Regulror Meeting or the City Council of Schertz, Texas was
held on October 6, 1961.
The Meeting was called to order by !~ayor Roy U. Richard.
The follo~~ng Aldermen were present: Elgin Beck, Geo. P.
Bolton, A. O. Haverlah and Walter A. Schertz.
City Attorney Louis Saegert, Fire Marshal Fritz Rusch and
City Marshal Hugo W. Ackermann were also present.
TPe minutes of the last regular meeting of September 7, 1961
were read, and on a motion by Geo. P. Bolton, seconded by Elgin
Beck, the minutes were unanimously approved.
On a motion by Elgin Beck, seconded by Geo. P. Bolton, that
the easement across the railroad property at Live Oak Road be
accepted. Motion was unanimously approved.
On a motion by Geo. P. Bolton, seconded by A. O. Haverlah, that ~ I,t'~?-

BE IT ORDAINED BY THE CITY COlmCIL OF THE CITY OF SCHERTZ,
TEXAS, as follows:
SECTION 1. FIRE LIMITS: The following shall be and are hereby
declared to be th3 fire limits:
AREA NO. ONE (1)
BEGINNING at intersection of E8st line of Lindbergh Ave.
and North line of Main Street in Schertz, Texas;
'fl!ENCE in an eastern direction wi th N line of Main Street to
SE corner of tract of land conyeyed to H.P. Thulemeyer by
deed recorded in Vol. 175, page 113 of Guadalupe County
Deed Recor ds ;
THENCE in a Northern direction with east line of lot conveyed
to H. P. Thulemeyer by deed recorded in Vol. 175, page 113 of
the deed records of Guadalupe County, ~exas, a distance so
than an extension of the North line of that certain tract of
land conveyed to Malford Koch by deed recorded in Vo. 236,
page 313 of the deed records of Guadalupe County, Texas

SECTION 2. PERMITS AND INSPECTIONS: No wall, structure,
building, or part thereof, shall hereafter be built, enlarged, or
altered, until a plan of the proposed work, together with a state-
ment of materials to be used, shall have been submitted to the
Building Inspector, who shall, if in accordance with the provisions
herein contained, issue a written permit ln trip11cate for the

proposed work. Permits to be kept on file with the City Secretary.
Structures hereafter erected without a permit, or not in
conformity with this ordinance, ~ball be removed.
No building shall be moved from without to within the fire
limits, nor from one location to another within the fire limits until
a permit shall have been issued therefor. No permit shall be issued
unless such construction is in accordance with this ordinance.
The designated Building Inspector shall inspect, as often as
practical, construction in progress to see that all provisions of
this ordinance are being complied wi the
SECTION 3. CONSTRUCTION REQ,UIRED WITHIN T:IE :?IRE LIMITS: No building
or structure of wooden, ironclad (whether on wood or metal supports),
stucco, or veneer type construction, or any building whose walls
contain ,~od supports, shall be permitted except as indicated in
Section 4. No building shall be built, enlarged, or altered here-
after, except in accordance with this ordinance.
The thickness of walls shall be not less than as given below:
Brick walls shall be not less than 12 inches thick except that
small one-story buildings with floor areas of 750 square feet or
less may have walls of 8 inches thick.
Reinforced concrete walls may be three-fourths of the thick-
ness of brick walls but in no case less than 8 inches.
Hollow building tile may be us ed as filler walls provided such
walls be supported on reinforced concrete or brick pillars or
columns spaced not more than 16 feet apart; walls to be not less
than 12 inches thick. Small one-story buildings of less than 500
square feet" floor area may have walls of 8 inch hollow building tile.
Solid stone walls shall be 4 inches thicker than brick walls for
like construction. All exterior walls, party walls, and division
fire walls shall have parapets extending at least eighteen inches
above the roof, and said parapets shall be at least twelve inches
thick, except where eight inch walls are permitted as above, in
which case parapets may be eight inches thick.
SECTION 4. FRAME BUILDING IN FIRE LIMITS: The following frame
structures are permissible in the fire limits:
a. Temporary one-story frame buildings for the use of builders.
b. Wooden fences not over 8 feet high without roof or cover.
SECTION 5. ROOFS: All buildings or structures hereafter constructed
in the fire limits shall have incombustible roof coverings.
No roofing on an existing roof shall be renewed or repaired to
a greater extent than 10% of the roof surface, except in conformity
with this ordinance, and in no instance shall more than one permit
be issued each existing build! ng in anyone year.
SECTION 6. REPAIRS AND ADDITIONS: Any existing building wi thin the
fire limit s which hereafter may be damaged by fire, decay, or other-
wise, to an amount greater than 50% of its present value, exclusive
of the foundation, shall not be repaired or rebuilt, but shall be
removed.
Extensions, remodeling, or additions to existing buildings
shall not be considered as repairs, and shall not be permitted except
when conforming with Section 3 of this ordinance.

