Regular meeting of the Schertz City Council held at the City Hall in Schertz, Texas,
on October 8, 1964.

present: Ralph R. Ikels, Raymond G. Koym, Ottomar A. Schertz, Malford C. Koch
and Clifford L. Rowell, Sr. Others present City Attorney Louis Saegert, Freddie and
Russell Rowell, Walter A. :)chertz, Archie J. Woodward, Hugo W. Ackermann, Mack Kardys
and Jimmie Dunham.
Minutes of the meeting on September 15, 196~ were read. On a motion by Mr. Koch
seconded by Mr. Koym the min1ltes be approved, motioo carried. Minutes of the meet-
ing on September 21, 1964 were read~ On a motion by Mr. Koch seconded by Mr. Koym
the minutes be approved, motion carried. minutes of the meeting on September 22, 1964,
were read. On a motion by Mr. Koym seconded by Mr. Rowell the minutes be approved,
motion carried. Minutes of the meeting on October 5, 1964 were read. On a motion by
Mr. Koch seconded by Mr. Schertz the minutes be approved, motion carried.
Mr. Ackermann informed the Council he is trying to establish a Mama Patrol for
the school children and is going to present the PTA for further assistance.
Also Mr. Ackermann stated the highway crossing lights have been changed and
they are Waiting on the Railroad Company now to hookup their part on the lights.
. Motion by Mr. Ikels seconded by Mr. Koym to pay Alamo Road Boring Inc. $2,251.60
for extra work on Highway and Railroad crossinl? at Lhe Oak Road. Motion unanimously

A request by residents for additional fire protection covering a portion of FirstJu l7J
and Second streets and Zuehl Road. And also on Selma Rood near Ira St. Hr. Rowell fl'1

for out of the Sewer System Construction Fund. Motion unanimously carried.
Mr. Jimmie Dunham complained of chug holes on Pecan Drive and also asked that (p f fa ~

Hr. :,Talter A. Schertz asked the opinion of the Cotmcil about selling lots which d
have been platted and recorded next to the Aviation Heights Trailer Courts, lots will 07,131

Mr. Rusch gave a report on the Ball Park and further work will be resumed on this." ~a
The Mayor asked if the Council wished to take any further action on the widening
of FM 78 thru the city. As too County Commissioners office has stated they cannot help
in the expense of obtaining the necessary land. That the county will continue to main-IA.I~1
tain the Highway thru the City. Mr. R~ell says they should not give up on the project 1.3 ~
as there may be some way to reach an agreement with the Railroad. There waS men tion
of reducing speed limits on the trains to try and get them to reconsider the plan. Mr.
Schertz and Mr. Koch were of the same opinion as Mr. Rowell. Mayor Richard then asked
if the Council agreed to notify by letter Guadal upe & Bexar counties and the Highway
Department, that, the City of Schertz cannot obtain the necessary land and cannot
finance the project and they are free to proceed with a By-Pass Rente or whatever,
they see fit to do. Mr. Rewell questioned the Mayor as to why vote on this as it was pre-
viously passed by the council and also by a vote of the citizens to build the road.
That he should tell the residents of the City hew it stands. Motion was made by Mr.
Ikels and seconded by Mr. Koym to write the letter of notification. Voting for noti-
fication _ Mr. Ikels and Mr. Koym, voting against notification none, Mr. Schertz, Mr.
Koch and Mr. R~ell abstained from voting.

The Boy Scouts wish to have a show using Snakes, Birds, and Alligators as a 1,111'1,

Mr. Schertz asked if there is some way to get too United Gas Corp. to furnish 64,/~1
gas for a new trailer project. He will work out a letter with the City Secretary to I&,1
the Gas Corp.
Mr. Riedel asked if there would be any objections to enlarging his store building
that might be in a city ordinance. No objections on this.

