07-08-1975 274 I i'\ ') \ \ \o~ ~~ ,,< ,\ SPECIAL SESSION OF THE CITY COUNCIL JULY 8, 1975 The Schertz City Council convened in Special Session, July 8, 1975, at 7:05 P.M. in the Council Chambers, 401 Oak Street with the following members present: Mayor Robert C. Bueker, presiding; Nell G. Funk, Donald J. Seeba, Walter F. Schneider, Ed L. Sharpe and Gail Hyatt. Also City Manager Denny L. Arnold and City Secretary June G. Krause. #1 PUBLIC HEALTH: Mr. Charles DeViney, Director of Family Planning for the Community Council of South Central Texas, Inc., addressed the Council relative to formation of a Public (County) Health unit. Mr. DeViney had previously made a similar presentation to the Guadalupe County Commissioners. who said they were unable to fully finance a unit but would give $8,000, if. another $8,000 could be obtained from the four incorporated cities in the County or any other source. The City of Seguin is~ interested if the other cities would give their fare share. Mr. DeViney has meetings set with Marion and Cibolo in the near future and will report back to the City Manager of the outcome. At this time, Council agreed to further consider the request at that time. #2 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by the City Manager. Mr. Sharpe moved that said ordinance be considered by the Council. Mrs. Hyatt seconded the motion which was carried by the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt. NAYS: None The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF ONE CERTAIN TRACT OF LAND CONTAINING 15.50 ACRES OUT OF GUADALUPE COUNTY, TEXAS, AND AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARING Whereupon Mr. Sharpe moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 15th day of July, which motion was seconded by Mrs. Hyatt and which carried by the following vote: AYES: NAYS: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs, Hyatt. None #3 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by the City Manager. Mrs. Hyatt moved that said ordinance be considered by the Council. Mr. Seeba seconded the motion which was carried by the following vote: AYES: NAYS: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt. None 275 The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF ONE CERTAIN TRACT OF LAND CONTAINING 19.9 ACRES OUT OF GUADALUPE COUNTY, TEXAS, AND AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARING Whereupon Mrs. Hyatt moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 15th day of July, 1975, which motion was seconded by Mr. Seeba and which carried by the follow- ing vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt. NAYS: None #4 ORDINANCE: The Mayor introduced the following captioned ordinance IJ/ '> ,- which was read in full by the City Manager. Mr. Sharpe moved that said ordinance be considered by the Council as an emergency measure, which motion was seconded by Mr. Seeba. Whereupon said motion was fully dis- cussed and considered. The Mayor put the motion to consider said ordinance as an emergency measure to the members of the City Council and said motion was approved and adopted by the following vote: AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt. NAYS: None The Mayor then introduced the hereinafter set forth ordinance as an emergency measure. Thereupon it was moved by Mr. Seeba and seconded by Mr. Schneider that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: 1 f'/---' /)-:;~,;... NAYS: None AN ORDINANCE SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF ONE CERTAIN TRACT OF LAND CONTAINING APPROXIMATELY 75 ACRES OUT OF GUADALUPE AND COMAL COUNTIES BY THE CITY OF SCHERTZ, TEXAS, AUTHOR- IZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND DECLARING AN EMERGENCY. 276 There was some discussion on the Rubin and Aaron Beck Sewer Line Easement in Deer Haven. Mr. Rubin Beck had requested a letter to the effect that the City will at some future time construct a sewer line (outfall) for a distance of approximately 500 feet from the intersection of Antler Drive and FM 3009. The Council agreed but with the stipulation that this line would be installed at the City's expense in lieu of payment for easement rights granted the City by Rubin and Aaron Beck. There being no further business to come before the Council at this time, on a motion by Mrs. Hyatt and seconded by Mr. Schneider, the meeting was adjourned at 8:45 P.M. Bueker, presiding; Donald J. Seeba, Walter F. Schneider, and Ed L. Sharpe. Absent: Nell G. Funk and Gail Hyatt. Present were Assistant City Manager Harold D. Baldwin and City Secretary June G. Krause. #1 APPROVAL OF MINUTES: A. Mr. Schneider moved to approve the minutes of the Regular Meeting of July 1, 1975 as presented. Mr. Seeba seconded the motion which carried with the following vote: AYES: NAYS: Mr. Seeba, Mr. Schneider and Mr. Sharpe. None MRS. FUNK ARRIVED AT 7:03 P.M. ;;2 HEARING OF RESIDENTS: Mr. Uhr, Cistrict Manager of Entex, requested he, their Division Manager Mr. W. H. Fortner and the new District Manager Mr. Harry Overstreet, be allowed time to address the Council when Item #4 comes before the Council.
