03-11-1975 21~ SPECIAL MEETING OF THE CITY COUNCIL MARCH 11, 1975 The Schertz City Council convened in Special Session, Tues- day, March 11, 1975, at 7:17 P.M. in the Council Chambers, 401 Oak Street with the following members present: Mayor Robert C. Bueker, presiding; Donald J. Seeba, Robert E. Schwartz and Mrs. Bobbie L. Koch. Absent: Mrs. Nell G. Funk and Tom Koole. Also City Manager Denny L. Arnold and City Secretary June G. Krause. Mayor Bueker suggested that in order to save time, since the Cibolo Council nor City Engineer had arrived, the Council move to item No. 4 on the agenda. #4 Council discussion and consideration of personal Tax Policy. Mr. Arnold explained that contrary to remarks that have been made to City staff by businessmen of the cvww~nity, we are not instituting a new policy. The Tax Assessor/Collector, by mailing our rendition requests to businesses, is merely giving all businessmen an opportunity to render their personal property as they see fit. Mr. Baldwin, CityTax A/C, summarized the tax law which states that everyone will render their personal as well as real property and stated that he would accept all renditions presented to him. He gave a history of the City tax rolls from 1962 to 1974, show- ing personal property taxes have been assessed and paid by businessmen since 1962. Mr. Arnold stated that only Council can set or change policy and the Tax Department is only contin- uing with the policy already set by Council, several year ago. The general concensus of the businessmen present (including Dr. Mays, Ed Zinnnermann, John Sippel) was that the personal property tax should be done away with or the City would be taxing new and small businesses out of the City. Mayor Bueker explained that he would like for the full Council to be present when a decision on this subject is made; therefore he requested to delay decision until the regular meeting of March 18, 1975. #1 ETJ meeting with Cibolo City Council. Cibolo City Council including Mayor Schlather, Ed Ling, Mr. Niemietz, Mr. Kierum, Mrs. Lieck and Mrs. Dykes, and City Secretary Linda Ling, arrived at 7:47 P.M. Mayor Schlather, speaking for the entire Cioolo Council, said he felt the extra-territorial jurisdiction line as shown by the City of Schertz is fair and he wanted to compliment Schertz City Council on a good job. Since both Councils were in agree- ment as to the ETJ line, they decided to try to have every thing for finalization and passage of an ordinance at their meetings of April 1st and 3rd, 1975. 21~ #2 RESOLUTION: City Engineer Howard Gaddis introduced the following captioned resolution, which was read in full: A RESOLUTION DIRECTING THE CALLING FOR BIDS FOR "WATER STORAGE FACILITIES FOR THE CITY OF SCHERTZ, TEXAS After full consideration and discussion by the Council, the following motion was made: Mr. Seeba moved to pass the above captioned Resolution calling 3'1- 'i'S for bids on water storage tanks of various types. Mr. Schwartz I , seconded the motion which carried with the following vote: AYES: Mr. Seeba, Mr. Schwartz and Mrs. Koch. NAYS: None #3 Swimming Pool Design. Mr. Gaddis had contacted a swimming pool specialists on designs/to discuss the pool with the Council, but he was unable to be pre- sent at this meeting. #5 School sewer rate: Mr. Gaddis briefed the Council on the different ways cities charge for commercial use sewage. The average for schools is 25 gallons per student per day Council accepted Mr. Gaddis' offer of the use of his personal flow meter to be placed on the highschoo1 line to obtain an accurate measurement for cV111parrison. The results of this metering and a decision will be made at the April 1, 1975 meeting. #6 Use of School Tax Records: Mr. Baldwin, Tax A/C briefed the Council on a letter he had written the president of the S-C-UC ISD Board requesting the use of their appraisal records by the City of Schertz. After discussion at their Board meeting, a ~otion was made, seconded~ and carried to allow the City Tax Office to obtain copies of'''' their records at a cost of $3.00 per card plus man hour and copy costs. After Discussion, Mr. Seeba, moved to go back to the School Board and renegotiate stating the City will pay for managerial 39-7:S costs with no mention of per card cost. Mr. Schwartz seconded the motion which carried with the following vote: AYES: Mr. Seeba, Mr. Schwartz and Mrs. Koch. NAYS: None. #7 Discussion of Fuel Adjustment Charges. Council discussed the various ways the citizens of Schertz could protest effectively the high cost of fuel adjustment-charges. 220 There was present a group of citizens with samples of two petitions they were going to circulate; one to the Railroad CUluwission and one to the United States and Texas representatives. Mrs. Koch moved to adopt a resolution to be signed by the Ilfv1!f Mayor and each individual Councilmember with a copy of the ~v petitions of citizens as an attachment. Mr. Seeba seconded the motion which carried with the following vote: AYES: Mr. Seeba, Mr. Schwartz and Mrs. Koch. NAYS: None #8 GENERAL DISCUSSION: (1) Mayor Bueker advised that as a result of Council decision of the meeting of March 4, 1975, he had invited Mr. Naylor to the next workshop meeting of the Council. (2) The Mayor read an amendment to the amendment Cibolo Creek Municipal Authority is proposing to original legis- lative Act which created them as an authority. This was just a discussion item and is to be voted on at the March 18, 1975 meeting, after Council has opportunity to study it. (3) Another item for Council consideration was a letter from the City of Cibolo concerning the availability of water to them after their sewer system is cuwpleted. There being no further business to come before the Council at this time, Mayor Bueker declared the meeting adjourned at 10:10 P.M.