Section 1.
All collectors of garbage shall not ooerate vehicles in any of the alleys, of
the City of Scherlz, Texas, exceot in designated comrrercial districts for the col-
lection of ~arbage.
Section 2.
Eve ry mmer, occuoant, tenant or Ie ssee us ing or occupying any building or
structure within the corporate limits of the city, for residence, church, school,
college, lodge, commercial, business or othpr purposes shall provide and maintain metal
garbage and trash containers of sufficient number to hold the r:arbage and trash

that will normally accu~llate on the prem;ses. Such containers shall be of not
less than five (~) gallons capacity and not more than fifty-five (~~) gallons',
capacity, constructed of galVanized iron, tin or other suitable metal, with a
tight fitting lid or cover. The container must not have any inside structures,
such as inside bands or reinfoI'C'ing angles, or anything td. thin the container to pre..~--,
vent the free discharge of the contents. Cover for containers shall fit securely I I
so as to prevent unnecessary odors. Brass, leaves and branches need not be placed
in metal containers. ~
Section 3.
The lids or covers of all garbage and trash containers shall at all times be
kept secure and fastened so that flies and other insects may not have access to
the contents thereof. Sllch lids or covers shall only be removed whUe the con-
tainers or receptacles are being filled or emptied, as the case may be.
Section 4.
Any person, firm, or corporation viola ting any prOV1.S1.on of' this ordinance
shall be guilty of a misdemeanor and shall be fined not more than $1)0.00 for
each violation the reof. Each day that any of the provisions of this crdinance
are violated shall be deemed a separate offense.
Section '5.
All ordinances or parts of ordinances in conflict herewith are hereby re-
pealed.

officer.. After through discussion and consideration of same. On a motion by Mr.
Koch seconded by Mr. Schertz the ordinance be accepted and approved. Motion un-
animously carried. Motion by Mr. Koym seconded by Mr. RCMell re: not to accept
the resignation of Mr. Woodward and Mr. Woodward agreed to continue on as chief of

AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, CItEATING THE OFFICE OF FIRE CHIEF
'OF THE SCHE'?TZ VOLTTNTEER FIRE DEPARTMENT, SCHERTZ, TEXAS, AND PRESCRIBING THE
DUTIES AND RESPONSIBILITIES OF SUCH OFFIC~ AND PROVIDING FOR THE ASSIGNMENT
OF DnTIES OF SAME OFFICER IN THE SCHERTZ VOLUNTEER FIRE DEPARTMENT, SCHERTZ,
TEXAS.
BE IT ORDAINED BY '!HE CITY COUNCIL OF THE Clrry OF SCHERTZ, TEXAS:
Section 1.
The office of Chief of the Volunteer Fire Department of the City of Schertz,
Texas, is hereby created. Such officer shall be selected by the mayor with 0
the consent of the City Council upon the recommendation of the Board of Di-
rectors of the Schertz Volunteer Fire department.
Section 2.
There shall be selected four assistants to the fire chief who, with the fire

chief, and under his direction, shall be responsible for the training and mobili-
zation of the Volunteer Fire Department, for too purpose of combating fires and
performing all other duties which shall be assigned to the Volunteer Fire Depart-
ment of the City of Schertz, Texas.
Section 3.
The fire chief shall be directly responsible to the Mayor and the City Cooncil
of the City of Schertz, Texas, and the assistant fire chiefs shall be responsible
to the fire chief only.
Section 4.
The fire chief shall have full authority to assign to the assistant fire chiefs
such duties as he m~ deem appropriate or necessary.
Section 5. .
The fire chief and assistant fire chiefs shall be duly responsible and shall
have flul control over the use, care and maintenance of the fire-fighting equip-
ment of the City of Schertz, Texas. The fire chief and the fire chief's assistants
shall be responsible for, and have full authori tor, incident to conduction of fire
drills and maintaining a training schedule for the members of the Volunteer Fire
Department of the City of Schertz, Texas. Drills for the members of the Volunteer
Fire DepartTrent of the City of Schertz, Texas, shall be conducted each and every
month in accordance with the requirements of the Texas Stat.e Board of Insurance.
Section 6.
T~ fire chief shall be fully responsible for and shall have full authori tor
and control over all members of the Schertz Volunteer Fire Department and any
other citizens or persons present at any fire in the City of Schertz, Texas. In
the event that the fire chief is not present at any fire the assistant fire chief
who first arrives at the scene of the fire shall take charge and remain in charge
until the chief arrives.
Section 7.
The Fire Chief of the Volunteer Fire Department of the City of Schertz, Texas,
or his a ssistants in his absence, shall have full authority to restrict access to
the vicinity of any fire to such persons as he my see fit and such fire chief may
arrange such traffic controls as he my deem ne cessary.
Section 8.
This ordinance shall be effective from and after its passage.
Section 9.
All ordinances or parts of ordinances in conflict herewith are hereby repealed.

