets, roads, alleys, and adjacent sidewalks within
the area of such Project, together with all storm and
sanitary sewer mains in such dedicated areas, after
the Local Authority, at its own expense, has completed
the grading, improvement, paving, and installation
thereof in accordance with specifications acceptable
to the Municipality;
(b) It will accept necessary dedications of land
for, and will grade, improve, pave, and provide sidewalks
for, all streets bounding such Project or necessary
to provide adequate access thereto (in consideration
whereof the Local Authority shall pay to the Municipality
such amount as would be assessed against the Project site
for such work if such site were privately owned); and
(c) It will provide, or cause to be provided, water
mains, and storm and sanitary sewer mains, leading to
such Project and serving the bounding streets thereof
(in consideration whereof the Local Authority shall.

7. If by reason of the Municipality's failure or refusal
to furnish or cause to be furnished any public services or
facilities which it has agreed hereunder to furnish or to
cause to be furnished to the Local Authority or to the tenants
of any Project, the Local Authority incurs any expense to
obtain such services or facilities then the Local Authority
may deduct the amount of such expense from any Paynents in
Lieu of Taxes due or to become due to the Municipality in
respect to any Project or any other low-rent housing projects
owned or operated by the Local Authority.
8. No Cooperation Agree1ll!tnt heretofore entered into between
the Municipality and the Local Authority shall be construed
to apply to any Project covered by this Agreement.
9. So long as any contract between the Local Authority and
the Government far loans (inCluding preliminary loans) or
annual contributions, or both, in connection with any Project
remains in force and effect, or so long as any bonds issued in
connection with any Project or any monies due i te tthe:-Goy:ertJment
in connection with any Project remain unpaid, this Agreement
shall not be abrogated, changed, or modified without the consent
of the f1overnment. The privileges and obligations of the
Municipality hereunder shall remain in full force and effect
with respect to each Project so long as the beneficial title
to such Project is held by the Local Authority or by the

Government or by any other public body or governmental agency
authorized by law to engage in the development or administration
of low-rent housing projects. If at any time the beneficial
title to, or possession of, any Project is held by the Government,
other public body or ~overnmental agency, the provisions hereof
shall inure to the benefit of and may be enforced by the Government,
such other public body or governmental agency.

have respectively signed this Agreement and caused their seals to

Mrs. Bennett, City Welfare Director, reported that she is doing a
wonderful job in obtaining aid and supplies for the needy families.
The Citizens Advisory Committee suggested a new plan on the refreshment
stand at the Ball Park. Mr. Koym will investigate and recomnend any
necessary changes.

A joint meeting with Cibolo will be SCheduled to discuss water
rates.
A meeting will be held next Thursday to discuss the garbage contract.
Mr. Saegert will draw up an ordinance on the sale of water

Mr. Carter and Mr. Eads of Hoare Service, Inc. were present to
answer questions and brief the Council on trash and garbage pickup service'
and stated that their company would like to bid on a contract for such
services.

territorial Jurisdiction.
A motion by Hr. Koym and seconded by Mr. Marx to pass a Resolution /b-&:'CJ
appointing Delos R. Durden, Hugh G. Sandifer and Charlie E. Sartain to
the Equalization Board for 1969.
Mr. Cross will meet with Mr. J. S. Newman of the Lo-Vaca Gathering
Co. at 9:00 A. M. tomorrow in regard to the easement over their gas line.

AN ORDINANCE PROHIBITING SEL~-SERVICE GASOLINE STATIONS:
BE IT ORDAINED BY THE CITY COlmCIL OF THE CITY OF SCHERTZ, TEXAS:
Section 1. Definition. The City Council find the term
"volatile or flammable liquids" as used in this section means
and includes ga1501ine commonly and generally used in the operation
of motor vehicles.
Section 2. Dispensing of gasoline. It shall be and is
unlawful for the owner or operator of any garage, service station
or other dispensary of volatile or flammable liquids, selling or
disposing of same to the public within the corporate limits of this
city to permit delivery or dispensing of any volatile or flammable
liquids, as defined in this section, into the fuel tank of a motor
vehicle or into any other container except by the owner or operator
of sllch service station, ~arage or other dispensary, or by a
regu~arly a~thorized employee of such owner or operator.
Section 3. Each unauthorized sale: separate offense. Each
sale or delivery 01' volatile or flammable liquids as herein defiIed
except by the owner or operator of a service station, garage or
other dispensary, or by a regularly authorized employee of such
owner or operator, shall constitute a separate and independent
offense under this section.
Section 4. Panfil ty. Any person, firm, partne rship, ar
corporation who violates any provision of this section or fails to
comply with any such provisions shall be deened guilty of a misde-
meanor and, upon conviction thereof, shall be punished by a fine of
not less that one dollar ($1.00) nar more than one hundred dollars
($100.00) .

