REGULAR MEETING OF THE CITY COUNCIL
AUGUST 5,1975
The Schertz City Council convened in a Regular Meeting, Tuesday,
August 5, 1975, 7:00 P.M. in the Council Chambers, 401 Oak Street with the
following members present: Mayor Robert C. Bueker, presiding; Nell G. Funk,
Donald J. Seeba, Walter F. Schneider, Ed L. Sharpe and Gail Hyatt. Also Denny
L. Arnold, City Manager, City Secretary June G. Krause and City Attorney Richard
L. Harris.
#1 APPROVAL OF MINUTES: A. Regular meeting of July 15, 1975.
(1) Mrs. Hyatt requested the minutes be amended
as follows: Item #4, page 277, at end of first paragraph add: "Mr. Fortner
advised the Council that if they did not approve the 60~ increase as requested,
they (Entex) would proceed with a rate hearing."
Mrs. Hyatt also wanted to add the following sentence to the fourth paragraph
of Item #4: "Mrs Hyatt asked the Council if they real ized and understood what
Mr. Fortner had said regarding the rate request and the Council said they
understood. II
(2) Mrs. Funk, referring to Item #7 CCMA Budget Review, said that in her opinion
she believes the CCMA Board should tentatively approve their own budget prior to
submitting it to the City Council for review and/or acceptance.
Mrs. Funk also asked what action had been taken on General Discussion Item #9 B
concerning the junk behind Ace Plumbing Company. Mr. Baldwin reported the City
Inspector had contacted the owner in this respect, the vehicles had been reported
to the Police Department and the City had sent the owner a weed and trash letter
in accordance with City ordinance. Chief Schoonover stated the owner is making
some effort to clean up the lot and his department will continue to check on the
situation.
(3) Mrs. Hyatt asked what had been done regarding the cleaning of the lots be-
hind Marilyn Drive and was told Mr. Arnold had contacted the owner, who has
tractor mowers in the area and the lots should be cleared very soon.
(4) Mrs. Hyatt also asked the status of the abonandoned well mentioned in Item #9
E of the minutes under discussion. Mr. Arnold advised he had not been able to
talk directly to the owner but had discussed it with his associate and could get
no clear answers from him; but will write to Mr. Schaefer requesting permission
to fi 11 the well in.
Mrs. Hyatt moved to accept the minutes of the Regular Meeting of July 15, 1975
as amended. Mrs. Funk seconded the motion which carried with the following vote:

B. Mr. Sharpe moved to accept the minutes of the Special Session of July 29,
1975 as presented. Mrs. Hyatt seconded the motion which carried with the follow-
ing vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
C. Mr. Schneider moved to accept the minutes of the Special Meeting of July 30,
1975 as presented. Mrs. Hyatt seconded the motion which carried with the follow-
ing vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
#2 HEARING OF RESIDENTS: There were no residents wishing to be heared at
this time.
#3 PLANNING & ZONING MINUTES: Mr. Schneider moved to accept the minutes
of the regular meeting of the Planning &
Zoning Commission of July 9, 1975 as presented. Mrs. Funk seconded the motion.
Mayor Bueker suggested the General Discussion items concerning their recommendation
to the Council to take immediate action against owners of lots who allow high weeds
to remain, should not be in their minutes as this type of action does not come under
the functions of their Commission.
The Mayor then called for a vote on the motion which carried as follows:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
#4 ORDINANCE: The Mayor introduced the hereinafter set forth ordiRance,
which has been read and considered at the last regular meeting
of the City Council on the 15th day of July, 1975. It was determined that the City
Secretary had caused a short synopsis of said proposed ordinance to be published in
the official City newspaper after its consideration at the last regular meeting of
the City Council and prior to this meeting.
Whereupon said ordinance was discussed and further considered by the Council.
Thereupon it was moved by Mr. Seeba and seconded by Mr. Schneider that said ordinance
be finally passed and adopted. The Mayor put the motion to a vote of the members of
the City Council and the ordinance was finally passed and adopted by the following
vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
AN ORDINANCE REQUIRING PERMITS FOR CARNIVALS AND OTHER SIMILAR ITINERANT
ACTIVITIES WITHIN THE CITY OF SCHERTZ, TEXAS; DEFINING CERTAIN TERMS USED
IN THIS ORDINANCE; SETTING THE REQUIREMENTS FOR A PERMIT; RESTRICTING GAMES
AND ACTIVITIES; SETTING HEALTH REQUIREMENTS; PROVIDING FOR REVOCATION OF
PERMIT UNDER CERTAIN CONDITIONS; PROVIDING FOR PENALTIES FOR VIOLATION OF
THIS ORDINANCE; CONTAINING A SAVING CLAUSE; REPEALING OTHER ORDINANCES IN
CONFLICT; AND CONTAINING OTHER RELEVENT MATTERS.

