SPECIAL SESSION OF THE CITY COUNCIL
NOVEMBER 13, 1973
The City Council met in Special Session Tuesday, November 13,
1973 at 7:00 P.M. in the City Council Chambers, 608 Live Oak Road
wi th the Schertz', Cibolo , Universal City Independent School Dist-
rict Board of Trustees.

Mr. Larry O'Grady, Advisor, Catholic Youth Organization and
three students appeared to explain a Wa1kathon to support their
Christmas for the Senion Citizens program. The Walkathon will
be held November 23, 1973.
Discussion items as follows:
1. Safety of School children crossing the Cibolo Creek at
the low water crossing (Aviation) and on FM 78 bridge.
2. Safety of school children walking along FM 78 from
Schertz to Cibolo.
3. What route will be available for pedestrian traffic to
the new middle school?
4. From which areas will students be drawn to attend the
new middle school and what grades will the school consist?
There was lengthy discussion, with many questions and answers,
on the above subjects. Much of the discussion concerned the new
pedestrian bridge over the Cibolo Creek. It was agreed that Schertz
and Universal City City Councils will hold a joint meeting on
November 20th, 1973.
On a motion duly made and seconded, the Council adjourned at
9:30 PM.

The Schertz City Council met in Special Session Friday,
November 16, 1973 at 7:00 P.M. in the City Council Chambers, 608
Live Oak Road, with the following members present: Mayor Robert
Bueker, presiding; Mrs. Funk, Mrs. Koch, Mr. Sandifer and Mr.
Koole; Mr. Joe Stulb, Chairman and eight members of the Charter
Writing Committee.
Mayor Bueker explained the purpose of the meeting was to get
together with the Charter Writing Committee and Mr. Richard Harris,
attorney for the City, and exchange ideas concerning the Home Rule
Charter presented so that it may again be presented to the citizens
at an election.
Mr. Harris said he had nothing specific about the charter but
general ideas. Some parts have too much procedures as the State
Legislature has more or less taken care of those things. He had
two main points: 1. Article 4.09 Section f. concerning passage of
Ordinances, would prove very costly for the City. 2. Article 1.02
concerning annexation, need more lenient requirements than by
election - Mr. Harris agreed that item 102.b (1) gave the City that
provision of flexibility they were looking for.
Mrs. Funk asked if all the Utility Companies had been invited
to the session of the CVllllLlission when they were discussing Article
XI which concerns franchises. Mr. Stulb stated none were invited
but representatives of the Gas Cv~pany were at one of their meetings.
Mrs. Funk stated representatives from GVEC, Southwestern Bell Tele-
phone and the United Gas Company have all registered protests to
Article XI of the present charter.
When questioned by Mrs. Funk on the following Articles, Mr.
Stulb gave the following responses~
1. Article 4.02 - Qualifications for Mayor &
cerning the phrase "have attained the age of 21".
felt it was a necessary provision in the charter
conflict with the lowering of voting age.
2. Article 4.06, Section b (3): failure to attend three
consecutive meetings of the Council constituting a forfeiture of
office. Possibly it should be regular meetings but he does not
think valid reason for changing since the part about being out
of the county being good cause for being absent takes care of it.

3. Article 4.09, Section c. - Notice of Regular meetings.
This law was changed by the Legislature from 3 days to 72 hours
after this charter was written.
4. Article 4.09, Section f (1): passage of penal ordinances.
published twice within 15 days after passage is impossible with
a weekly newspaper. Mr. Stulb agreed it would have to be changed.
5. Article 6.02, Section b - pay plan for City employees.
Mrs. Funk explained this was tried at the last budget sessions
and would be far too costly for the city. Mr. Harris made the'
statement that Pay Plan as such could be construed to mean what
we have at present time and the Council can do with it what it
desires.

6. Article 6.06 - City Secretary - Mrs. Funk felt that for
better working relations, the City Secretary should be hired by
and work under the City Manager. Mr. Stu1b stated the CVlwllission
felt the City Secretary was a secretary for the Council and
should be under the control of the Council. It was a1so brought
out the name City Secretary should be used throughout the charter
instead of the City Clerk as sometimes stated. Mr. Harris said
about the only cities using the term "City Clerk" are Commission
form of Governments.
7. Article 7.08 - Purchasing Procedures - Legislature has
changed this from $2,000 to $3,000.
Mr. Stu1b closed by saying if the Commission still has legal
authority to work on the charter, they will meet soon (December
6, 1973). He feels that if there is nothing harmful in this
charter, the Cvuuuission should represent it as it is written but
he cannot say how the individual members of the Cvuuuission will
feel about it. He said personally he would like to see even a
one page charter if possible but the CUlluuission felt the only
way the ordinary citizens would ever see the state laws were if
they were placed in and made a part of the Schertz Home Rule
Charter.
Mr. Hal Baldwin, Chairman of the CAC, feels that from
talking with the members of his committee, if the law suit
did not do anything else, it at least stimulated interest
in the charter and gave the citizens at least another month
or two to study the charter.
There being no further discussion, Mayor Bueker declared
the meeting adjourned at 9:00 P.M.

REGULAR SESSION OF THE CITY COUNCIL
NOVEMBER lO, 19/3
The City Council convened in Regular Session in the City
Council Chambers 01 Tuesday, November 20, 1973 at 7:02 P.M. with
the following members present: Mayor Bueker, presiding; Mrs. Koch,
Mrs. Funk, Mr. Sandifer, Mr. Koo1e and Mr. Schwartz.
Mayor Bueker requested the minutes of the meeting of November
6, 1973 be changed as follows: 10th paragraph, page 1 - should
read: "Mayor Bueker explained he wanted to give Mr. Arnold authority
to rent necessary equipment and pay, on an in-house operation, a
qualified operator to do the preliminary work on the south drainage
ditch." Mrs. Funk moved to accept these minutes as amended. Mr.
Sandifer seconded the motion with all members voting aye. F" r '.
