The follo~~ng Aldermen were present: Elgin Beck, Geo. P. Bolton, A. O. Haverlah and Walter A. Schertz. City Attorney Louis Saegert, Fire Marshal Fritz Rusch and City Marshal Hugo W. Ackermann were also present. TPe minutes of the last regular meeting of September 7, 1961 were read, and on a motion by Geo. P. Bolton, seconded by Elgin Beck, the minutes were unanimously approved. On a motion by Elgin Beck, seconded by Geo. P. Bolton, that the easement across the railroad property at Live Oak Road be accepted. Motion was unanimously approved. On a motion by Geo. P. Motion was unanimously approved. t:l51 ~/, o~.) /?~ FIRE LIMITS ORDINANCE #57 BE IT ORDAINED BY THE CITY COlmCIL OF THE CITY OF SCHERTZ, TEXAS, as follows: SECTION 1. FIRE LIMITS: The following shall be and are hereby declared to be th3 fire limits: AREA NO. ONE (1) BEGINNING at intersection of E8st line of Lindbergh Ave. and North line of Main Street in Schertz, Texas; 'fl!ENCE in an eastern direction wi th N line of Main Street to SE corner of tract of land conyeyed to H.P. Thulemeyer by deed recorded in Vol. 175, page 113 of Guadalupe County Deed Recor ds ; THENCE in a Northern direction with east line of lot conveyed to H. P. SECTION 2. PERMITS AND INSPECTIONS: No wall, structure, building, or part thereof, shall hereafter be built, enlarged, or altered, until a plan of the proposed work, together with a state- ment of materials to be used, shall have been submitted to the Building Inspector, who shall, if in accordance with the provisions herein contained, issue a written permit ln trip11cate for the o " ~. Structures hereafter erected without a permit, or not in conformity with this ordinance, ~ball be removed. No building shall be moved from without to within the fire limits, nor from one location to another within the fire limits until a permit shall have been issued therefor. No permit shall be issued unless such construction is in accordance with this ordinance. The designated Building Inspector shall inspect, as often as practical, construction in progress to see that all provisions of this ordinance are being complied wi the SECTION 3. CONSTRUCTION REQ,UIRED WITHIN T:IE :?IRE LIMITS: No building or structure of wooden, ironclad (whether on wood or metal supports), stucco, or veneer type construction, or any building whose walls contain ,~od supports, shall be permitted except as indicated in Section 4. No building shall be built, enlarged, or altered here- after, except in accordance with this ordinance. The thickness of walls shall be not less than as given below: Brick walls shall be not less than 12 inches thick except that small one-story buildings with floor areas of 750 square feet or less may have walls of 8 inches thick. Reinforced concrete walls may be three-fourths of the thick- ness of brick walls but in no case less than 8 inches. Hollow building tile may be us ed as filler walls provided such walls be supported on reinforced concrete or brick pillars or columns spaced not more than 16 feet apart; walls to be not less than 12 inches thick. Small one-story buildings of less than 500 square feet" floor area may have walls of 8 inch hollow building tile. Solid stone walls shall be 4 inches thicker than brick walls for like construction. All exterior walls, party walls, and division fire walls shall have parapets extending at least eighteen inches above the roof, and said parapets shall be at least twelve inches thick, except where eight inch walls are permitted as above, in which case parapets may be eight inches thick. SECTION 4. FRAME BUILDING IN FIRE LIMITS: The following frame structures are permissible in the fire limits: a. Temporary one-story frame buildings for the use of builders. b. Wooden fences not over 8 feet high without roof or cover. SECTION 5. ROOFS: All buildings or structures hereafter constructed in the fire limits shall have incombustible roof coverings. No roofing on an existing roof shall be renewed or repaired to a greater extent than 10% of the roof surface, except in conformity with this ordinance, and in no instance shall more than one permit be issued each existing build! ng in anyone year. SECTION 6. REPAIRS AND ADDITIONS: Any existing building wi thin the fire limit s which hereafter may be damaged by fire, decay, or other- wise, to an amount greater than 50% of its present value, exclusive of the foundation, shall not be repaired or rebuilt, but shall be removed. Extensions, remodeling, or additions to existing buildings shall not be considered as repairs, and shall not be permitted except when conforming with Section 3 of this ordinance. 118 SECTION 7. ARBITRATION: Whenever an application ror permit to repair any existing building already looated within the fire limits 0 is m,ade by any person or firm, and the City Counc il end the applicant disagree on the extent of repairs to be made, and a permit is denied by the designated Building Inspector, then the City Councilor Commission shall appoint a competent end disinterested person, and the applicant shall appoint a third member, and the$e said three persons shall appraise the building, examine the plan of the proposed work, and the statement of materials and labor to be used in the repairing or rebuilding of said building, and make a signed written report of their findings to the City Counc11 or Commission. If such report reflects clearly -that said rebu11ding or repair1ng would be a violat10n of this ord1nancel then such application for permit shall be denied by the City Gouncil or Commiss10n, and if such report rerlects clearly that said rebuilding or repa1ring would be a violation of this ordinance, then 'such . application for permit shall be denied by the City Councilor Commisston, and if such report reflects that the person seek1ng said permit has complied w1th said ordinance, and the requested rebuilding or repairing is not in violat10n of said ordinance, then said City Councilor Commission shall issue a permit for the proposed rebuilding ore repairing. SECTION 8, VALIDITY OF ORDINANCE. If any section, paragraph, subdivision, clause, phrase or provision of this ordinance shall be adjudged inva11d or held unconstitutional, the s~e shall not 0 afrec~ the validity of this ordinance as a whole, or any part or . provision thereof, other than the part so dec1ded to be invalid or unconst1 tutional. SECTION 9. PENALTIES: Any person, firm or corporat10n, violating this Ordiaance shall be guilty of a m1sdemeanor, and upon conviction shall be fined a sum of not more than one hundred ($100.00) dollars. Each and every day or fractIon of a day during wh1ch this ordinance is violated shall be considered a separate offense and punishable as such. SECTION 10. provided in Inspector a (2) of this FEES: Upon application for each permit as heretofore Section Two (2) the applicant shall pay to, the Building fee of $5.00 for each permi t required in section Two ord1nance.
