A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on May
10, 2022, at 6:00 p.m. in the Hal Baldwin Municipal Complex Council Chambers, 1400 Schertz
Parkway, Building #4, Schertz, Texas. The following members present to -wit:

Call to Order
Mayor Gutierrez called the meeting to order at 6:00 p.m.
Opening Prayer and Pledges of Allegiance to the Flags of the United States and State of
Texas. (Councilmember Whittaker)
Councilmember Whittaker provided the opening prayer followed by the Pledges of Allegiance
to the Flags of the United States and the State of Texas.
Employee Recognition - Milestone Service Pin Presentations
City Manager Dr. Mark Browne presented the following employees with their milestone years
of Service Pins providing a brief bio of their career. Each employee introduced their family
members who were present and responded with thanks to the City for the opportunity to
serve.

City Manager Dr. Browne stated, Great Job everyone!.
Mayor Gutierrez stated that as he looks around the room, he noticed Joe Villarreal's shirt
- First Responders. He stated that our City is a First Responder, regardless of what the
situation is. They respond to our Residents needs whether it is a book report that there is
an emergency they have to get done before the final grades are in or a pipe busting. It is
incredible that our staff is able to provide for our community and residents and the
support he sees here this evening supporting your co- workers, that is very impressive.

. Special Introductions: Citizens Police Academy Graduates (Off. Anna Kraft)
Special Projects Officer Anna Kraft provided information on the recent Citizens
Police Academy class and recognized those that attended all the classes and
graduated.

Councilmember Allison Heyward read the proclamation and Mayor Gutierrez
presented it to the Fire Department Personnel who were attending. Members
present thanked the City for the recognition.

Office thanked the Mayor, Council, City Attorney, City Management, all Staff and
the Citizens for the opportunity to serve and the recognition.

• Announcements and recognitions by the City Manager (M. Browne)
City Manager Dr. Browne showed a photo of our new City Salsa Garden and stated that
today he had the opportunity to present two City Manager Coins to Ms. April Toman of
the Library and Mr. Jared Montney of the Parks Department who was at the new City
Salsa Garden at the Library. He stated he thought this was a really inventive project that
April and Jared did together - they worked on this jointly. They had a session where
they read the book "Salsa Garden" - April would read to 50 children and then when they
were done, they actually planted a Salsa Garden, Jared provided all the vegetables. In
the photo you can see behind them tomatoes, peppers, cilantro and basil and everything
else that goes into salsa. Great program, and he believes they are trying to plant the
garden and keep it going - maybe they will make salsa when it is all done.

Hearing of Residents
This time is set aside for any person who wishes to address the City Council. Each person
should fill out the speaker's register prior to the meeting. Presentations should be limited to
no more than 3 minutes
All remarks shall be addressed to the Council as a body, and not to any individual member
thereof. Any person making personal, impertinent, or slanderous remarks while addressing
the Council may be requested to leave the meeting.
Discussion by the Council of any item not on the agenda shall be limited to statements of
specific factual information given in response to any inquiry, a recitation of existing policy in
response to an inquiry, and /or a proposal to place the item on a future agenda. The presiding
officer, during the Hearing of Residents portion of the agenda, will call on those persons who
have signed up to speak in the order they have registered.
Mayor Pro -Tem David Scagliola read the names of those who wished to speak. Mayor
Gutierrez recognized:
. Mr. Daniel Jameson 1048 Richmond Drive, who spoke regarding the Main Street
Project, about the need to resurface Main Street. He stated the potholes need to be fixed
between Schertz Parkway and Main Street and the ones on First Street.
. Mr. Glen Outlaw, 3729 Forsyth Park, who addressed questions and provided his
comments regarding agenda Item 4 - Ordinance No. 22 -M -20 changing term dates for
Boards, Commission and Committees, and the requirement of Board Volunteer Members
to take part in an interview process. He stated that as the current Chair of the Planning
and Zoning Commission he wanted to share some comments as he was in the
audience last week when the proposed ordinance was discussed, which was basically