thereby constituting a quorum of each council, at which time among other
proceedings had was the introduction of the following resOlution:
~n~EREAS, the sewer plants of Cities of Universal City and Schertz are
each nearing capacity, and
WHEREAS, the City of Universal City has filed an application with the
Texas IN"ater Quality Board for an amendment to its sewer permit, and
l"HEREAS, the City of Schertz has in preparation an appl~.cation to file
with the Texas \.1Tater Quality BO;:l'Y'd for an amendment to its sewer permit, and
l..JHERELS, the San Antonio River Authority has had accomplished an engineering
study, by an independent consultant engineering firm, of the feasability
of a Regional Sewage System servicing the F'''',)er Cibolo Creek watershed, and
\,.vIlEREAS, the engineFlring study found said regional sYl'ltem to be feasible
and proposed that the San Antonio River Authority purchase UniverSal
City and Schertz sewer plan ts, for stated costs, an d operate them
charging the Cities of Universal City and Schertz processing fees of
$O.lr; per JOOO gallons per month (decending), and
hJHEREAS, the Cities of Universal City and Schertz would be required to
pay to the San Antonio River Authority a connection fee of $100 for each
residential connection or equivalent, and
:fTEREAS, eac'l of the plants of the two cities if expansion is pennitJ~d
will be capable of processing sewage with effl uent meeting the standards
prescribed by the State of Texas, and
'1THEREAS, both of the proposals contained in the San Antonio River Authority
study would place e&c::'~ of the two cities envolved at a financial disadvantage
of cor" ~~rable exten t,
~~]rnREFORE BE IT RESCLVED by the City Councils of the Cities of Universal
City and Schertz each independently and collectively to reject each OJ the
proposals contained in the Upper Cibolo Creek lplatershed Regional Sewage
System Study as not being advantageous to either or both of the cities
concern, and
BE IT FURTHER RESOLVED that the City of Universal City and the City of
Schertz shall independently proceed with the processing of its application
for amendment of its sewer pennit with each city herebv going on record
as favoring the others application.
The said resolution was read in full and upon motion of Alderman Phillips
(Universal City) and Alderman Kazben (Schertz) se.conded by Alderman Prater
(Universal City) and Alderman Koym (Schertz), that the same be passed and
adopt!d the question was called for and the followir"5 members of the City

1969. The estimated taxes for 1969 was $4,919,482.S2'. A motion by
Mr. Kazben, seconded by Mr. KoyJI and unanimously carried to accept the
Resolution.
The Council agreed to look for a used car to replace the patrol car
that was wrecked.
=A Resolution was adopted and passed to make a request for a hearing
on our Sewer Permit. This is to be held on the 6'" .....mds.
A Resolution was adopted to file andapplication fer a permit to
enlarge the sewer facilities. The application on the Sever is to be