SECTION 7. ARBITRATION: Whenever an application ror permit to
repair any existing building already looated within the fire limits 0
is m,ade by any person or firm, and the City Counc il end the
applicant disagree on the extent of repairs to be made, and a
permit is denied by the designated Building Inspector, then the
City Councilor Commission shall appoint a competent end disinterested
person, and the applicant shall appoint a third member, and the$e
said three persons shall appraise the building, examine the plan of
the proposed work, and the statement of materials and labor to be
used in the repairing or rebuilding of said building, and make a
signed written report of their findings to the City Counc11 or
Commission. If such report reflects clearly -that said rebu11ding
or repair1ng would be a violat10n of this ord1nancel then such
application for permit shall be denied by the City Gouncil or
Commiss10n, and if such report rerlects clearly that said rebuilding
or repa1ring would be a violation of this ordinance, then 'such .
application for permit shall be denied by the City Councilor
Commisston, and if such report reflects that the person seek1ng
said permit has complied w1th said ordinance, and the requested
rebuilding or repairing is not in violat10n of said ordinance, then
said City Councilor Commission shall issue a permit for the
proposed rebuilding ore repairing.
SECTION 8, VALIDITY OF ORDINANCE. If any section, paragraph,
subdivision, clause, phrase or provision of this ordinance shall
be adjudged inva11d or held unconstitutional, the s~e shall not 0
afrec~ the validity of this ordinance as a whole, or any part or .
provision thereof, other than the part so dec1ded to be invalid
or unconst1 tutional.
SECTION 9. PENALTIES: Any person, firm or corporat10n, violating
this Ordiaance shall be guilty of a m1sdemeanor, and upon conviction
shall be fined a sum of not more than one hundred ($100.00) dollars.
Each and every day or fractIon of a day during wh1ch this ordinance
is violated shall be considered a separate offense and punishable as
such.

This ordinance shall become effective, upon passage, end

The meeting was called to order by Mayor Roy W. Richard.
The following named Aldermen were present: Elgin Beck, Geo. P. Bolton, W.E.Ebert
and A.O.Haverlah.
Minutes of the meetings of 11/2/61, 11/16/61, 12/7/61, 12/16/61 and 12/28/61 were
read and on a motion byGeo. P. Bolton seconded by W.E.Ebert they be approved as
as read. The motion was unanimously approved.
Mr. Berry and Mr. Grooms owner and attorney of some property in Cibolo, Texas
appeared before the Council asking for their approval of sub-dividing said property

ING WITH THE CALENDAR YEAR 1962; CONFIRMING THE DETERMINATION
HERETOFORE MADE ON THIS EFFECT, AND REPEALING ALL ORDINANCES
AND PARTS OF ORDINANCES IN CONFLICT.
WHEREAS, the City Council of the City of Schertz, Texas, having de-
termined to timely assess for taxation all property subject to taxation
within the limits of said City, commencing onJanuary 1, 1962, by and
through its own Tax Assessor-Collector instead of by and through the
Tax Assessor-Collector of Guadalupe County, as provided by previously
enacted ordinances of said City, and having heretofore duly appointed
G. W. Pickrell as the assessor and collector or taxes of said City,
now desires to confirm the establishment and adoption, for the pur-
poses of taxation in said City, the calendar year as the City's fiscal
year for such purposes; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:

That the calendar year, for the purposes of taxation in the City
of Schertz, Texas, for each and every year, commencing with the cal-
endar year 1962, shall be, and the same is hereby adopted as the City's
fiscal year.
II
That the ordinances 'heretofore enacted by the City Council re-
lating to the assessment of all taxable property in the City of Schertz,
for the year 1962, including the appointment of G. W. Pickrell as the
Tax Assessor-Collector of said City, and including all other actions
taken and made by the City Council of said City, all being with the
intent, puppose and design of estab1i~hing as the City's fiscal year,
each calendar year commencing with the calendar year 1962, shall be,
and the same are hereby confirmed.
III
That all ordinances or parts of ordinances heretofore passed
and enacted by the City Council of the City of Schertz, Texas, in
conflict with this ordinance, shall be, and the same are hereby
repealed,to the extent of such conflict.