day of November, 1964.
Mayor Roy W. Richard called the meeting to order with the following named Alder-
men present: Clifford L. Rewell, Raymond G. Koym, Ottomar A. Schertz, Malford C. Koch,
and Raloh R. Ikels and City Attorney, Louis Saegert, also present were Tom Stewart,
Howard Schneider, Archie Woodward, Fritz Rusch, Armando Luna, Manuel Rendon, Jay Dyal
and Marshal Hugo Ackermann.

Contracts of agreement on Urban Project have been signed and mailed to Texas

Marshal Ackermann stated he thought the City waS covered by protection while he
was away as Mr. Jay Dyal had been accepted by the Council as a depty and he had also Ii L
asked Mr. H",ard Schneider, constable to look after any needed help in law enforce- ~T.16~
mente Also that he had notified Mayor Richard he would be a1Aay from the City. Dis- \
cussion at this time was can the depty make a legal arrest or charge if he is not paid
by the City. Resolution as passed was Mr. Ackermann would pay his replacement. This
is not legal. Also, Mr. Dya1 had not signed his oath of office or been sworn in and
bonded. This was taken care of tonight by the City Secretary. The law reads that a
law enforcement officer must be paid at least $40.00 per month to make arrests and
prosecution legal. Mr. Sae~ert will check to see ,if this a)plies to appointive city
jobs. And it was determined tte City needs more deputies and asked for recommendations.
Mrs. Ackermann stated that some one from Schertz on the Council had passed the word
in Universal City that Mr. Ackermann would be discharged upon his return for not,
having a replacement and not telling anyone he was leaving.
Mayor Richard asked the Council members to contact some people and talk to them ~4.1~1
in regard to serving on the Planning Commission and recommend them at the next meet- -t I
ing. Five members are needed. I~
Mr. Luna has secured an Easement crossing the Gas Line in order for tte City "If 16((
to run water to his property. He will work with Mr. Rordell in trying to line up I ~ ~
connections on the sewer. ~
Mr. Rusch read a survey as made and recommended by a committee on Fire Protec-
tion he also had been to Austin and reported all improvements.

The $2r;0.00 a110ted for Civil Defense has not been used and it was agreed by
the Council to use the money for Radio Communications for the City and place the
unit in the City Hall whereby the Marshal can be contacted or other offices
(Sheriff, etc) in case of emerqency. Mr. Ackermann says he can get the unit
and it will be installed at once. Personnel in the city office will get instruc-
tions in using same.
Question arose as to cleaning around fire plugs. Mr. Rusch asked if the city
or fire department should do this job and it was then decided tl'B city should take
care of the cleaning.
Mr. Koym and Mr. Rowell reported they had inspected the building cwned by
Mr. Pfeil and in their opinion the city should not buy it, due to excessive re-
modeling cost.
Should the City obtain a Tax NUll'ber? Report on this later.
Motion by Mr. Koym seconded by Mr. Schertz to pay Mr. Wal tisperger $66.43 for
paving material.
Mr. Rowell asked if City Ordinances were for all and if so why could any
one person be exempt from complying with them? His opinion was anytime Mr. Acker-
mann was to be away he should notify the Mayor and the Citv Secretary. ' He was
displeased with the way animals were picked up and held without a proper place to
keep them and, there are to many killed without sometines holding them for ob-
servation. He thought we should have Dr. Waldrip board them.

bout requesting a signal of some kind be installed by the Railroad Co. after
much discussion on the subject it was recommended the city notify the Rail-
road that an ordinance will be proposed for consideration of reducing the speed
limit on trains at the Jarluary 7th meeting if they care to have anyone attend.