#5 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance,
which has been read and considered at the last regular meeting
of the City Council on the 15th day of July, 1975. It was determined that the City
Secretary had caused a short synopsis of said proposed ordinance to be published
in the official City newspaper after its consideration at the last regular meeting
of the City Council and prior to this meeting.

Session in accordance with Section 2 (q), Chapter 31. House Bill No.3, at 7:28 D.M.

THE MEETING OF SUCH BOARD.
#6 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance,
which has been read and considered at the last regular meet-
ing of the City Council on the 15th day of July, 1975. It was determined that
the City Secretary had caused a short synopsis of said proposed ordinance to be
published in the official City newspaper after its consideration at the last regu-
lar meeting of the City Council and prior to this meeting.
Whereupon said ordinance was discussed and further considered by the Council.
Thereupon it was moved by Mr. Seeba and seconded by Mrs. Funk that said ordinance

15.50 ACRES OUT OF GUADALUPE COUNTY, TEXAS BY THE CITY OF SCHERTZ,
TEXAS AND AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH
NOTICE OF SUCH PUBLIC HEARING.
#7 ORDINANCE: The Mayor introduced the hereinafter set forth ordinance,
which has been read and considered at the last regular meeting
of the City Council on the 15th day of July, 1975. It was determined that the

19.9 ACRES OUT OF GUADALUPE COUNTY, TEXAS BY THE CITY OF SCHERTZ,
TEXAS AND AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH
NOTICE OF SUCH PUBLIC HEARING.
#8 RESOLUTION: The Mayor introduced the following captioned Resolution
which was read in full by the City Manager. The Resolution
IJ6 was then discussed and fully considered by the Council. Mr. Sharpe ~oved to adopt
~,~~ Resolution No. 75-R-15. Mr. Seeba seconded the motion which carried by the follow-

A RESOLUTION AUTHORIZING THE ALAMO AREA COUNCIL OF GOVERNMENTS
TO PURCHASE RADIO COMMUNICATIONS EQUIPMENT FOR THE CITY OF
SCHERTZ, TEXAS.
#9 POLICE VEHICLE: Mr. Arnold briefed the Council on the discussion
Chief Schoonover had with the Purchasing Agent of
the City of San Antonio, in which it was ascertained Schertz could purchase a
new 1975 police package Plymouth automobile through San Antonio's bid to replace
the police car recently wrecked.
After discussion and consideration by the Council and determining two were available
r1~ Mrs. Hyatt moved the City purchase two (2) police package 1975 Plymouth vehicles
or' through San Antonio's bid for a price of $4,272.00 each. Mrs. Funk seconded the
J~ motion which carried with the following vote:
AYES: Mrs. Funk, Mr. Seeba, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt.
NAYS: None
Council decided to pass over item #10 Budget Review until all Previously Tabled
and General Discussion items had been discussed.
Mrs. Hyatt temporarily left the meeting at 8:25 P.M. to obtain her budget material.
#11 PREVIOUSLY TABLED SUBJECTS: (1) Deer Haven/Oak Forest Subdivisions.
Mr. Arnold briefed the Council on
the plugging:,of the Oak Forest Hater Well as directed by the Council and asked
their permission to pay the bill accordingly. After discussion, Mrs. Funk

moved to pay Haskin Pump Service, in the amount of $1,590.50, for plugging
the Oak Forest Water Well from bond monies. Mr. Sharpe seconded the motion
which carried with the following vote:

#11 (3) Industrial Park - Mayor Bueker briefed the Council on further discussions
he has had with Mr. Naylor concerning the sewer line re-
quested for the Industrial Parkarea. After discussion, it was Council consensus
to stand with the decision made at the previous Council meeting; namely, the
City offers a seven year annexation moratorium and any utility installations
outside the city should be by the developer. It was requested this be put
in ordinance or resolution form.
Mrs. Hyatt returned at 8:37 P.M.
#11 (7) Newsletter Review: Council reviewed the proposed July newsletter,
adding three items. After approval of the
newsletter, there was discussion concerning publishing of the Council minutes.

#10 BUDGET REVIEW: Council continued their review of the proposed 1975-
1976 Budget.
#12 GENERAL DISCUSSION: Mr. Arnold advised that County Commissioner
David Blume visited with him and informed him
the City will be notified by AACOG of some Federal Manpower Program money
available to the City through the County Commissioner's Court for the hiring
of employees. Mrs. Hyatt suggested we keep in mind the necessity of a Juvenile
Probation Officer and Mrs. Funk reminded the Council of the need for four
dispatchers.
#13 ADJOURNMENT: Mrs. Funk moved to adjourn the meeting at 11 :26 P.M.