A Resolution authorizing Mr. Cross to sign for a Federal Grll1t under

In consideration ot the mutual covenants hereinafter set

1. WheJlever used in this Agreement:
(.) The term "Project" shall mean any low-rent housing
hereafter developed as an entity by the Local Authority
With financial assistance of the United State. of
.A1Isrica (herein called the "Govemment"), pursuant to
the United States Housing Act of 19.37, as amended,
and the Department of Housing and Urban Development
Act; excludirlg, hOirever, any 1c:1f-rent housing project
covered by any contract for loans and- annual ccmtributions
entered into between the Local Authority and agencies
of the Govemment prior to the date of this Agreement.
(b) The term "Taxing Body" shall mean the State or
any' political subdivision or taxing unit thereof in
which a Project is situated and which would have
authority to assess or levy real or personal property
taxes or to certify such taxes to a tax:lng body or
public Bft1eer to be levied for its use and benefit
with respect to a Project it it were not exempt from
taxation.
(c) The term "Shelter Rent" shall mean the total of
all charges to all tenants of a Project far dwelling
rents and nondwelling rents (exCluding all other income
of such Project), less the cost to the Local Authority
of all dwelling and nondwelling utilities.
(d) The term "Slum" shall mean any area where dwellings
predominate which, by reason of dilapidation,
overcrOWding, faulty arrangement or design, lack of
ventilation, light or sanitation faci1it:iss, or any
combination of these factors, are detrimental to
safety, health or morals.
2. The Local Authority shall endeavor (a) to secure a
contract or contracts with the Govemment tor loans and annual
contributions covering one or more Projects cOIIPrising
approximately units of low-rent housing ad
(b) to develop and administer such Project or Projects, each
of which shall be located within the corporate limits of the
Municipality. The obligations of the parties hereto shall
apply to each such Project.
3. (a) Under the calstitution and statutes of the State
of Texas all Projects are exempt from all real and
personal. property taxe. and special asses81118nts levied
or imposed by any Taxing Boc:\'r. With respect to. any
Project, so long &s either (i) such Project is arned
by a public body or gove. ........ntal agency and is used
for low-rent housing purposes, or (ii) any contract
between the Local Authority and the Government for
loans or annual contributioos, or both, in connection
with such Project remains in- force and effect, or
(fii) any bonds issued in connection tith such
Project or any monies due to the Government in connection
with such Project remain unpaid, whichever period
is the longest, the Municipality agrees that it will
not levy or iq>oee any real or personal property
. taxes or special assess_nts upon such Proje ct or
upon the Local Authority with respect thereto.
During such period, the Local Authority shall make
annual paJ",'~i,Jts (herein called "P~"..,",ts in Lieu of
Taxes") in lieu of such taxes and special assessments
and in payment for the Public services and facilities
fumished from time to time without other cost or
charge for or with respect to such Project.

116 (b) Each such annual PSJI":;...,,t in Lieu of Taxes shall
be made after the end of the fiscal year established
for such Project, and shall be in an amount equal to
either (i) ten percent (lO() of the aggregate Shelter
Rent Charged bY' the Local A.uthority in respect to
such Project during such fiscal year, or (ii) the 8JlOUDt
permitted to be paid bY' applicable State law in effect
OIl the date such payment is _de, whichever amount
is the lover.
(c) The Local Authority shall distribute the P8.J'" "",ts
in Lieu of Taxes among the Taxing Bodies in the
proportion which the real. property taxes which would
have been paid to each Taxing Body far such year if'
the Project were not exeapt frOIl taxation bears to
the total real. property taxes which would have been
paid to all Taxing Bodies for such year if the
Project were not exempt frCIII taxation; PrOVided,
however, That no pa)'1llent for any year sha!.! be made
to any Taxing Body in excess of the 8Jloun.t of the
real property taxes which would have beeD paid to
such Taxing B~ for such year if the Project were
not exempt f'rma taxation.
(d) Upon failure of the Local Authority to _ke any
PaJI',.:.".t ;in Lieu of Taxes, no lien against any Project
or assets of the Local Authority shall attach, nor
shall any interest or penal ties accrue or attach 00
account thereof.
4. The Municipality agrees that, subsequent to the date
of initiation (as defined in the United States Housing Act of
1937, as _ended) of each Project and within fiTe years after
the completion thereof, or such further period as may be .
approved by the Goverrment, there has been or will be eliJlinatiOll
(as approved bY' the Govem.ent) by de.olitia, condeEation,
effective closing, or compaLsor.Y repair or improve_nt, of
UDsafe or insanitary dwelling units situated in the locality
or llletropolitan area in which such Project is located, aubata1tially
equal iD nUJlber to the nUllber of newly cODStructed dwelling
units provided by such Project; Provided,. That, where more
than one faDdly is living in an UDsat'e or insanitary dvelliDg
unit, the elimiDation of such unit shall count as the elill1.natiOD
of' units equal. to the nUJd:)er of f8llil1es acco_odated therein;
and PrOvided, f'urther, That, ttns paragraph 4 shall not apply
in the case of (i) any Project developed on the site of a
SlUJI cleared subsequent to July 15, 19"9, and that the dwelling
units elimnated by the clearance of the site of such Project
shall not be counted as elilrination for any other Project
or any other low-rent. housing project, or (11) any Project
located in a rural nonf'ara area.
5. During the period cOllll8ncing wi th the date of the
acquisitioa of any part of the site or sites ot any Project
and continuing 80 long as either (i) such Project is owned
by a public body or gov:..."" :;.,,,ta;L agency and is used for low-rent
hOtlsiDg purposes, or (ii) any contract between the Loc8l.

