08-19-1975 292 I ~ ~ ,\ REGULAR MEETING OF THE CITY COUNCIL AUGUST 19, 1975 The Schertz City Council convened in Regular Session, Tuesday, August 19, 1975 at 7:02 P.M. in the Council Chambers, 401 Oak Street with the following members present: Mayor Robert C. Bueker, presiding; Donald J. Seeba, Walter F. Schneider, and Ed L. Sharpe. Absent: Nell G. Funk and Gail Hyatt. Also present City Manager Denny L. Arnold and City Secretary June G. Krause. #1 APPROVAL OF MINUTES: A. Mr. Seeba moved the minutes of the Regular meeting of August 5, 1975 be approved as Mr. Schneider seconded the motion which carried with the following presented. vote: AYES: NAYS: Mr. Seeba, Mr. Schneider and Mr. Sharpe None B. Mr. Sharpe moved to accept the minutes of the Special Session of August 12, 1975, as presented. Mr. Seeba seconded the motion which carried with the follow- ing vote: AYES: NAYS: Mr. Seeba, Mr. Schneider and Mr. Sharpe None #2 HEARING OF RESIDENTS: There were no residents wishing to reserve time for agenda items. Mr. Hotz of 217 Judith Ann Drive, requested help from the Council concerning a noise problem on his street. One of his neighbors drives a large refrigeration trailer truck and the weekend before parked it in front of his house for 2~ days with the refrigeration motor running causing a constant loud noise that disturbed him and his neighbors. Mayor Bueker explained the only ordinance which would help, the Traffic Control Ordinance, states that a vehicle cannot be parked on City streets longer than 48 hours. We do not have a truck route provision in the ordinance and the State is still trying to define what con- stitutes noise level in the Air Pollution Control Act. Mayor Bueker assured Mr. Hotz the matter will be investigated to see what solution can be found. #3 CITIZEN ADVISORY COMMITTEE MINUTES: Committee meeting of July 31, 1975. carried with the following vote: Mr. Sharpe moved to accept the minutes of the Citizen Advisory Mr. Schneider seconded the motion which ~YES: NAYS: Mr. Seeba, Mr. Schneider and Mr. Sharpe None #4 GVEC: Mr. Doyle Hines, General Manager of Guadalupe Valley Electric Cooperative, addressed the Council again with their request for a $10.00 reconnect fee to be charged to customers in the City of Schertz. Mr. Hines explained the charge had been approved by five other cities in the area. After lengthy discussion and consideration by the Council, Mr. Seeba moved to authorize GVEC to charge a reconnect fee of $10.00 to consumers anytime a new connection or a re-connection is made. Mr. Seeba seconded the motion which carried with the following vote: AYES: NAYS: Mr. Seeba, Mr. Schneider and Mr. Sharpe None #6 PAYMENT AUTHORIZATION: Council authorization was requested to pay $2,835 for the installation of the water line to Country Corner Restuarant. " Mr. Seeba moved to authorize payment to SACC, Inc. Utilities Contractor in the l'~ amount of $2,835 for the installation of the water line to Country Corner Restua- rant. Mr. Sharpe seconded the motion which carried with the following vote: AYES: Mr. Seeba, Mr. Schneider and Mr. Sharpe NAYS: None #7 PAVILION RESERVATION: . Mr. Arnold said he has had requests from three organizations (Jaycees, Chamber of Commerce and Knights of Columbus) for use of the large pavilion in the City Park with alcoholic beverages being consumed. It was Council concensus to leave decisions of this nature to the decretion of the City Manager. #8 LONE OAK TREE: Mr. Arnold has had requests for something to be done about the low hanging and dead limbs on the tree in Lone Oak Park, specifically the ones touching the roof of one of the residences. Since the one bid given the Parks Superintendent for treatment and repair of this tree was rather high, it was concensus of the Council that since the park is primarily used by residence of this one subdivision, the City Manager should contact the Lone Oak Garden Club seeking their help with