WHEREAS, the City Council of the City of Schertz heretofore on
November 16, 1961, passed and adopted an ordinance assigning to the recorder
of the Corpotation Court of the City of Schertz (among other duties) all of
the duties and granting to him all of the powers of the Tax Assessor-Coll-
ector of the City of Schertz, Texas; and did provide for the giving of bond
for the faithful performance of his duties; and
WHEREAS, G.W.Pickre11, being the recorder of the Corporation Court
of said City, and having the duties and powers of Tax Assessor-Collector of

said City conferred upon him pursurant to the aforesaid ordinance, and having
made good and sufficient bond in the amount of $5,000.00 for the faithful per-
formance of his duties as requied by the aforementioned ordinance, did timely
enter upon his duties, and, at all times material and subsequent thereto, has 1--'
been exercising the power and duties of Tax Assessor-Collector of the City of oJ I
Schertz pursuant to the laws of the State, including particularly those pro-
vided by Chapter 5, Title 28 of the Revised Civil Statutes, 1925, as amended,
other than the collection of certain taxes by the 'County Tax Assessor, said
taxes being due said City from tax levies previously made by said City; and
WHEREAS, the City Council of the City of SChertz, Texas, did, among
other-things, determine by and in an ordinance passed and adopted on December
28, 1961, that each person, partnership and corporation owning property within
the city limit s of the City of Schertz, Texas, shall, between the first day
of January and the first dq of April of each year hand to the City Tax Ass-
essor-Collector a full and complete sworn inventory of the property possessed
or controlled by him, her or them, within the said limits of the first day of
January of the current year; and
WHEREAS, this City Council finds that the aforesaid Tax Assessor-Collector
has been endeavoring to get persons owning taxable property in the City of Schertz
to render such property in conformity with the above referred to ordinance, how-
ever, it is the opinion of this City Council that further public notice should
be given for the purpose of better informing all such persons owning taxable
property in the City of their rights and duty to render their property for tax:-
atioD; accordingly, it is the desire of this City Council to authorize the giving
of the notice hereinafter provided for; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
That the f'indings and determinations made and recited in the preamble 0
hereof' shall be, and each of them is hereby made a part of this ordinance, and
as to each such f'inding and determination so made in the preamble hereof it
shall be and is hereby confirmed.

That G. W. Pickrell being a sui table person to hold, occupy and exercise the office
and all powers and duties of Tax Assessor-Collector for the City of Schertz, Texas,
his appointment to said orfice and making bond therefo~ are hereby in all respects
confirmed and approved.

That, G.W.Pickrell, Tax Assessor-Collector of said City shall be, and he is
hereby authorized to execute a notice in the substantial form hereinafter set forth,
which he shall cause to be published in the SEGUIN ENTERPRISE once a week for four
(4) consecutive weeks, and the date of the first publication to be made promptly
after the enactment of this ordinance, such notice to be and read substantially
as follows:

as provided by previously enacted ordinancesof Said City, and pursuant thereto
appointed G.W.Pickrell as the assessor and collector of taxes of said City, and
conferred upon him the powers and duties 01 such office, now desires to further firmly
establish that all taxable property situated within the City of Schertz, Texas, as of
January 1st of each Y9U and every calendar year hereafter, including the calendar
year 1962, shall be rendered as provided for by and in this ordinance and in accord-
ance with the laws of the State of Texas;
and
WHEREAS, it is further the desire of this City Council to fix and determine
when ad valorem taxes shall be and become due and payable; to further provide that
no discount shall be allowed for early payment of taxes; nor shall split tax pay-
ments or partial payment privileges on current taxes be allowed as is presently
allowed by law under Articles 7255b and 7336 levised Civil Statutes, 1925, as amended
for payment of State and County Taxes; and to further provide for penalties, interest.
and costs on deliquent taxes; and
WHEREAS, it is also the desire of this City Council to specifically except and
provide that the Tax Assessor-Collector of Guahlupe County shall continue to receive
and collect all ad valorem taxes due the City of Schertz up to and including September
30, 1962, for the reason that said County Tax Assessor-Collector has, pursuant to prev-
ious ordinances enacted by the City of Schertz, Texas, been collecting such taxes; it
being the option of this Council in this respect that it would result in confusion to
the taxpayers of the City to require them to make any payments of texas to the newly
appointed Tax Assessor-Collector of the City until the collection of current taxes for
the year 1962 of the City become due on October 1, 1962; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
I
That all persons owning property, subject to taxation, within the limits of
the City of Schertz, Texas, on January 1st of each and every calendar year hereafter,
including the calendar year 1962, shall have the right to assess or render such prop-
erty for taxation as of January 1st of each year with the Tax Assessor-Collector of
said City, at his office in the City of Schertz, Texas, such right to assess and render
such property being for and during the period between January 1 and April 1 of each
such calendar year, and there shall be and there is hereby imposed upon each such per-
son owning such taxable property in the said City of Schertz the duty of assessing or
rendering such property for taxation with the City's Tax Assessor-Collector between
January 1 and April 1 of each, year and evry calendar year.
II
That ad valorem taxes levied and assessed on taxable property for each cal-
endar year shall be and become due and payable on October 1 of the calendar year in
which the levy and assessment is made, and all such taxes not paid on or before Jan-
uary 31 next succeeding the year for which the levy is made, shall be and became del-
inquent on February 1 of the calendar year next succeeding the year for which such
levy is 'made; and all such taxes shall be paid to the Assessor-Collector of taxes of
the City of Schertz at his office in the City of Schertz, Texas; PROVIDED HOWEVER,
that until ad valorem taxes levied for the year 1962 become due and payable on October
1, 1962, it is hereby specially determined and provided that vthe Tax Assessor-Collector
of Guadalupe County shall continue to collect all ad valorem taxes due and owing to the
City of Schertz, but commencing on October 1, 1962 and thereafter the Tax Assessor-
Collector of the City of Schertz shall collect all ad valorem taxes, both current and
delinquent, due and to become due the City of Schertz, and commencing on ad after
October 1, 1962 the Tax Assessor-Collector of Guadalupe County shall no longer collect
any taxes for or due or owing to the City of Schertz.
III
That commencing with ad valorem taxes levied bI the City of Schertz for the
calendar year 1962 and for each calendar year thereafter (until and unless changed by

That all ad valorem taxes, as and when the same shall be and become delinquent
shall bear interest at the rate of six per cent (6%) per annum from the date of their
delinquency.

That if any person shall fail to pay to the City of Schertz all of the ad val-
orem taxes levied and iJlposed by' the City of Schertz upon him or his property for a
calendar ,-ear, on or before the 31st clay of Januar)" next succeeding the year for which the le~
lev,y is made, then the following penaly shall be payable on such taxes as are delinquent
to-wit: /if
1% paid at any time during the month of Febru&r7 next succeeding the year for
which the levy is made;
2% if paid at any time during the month of March next succeeding the -rear for
which the leVY' is made;
3% if' paid at any time during the month of April next succeeding the ,-ear for
which the leV)" is made;
4% if paid at any time during the month of Mq next ,succeeding the year for
which the lev,y is made;
5% if' paid at any time during the month of June next succeeding the year for
which the leV)" is made; and
8% if' paid on or after the 1st day of July next succeeding the year for which
the levy is made; and
that all costs in addition thereto that may be imposed by' law shall be, and the SSE
are hereby' charged and imposed in addition to penalties and interest accniDg under the
provisions hereof against any person or property delinquent in such taxes.
That on any list prepared by' ~ Tax Assessor-Collector for the City of Schertz_[l
showing delinquent taxes owed the City of Schertz, it shall not be neces88l"T for such -.J
Assessor-Collector of taxes to show on any such list the penalties. interest and costs
accrued against any land, lots and/or other property delinquent in taxes, but in each
and every instance all such penal ties, interest and costs shall be and l"ellain a charge
imposed hereby', with the same force and effect as if' entered on any such list of del-
inquent taxes,and the Assessor-Collector of taxes for said Ci,* shall calculate and
chargeall such penal ties, interest and costs OIl all delinquent tax statements or del-
inquent tax reports issued by' him.
VII
That the provisions of this ordinance are severable and in the event that
any provision hereof shall be declared invalid or unconstituticmal by' a court of cOlllp-
etent jurisdiction in this State, it is he~by' declared that the remaining provisions
hereof would have been enacted notwithstanding such judicial deterllinaticm of the in-
validity of any particular provision or provisions in any respect; and all reuining
valid provisions hereof shall continue to be and rellain in full* force and effect.
VIII
That all ordilnances or parts of ordinances heretofore passed and adopted by
the City Council of the City of Schertz, Texas, and now in effect in conflict herewith,
shall be, and the S8lll8 are hereby' repealed to the extent of such conflict.

