MINUTES
REGULAR SESSION
JULY 24, 2007
The Schertz City Council convened in Regular Session on Tuesday, July 24, 2007 at 6:30
p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4,
Schertz, Texas. The following members were present: Mayor Pro Tern David L.
Scagliola presiding, Councilmembers Jim Fowler, John Trayhan, Tony Wilenchik and
Michael Carpenter. Absent: Mayor Hal Baldwin and City Manager Don Taylor. Also
present were, Assistant City Manager John Bierschwale, Assistant City Manager David
Harris, Director of Development Services Leonard Truitt, City Secretary Judy Tokar and
Special Projects Coordinator Brad Gildea.
#1 CALL TO ORDER.
Mayor Pro Tern Scagliola called the meeting to order at 6:30 p.m.
#2 PLEDGES OF ALLEGIANCE TO THE UNITED STATES AND STATE
OF TEXAS (Honor the Texas flag; I pledge allegiance to thee, Texas, one
state under God, one and indivisible).
Both pledges were recited.
#3 PRESENTATION: Presentation to the City of Schertz from the Friends of
Northern Schertz Parks for park project. (Presenter: Dwayne McCune)
Debbie Bell presented a check in the amount of $25,000.00 to Mayor Pro Tern Scagliola
from Armadillo Homes for the parks at Schertz Parks North.
#4 HEARING OF RESIDENTS.
Frances Rushing, Chamber President, announced the following; ribbon cutting at Dr.
Anthony and Gloria Wright's office on July 26th; and Networking Connection hosted by
IBC Bank on July 26th. Ms. Rushing wanted to speak to the Council regarding the
agenda item on renewing the City's membership with the Metrocom Chamber of
Commerce. She feels it is important that the City supports its own Chamber. There has
been misrepresentation by the Metrocom Chamber that they represent the businesses of
Schertz and that membership in both is reciprocal.
Jewell Davenport, Chamber Board member, agreed with Ms. Rushing that the City of
Schertz should support only one chamber, the Schertz Chamber of Commerce.
Debbie Krause, Chamber Board Member, said in talking with businesses they like the
Schertz Chamber because of all the activities they are doing.

Kelly Smith, citizen and business owner asked that Council take several items under
consideration before voting. He feels the Metrocom Chamber have misrepresented
themselves to the local businesses indicating they represent the City of Schertz. It is
important to be a team player but he doesn't feel withdrawing from the Metrocom
Chamber will affect the City's reputation in the community. He recommends Council
vote not to renew the membership to the Metrocom Chamber
Robert Brockman, 1000 Elbel Road, attended the Library Advisory Board meeting last
night and he said they want to go forward with the plans for the new library. He wanted
to know if it was allowable to sell animals in parking lots in the City?
ACTION ITEMS:
#5 Approve minutes of Regular Sessions of June 19, 2007, June 26, 2007 and
July 10,2007.
Councilmember Trayhan made a motion, seconded by Councilmember Fowler, to
approve the minutes of regular session of June 19, June 26 and July 10, 2007. The
motion carried 5-0 and the vote was as follows:
A YES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.
NA YES: None.
#6 ORDINANCE: Discussion and action on first reading of an ordinance
providing that the Code of Ordinances of the City of Schertz, Texas be
amended by revising Chapter 90, Water, Wastewater Disposal, Exhibit 4,
Water rates established; providing a repealing clause; and providing an
effective date. (J. Bierschwale)
John Bierschwale, Assistant City Manager, said the rate change of 23 cents is a pass
through cost to cover debt services; it is requested by the Schertz Seguin Local
Government Corporation. The rate change is from $1.95 to $2.18 per 1,000 gallons of
water.
Councilmember Trayhan made a motion, seconded by Councilmember Carpenter, to
approve first reading of an ordinance providing that the Code of Ordinances of the City
of Schertz, Texas be amended by revising Chapter 90, Water, Wastewater Disposal,
Exhibit 4, Water rates established; providing a repealing clause; and providing an
effective date, correcting a typo on page 2, Section 1. The motion carried 5-0 and the
vote was as follows:
A YES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.
NA YES: None.
#7 ORDINANCE: Discussion and action on first reading of an ordinance
providing for the extension of the boundary lines of the City of Schertz,

Texas by the annexation of approximately 194.56 acres located at the
southwest corner of Eckart Road and Froboese Road; and related matters.

David Harris, Assistant City Manger, said the spelling of Eckart (Eckhardt) Road was
misspelled throughout the ordinance and documents; it will be corrected for the final
reading.
Councilrnernber Carpenter made a motion, seconded by Councilrnernber Trayhan, to
approve the first reading of an ordinance providing for the extension of the boundary
lines of the City of Schertz, Texas by the annexation of approximately 194.56 acres
located at the southwest corner of Eckart Road and Froboese Road; and related matters.
The motion carried 5-0 and the vote was as follows:
A YES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.
NA YES: None.
#8 ORDINANCE: Discussion and action on first reading of an ordinance
providing for the extension of the boundary lines of the City of Schertz,
Texas by annexation of approximately 35.874 acres located at the terminus of
Hillbrook Drive and adjacent to FM 1518 approximately 2,200 feet south of
the intersection of FM 1518 and Schaefer Road; and related matters. (D.