was to redo the appointment /reappointment process. In his experience, coming up
five -half years appointed on Planning and Zoning, as the Chairman he has had only two
problems with the system. Number 1, was finding people that wanted to serve, and
number 2 was actually conducting interviews. He is befuddled about sudden need to redo
a system that seems to have been serving us fairly well all these years. Last week
Council had very good discussion about the proposed ordinance, a lot of good points
were made and a lot of good ideas were shared. He thinks it is a great idea that you want
to involve the chairpersons from the various committees in the interview, great step. No
one really knows how an applicant or a re- appointment is going to fit with committee
better than that committee chairman.
Some concerns with other things, the idea that we should replace someone on a
committee or a council just because they've been there for a while, and we have someone
else who wants to be there. He is not sure of the wisdom of that move as we cannot
speak for a lot of the committees. He has served on TSAC for a while and as a
subject -matter expert, he is a member of the Building and Standards Commission, but
he can tell you for Planning and Zoning there is a learning curve, it takes a while for a
new member to get up to speed and really understand what they are doing and get a good
grasp of the City's Unified Development Code and our procedures. To just arbitrarily
replace someone so that someone else can have a new chance to serve, we lose all of that
experience and knowledge. His other concern deals with being able to schedule these
interviews, and he will give you the problem he has had. He is a member of the
Interview Committee and the Mayor called wanting to have discussion about the system,
they scheduled that meeting three times before they found a date where enough
individuals could show up. The first two times he was available, the third time he was
not, it was his 52nd wedding anniversary, had dinner reservations and there was no way
he was going to miss that to come to the committee meeting. His concern is the
availability of individuals, if you have to interview people to reappoint them, how are we
going to work with their schedule. He would hate to see someone fall by the wayside
just because our two calendars couldn't agree. The only other question he has is where
you are separating the boards and commissions. Basically you are going to separate
them into three groups which would imply that the Interview Committee is going to
meet at least three times for appointments and reappointments, he wonders in between
when there are vacancies are those applicants going to have to wait for those three
opportunities or will the Interview Committee meet in between those in order to fill the
vacancies?

one motion. There will be no separate discussion of these items unless they are removed from
the Consent Agenda upon the request of the Mayor or a Councilmember.

Mayor Gutierrez asked Council if there were any items they wished removed. As no
items were requested, Mayor Gutierrez called for a motion to approve consent agenda
items 1-3.

5. Ordinance No. 22 -T -21- Consideration and/or action adopting an Ordinance by the
City Council of the City of Schertz, Texas authorizing an adjustment to the fiscal year
2021 -2022 budget to landscape the Cibolo Valley Drive medians, repealing all ordinances or
parts of ordinances in conflict with this ordinance; and providing an effective date. (First

AUTHORIZING AN ADJUSTMENT TO THE FISCAL YEAR 2021 -2022 BUDGET
TO LANDSCAPE THE CIBOLO VALLEY DRIVE MEDIANS, REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS
ORDINANCE; AND PROVIDING AN EFFECTIVE DATE (First Reading)
Mayor Gutierrez recognized Assistant City Manager Brian James who introduced this item
stating that the City of Schertz and the City of Cibolo partnered to construct a new 0.5 mile
(approx.) segment of Cibolo Valley Drive between IH -35 and Old Wiederstein Road. As part
of the project the road was widened from 2 lanes to 4 lanes with added turn lanes and
two medians that are currently empty with a road base. A landscaping plan was created that
includes low -water plants, drip irrigation system, and decorative rock. The plan was
reviewed by staff from both cities. Traffic control is also included in the cost due to the need
to shut down a lane on either side of the medians during installation. The project is expected
to take 12 days barring any weather delays.
First step is to approve the budget adjustment to landscape the Cibolo Valley Drive Medians,
once approved staff will come back to Council with a resolution to approve a contract for the
landscape. Staff recommends Council approve Ordinance 22 -T -21 on first reading to
authorize an adjustment to the fiscal year 2021 -2022 budget to landscape the Cibolo Valley
Drive medians.
No discussion by Council so the Mayor asked for a motion to approve.