Minutes of Council meetings on December 3 and e were approved as read. (
Mayor Richard announced that the City was considering an Ordinance to control ~6,~"
the speed of trains better fmr safety. The City does not know for sure what to do /31
as there is definite need of improvements on this. Mr. Carpenter was introduced.
He is assistant Supt. of Safety for the Railroad. Mr. Carpenter gave facts and
figures relating to accidents. They have found that speed is not a large cause
of accidents as most of these occur at a speed of less than 30 MPH. irJ'arning lights
and bell system do not prevent crossing accidents but there are more at this type of
warning signal. A nar;man or arm gates that lrn..rer are the best prevr.mtive. Cannot
install gates at Live Oak as this would cost about $11,000.00. Mr. Carpenter stated
he had intended to ask the City to raise the speed limit to 70 MFR. Mr. Burnett
said he would get action on hooking up the Highway signal 1 ight with the Railroad
light. Mr. Gibson Division Engineer agreed if the City would allow him 90 days,
he wO'lld have a new crossing in at Live Oak Road approximately 32 fe.et vide with an
improved a0proach of heavy timbers and all the same as the one at First St. and High-
way 78. The council agreed to allow tre requested 90 days. Mr. Gibson als 0 informed
the Council the Co. does not give leases for more than one yearhcwever they do
have renewal options and he would obtain the full information on the vacant lot
at the corner of First and Main Streets and let us know in a few days.
Mr. Rewell asked Mr. Carpenter to relate to the Council the information he had ?3,# ~
givep to him in T'egard to the extra footage for widening Highway 78. Mr. Carpenter :;e
said the Company was concerned with pr0bably a drainage hazard, and there are under- /
ground cables that would have to be moved at consideraable expense. -;l
Mr,s. Wanda Koch complained about a Water Bill on which the meter was out of ~.O'fr
order and the amount was same8S prior month. She complained of Mr. Riedel not being )31
hooked up on water and sewer, why force some to comply and overlook others. Most
cities charge only the minimum as this is not the fault of the consumer. Mayor
Richard appointed Mr. Koch, Mr. Rowell and Mr. Schertz to review a Ordinance e1 and
recommend' any changes, they deem necessary.
Mr. Rowell agreed all citizens should have to comply with ordinances. Mayor
Richard stated the individual has private water and sewer system. Attorney Saegert
,will c~ck the laws as pertaining to this type of project in regards to sewer,
water or/and health. It is reported .severa1 citizens have remarked they have not

The meeting was called to order by Mayor Richard. Those present were Alder-
men: Clofford L. Rowell, Raymond G. Koym Malford Koch and Ralph Ikels. Others
present were Marshal Ackermann, Louis Saegert, Fred Rcwe11, 1.fal ter Schertz, Charles l

LO'lis Saegert read a petition in reference to the contamination of the ,,_
Cibolo Creek. Motion by Clifford Rowell seconded by Taymond Koym that above

Hugo Ackermann read a letter from San Antonio River Authority in reference
to fil'!ld test made of water in Cibolo Cre k.
Mayor Richard read letter from San Antonio River Authority with reference
to setting a meeting with the Council. It was agreed to check with them to
see if March 24, 196~ would suit them.
Mayor Richard read the financial statement of the waterworks and sewer system.
City Council authorized that Raymond Koym secure Bone one to plow and plant
grass in the City Park a-ea. Motion by Malford Koch seconded by Clifford Rowell,
motion carried. '
Mayor Roy W. Richard turned the meeting over to Mayor Pro tem Ralph Ike1s.
Mr. Charlie Cross presented a plat of Unit One of Lone Oak Subdivision.
The City Council had no objection to the proposed subdivision and instructed
Louis Saegert to draw up the necessary resolution.

After a through discussion on ordinances, on a motion by Mr. Ikels seconded
by Mr. Schertz, that Mr. Saegert engage the services of Mr. Olson, an attorney to

