02-11-1975 20~) ~) , SPECIAL MEETING OF THE CITY COUNCIL FEBRUARY 11, 1975 The Schertz City Council convened in Special Session, Tues- day, February 11, 1975, at 7:07 P.M., in the Council Chambers, 401 Oak Street, with the following members present: Mayor Robert C. Bueker, presiding; Mrs. Nell G. Funk, Donald J. Seeba, Tom Koo1e and Robert E. Schwartz. Absent: Mrs. Bobbie L. Koch. Also City Manager Denny L. Arnold, City Secretary June G. Krause, Financial Advisor Tom Anderlitch and City Engineer Howard Gaddis. #1 BOND SALES: Mr. Tom Ander1itch discussed with the Council the issueing of bonds and suggested the con- sideration of issueing the $350,000 additional required for the upper tier water system. After considerable discussion, Mr. Seeba moved to authorize Mr. Tom Ander1itch to advertise for the sale of $400,000 Water and Sewer Revenue Bonds and $235,000 General Obligation Bonds, providing that the City can get a contract to obligate Homecraft to tie in the line they will need prior to construction. Mrs. Funk seconded the motion which carried with the fo11owing'-vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, Mr. Schwartz._ NAYS: None I' r /5 Mr. Anderlitch requested the Council reserve February 26, 1975 as a Special Session meeting to open and award bids on the bonds. #2 COMMUNITY DEVELOPMENT: Mr. Darrell Farr, CD Coordinator, presented the final draft of the Cuulluuni ty Development application for Council's consideration. "... it, it, * * * * * * * * * * * * * * * PUBLIC HEARING OF THE CITY COUNCIL FEBRUARY 11, 1975 A Public Hearing was held by the City Council in the Council Chambers, 401 Oak Street, on Tuesday, February 11, 1975, at 8:30 P.M. with the following members present: Mayor Robert Bueker, presiding; Mrs. Nell G. Funk, Donald J. Seeba, Tom Koole, Robert Schwartz. Absent: Mrs. Bobbie L. Koch. The purpose of the Public Hearing was for presentation and dis- cussion of the final draft of the Cuulluunity Development application. There being no citizens present wishing to question any portion of the application, Mayor Bueker declared the Public Hearing closed at 8:33 P.M. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * 204 The Mayor reconvened the Special Meeting of the City Council at 8:33 P.M. 7," Ie. : Mr. Seeba moved to authorize the Mayor to sign the finally typed CVlwuuni ty Development application. Mrs. Funk seconded the motion which carried with the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Koole, and Mr. Schwartz. NAYS: None If4 RANDOLPH FAIR: Mr. Arnold briefed the Council on a request received from the Randolph Chamber of CV~llerce to use the covered slab in the park for the 1975 Randolph Fair. At this time, Mr. Arnold was only wanting to know if the Council wanted to consider the request; the details could be worked out later. Council requested Mr. Arnold obtain details from the Chamber of Cvwwerce and bring them back to the Council for consideration. If5 WATER & SEWER REBATE PAYMENTS: Mr. Arnold presented some proposals as made by Mr. John Schaefer at a meeting held on February 4, 1975~ concern- ing the settlement of the Village Subdivisions water and sewer rebate payments and his street paving participation payment. Council agreed with certain parts of the proposals and disagreed with others. The City Manager was asked to contact Mr. Schaefer and present the Council's counter proposals. Mayor Bueker said there was a verbal agreement between Mr. Schaefer and the Council stating that he would not get rebates for utilities on Village 3 and 4. It was suggested that the City get written and signed statements from the former Mayor and Councilmembers who were on the Council when this verbal agreement was made. If6 DEER HAVEN SEWER LINES: Mayor Bueker brought the Council" up to date on the sewer collection lines in Deer Haven. Concerning the easement for this line, Mr. Theis said the City could take him to court before he would grant an easement;but Mr. Smith, 1116 Antler Drive, said he would donate the entire 12 feet for easement if the City would build a gravel road over the top of the easement so he could have access over the easement to his garage and connect his house to the sewer line. Mr. Arnold gave an estimate for this work as follows: $200 to put in the sewer line and $200 for the gravel road. The alternatives for obtaining the easement over the Beck property are: (1) City put in the 527' line to Mr. Beck's house and he will donate all the land for the easement. (2) condemnation proceedings which would cost the City in excess of $10,000. (3) Pay Mr. Beck $10,000 for the easement or (4) give Mr. Beck a variance whereby he would not have to connect until a line is closer to his house. Mr. Graham of CCMA has been negotiating with Mr. Beck in behalf of the City and Mrs. Funk suggested Mr. Arnold should be present at these meetings. 205 #7 ETJ SETTLEMENT WITH CIBOLO: Mr. Baldwin, Asst. City Manager, showed Council on a map how he had taken annexation ordinances from both Schertz and Cibolo showing city limit lines for each city with dates of passage of each ardinance. With this information the Council came to a common agreement of the ETJ line. The agreed with Mayor Sch1ather of Cibo1o that Schertz present their proposed ETJ boundaries to Cibolo. After Cibolo has had time to agree on a boundary, the two cities will meet to arrive at an agreement. #8 GENERAL DISCUSSION: Mayor Bueker read a contract agreement between the City of Schertz and the CVllullunity Council of South Central Texas, Inc. Council agreed with the wording with the exception that it should contain the statement: "This agreement should continue in force for a period of one year from date". Mr. Arnold reported there were 12 people present for the first meeting of the Senior Citizen Program. They will have an organizational meeting February 21, at 10:00 AM in the Council Chambers.