The following named Aldermen were present: Elgin Beck, Geo. P, Bolton, W.E.Ebert

Mayor Richard brought up the question of What would happen if the city agreed to
a franchise and then later wanted to purchase the rights or system to opera"te the:ir
. own utilities. The directors said this would have no bearing on the franchise.
The City Council asked for time to consider the proposition further.

An invitation to a dinner at Ramada Inn was read.
Mayor Richard read a letter from the Board of Directors of the G.V.E.C. who ?,'"

franchise with their company. It was agreed by the Council that they would invite 1 i, 0
them to meet here at Schertz on the 12th of March at 8:00 P.M.
Mr. Robinson presented to the Council a proposed building program that he
wants to get started here at Schertz and it must guarantee the V .A.there will be
water for the new houses. This brought up the question of the City of Schertz
washing to buy the Water Works, Attorney Jandt the attorney for the Water Co. was
present and read a proposed franchise for 50 years for the, Water Co. assuring all c,~,c?3
that the contract etc would read whereby the City could purchase at any time and (11
also they could go ahead and furnish water to the new building project. After much
consideratiQn and discussion on a motion by Oeo. P. Bolton seconded by W.E.Ebert
that the City grant the Water Works a 50 year franchise. Motion unanimously carried.

Regular Meeting of the City Council of the City of Schertz, Texas was held at
8:00 P.M. on the 5th day of April, 1962.
The meeting was called to order by Mayor Roy Richard and the following named
Aldermen were preserm: Ralph Ikels, W.E.Ebert, Elgin BeCk, Geo. P. Bolton and A.D.
Haverlah. Also present were Mr. Winters and Mr. Edmundson from the Southwestern Bell
Telephone Co. Who spoke to the Council on rates and service, and zoning.
Mayor Richard read a letter from the Schertz State Bank as a bidder on being "J, t!J<?Co
considered as a Depository for the city on the Sewer Bonds. And Schertz Bank also I?-l
recommended the Frost National Bank of San Antonio for this. There was also a letter
from the Frost Bank stating they would like to handle the accODIlt. The Council agreed
that the Frost Bank would be accepted.
Letter from the HHFA on the loan application was read st8ting all is in order.
A letter to Mr. .;;)eligmann from the State Health JJepartment, with a letter from '?,O~?
Mr. Seligmann recommending the change as required on his contract as the Engineer on I
the sewer project. On a motion by Mr. Bolton seconded by Mr. Beck that the recommended I;).' ~
amendment be made and passed. With copies being forwarded at once to the HHFA also.