Since a report was given Wednesday", 2nd of June to the Planning Comission on

1. In reference to street repairs, Mr. Schertz was asked to contact Mr. ElCM81l
I t., D0 and see about getting a maintainer" they fe1i- this would accomplish more than the
~l'~ ~ present methods. The Council agreed to pay as much as $500 to $1,,000. Several
different bad streets were mentioned. .
Mr. Marshall gave an interesting report on. the progress of the Softball League
and other recreational activities. Mr. Marshall said" he would try to provide most -
sports that the children showed interest in. He has the school's perm:lBsion' to
use the tennis courts and the gym. It was decided that each player furnish their 0
own tennis equipJlEnt and games such as horseshoes and volleyball would be furnished
for the participants. The softball league at the present had approximately five
teams" Mr. Marshall reported and he plans a JlEeting in the near future with these
teams for further planning. Mr. MartEall espec:1ally wanted the Council's per-
mission to use the diamond two or possible three nights a week for league gaJ'll! S _
this was granted by the Council. It was decided and agreed that tl'ere be a charge
of $3.00 per night for lights and $1.00 per person to be in tl'e league. . Mr.
Marshall suggested a Schertz Team with t.ach member sponsored by a Schertz Merchant.

On a motion by Mr. Perryman, seconded by Mr. "Koym., that Mr. Marshall be allowed

carried. It was stated that the Chamber of COTl1llerce or ifFIll might run the con-

Mr. Saegert read a letter and two ordinances he rece'ived from William A. Olson
in regards to our present sewer ordinances. There was some discussi6n on this and
the council will consider the Ordinance::!'.
It was noted the next City Council Ileeting will be held on the 17th of June 1965
and the Planning Commission will meet on the 22nd day of .June 196".
Mayor Richard read a letter he had received from Mack Kardys. Mr. Kardys
suggested, a sign be placed below the stop light at First and FM 78 crossing which would) O'D
enable a car to come to a full stop then 'turn right on a red .light. He was upset t:J:,:
over the slow moveITent of car<! during the busy hours. Mayor Richard stated this light ~~C
was not ours to control, but that the Highway Dept. took care of it; therefore the "

Section 3. Tl'E importance of this ord:inance creates an el1ergency and an
imperative public necessity that the rule requiring ordinances to be read at three

After careful consideration and discussion on a motion by Mr. Koym, seconded
by Mr. Perryman, the tax rate for The City ~ Schertz be set at$.90 per hunclred
valuation as follows: $.60 to General Fund;'IJ.2L) to Sewer System Bonds arrl $.O~ to
Fire Engine warrants. The motion was unanimously approved and carried.
Mr. J. R. Robinson infonned Mayor Richard he would like to open one or
perhaps two more streets for building in The Westland Park Sub-Division. V.A. and
F.R.i. requires addi tional work or rebuilding of Oak Street as the main entrCllce
and the Council will ask Mr. Cross to run a survey on same and give an estimate of
the costs. Mr. Robinson has indicated he will pay a portion of the costs.
Notice from Miss Elbel requesting leave from 9th to 21st of August. And
notice Mr. Koym will be out of the City 7th and 8th of August.

AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS PROHIBITING THE DEFACEMENT OR PAINTlNG
OF BUILDINGS AND FENCES OR OTHER PROPERTY AND PROHIBITIN G THE PLACING OF ANY SIGN,
PLACAR.D, NOTICE OR ADVERTISING DEVICE ON UTILITY POLES AND PROVIDING A PENALTY
THEREFOR.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
Section 1.
It shall be unlawful for any person to post, paint or otherwise exhibit on any
building, fence, bulletin board or other property not belonging to or controlled
by him, without the permission of the person owning or controlling the same, any
advertisement, poster, bill or other notice or sign.
~ection 2.
It shall be unlawful for any person to place any sign, placard, notice,
bulletin board or advertising device of any nature or kind whatsoever upon or
against any pole erected, used or maintained' in any street in the city for tl'e
support of any telegraph or telephone wire, or electric lanp, light or wire. It
shall be the duty of the city marshal and deputy to remove any advertising natter
attached to or against any pole in violation of this section.
Section 3. [l
Any person, firm or corporation who shall violate any of the terms of this
ordinance upon conviction thereof in the corporation court shall be fined not less -.J
than $1.00 nor more than $200.00 for each such of'fense and each violation and each
day thereof shall be deened a failure to comply with the terms of this ordina'lce
and shall constitute a separate offense.
Section 4.
It is the intention of the City Council that this ordinance, and every provision
thereof, shall be cCllsidered separable; and the invalidity of any section, clause,
provision, or part or portion of any section, clause or provision of this brdinance
shall not affect the validity of any other portion of this ordinance.