John Bierschwale, Assistant City Manager, stated for the record that the service plan
under the capital improvement section should read that no impact fees will be charged to
any developer or landowner for waste water, and impact fees will be charged for water.
The City has an established agreement with the Schertz Cibolo Universal City ISO
regarding the impact fees.
Councilmember Trayhan made a motion, seconded by Councilmember Carpenter, to
approve the first reading of an ordinance providing for the extension of the boundary
lines of the City of Schertz, Texas by annexation of approximately 35.874 acres located
at the terminus of Hillbrook Drive and adjacent to FM 1518 approximately 2,200 feet
south of the intersection ofFM 1518 and Schaefer Road; and related matters. The motion
carried 5-0 and the vote was as follows:
Councilmember Trayhan amended the motion, seconded by Councilmember Carpenter to
include the above statement as part of the motion.
A YES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.
NA YES: None.
#9 RESOLUTION: Discussion and action on a resolution declaring the current
number of inhabitants in the City of Schertz, Texas. (J. Bierschwale)

John Bierschwale, Assistant City Manager, said the City must establish a new population
figure for annexation process. The count used is acquired from various data records, but
staff used the number of water connections, which are more accurate. Total inhabitants
are 31,788 as of July 24, 2007.
Councilmember Carpenter made a motion, seconded by Councilmember Trayhan, to
approve a resolution declaring the current number of inhabitants in the City of Schertz,
Texas. The motion carried 5-0 and the vote was as follows:
AYES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.
NA YES: None.
#10 Discussion and action on Schertz Seguin Local Government Corporation
Fiscal Year 2006-2007 budget amendment. (A. Cockerell)
Allan Cockerell, General Manager for Schertz Seguin Local Government Corporation,
said the budget amendment is to transfer monies from the Contingency Account into the
Capital Outlay Account in order to purchase an additional stainless steel pump.
Councilmember Fowler made a motion, seconded by Councilmember Trayhan, to
approve Schertz Seguin Local Government Corporation budget to transfer $23,000.00 to
pay for a stainless steel pump. The motion carried 5-0 and the vote was as follows:
A YES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.'
NAYES: None.
#11 Discussion and action to transfer funds for the ball field bleachers from the
Hotel Occupancy Tax Fund. (D. Taylor)
John Bierschwale, Assistant City Manager, said the request is to purchase bleachers for
the new ball fields in the amount of$22,985.00.
Councilmember Carpenter asked why this request for the bleachers was not presented to
the Parks and Recreation Board for review and approval since this was their request. He
felt this expenditure should had gone through the budget process for next year, and also
understood from BVY A that if the bond had passed they would not be asking the City to
purchase bleachers.
Councilmember Trayhan made a motion, seconded by Councilmember Fowler to approve
the transfer of funds from the Hotel Occupancy Tax Fund Fiscal Year 2007 for
$22,985.70 for bleachers. The motion carried 5-0 and the vote was as follows:
A YES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.
NA YES: None.

#12 Discussion and action on City of Schertz remaining a member of the
Randolph Metrocom Chamber of Commerce. (T. Wilenchik & D. Taylor)
Councilmember Wilenchik said even though the Mayor is not present the Mayor had
expressed to him that there is a synergy between the Chambers, and that membership in
the Schertz Chamber only may give the impression of isolationism. The mayor also
expressed that joint Chamber membership may help the City advance issues that may
involve and affect the businesses and citizens.
Councilmember Wilenchik added that the Metrocom Chamber has marketed their
membership to businesses by stating they represent the City of Schertz. He feels the
businesses may think they are getting a broader exposure throughout the Metrocom by
membership in the Metrocom Chamber, when, in essence, the Schertz Chamber will give
the businesses better representation. He also feels City membership solely in the Schertz
Chamber takes away the competitive edge for the Metrocom Chamber.
John Bierschwale, Assistant City Manager, reminded the Council of the sales tax
generated from our local businesses and feels strongly that the City of Schertz should
support the local chamber.
Councilmember Wilenchik made a motion, seconded by Councilmember Fowler, not to
renew the City's membership with the Randolph Metrocom Chamber of Commerce. The
motion carried 5-0 and the vote was as follows:
AYES: Councilrnernbers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.
NA YES: None.
#13 Discussion and action on the agenda for August 7th meeting (National Night
Out). (D. Taylor)
John Bierschwale, Assistant City Manger, told Council that they would be provided a
schedule and transportation to visit the different neighborhoods for National Night Out.
Councilmember Wilenchik made a motion, seconded by Councilmember Fowler, to
postpone the discussion until next week until they could speak to the City Attorney. The
motion carried 5-0 and the vote was as follows:
A YES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik, and Carpenter.
NA YES: None.

John Bierschwale, Assistant City Manger, said with the heavy rains no damages to homes
were reported.

Attended several committee meetings and there is a definite need for volunteers
and encouraged citizens to participate.

Asked if the Council was holding up the progress on library project and requested
it be on the next agenda?
