REGULAR MEETING OF THE CITY COUNCIL
MAY 6, 1975
The Schertz City Council convened in Regular Session, Tuesday,
May 6, 1975, at 7:00 P.M. in the Council Chambers, 401 Oak Street
with the following members present: Mayor Robert C. Bueker, pre-
siding; Nell G. Funk, Donald J. Seeba, Walter F. Schneider, Ed L.
Sharpe and Gail Hyatt. City Manager Denny L. Arnold, City Secre-
tary June G. Krause, City Engineer Howard W. Gaddis and City
Attorney Richard W. Harris.
#1 APPROVAL OF MINUTES: A. Mrs. Funk moved to accept
the minutes of the Regular Meet-
ing of April 15, 1975 as presented. Mr. Schneider seconded the
motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and
Mrs. Hyatt.
NAYS: None
B. Mr. Seeba requested a clarification of the motion he made
concerning Item 115 of the minutes of the Special Meeting of
April 29, 1975 to read as follows: "Mr. Seeba moved to pay
$21,399.45 to Cibo1o Creek Municiap1 Authority at this time and
further study the request at the May 6th meeting."
Mr. Seeba then moved the minutes of the Special Meeting of April 29,
1975 be accepted as amended. Mrs. Hyatt seconded the motion which
carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.
NAYS: None
#2 HEARING OF RESIDENTS: A. Mr. Jesse Graham requested
time to answer any questions
when Item No. 6 is brought before the Council.
B. Mr. Jeff Duffield, 1020 Fawn Drive, wanted to know vhat route
the sewer line is taking in Deer Haven and would it be routed so
that the trees would be saved. Engineer Gaddis felt sure this
could be accomplished. In answer to Mr. Duffield's question,
Mayor Bueker stated there were no plans at this time to widen
or rebuild the streets in Deer Haven.
C. Mr. Robert Strange briefed the Council on the current member-
ship and activities of Buffalo Valley Youth Association. He read
a letter of request to name the softball fields in the City Park
after certain citizens. Mr. Strange was told the Council would
consider his request after doing some investigating to see if the
fields had ever been named.
D. Mr. Bill Gillum introduced himself as an attorney new to the
area with offices in Universal City and the Persimmon Hills Apart-
ments.

#3 PLANNING & ZONING MINUTES: A. Mrs. Funk moved to
accept the minutes of
the Special meeting of the P&Z of April 14, 1975. Mr.
Schneider seconded the motion which carried with the following
vote:

Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.

B. Mr. Seeba moved to accept the minutes of the Regular
Meeting of the P&Z of April 23, 1975. Mrs. Funk seconded
the motion which carried with the following vote:
AYES: Mr~. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.
NAYS: None
#4 BID OPENING AND AWARD: Mr. Gaddis opened the bids
on the Water Storage Facil-
ities and the Mayor read them as follows:

Mayor Bueker declared Universal Tank Co. as the apparent low
bidder. Mr. Gaddis suggested the Council ,consider the differ-
ence in the two lowest bids comparing the number of days for
cv~pletion as well as the base bid.

After discussion, Mrs. Funk move~ to table decision on this bid
until the Special Meeting of May 13th. Mrs. Hyatt seconded the
motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and
Mrs. Hyatt.
NAYS: None
#5 POLICE RESERVE OFFICER: Mayor Bueker introduced Mrs.
Joan Woods, wife of Schertz
Police Officer Ron Woods, who has completed the Police Reserve
Course, being first in a class of 16 members.
Mr. Seeva moved to appoint Mrs. Joan Woods to the Police Reserve
H~ Force of the City of Schertz. Mrs. Funk seconded the motion

and Mrs. Hyatt.

