01-02-197432 REGULAR SESSION OF THE CITY COUNCIL JANUARY 2, 1974 The City Council convened in Regular Session in the Council Chambers on Wednesday, January 2, 1974 at 7:00 P.M. with the following members present: Mayor Robert C. Bueker, presiding; Mayor Pro -Tem Schwartz, Mrs. Funk, Mrs. Koch, Mr. Sandifer and Mr. Koole. #1 APPROVAL OF MINUTES: Mrs. Koch moved the minutes of the Regular Session of December 18, 1973 be approved as presented. Mr. Sandifer seconded the motion with all members voting aye. #2 HEARING OF RESIDENTS: a. Mr. Dick Chambless reserved the right to be heard when item No. 5 of the agenda was brought before the Council. b. Mr. Dick Carroll again asked when the ordinance on animal control was to be brought before the Council. Mr. Arnold ex- plained it should be on the agenda of the meeting of January 15, 1974. c. Mr. Al Pefferkorn asked if Mr. Koole had a statement he wanted to make at the beginning of the meeting. Mr. Koole said that con- cerning the question he asked Mr. Hal Baldwin at the last Council meeting on Urban Renewal, he did not receive the information from Mr. Pefferkorn. In fact, Mr. Pefferkorn had never made any state- ments concerning Mr. Baldwin to him. Mr. Koole went on to say he had not finished his investigation into what was said about Mr. Baldwin but assured Mr. Baldwin that he would continue and would let him know the outcome. #3 CIVIL RIGHTS COMPLIANCE: Mr. Arnold explained this form is a necessary part of the 1 City's Annual Arrangements Program. Mr. Schwartz moved to give authorization to Mayor Bueker to sign the HUD -41901 form "Assurance of Compliance of the 1964 Civil Rights Act." Mrs. Funk seconded the motion with all members voting aye. #4 APPOINTMENT OF POLICE OFFICER: Mr. Arnold presented a personnel file on Mr. William Barber, as compiled by Chief Schoonover, for Council perusal. He explained Mr. Barber had been appointed to fill a vacant patrolman position by him and Chief Schoonover. Mrs. Koch asked if this is going to be the hiring procedures. Mr. Arnold explained the Council still can approve any appointment. Mrs. Funk said the only thing about this appointment she didn't feel was right is that Patrolman Mosher resigned on the 17th, the City advertisement was published on the 20th and Mr. Barber was hired on the 21st of December, 1973, without waiting to see if any comparable applications were received. Mr. Arnold said perhaps he was guilty of rushing the appointment but Mr. Barber had been thoroughly checked out and was a certified officer, was available immediately and the City was in need of an officer to alleviate the holiday workload on the Police Department. He also explained his office is now working on a complete set of personnel rules and hopes to have a working copy for the Council by the end of January. After additional discussion, it was agreed t� by the Council, for Mr. Arnold to include in the policy that employees be requested to give two weeks notice, allowing sufficient time to advertise before hiring a replacement. Mr. Sandifer moved to accept the appointment of Mr. William Barber as Patrolman. Mr. Schwartz seconded the motion with all members voting aye. Mayor Bueker announced the meeting be recessed at 7:30 P.M. CITY COUNCIL PUBLIC HEARING JANUARY 2, 1974 A Public Hearing was held by the City Council in the Council Chambers, 608 Live Oak Road, on Wednesday, January 2, 1974, at 7:30 P.M. with the following members present: Mayor Bueker, presiding; Mr. Schwartz, Mt. Sandifer, Mrs. Funk, Mrs. Koch and Mr. Koole. A. The purpose of the Public Hearing is to hear any testimony pursuant to changing the zoning classification of a 1.062 acre tract of land out of the Lone Oak Subdivision as requested by the owner, Green Valley Development Corpora- tion, from a R -1 to a C -1 classification. Mr. Chambless, speaking as a member of the Planning and Zoning Commission, requested the Council see that the right -of -way for the widening of Highway 78 be obtained by donation from the owners before this property be rezoned. Mr. Arnold explained that if this was done, the Corp. involved could be out quite a bit of money then perhaps the P &Z or Council would not pass the zoning request. Mayor Bueker suggested the ones requesting the rezoning submit a letter of intent to give the ROW requirements at the time the request is made. Mr. Schertz, one of the owners, questioned the need for extra right -of -way since adjoining property owners had built al- most to the property line. Mayor Bueker replied that we have not received the Feasibility Study from the Highway Department; therefore, he will obtain the ROW footage requirements from the Highway Department engineer before finalizing the rezoning January 15, 1974. There being no additional citizens present to protest the rezoning, the Public Hearing on this issue closed at 7:45 P.M. 34 B. The purpose of this Public Hearing is to hear any testimony pursuant to changing the zoning classification of both sides of Main Street from Live Oak Road to Oak Street to a C -1 classification. Mayor Bueker explained that at the present time, there are various zoning classifications along Main Street. Mr. Schertz, Ex. Director of UR, reminded the Council they had received a letter from the UR attorney stating the changing of the zoning on Main Street would jeopardize the present UR project, and asked this be considered. Mayor Bueker said the Council will not take definite action on this rezoning of Main Street until after Urban Renewal closes out unless the Council changes its mind. Mrs. Koch said she had talked with several residents of Main Street and none she spoke with want the street rezoned even though they are