(a) Furnish or cause to be furnished to the Local
Authority and the tenants of such Project public
services and facilities of the same character and
to the s_ extent as are furnished from time to
time without cost or charge to other dwellings and
inhabi tants in the Municipality;
(b) Vacate such streets, rcsds, and alleys within
the area of .suchPl"oject as may be necessary in the
development thereof, and convey without charge to
the Local Authority such interest as the Numicipality
may have in such vacated areas, and, insofar as it
is law:fuJ.ly able to do so without cost or expense
to the Local Authority or to the Municipality,
cause to be removed from such vacated areas, insofar
as it may be necessary, all public or private utility
lines and equipment.
(c) Insofar as the Municipality mq lawfully do so,
(i) grant such deviati ons from the building code of
the MUnicipality as are reasonable and necessar,y to
promote economy and efficiency in the development
and administration of such Project, and at the
same tillle safeguard health and safety and (ii) make such
changes in any zoning of the site and surrounding
territory of such project as are reasonable and
necessary for the deve.lopment and protection of such
Project and the surrounding territory;
(d) Accept grants of easements necessary for the
development of such Project; and
(e) Cooperate with the Local Authority by such
other lawful action or ways as the Municipal i ty and
the Local Authority may find necessary in connection
wi th the development and administration of such Project.
6. In respect to any Project the Municipality further
agrees that within a reasonable time after receipt of a written
request therefor from the Local Authority:
(a) It will accept the dedication 6f all interior
streets, roads, alleys, and adjacent sidewalks within
the area of such Project, together with all storm
and sanitary sewer mains in such dedicated areas,
after the Local Authority, at its own expense~ has
completed the grading, impDovement, paving, and installation
thereof in accordance with specifications acceptable
to the Municipality;
(b) It will accept necessary dedications of land far,
and will grade, improve, pave, and provide sidewalks for,
all streets bounding such Project or necessar,y to
provide adequate access thereto (in consideration
whereof the Local Authority shall pay to the Munic:1paliV
such amount as would be assessed against the Project
site for such work if such site were privately owned); and
(c) It will provide, or cause to be provided, water
mains., leading to such Project and serving the
bounding streets thereof (in consideration whereof
the Local Authority shall pay to the Municipal ity
such amount as would be assessed against the Project
site for such work. if such site were privately owned).
7. If by reaSal of the Municipality's failure or refusal
to furnish or cause to be furnished any public services or
facilities which it has agreed hereunder to furnish or to
cause to be furbished to the Local Authority or tb the tenants
of any Project, the Local Authority incurs any expense to obtain
11 &uCh services or facilities then the Local Authority nqay deduct
the amount ot such expense from anT Payments in Lieu of Taxes
due or to become due to the Municipality in respect to any
Project or any other low-rent housing projects owned ar operated
by the Local Authority.
8. No Cooperation Agreement heretofore entered into between
the Municipality and tie Local Authority shall be construed to
apply to any Project covered by this Agreement.
9. So long as any contract between the Local Authority
and the Govem1llent for loans (inCluding preliminary loans)
or annual contributions, or both, in connection with any
Project remains in farce and effect, or so long as any bonds
issued in connection with any Proje ct or any monies due to the
Gove..,.,, ~nt in connection with any Project remain qpaid,
this Agreement shall not be abrogated, changed, or modified
without the consent of the Government. The privileges and obligations
of the Municipality hereunder shall remain in full force and
effect with respect to each Project so long as the beneficial
title to such Project is ield by the Local Authority or by the
Gove... .....0::.60 t or by any other public body or governmental agency
authorized by law to engage in the development or administratiOll
of low-rent housing projects. If at any time the beneficial
title to" or possession of" any Project is held by the Government"
other public body or governmental agency, the provisions hereof
shall inure to the benefit of any may be enforced by the Govem.nt,
such other public body or governmental agency.