#6 CC}~ PAY}illNT: Council thoroughly discussed the paying
to Cibolo Creek Hunicipal Authority the
City's portion of the Deer Haven/Oalc Forest sewer line.
The problem of trees being removed on a previous sewer line in-
stallation ,vas discussed and Hr. Graham, General Hanager of CCNA,
said he had not authorized the removal of the trees on Bubbling
Springs Road so felt no responsibility to replace them. Nr.
Harris felt there could be no legal action taken as the trees
were planted on City right-of-way.
Mayor Bueker suggested the Council be thinking about a solution
to this problem which will be brought before them at the next
Regular meeting.
Mr. Seeba moved to pay CCMA the City's portion of the Deer Have/
Oak Forest sewer line in the amount of S30,883.69 as specified M~
on CCMA statement of April 24, 1975. Mrs. Hyatt seconded the I I
motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.
NAYS: None

#7 RESOLUTION: - authorizing Homecraft CorpoTationto form
a Municipal Utility District and #8 HOMECRAFT CONTRACT - discussion
of a Water Sales contract with Homecraft - were discussed at length
as one item. It was Council decision not to pass the resolution
until acceptance of the contract by both Homecraft and the City.
Council then considered and discussed the revised contract as
presented by Homecraft and formulated a counter-proposal to be
sent back to them.

Mr. Seeba moved to table Item In and Item If8 until the Special '7'::.~/-
Meeting on May 13, 1975, when Council will have a chance to review
all the changes suggested. Mr. Sharpe seconded the motion which
carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.
NAYS: None
If9 ORDINANCE: Mr. Seeba moved to approve the Urban Renewal
project. In order for the ordinance to be
read and considered, Mr. Seeba withdrew his motion.
The Mayor introduced the following captioned ordinance which was
read in full by the City Manager. Sr. Seeba moved that said I.' / - ~! L:'"
ordinance be considered by the Council as an emergency measure,
which motion was seconded by Mrs. Funk. Whereupon said motion
was fully discussed and considered. The Mayor put the motion to
consider said ordinance as an emergency measure to the members
of the City Council and said motion carried by the following vote:
AYES: Mrs. Funk, Mr. See ba , Mr. Sharpe and Mrs. Hyatt.
NAYS: Mr. Schneider

The Mayor then introduced the hereinafter set forth ordinance
as an emergency measure. Thereupon it was moved by Mr. Seeba
,,( and seconded by Mrs. Funk that said ordinance be finally passed
and adopted. The Mayor put the motion to a vote of the members

ORDINANCE NO. 75-U-lO
AN ORDINANCE ACCEPTING PROJECT IMPROVEMENTS
CONSTRUCTED BY THE URBAN RENEWAL A.:ENCY
ON STREETS AND PARK LAND PREVIOUSLY DEDI-
CATED TO THE CITY OF SCHERTZ, TEXAS, AND-
DECLARING AN EMERGENCY.
#10 ORDINANCE: The first reading of an ordinance providing
for licensing and regulation of General
Contractors was tabled at the request of the City Manager until
the Regular Meeting of the City Council of May 20th so that Council
may receive copies of the proposed ordinance for review and study.

Mayor. Mr. Sharpe moved that said ordinance be considered by the
Council. Mrs. Hyatt seconded the motion which was carried by
the following vote:

and Mrs. Hyatt.

The following captioned ordinance was then discussed and fully
considered by the Council:
AN ORDINANCE SETTING A TIME, DATE AND PLACE
FOR A PUBLIC HEARING ON THE PROPOSED ANNEXA-
TION OF ONE CERTAIN TRACT OF LAND CONTAINING
266.035 ACRES OUT OF GUADALUPE COUNTY, TEXAS
BY THE CITY OF SCHERTZ, TEXAS, AND AUTHORIZING
AND DIRECTING THE CITY SECRETARY TO PUBLISH
NOTICE OF SUCH PUBLIC HEARING
Attorney Harris asked that the reference to the publishing of
the notice of public hearing be changed to read "be published
one time in a newspaper" instead of "once a week" as read.
Whereupon Mr. Sharpe moved that said ordinance be further con-
sidered at the next regular meeting of the City Council to be
held on the 20th day of May, 1975, which motion was seconded
by Mrs. Hyatt and which carried by the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.