Mayor Gutierrez stated that the way they are going to discuss this item is one issue at a
time and try to get a consensus before they move to the next portion of the ordinance.
There are four (4) parts of the ordinance. Regarding the first portion of the Ordinance
Deputy City Secretary Sheila Edmondson stated it was discussion regarding Exhibit A,
which was the schedule of changing the Boards Commissions term dates, these are
broken out into three different term ending dates. (No change to the exhibit as presented
last week) Ms. Edmondson as for discussion regarding the schedule.
Part 1. Exhibit A- Boards, Commissions and Committees: New Term Expiration Dates
Councilmember Heyward expressed her concern for the number of individuals that will
have to be re- interviewed plus the number of new interviews - the time involved to
accomplish this and that we are breaking this now up to three (3) times a year. She likes
staggering the term expiration dates of the different boards. Ms. Edmondson stated that
of the first expiration date in June that 16 volunteer members will be considered for
reappointment and interviews, this number does not include new volunteer applications.
Councilmember Heyward is concerned with getting a time set up for all these interviews
which would also include the Interview Committee. As Mr. Outlaw mentioned what
would happen if one of the volunteers could not make the interview, would they be
considered. She likes the different schedule of re- appointments.
Councilmember Davis stated he is not quite sure if he understands the concerns having
been on the Interview Committee since he got on Council back in 2016. He doesn't
recall the City Secretary's office in any of that time mentioning that they had a hard time
scheduling people for any of these meetings. There is always the potential that
somebody can't make a particular meeting. Commissioner Outlaw comments earlier
were about a meeting for the committee to talk about how the committee operates not
the interview for other people. We have had a lot of flexibility in our meetings with
adjusting times and even meeting more than once to meeting with someone who was
interested in being on a board.
He doesn't see the problem, as a matter of fact the only potential problem we get out of
this is, and we haven't had a problem because the general mindset has been, since before
he got elected as council, he started out on the Parks Board and TSAC in 2008; he
doesn't' see a problem because our general process was if someone was on a board, and
they wanted to stay on the board they would inform the City Secretary that they would
like to be reappointed. The consensus in the community in the city was we reappointed
that person. His entire time on boards and commissions and on council he doesn't recall
getting a call from the City Secretary, Board or Commissioner or City Management
saying we have a problem with this person on the board, and we need to re- evaluate
them and maybe not reappoint them. It has been that if you are on a board and want to
stay on the board you stayed.