On the 3rd day of July, 1969, the City Council of the City of Schertz,
Texas met in Regular Session. Mayor Roy W. Richard called the meeting to
order with the following named Aldermen present: Raymond G. Koym, Jimmie
v. Dunham, Edgar T. Marx and Leonard J. Kazben, absent: Malford C. Koch.
Also present Mrs. Ackermann, C.C. Crass,.c. Sturrock, Russell and Fred Rowell,

Minutes of June S, 12, 19, and 21) .meetings were appreoved as read.
Mr. Schoonover said he relieved Mr. Greer from duty as a policeman
at 4:):) P.M. on 20 June 1969.

Schertz application for p1enn:i.t. Will notify the City within 30 days.
Copy of letter from U.C. to Texas Water Quality Control Board re-
questing the hearing be .held in H.C. en sewer expansion permit.

in his subdivision.

found 398 sub-standard homes within the r:; mile radius of the city and
is therefore apply~ng for 120 units, 60 for the aged and 20 for renters,

The city concurs on the above. Both motions carried unanimously.
Planning commission having passed on the plat of Greenfield

Will advertise for bids on July 30 and August 6 - bids to be opened
Angust 14, 1969. This on a motion by Mr. Dunham, Seconded by Nr. 351 (P9

reference to a public hearing on Sewer nlants. HearinR will be at
7:30 P.M. in Rose Garden Elementary school in U.S. August 7.

and determines that to pay the operating expenses of the Citywhich

to adopt such reasona1D~measures, from time to time as are per-
mitted by law and which wlll tend to enhance the economic stabHity
and growth of the city and its environs by attracting the location
of new, and too expansion of old, indllstires therein; and

extraterrHorial jurisdiction of said city consisting of l4iJ.28acres
more or less in Comal County described in deed from Mapier ~o!?ers
et al to R.obert Baker dated September 8, 1949, recorded in Volume 91,
Page 578 of the Deed Recordsof C0mal County, Texas, and being out of
the Geo!l'g~ M. Dolson Survey No. 96, Absteact 120, Comal CO\Jnty, Texas,
a plat of which is hereto attached and nBrked Exhibit "a", and
~,t~MAS, such tract of land is suitable for an estabj,ishment of an in-
, dustiral area or district under the "Municilal Annexation Act",
Areicle 970a, Vernon's Annotated Texas Statutes, wherein provisions is
expressly made in Article I, Section S, for the establis ment in in-
dustirl districts by municjpalities in this State; and

Section 2. Such districts shall be numbered and be designated by metes and
bOlmds in accordance with terms hereandafter set out.
Section 3.It is hereby declared to be t he purpose of the City Counc; 1 of the
Gity of Schertz, Texas, to treat with BRCh area from time to ti me as may be
in the best interest of said City, and the attraction and maintenance of in-
dustry therein.

Section 4. The City Council of the City of Scherta, Texas, hereby reserves and
preserves all rights and powers of the City of Schertz with respect to such
industrial district, except as herein expressly otherwise stated.
Section 5. Should any port~on of the area herein de'Signated as an industrial
district be not actually s .tuated wi thin the extraterritorial jurisdiction of
the City of Schertz , Texas, and not therefore capable of being so designated, such
fact whall not affect the validity of this designation as to the remaining
pottion of said a rea.
Section 6.All ordinances or parts of ordinances heretofore adopted which are in
conflict with this ordinance are hereby repealed insofar as the same are in con-
flict with the provisions hereof.
Section, 7. No portion of the above described area shall be. designated an official
industrial district of the City of Schertz, Texas, until 'after the owners of s'ch
port: on of slJch area enter into contract with the City of Schertz, Texas, in
accordance with the terms of this ordina nce.
Section 8.Whenever sllch area is granted the privileges and rights of an in-
dustrial district as provided in the above nentioned statues and from that date
on the portion of such area shall retain i tsextraterritorial status as an in-
dustrial district and shall be immune from annexation by said City for a period
not to exceed seven (7) years unless extended by said City Council and the
owners of sl~h land in such industrial district.
Section 9. Such contract shall provide that the said industrial district must
conform with the ordinances of the said City as to subdivision of land and 10-
cat] on of all public utility services furnished by the City of Schertz, Texas,
and further that the location of drainage structures streeIB, alley and location
of utilities of such tract or tracts must be approved by the City Planning
C3mmi ssi on of the City of Sche rtz, Texas.
Section 10. Any structures on such site or sites nnst comply with the Building
Code of Schertz, Texas, the Plumbing Code of Schertz, Texas, and ilectnical
Code of Schertz, Texas, and all ordinances whether enumerated herein or not which
regulate or control the constructi on and maintenance of buildings and other
structures.
Section 11. No portion of the above descr5bed area shall be granted an indust-
rial distr ct status unless permanent and substantial improvements to be used
for munufactu....ing purposes are constr'~cted on that portion of the area to which
such status is to be granted w:thin 90 days after entering into the contraot
herein providing for and in the event such improvem ents are not completed wi thin
the specified time, then in that event such agreement concering extraterritorial
jurisdiction or such porti"n of such area shall be null and void and of no force
and effect.
Section 12. Such contract may prOVide for the furnishing of services by the City
of Schertz, Texas, such as water service, sewer service, garbage collection ser-
vice, fire protectjon and any other services to citizens furnished by the city

