08-12-1975 2~H SPECIAL SESSION OF THE CITY COUNCIL AUGUST 1 2, 1975 The Schertz City Council convened in Special Session, Tuesday, August 12, 1975 at 7:00 P.M. with the following members present: Mayor Pro Tern Donald J. Seeba, presiding; Nell G. Funk, Walter F. Schneider and Ed L. Sharpe. Absent Mayor Robert C. Bueker, and Gail Hyatt. Also present City Manager Denny L. Arnold and City Secretary June G. Krause. #1 ORDINANCE: The Mayor Pro Tern introduced the following captioned ordinance which was read in full by the City Manager. Mr. Sharpe moved that said ordinance be considered by the Council as an emergency measure, which motion was seconded by Mrs. Funk. Whereupon said ordinance was t'r,' fully discussed and considered. The Mayor Pro Tern put the motion to consider ,31,;J said ordinance as an emergency measure to the members of the City Council and said motion was approved and adopted by the following vote: AYES: NAYS: Mrs. Funk, Mr. Schneider and Mr. Sharpe None The Mayor Pro Tern then introduced the hereinafter set forth ordinance as an emergency measure. Thereupon it was moved by Mr. Sharpe and seconded by Mrs.Funk .,' _.'{;' that said ordinance be finally passed and adopted. Then Mayor Pro Tern put the I' motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: AYES: NAYS: Mrs. Funk, Mr. Schneider and Mr. Sharpe None AN ORDINANCE PROVIDING FOR THE EXTENTION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS BY THE ANNEXATION OF ONE CERTAIN TRACT OF LAND CONTAINING 83.51 ACRES OUT OF COMAL COUNTY AND DECLARING AN EMERGENCY. #2 ORDINANCE: Mayor Pro Tern introduced the following captioned ordinance which was read in full by the City Manager. Mr. Sharpe moved that said ordinance be considered by the Council as an emergency measure, .,... which motion was seconded by Mr. Schneider. The Mayor Pro Tern put the motion to consider said ordinance as an amergency measure to the members of the City Council and said motion was approved and adopted by the following vote: AYES: Mrs. Funk, Mr. Schneider and Mr. Sharpe nays; None The Mayor Pro Tern then introduced the hereinafter set forth ordinance as an ~ emergency measure. Thereupon it was moved by Mr. Sharpe and seconded by Mr. 13~~'1~ Schneider that said ordinance be finally passed and adopted. NAYS: None AN ORDINANCE SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF TWO CERTAIN TRACTS OR PARCELS OF LAND CONTAINING APPROXIMATELY 34.767 ACRES AND 64.771 ACRES RESPECTIVELY OUT OF COMAL COUNTY; AUTHOR- IZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND DECLARING AN EMERGENCY. #3 ORDINANCE: The Mayor Pro Tern introduced the following caption ordinance which was read in full by the City Manager. Mrs. Funk moved that said ordinance be considered by the Council. Mr. Sharpe seconded the motion which was carried by the following vote: AYES: Mrs. Funk, Mr. Schneider and Mr. Sharpe NAYS: None The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE ABANDONING AN EASEMENT FOR STREET PURPOSES ALONG A PORTION OF WRIGHT AVENUE IN THE CITY OF SCHERTZ, TEXAS Whereupon Mrs. Funk moved that said ordinance be further considered at the next ~ regular meeting of the City Council to be held on the 2nd day of September, 1975, ~,1~ which motion was seconded by Mr. Sharpe and which carried by the following vote: AYES: Mrs. Funk, Mr. Schneider and Mr. Sharpe. NAYS: None I ~? ~~I ,~ #4 ORDINANCE: The Mayor Pro Tern introduced the following captioned ordin- ance which was read in full by the City Manager. Mrs. Funk moved that said ordinance be considered by the Council. Mr. Sharpe seconded the motion which was carried by the following vote: AYES: Mrs. Funk, Mr. Schneider and Mr. Sharpe. NAYS: None The following captioned ordinance was then discussed and fully considered by the council: AN ORDINANCE AUTHORIZING THE CITY SECRETARY OF THE CITY OF SCHERTZ, TEXAS TO DESTROY CERTAIN DATED RECORDS OF THE CITY AS ITEMIZED HEREIN. Whereupon Mrs. Funk movedthat said ordinance be further considered at the next regular meeting of the City Council to be held on the 2nd day of September, 1975, which motion was seconded by Mr. Sharpe and carried by the following vote: AYES: Mrs. Funk, Mr. Schneider, and Mr. Sharpe NAYS: None 2Ul #5 RESOLUTION: The Mayor Pro Tern introduced the following captioned resolution which was read in full by the City Manager. The following captioned resolution was then discussed and fully considered by the Council: A RESOLUTION EXPRESSING THE CITY'S DESIRE TO ASSIST AND ENCOURAGE INDUSTRIAL DEVELOPMENT THROUGH SEVEN YEAR ANNEXATION MORATORIUMS, AND PLACING THE BURDEN OF EXTRATERRITORIAL UTILITY CONSTRUCTION UPON THE INDUSTRY INVOLVED. Whereupon Mr. Sharpe moved that said resolution be adopted, which motion was I~)/~.~ seconded by Mrs. Funk and which carried by the following vote: AYES: Mrs. Funk, Mr. Schneider and Mr. Sharpe NAYS; None #6 TRAFFIC CONTROL: Council discussed several needed changes to the Traffic Control Ordinance, the changes to be compiled by City Staff and presented at a public meeting before finalization. GENERAL DISCUSSION: The City Manager advised he had talked with Engineer Gaddis, who told him he should be able to advertise for swimming pool bid in October. Mr. Arnold also advised the City has received a request from the Texas Highway Department to eliminate parking on highway right-of-way on FM 3009 along the side of Country Corner Restaurant. He will follow up on the request and report back to the Council.