1962 at 8.00 P.M. The meeting was called to order by Mqor Roy W. Richard with thefoll-

Minutes of Special Meeting held on April 19, 1962 was read and on a motion by Ralph
Ikels seconded by W .~. that minutes be approved as read. Motion carried.
A motion was made by Mr. Ralph lkels seconded by Mr. W.E.Ebert that G.W.Pickrell be
appointed for a two year term as Corporation Court Judge, Secretary-Treasurer and Tax~.J ,O,..s

Proposed Budget for the City for the year 1962 was read and compared with 1961 bud,,~.o~'
get, after much discussion on a motion by Mr. R.R.Cosby seconded by Mr. Geo.P.Bolton I '-If)
,that the budget for 1962 be set for $28,868.25 accepted and approved. Motion was unim-

All Tax assessments rendered and unrendered were read as approved by the Equalization V
Board., Mr. Spurlock, Mr,Z~rman and Mr. Odo Reidel were present and they asked the tJ,~rl
council to have a recheck made on the Utilities Companies properties as they seeEd to d
think they were listed as being to low. Mayor Richard will request the Equalization
Board to reconsider these at once. The board will report on same on the 7th of May 1962.
Mayor Richard read a proposed Ordinance on Sanitary Sewer Construction Account and~ ~~q
naming Frost National Bank of San Antonio, Texas as the depository and setting up an (, r) 1
account of $1,500.00 to start.
Mr. Tom Stewart asked the council to take into consideration SOJOO caanges on the ~~IOtflfj
rates for Electricians Licenses. The council agreed to study this and report at later It,. D
date .

Companies, bondS, bids and all things pertaining to the project were checked and
at,ter JIllch discus,sion found to be in order, it seemingly pointed to Mr. Riesenecker
being the low bidder and the one to be awarded the contract. However, Alderman Blair a
ne~ member of the ~iversal City council objected to any- kind of a bridge and stated that
he would not approved of anything other than a concrete slab crossing- this was also the
opinion of AIderman Collins of Universal City. After much discussion of Mayor Parkhurst
of Univers,al. City and one ,other Alderman trom there Mr. Daubie no agreement could be
reached and Mqor Parkhurst asked that he be allowed to get his entire council together
and would call May'or Richard tomorrOW' on the decesion.
Mayor Richard read a letter from Mr. Saegert city atto1'l18Y relative to the leg-
ality of Mr. Fritz Rusch and Mr. Hugo Reicherzer serving as Fire Marshall and Assistant
Fire Marshall and also being elected members of the School Board. No constitutional or
statutor,r law opposing the above dual jobs have eVer been enacted as a law in the State
of Texas, it is therefore legal for them to serve on each. On a motion by Mr. Cosby and
seconded by Mr. Ikels that Mr. Rusch be appointed Fire Marshall and Mr. Reicherzer be

engineers on the project explained how all plans must be approved by FHA and Va on

Mayor Richard called the meeting to order at 8.00 P.M. with the following named

Mr. Gilbert Koppin appeared with his electrician Ira Hecox about some wiring to be
done at the First Baptist ~hurch and which Mr. Alva Rhodes the City F:lectricial Insp-
ector will not allow them to install as it does not conform with the National Code. and
the City Ordinance. Mr. Rusch Fire Marshall also says the work does not meet the ~tand-
ard requirements or the State Fire Laws. ai"ter much discussion the Council could riot

by Rauscher, Pierce and Company., Inc. for the $29,000 of said bonds maturing on June 1,

ice of Sale, was the highest and best bid submitted for said bonds; and that such bid

Upon presentation to the Registrar of ony or the registered bonds as to principal,

representative, such bond shall be transferred upon such books.

bonds hereby issued may treat the bearer of any of the bonds issued hereunder, which
shall not be r'2gistered as to principal, and ma:y treat the bearer of any coupons apper-
tmning to any of the bonds issued hereunder, whether or not such bonds shall be so reg-
istered as to 9r:L'1cipal only, as the; absolute owner of such bond or co~pon"as the case

DEPOSITORY FOR SAID CONSTRUCTION ACCOUNT; PROVIDING THAT CERTAIN MONIES

the city in firiancing the construction of said sanitary sewer system, whiah has been
designated by said Housing and Home Finance Agency as Project No. PFL-TEX-238" and ..

project be sent to FFHA at Ft. Worth for clearence and approval.Motion carried.
It was suggested the Secy write Mr. Kramer about the condition of the Railroad
crossing. Also a letter to Mr. Carl S. Braunig about the Highwq light not workingall
the tiE, and ask for a surveY' to be made on the 'traffic conditions 'on '1518 past the
High School to get whatever signs or what might be recoDlll8nded by them.
Marshall Ackermann informed the Council that he would not be able to perform
- h1a duties on his present expense and pq and asked for more money. After much dis-