and conditi.ons as rray be provided by sl1ch contract and upon paym ent
of such fees and charges by tre owners of sl1ch protion of sllch area
as may be provided in such contract and as may be deemed appropriate
or proper in the sale discretion of the City CcuncH of the City of
Schertz, Texas.
Section 13. Prior to entermng into sllch contract with Ue owners of
any portion of the apave described area the said owners shall file
with the city secretary of the City of Schertz , Texas, one copy of the
blue print, plan sand sp ecification for the construction of improve-
ments to be errected theron. The owners of slch area must also
obtain a building permit in accordance with the Building Code of the
City of Scbert~, Texas, prior to construction of any improvements
as prescribed by the Building Code of the City of Sclertz, Texas.
Section lL. Owners of such area shall be cilowed such refunds for water
and sewer mains on or connect'ng such areas as may from time to time
be prnvided by the City Council of the City of Schertz, Texas, provided
however, that no refund shall be allowed for installat on of water
mains where no sewer mains have be installed.

in Schertz, Teyas, on the 4th day of September 1969.
Hayor Roy 1N. Richard called the neeting to order with the follow-
ing Aldermen present: Raymond G. Koym, Jimmie V. Dunham, and Edgar
T. Marx; Absent: Malford C. Koch and Leonard J. Kazben, also present
C.C. Cross, Fred and Russell Rowell, C.L. Sturrock, Mrs. E. Siskey and
Archie J. 'Voodward.

Aug. 1969, recomr~ending purchase of Fire Truck and urging cleanup of

City Attorney Louis T .Saegert, Russell and Fred Rcwell, George Gesche,

Resolution was read reappointing Mr. Ralph R. Ikels and r~orge
P. Bolton to serve 2 year terms on the Board of Commissioners from
October 21, 1969 thro'lf"h October 20, 1971. Motion was made by Mr.
Zaxben, and seconded by May. Koym to accept and approve the above.
The resolution carried unanimously.
Firemens pay was appr!wed for September.
Agreed by the council to keep Robert Arenas on the payroll.
He was injured while mowing at the City ;;lever Plant.
After discussion, a motion made by Mr. Koym, seconded by Mr. Marx.
was unanimously ca rried to advertise for bids on a new fire trllcj.
Bids will be opened Nov.~ 1969 at 8:00 P.M. at the City Hall.
City Welfare Director, Mrs. Glynn "J. Bennett, submitted a report
revealing much assistance has been rendered which involve many hours
and lots of travel. Mrs. Bennett is to be highly commended for her
work.
Letter was received from Chairman, Housing Authority, recomrrend-
ing Mr. Ed'rJard ~rinlanan be removed from the board and Mr. L~onard
M. Trent appointed as a replacement.
Plat of Schaefer new subdivision turned over to Planning I;t; Zon-
ing Commj ssirn. Request change to incl ude Trailer Park.
Letter from Coy Simmons requesting City Water .for Oak Forest.
Motion was made by Mr. Kazben and seconded by Mr. Koym to accept
req"ests for annexation and extension of city limits. The motion
was unanimously carried.
Hr. Saegert explained recommended amendmen~r. 199 to Sub...
division Ordinance. Motion was made by Mr. Kazben and seconded by
Mr. Marx to adoot same. The motion carried unanimously.

city limits of Schertz were read and approved unanimously.
