09-16-1975 :)07 REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 16. 1975 The Schertz City Council convened in Regular Session. Tuesday. September 16. 1975 at 7:07 P.M. in the Council Chambers. 401 Oak Street, with the following members present: Mayor Robert C. Bueker. presiding; Walter F. Schneider. Ed L. Sharpe. and Gail Hyatt. Absent: Nell G. Funk and Donald J. Seeba. Also present were City Manager Denny L. Arnold and City Secretary June G. Krause. #1 APPROVAL OF MINUTES: A. Mrs. Hyatt moved to accept the minutes of the Public Hearing of September 2, 1975 as presen- ted. Mr. Sharpe seconded the motion which carried with the following vote: AYES: Mr. Schneider. Mr. Sharpe and Mrs. Hyatt. NAYS: None B. With reference to the minutes of the Regular Meeting of September 2, 1975, Mr. Sharpe asked that the second paragraph under Item #12 be corrected to read: IIMr. Sharpe stated he thought that Mr. Schwartz caul d very well be the best qua 1 ifi ed. . . . . . . . . . . . . " . Mr. Schneider moved to accept the minutes of the Regular Meeting of September 2. 1975, as amended. Mr. Sharpe seconded the motion which carried with the follow- ing vote: AYES: Mr. Schneider. Mr. Sharpe and Mrs. Hyatt. NAYS: None C. Mr. Sharpe moved to accept the minutes of the Public Hearing of September 9, 1975 as presented. Mrs. Hyatt seconded the motion which carried with the follow- ing vote: AYES: Mr. Schneider. Mr. Sharpe and Mrs. Hyatt. NAYS: None D. Mr. Sharpe moved to accept the minutes of the Special Session of September 9, 1975 as presented. Mrs. Hyatt seconded the motion which carried with the follow- ing vote: AYES: Mr. Schneider, Mr. Sharpe and Mrs. Hyatt. NAYS: None #2 HEARING OF RESIDENTS: A. Mr. Harold Christian. 605 Aero Avenue. said his neighbor, next door. has a large St. Bernard dog that is full of ticks. causing the ticks to come over into his yard. He has sprayed his yard several times but still has ticks. Also, the man does not pick up after his dog and the odor is terrible. Mr. Christian was told the City has an existing ordinance to cover this situation but the lack of a City Health Officer makes it a little difficult to enforce. The matter will be investigated to try to alleviate his problem. B. Mr. Christian also reported Mustangs with loud mufflers are going up and down Aero Avenue in the evenings. when they notice the police are not present. Mayor Bueker said he would alert the police of the situation. C. Mrs. Adela Schneider asked if there was to be discussion of the upgrading of FM 78 at this meeting and was told there would not be. 30b D. Mr. Dick Chambless addressed the Council concerning the high utility charges; stating the State Representatives are evidently not doing anything and asking the Council's help. MRS. FUNK ARRIVED FROM ANOTHER MEETING AT 7:17 P.M. Mayor Bueker gave a recap of actions already taken by the Council to help alleviate the rising utility costs, ending by saying the Council appreciates the problem especially for fixed income families but feel they have exhausted most sources that would have any impact on the situation. E. Mr. Christian asked if the garbage collection men couldn't be asked to be a little more careful of the cans and lids when collecting, as they continually seem to just toss the lids in the yard. The City Manager was asked to write Mr. Gutierrez asking him to correct this situation. #3 CITIZEN ADVISORY COMMITTEE MINUTES: Mr. Sharpe moved to accept the minutes of the Regular Meeting of the CAC of August 28, 1975 as presented. Mrs. Funk seconded the motion There was general discussion of the complaint items in the minutes. Mayor Bueker said the complaints should be listed in their minutes but they should not be just left at that. The Committee should follow up by calling City Hall and so advise the complaintant. Mrs. Funk, as well as other members of the Council, questioned the Committee motion that they wished to transfer the responsibility of the Community Fund to the Council. This fund was originally set up by the CAC to fund the Welfare Department and it should remain with that committee. Mayor Bueker agreed and although it requires a great deal of work, the CAC has no solid project in being except the Community Fund. Mr. Arnold was asked to review the CAC and Community Fund By-Laws, formulate an opinion and so advise the CAC. Mayor Bueker then called for a vote on the motion to accept the minutes of the CAC of August 28, 1975 which motion carried as follows: AYES: Mrs. Funk, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt. NAYS: None #4 PARK USAGE: The Mayor introduced the subject of the Jaycees' request for permission to use the pavilion area in the City Park for a dance October 25th, which was fully discussed by the Council. It was Council decision to turn the request over to the City Manager for disposition. Mrs. Funk moved that said ordinance be considered by the Council as an emergency measure, which motion was seconded by Mrs. Hyatt. Whereupon said motion was fully discussed and con- sidered. The Mayor put the motion to consider said ordinance as an emergency measure to the members of the City Council and said motion was approved and adopted by the following vote: AYES: Mrs. Funk, Mr. Schneider, Mr. Sharpe and Mrs. Hyatt. NAYS: None ORDINANCE NO. 75-M-31 AN ORDINANCE PROVIDING FUNDS FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1975 AND ENDING SEPTEMBER 30, 1976, BY APPROVING THE BUDGET FOR SAID PERIOD AND APPROPRIATING THE NECESSARY FUNDS OUT OF THE GENERAL AND OTHER REVENUES OF THE CITY OF SCHERTZ, TEXAS, FOR SAID YEAR FOR THE MAINTENANCE AND OPERATION OF THE VARIOUS DEPARTMENTS AND FOR VARIOUS ACTIVITIES AND IMPROVEMENTS OF THE CITY; AND DECLARING AN EMERGENCY. #6 TAX ROLL: Tax Assessor/Collector Hal Baldwin presented the 1975 Tax Ro 11 of the City of Schertz along with the II Sta tement of the Board of Equalization for the year 1975" for Council purusal. #7 ORDINANCE: The Mayor introduced the following captioned ordinance }~'; which was read in full by the City Manager. Mr. Sharpe moved that said ordinance be considered by the Council as an emergency measure, which motion was seconded by Mrs. Funk. Whereupon said motion was fully dis- cussed and considered. The Mayor put the motion to consider said ordinance as an emergency measure to the members of the City Council and said motion was approved and adopted by the following vote: AYES: Mrs. Funk, Mr. Sharpe and Mrs. Hyatt. NAYS: Mr. Schneider ORDINANCE NO. 75-A-32 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS BY THE ANNEXATION OF A CERTAIN TRACT OF LAND CON TAINING 34.767 ACRES OUT OF COMAL COUNTY, AND- DECLARING AN EMERGENCY. #8 ORDINANCE: The Mayor introduced the following captioned ordinance which rt, was read in full by the City Manager. NAYS: None ORDINANCE NO. 75-H-33 AN ORDINANCE PROHIBITING THE ACCUMULATION OF GARBAGE OR TRASH AND OTHER MATERIALS AS DEFINED HEREIN, PROHIBITING THE GROWING OF VEGETATION IN A MANNER INJURIOUS TO PUBLIC HEALTH, PROVIDING FOR THE ELIMINATION OF SUCH CONDITION BY THE CITY, PROVIDING A PENALTY FOR VIOLATION THEREOF, PROVIDING FOR THE CITY TO COLLECT FOR ANY EXPENSE INCURRED FOR SUCH VIOLATION, AND DECLARING AN EMERGENCY. #9 ORDINANCE: First reading of an ordinance adopting the 1975 National Electrical Code. After Council discussion, it was Council decision to table the consideration of this ordinance until further study could be accomplished to eliminate the double permit charge to Schertz citizens (requirements from both City and GVEC). #10 RESOLUTION: The Mayor introduced a Resolution setting per diem rates and travel policies for the City. After Council dis- cussion, there were several portions that needed re~ording, therefore passage of this resolution was tabled at this time. #14 CCMA BOARD ORDER: Council consideration of CCMA connection fee order. After discussion, the following were some of the items needing clarification or change: Section II (g) Design Meal - should be more definitive Section III - extract the rate schedule and make an annex for easier amendment and broaden the scope of categories. Section IV - coordinate of distance requirements with the inclusion of a feasibility prohibition statement. Council requested a representative of CCMA be at the next meeting to discuss the Connection Fee Order and how they arrive at their individual rates. #11 PREVIOUSLY TABLED SUBJECTS: There were none to be discussed at this time. #12 GENERAL DISCUSSION: (1) School Sewer Assessment: Council had again received a letter from the Superintendent of Schools concerning their sewer assessment. There was a short discussion 311 in which the Council felt they do not like to be put in the position of giving the schools concession over private citizens. They then asked the City Manager to write Mr. Nalls, Superintendent, acknowledging receipt of the letter. (2) Mr. Sharpe discussed the large buttons recently placed on Main Street saying they had created more of a traffic problem than before, especially for the business places in that area. He asked if a sign could be placed on the medium at Lindberg and Main stating a left turn is permitted across the buttons as most citizens assume it is against the law. Chief Schoonover advised he had nothing but praise from the motoring public and would investigate the possibility of placing the sign. (3) Mayor Bueker questioned the fact that in most every other state, the Mama Patrols are paid by the School Districts whereas here they are paid by the municipality. #13 ADJOURNMENT: On a motion by Mrs. Hyatt, seconded by Mrs. Funk and unanimously approved, Mayor Bueker declared the meeting adjourned at 10:57 P.M. /;;;:L; (C. :ct.-,1:./ Mayor, City of Schertz, Tex~s- ATTEST: ~~ . );jKrqNAtJ Ci~Secretar~ City~ Schertz PUBLIC HEARING OF THE CITY COUNCIL SEPTEMBER 23, 1975 The Schertz City Council held a Public Hearing Tuesday, September 23, 1975 at 7:02 P.M. in the Council Chambers, 401 Oak Street, with the following mem- bers-present: Mayor Robert C. Bueker, presiding; Mrs. Nell G. Funk, Donald C. Bueker, Walter F. Schneider, Ed L. Sharpe and Gail Hyatt. Mayor Bueker stated the purpose of the Public Hearing was to allow citizens to appear and be heard on the proposed annexation of 13.20 acres of land out of Guadalupe County. City Manager Denny Arnold pointed out on the plat the loca- tion of the land in question. There were no citizens wishing to be heard.