aware that the rezoning will not effect their single family position. They were not against the 26 unit Home for the Elderly but just did not want commercial. Mr. Chambless stated the P &Z was requesting this rezoning as much for the protection of the elderly as any other reason. The C -1 classification should insure owners receiving more money for their property at the time of a sale. Mayor Bueker asked the Council to defer action on this re- zoning until after the close of Urban Renewal. There were no citizens present to protest the rezoning. The Public Hearing closed at 7:58 P.M. Mayor Bueker declared the Regular Council meeting reconvened at 8:00 P.M. # 6 BID AWARD ON CITY EQUIPMENT: Mr. Arnold gave his recommendation that the Council award the bid for the Sewer Rodder to the Rockwell International even though it is not the lowest bid received. His decision is based on the recommendations of both the Utility Superintendent and the City Engineer. Mr. Arnold also recommended the bid on the Front End Loader/ tractor be awarded to the low bidder, International Harvester. He went on to explain the difference in the bid price and the budget allocation was brought about by the Companies not being able to get factory participation. Mayor Bueker requested the Utility Supt., Marvin Patterson, call cities who use the O'Brien Sewer Rodder for additional information before finalizing a decision. JJ Mr. Schwartz moved to have the City Manager and Utility Superintendent Took into the sewer rodder situation and ))I finalize recommendations for Council decision on Jan- uary 15, 1974. Mrs. Koch seconded the motion with all members voting aye. Mr. Johnson submitted a report on prices he had obtained by calling dealers for a 1/2 ton pickup since no bids were received. The price of $2595.00 with delivery in February from Tom Benson Mazda was the lowest he was able to get. Mr. Koole said he would check with Mission City Mazda and feels he can get a better price and delivery. Mr. Schwartz moved to accept the Mazda and if one can be obtained at a lower price than $2595, purchase that one; also to accept the bid from International Harvester for the front end loader /tractor with related equipment. Mrs. Funk seconded the motion with all members voting aye. #7 SALARY INCREASE REQUEST: Mr. Arnold asked the Council to disregard the request for salary increase for the Tax Assessor/ Collector. Mr. Graham was approached by Rep. Bennie Bock (without any solicitation on Mr. Graham's part) to be his Administrative Assistant. Mr. Arnold went on to explain that although he hates to lose Mr. Graham, this is a great apportunity for him. Mr. Bock needs his services on the 7th of January but has made arrangements for him to return for any help needed by the City in training a new Tas A /C. Mr. Mansfield. requested to speak, saying that although he wishes Mr. Graham well, he thinks it would be best for the City if we could draw up a contract whereby employees would have to agree to serve at least one or two years with the City. Mayor Bueker answered by saying since the City is not paying a high salary, we cannot hope to retain these young people very long but that we do gain by having young men work for the City. Mr. Arnold agreed that the City got far more from Mr. Graham than they paid for. Mr. Schwartz moved a letter of appreciation be written from the Mayor to Mr. Graham for a tremendous job well done. Mrs. Funk seconded the motion with all members voting aye. #8 TRAFFIC CONTROL ORDINANCE: There was lengthy dis- cussion and consideration on the proposed Traffic Control Ordinance which is to be finalized at the meeting of January 15, 1974. #9 PREVIOUSLY TABLED SUBJECTS: (1) Concerning the 236 Housing Project as it relates to the Val Verde Apartments, some of the points discussed were: a. should the City allocate 2% to the low income families instead of the 1�0 now allocated. 36 b. The additional trouble caused by vandalism, burglary etc. in this area. c. requesting the leasing manager to consider the possibility of placing all the elderly in one building. Mayor Bueker suggested this subject be brought up at the conference meeting with HUD on January 15, 1974. #10 GENERAL DISCUSSION ITEMS: A. Mrs. Koch presented a letter she had received from the Hydro Lock Company advertising a fire plug locking devise that is very good but expensive. She recommended the Council look at this again at budget time. B. Mrs. Funk asked what had transpired concerning the Burton property being used as a public street. Mr. Arnold said he and Mr. Johnson found a sign and put it in the middle of the drive and the people still drive around it. Mrs. Burton said she would just have to put back the sign stating "Private Property" she had there before that had worked. C. Mayor Bueker reminded the Council and public of the meeting with HUD on January 15, 1974. D. Mayor Bueker extended an invitation from the CCMA to the Council and spouses to a meeting and dinner on February 15, 1974 on Future River Authorities. R. Mayor Bueker requested the Council be thinking about controlling home businesses for future meetings. F. Mr. Arnold read a letter from Mr. Fritz Schlather, Mayor of Cibolo, concerning entering into a contract for inter -local Police Protection for the two cities. This is merely to advise that facts are being gathered to be considered. G. Mrs. Funk asked Chief Schoonover about the long delays being reported in getting in touch with the police in the evenings. Chief Schoonover reported there have been some mix ups that are being worked out. #11 Mrs. Funk moved the meeting be adjourned at 10:15 P.M. Mrs. Koch seconded the motion with all members voting aye.