The only value he sees coming out of this is if, we really want to re- evaluate board
members, and we have never had 16 people for interviews. When we have had openings
on board and commissions. We will if we are going to change the standard and the
standard becomes everyone who is due for a re- appointment has to get reevaluated or
re- interviewed, as well as anyone who puts in an application for a potential seat. This is
what we are creating here. This evening we had a resignation on one of the boards, this
creates an opening, by reevaluating those who terms who are expiring, there is a
potential of creating other openings because they have to reapply and be re- interviewed.
We have created a situation where instead of trying to fill an opening, we are saying that
we need to reevaluate people to fill two or three openings. With this you are doing this
for every board that we have in the community. The only value for him if that is the
intent of Council where we want everyone to reapply and explain why they'd like to stay
on the board, the only thing that makes sense to him is to split up the number of sessions
and stagger the terms into the three or four groupings. By implementing this vision of
making people revalidate their positions or reapply for their positions, we are now
creating more workload for both the Interview Committee and the City Secretary's
office. We are creating more of a scheduling nightmare because in the past the City
Secretary would say if we have three people on the parks board that their terms are up
the City Secretary would reach out to them and ask if they want to stay on the board, and
if all three said yes then there is no scheduling issue there is no interview.
Ms. Dennis stated that the process for term expiration on the various board she would
reach out to them, if they were interested in staying on the board, she would have them
fill out a new application, and it was provided in a packet to the Interview Committee for
consideration of re- appointment during their meeting they held annually to go over
re- appointments and appointments plus interviewing those individuals for the openings
on the boards and commissions. There was not a scheduling issue at that time as the
Interview Committee was meeting to go over the applications of re- appointments and
was interviewing those interested on being on a board or commission.
Councilmember Davis stated that there was no additional workload for the committee
the most they would do is if there was a vacant position, we would interview several
people. The typical process is that the City Secretary's office advertises that we are
looking for members for boards and commissions, which we have done at the Volunteer
Fair, advertised in the Magazine and on the City Website. Individuals apply when they
know there is a vacancy. For instance there is a vacancy on the Parks Board, 5
apply, then the Interview Committee interviews all 5 for the vacancy, recommends one
for the vacant position and then during the interview process they spend more time
trying to figure out where they would fit within the boards and committees, and in
talking to the applicants ask if they would be interested in sitting on a different board
that has a vacancy, the Interview Committee would make recommendations to council
for appointment. The Interview Committee spends a lot of time speaking to applicants
and have been very successful getting individuals out of their comfort zone and try
something new and try some of the other boards and commissions that have vacancies.
In the past there was not a scheduling issues, but now we would be creating one by now
requiring everyone to revalidate their intensions to stay on their board coupled with now
they have to sit for an interview as well.
Mayor Pro -Tem Scagliola stated that with the first item 1, 2 & 3 he does not have a
problem with that, it seems like that will streamline the process, let's divide it up into
three (3) different sections. He is all for incremental improvements, when they get to the
next section he will have his say.
Councilmember Whittaker stated that for Exhibit A, she thinks it makes more sense to
break it up into three (3) sections. It is a lot to interview for the vacancies or every one,
she thinks it makes sense.
Councilmember Dahle agrees with shifting the terms. It shows we are advertising all
year long for vacancies, and we would have the opportunity to interview throughout the
year. As for the comments about scheduling meetings, we have become very
comfortable with ZOOM meetings if necessary.
Mayor Gutierrez agrees with Exhibit A and having the Boards, Commissions, and
Committees on different term expiration dates. He stated that from this discussion there
is a consensus among City Council to accept Exhibit A: Boards, Commissions and
Committees -New Term Expiration Dates.
Exhibit B -Part 2: The Chair of the Board and the Volunteer Member will be notified
by the City Secretary's Office that the volunteer member's term is expiring in
approximately 45 days and if the volunteer member wants to be reappointed, they will
need to resubmit an application to be reappointed to the Board they wish to serve on.
Mayor -Pro Tern Scagliola asked City Secretary if this is the current process now.
Ms. Dennis confirmed that this is the current process in notifying volunteer members of
their term expiring. Mayor Pro-Tern Scagliola did not have any concern to change this
portion
Mayor Gutierrez asked if there were any other comments, as there were none, the
consensus was Exhibit B -Part 2 is to not change anything.
Exhibit B -Part 3: All new applicants and volunteer members who would like to be
appointed or reappointed to a Board, will go through the Interview Process. The
Interview Process consists of the new applicant or volunteer member being
interviewed by the Interview Committee and Chair of that
BoardlCommission /Committee to be selected to serve.
Councilmember Brown stated he did not agree with the interview process for each Board
Member.
Councilmember Davis corrected Exhibit B- indicating there were two #2. Deputy City
Secretary Edmondson apologized and said she would correct the numbering error.
Councilmember Davis continued that he understand from what the City Secretary
Dennis explained that Exhibit B #2: states that we are just interviewing new applicants,
but he did not agree with the rest of the sentence concerning interviewing new applicants