CHANGING THE CLASSIFICATION OF ONE CERTAIN TRACT
OF LAND FROM R-2 TO R-4 DESIGNATION, AND REFLECT-
ING SAID CHANGE ON CERTAIN ZONING DISTRICT MAPS,
IN ACCORDANCE WITH SECTION 9 AND SECTION 12 OF
THE ZONING ORDINANCE
Whereupon Mr. Seeba moved that said ordinance be further con-
sidered at the next regular meeting of the City Council to be
held on the 20th day of May, 1975, which motion was seconded
by Mrs. Funk and which carried by the following vote: '

PLAN TO BE IMPLEMENTED IN THE CASE OF AN
IMPENDING OR RECENT DISASTER OCCURING IN THE
CITY OF SCHERTZ; SAID PLAN SETTING FORTH THE
AUTHORITY, PURPOSE, OBJECTIVES, SITUATIONS AND
ASSUMPTIONS, ASSIGNMENT OF RESPONSIBILITIES,
SUPPORT, RESOURCE MANAGEMENT, IMPLEMENTATION,
AND OTHER RELATED FUNCTIONS TO BE PERFORMED
IN THE EVENT OF A DISASTER.

Schneider seconded the motion which carried with the following
vote:

1f15 TEXAS SECURITIES PAYMENT: Mayor Bueker explained
the statement from Texas
Securities Corp. for bond sales, including $7,762.50 for
Utility Bond System and $5,150.00 for General Obligation Bonds
for a total amount of $12,912.50.
Mrs. Funk moved to pay Texas Securities Corporation for bond
sales in the amount of $12,912.50. Mr. Schneider seconded the
motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.
NAYS: None
1f16 ATTORNEY l"~~: Mr. Arnold requested Council approval
to pay the City Attorney for legal
fees incurred for the South Drainage Ditch easement preparation.
Mr. Seeba moved to approve payment of the $220.50 to the City
Attorney for the South Drainage Ditch easement preparation.
Mrs. Funk seconded the motion which carried with the following
vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.

1f17 PLANNING CONSULTANT: Cv..........mity Develvp1l1ent Coordi-
nator Darrell Farr gave a
brief presentation concerning his request for consideration of
contracting with a planning consultant for preparation of an
application of Community Development monies for Rittimann Addition.
After discussioE, Council decided rather than use Schertz monies
for an area outside the City, to first submit an application
and if necessary tb later consider contracting with a consulting
firm.
#19 PREVIOUSLY TABLED SUBJECTS: (8) News1etter-
After careful consider-
ation of the proposed newsletter, Council had only one addition
to make; namely, add the name of Judy Letbetter to item 9.
Mr. Seeba moved to accept the newsletter as presented with the
one addition as stated above. Mr. Schneider seconded the motion
which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe
and Mrs. Hyatt.
NAYS: None/

(11) Mr. Arnold presented Policv Letter No. 75-P-3, stating
that members of the P&Z and BOA be real property owners within
the City; and Po1ic~ Letter No. 75-P-4, which states the news-
letter shall contain only items approved by unanimous consent of
Council members present and voting at the first meeting of each
month.

Mr. Sharpe moved to approve both Policy Letter No. 75-P-3 and :;,,1 Ij:"
Policy Letter No. 75-P-4 as written. Mr. Schneider seconded
the motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe

#18 GENERAL DISCUSSION: Mr. Arnold reported the first
day of the Spring Cleanup was
the hardest and longest day ever with 30 loads being picked up.
Because of difficulty involved, a new policy of having the
limbs and shrubs cut and bundled will be instituted in the future
area pickups. He also announced the cleanup crew can always
use more help.
1120 ADJOURNMENT: Mrs. Funk moved the meeting be adjourned
at 12:18 A.M. Mrs. Hyatt seconded the
moti on which carried unanimously.