this tree. #9 ORDINANCE: The Mayor introduced the following captioned ordinance which was read in full by the City Manager. Mr. Seeba moved that said ordinance be considered by the Council. Mr. Schneider seconded the motion which was carried with the following vote: AYES: Mr. Seeba, Mr. Schneider and Mr. Sharpe nays; None The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF ONE CERTAIN TRACT OF LAND CONTAINING 13.20 ACRES OUT OF GUADALUPE COUNTY BY THE CITY OF SCHERTZ, TEXAS, AND AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARING. Mr. Sharpe seconded motion which carried by the following vote: .,,/ ,1 ') '" 1::;" J'1 .' the AYES: NAYS: Mr. Seeba, Mr. Schneider and Mr. Sharpe None The following captioned ordinance was then discussed and fully considered by the Council : AN ORDINANCE LEVYING AND ASSESSING ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF SCHERTZ, TEXAS FOR THE YEAR 1975, PROVIDING THE BASIS OF ASSESSMENT OF APPRAISED VALUE AND PROVIDING FOR THE COLLECTION THEREOF AT THE RATE OF $1.00 ON THE ONE HUNDRED DOLLAR ($100.00) ASSESSED VALUATION Whereupon, Mr. Seeba moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 2nd day of September, 1975, which motion was seconded by Mr. Sharpe and which carried by the following vote: AYES: Mr. Seeba, Mr. Schneider and Mr. Sharpe NAYS: None #11 BUDGET REVIEW: Before discussing individual items on the budget, Mr. Seeba requested to address some comments on sewer and water rates; namely, he believes that when the sewer rates were set last year on water consumption, the revenues for water were curtailed. He then proposed the Council change the sewer rate to a flat fee based on number of baths or fixtures in a home with perhaps a slight raise in water rates. Mayor Bueker suggested pressing Environmental Protection Agency for a decision on assessing a flat rate charge as they have the final say as to the method of rate setting if the City wishes to continue getting Federal grant money. Mr. Schneider questioned why there are several residences in the older section of Schertz not now connected to the sewer system; and if they could be forced to connect. Council was in agreement to have the City Manager check with the City Attorney to determine the legality of requiring those residents to connect with the sewer system. Council continued to review the budget. Bueker, presiding; Donald J. Seeba, Walter F. Schneider and Ed L. Shapre. Absent: Nell G. Funk and Gail Hyatt. The Mayor explained the purpose of the public hearing was to hear all evidence relative to the proposed annexation of 15.5 and 19.9 acres of land out of Guadalupe County, Texas by the City of Schertz. There were no citizens present wishing to voice opinions, either pro or con, on the proposed annexation. After a brief discussion by the Council, Mayor Bueker declared the public hearing closed at 10:48 P.M. The Regular Meeting was reconvened at 10:53 P.M. by the Mayor. The Mayor then introduced the following captioned ordinance which was read in full by the City Manager. Mr. Seeba moved that said ordinance be considered by the Council. Mr. Schneider seconded the motion which carried by the follow- ing vote: AYES: Mr. Seeba, Mr. Schneider and Mr. Sharpe nays; None The following captioned ordinance was then discussed and fully considered by the Council: AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS BY THE ANNEXATION OF TWO CERTAIN TRACTS OR PARCELS OF LAND CONTAINING 15.5 ACRES AND 19.9 ACRES RESPECTIVELY OUT OF GUADALUPE COUNTY, TEXAS. Whereupon Mr. Seeba moved that said ordinance be further considered at the next regular meeting of the City Council to be held on the 2nd day of September, 1975 which motion was seconded by Mr. Schneider and which carried by the following vote: AYES: Mr. Seeba, Mr. Schneider and Mr. Sharpe NAYS: None On a motion by Mr. Schneider, seconded by Mr. Sharpe and unanimously carried, meeting adjourned at 11 :00 P.M.