at the same time of reappointment.
City Secretary Dennis stated that she is reading this portion of Exhibit B to read that the
Interview Board is going to re- interview everyone and the new applicants. She asked
Council if that is not the intent, please let us know.
Councilmember Whittaker asked concerning new applicants that are applying to a Board
that is full, are we going to interview them and at least be met them or do we tell them
the Board is full, but we have other openings on these Boards. She was unclear about the
process for this particular scenario.
City Secretary Dennis explained that we do interview all the new applicants and possibly
during that interview, it was discovered that they might be better suited for a different
Board.
Councilmember Whittaker wanted to speak to the new applicants and understand what is
the current process when they apply and how do you define a vacancy or an opening.
She has concerns that the with the current process, the volunteer member is the one who
decides if there is going to be a vacancy or opening, by staying or resigning.
Councilmember Whittaker stated that she feels City Council needs to input and have
communication with that applicant to make sure the best suited candidates are selected to
the Boards.
Mayor Gutierrez stated that this revision will state that if there are new applications from
citizens wishing to serve or fill a vacancy, they will be interviewed by the Interview
Committee at the same timeframe the interviews for that Board, Commission or
Committee are to be scheduled
Exhibit B: Part 4: All new applicants and volunteer members who would like to be
appointed or reappointed to a Board, will go through the Interview Process. The
Interview Process consists of the new applicant or volunteer member being
interviewed by the Interview Committee and Chair of that
Board/Commission/Committee to be selected to serve.
Councilmember Brown stated re- interviewing every person is going way too far, and
will inconvenience for the Chairs, Staff, and Volunteers. It is key that communication
continues. The City Council Liaison is another conversation to have, but we need to have
Staff identify the issue and bring to the City Manager and then to Council.
Mayor Pro -Tem Scagliola agrees with Councilmember Davis that changes need to be
made incrementally; expiration dates are good; the Chair of the board would be part of
the interview process. He stated his conclusion is before we change this process, we need
to sit down in a workshop that includes the Interview Committee, Committee Chairs and
Staff to discuss the interview and appointment process.
Councilmember Heyward agrees with Mayor Pro -Tem Scagliola that a workshop would
be good idea to discuss the details of the interview process. She also suggested that if
there are concerns about certain Boards, attending one of their meetings and talking to

the Chair would be efficient and helpful.
City Secretary Dennis stated that the current ordinance in place, all the Boards,
Commissions, and Committees term expiration date expires May 31, 2022. Mayor
Gutierrez agreed and said Council will take a vote on a portion of this ordinance
concerning the change in the expiration term dates.
Councilmember Dahle state a lot of good points have been made. He would like City
Council to have a say on who is appointed/reappointed. He agrees that interviewing
everyone is not the right way to go about this and there is a better way to set up this
process.
Councilmember Whittaker agreed that tonight Council needs to extend the term dates.
She would like clarification of vacancy and opening on a Board.
City Secretary Dennis listed the vacancies and openings on all the Boards, Commissions,
and Committees.
Councilmember Heyward would like to approve the Exhibit A- Schedule of Term
Expiration Dates, and on Exhibit B- 1 and 2. Mayor Gutierrez stated that
Councilmember Heyward made a motion to approve Ordinance 22 -M -20 with Exhibit A
and Exhibit B -with some revisions. Mayor Pro -Tem Scagliola seconded that motion.
Mayor Gutierrez stated the section concerning the process of appointments and
reappointment to the Boards will be discussed at a workshop that will include the
Interview Committee, Chairs of the Boards and Staff.
Moved by Councilmember Allison Heyward, seconded by Mayor Pro-Tern David
Scagliola to approve Ordnance No. 22 -M -20 on first reading to approve Exhibit A,
and under Exhibit B to pass #1 and #2 with revisions "wishing to serve or fill a
vacancy and remove the reappointments.
Councilmembers held off discussion on 2B until the committee comes back with
their recommendation.
Mayor Pro -Tem Scagliola stated that when the committee does sit down to discuss,
that they involve the subject matter experts participate in the process, as the chairs
of the different boards and commissions can provide their insights.

Mayor Pro -Tem Scagliola stated that he had the opportunity today to present a
proclamation recognizing National Nursing Home Week to those at the Silver Tree
Nursing and Rehabilitation Center today.
Councilmemer Whittaker stated that for Mother's Day she was able to take her youngest
out to Crescent Bend Nature Park and enjoyed one of our lovely parks. She stated that
her son just loved reading the little signs and how they found tons of wildlife and that he
was so engaged. Thanks to the Parks and Recreation Department for keeping up with
that Park.
Councilmember Heyward stated that she was able to celebrate with the City of Cibolo
National Night out and also attended with Cibolo the National Day of Prayer Celebration.
