11-27-2007 MINUTES REGULAR SESSION NOVEMBER 27, 2007 The Schertz City Council convened in Regular Session on Tuesday, November 27, 2007, at 5:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding, Mayor Pro-Tern David Scagliola, and Councilmembers Jim Fowler, John Trayhan, Tony Wilenchik and Michael Carpenter. Also present were: Assistant City Managers John Bierschwale and David Harris, City Attorney Michael Spain and Interim City Secretary Mary Ybarra. #1 CALL TO ORDER. Mayor Baldwin called the meeting at 5:30 p.m. #2 PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED ST A TES AND STATE OF TEXAS. Both pledges were recited. #3 EXECUTIVE SESSION: Called under Chapter 551 Texas Government Code, Sub-section 551.074 (1) - Deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of the City Secretary. Council adjourned into executive session at 5:33 p.m. The Mayor Pro-Tern Scagliola reconvened the meeting into regular session at 6:46 p.m. #4 Action, if any on the subject of the above executive session. The motion was made by Councilmember Fowler, and seconded by Councilmember Wilenchik, to hire Brenda Dennis as the City Secretary with an annual salary of $59,000.00, effective January 1, 2008. The motion carried 5-0 and the vote was as follows: AYES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik and Carpenter. NAYES: None. #5 HEARING OF RESIDENTS. Steve Layton, 12231 Lost Meadows, Cibolo, TX Item #10, Crescent Bend Nature Park (Lakewood Acres) City Council Regular Meeting 11/27/2007 42 . Spoke about the 200 acres envisioned as a park. He displayed several charts and noted that most of the usable land is in the 100-year floodplain. He stated that the neighbors support the plan for the park and are hoping that the park will be named" Crescent Bend Nature Park". Joel Tanner, 118 Lost Meadows, Cibolo, TX Item #10 (Lakewood Acres) . He stated that he has met with Mr. Logan on two occasions. He is primarily concerned about security, noise, and that the initial design of the park be maintained no matter who is seated in City Government. Parks & Recreation Board Meeting was held last night where they discussed the Lakewood Acres Park being constructed as a nature park . ALS money is currently being given to ALS, new recommendation for the funds to be given to the Park & Recreation Foundation was agreed to at the meeting Councilmember Trayhan . None Councilmember Wilenchik . Attended the Commissioners Court meeting. The county ETJ permanent burn ban was extended in Guadalupe County . Animal Shelter architectural design committee, Commissioner Wolverton voted against it because Schertz would pay a larger proportion of the money but not be able to use it. . Appointment to the AACOG Grants Advisory Board. Councilmember Wilenchik was asked ifhe would accept the appointment. . Executive Session to appoint HR Director City Council Regular Meeting 11/27/2007 43 . Last week Council received a design concept for a road behind the City Hall complex. If it is a design item does Council want them to bring it forward first? He thinks guidance should be set for staff. All Councilmembers agreed it should be placed as an agenda item. He and George Antuna attended the Board Member indoctrination training on the Commuter Rail Program #8 RECOGNITION: City of Schertz EMS Director The Mayor and City Council recognized Mr. Dudley Wait on being awarded the 2007 Journey of Excellence Award by the Texas Department of State Health Services. This award is only given when the Governor's EMS and Trauma Advisory Council decides that someone is deserving ofthis recognition. ACTION ITEMS: #9 MINUTES: Approval of minutes, Regular Session Meeting November 20, 2007. The motion was made by Councilmember Trayhan, and seconded by Councilmember Fowler, to approve the minutes of the regular session meeting of November 20, 2007. The motion carried 5-0 and the vote was as follows: AYES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik and Carpenter. NA YES: None. #10 RESOLUTION: Discussion and action on a resolution regarding a potential City of Schertz and Bexar County Park. (G. Logan) RESOLUTION NO. 07-R-51 A RESOLUTION OF THE CITY OF SCHERTZ SUPPORTING THE DEVELOPMENT OF LAKEWOOD ACRES AS A PROPOSED PARK SITE BY BEXAR COUNTY. Mr. George Logan, Parks and Recreation Director, introduced the item to City Council and recommended approval of this joint resolution after fielding questions from City Council. City Council Regular Meeting 11/27/2007 44 The motion was made by Councilmember Trayhan, and seconded by Councilmember Wilenchik, to approve a resolution supporting the development of Lakewood acres as a proposed park site by Bexar County. The motion carried 5-0 and the vote was as follows: AYES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik and Carpenter. NA YES: None #11 Discussion and possible action on the Miss Schertz Sweetheart Court agreement. (F. Rushing) Frances Rushing, Schertz Chamber of Commerce, approached the City Council requesting permission to terminate the agreement with the City of Schertz for the Miss Schertz Sweetheart Court. The motion was made by Councilmember Fowler, and seconded by Councilmember Wilenchik, to allow the Schertz Chamber of Commerce to terminate the Feb 2007 agreement with the City of Schertz for the Miss Schertz Sweetheart Court, with the understanding that the $3,000 remaining in the account be returned to the City. The motion carried 5-0 and the vote was as follows: A YES: Councilmembers Fowler, Scagliola, Trayhan, Wilenchik and Carpenter. NAYES: None DISCUSSION ITEMS: #12 Presentation and discussion regarding the Miss Schertz Sweetheart Court Corporation. (J. Bishop) Mrs. Sharon Pennington gave a presentation to the Mayor and City Council regarding the formation of the Miss Schertz Sweetheart Court Corporation, a newly formed 501c3 organization. Mrs. Pennington requested City Council's continued support as in the past, outlining the specific occasions and issues they need support for. She introduced the officers of the new organization and stated that the float is ready to go for the Festival of Angels Parade next week. City Council held some discussion about agreement arrangements with a 501c3 organization like the Miss Schertz Sweetheart Court Corporation. City Council asked for an action item on the agenda to address the Resolution supporting this Corporation. #13 Discussion on final reading of an ordinance approving a request for a Specific Use Permit for Lot 1, Block 1, in the Texas Tack and Trailer Subdivision. (c. Gabbard). Staff member Chris Gabbard of the Planning Department gave City Council a copy of the plumbers report and explained that the word "private" was added to the text of the ordinance to further specify that the wash rack is not connected to a private septic or a private sewer facility. No further discussion is required. This item is ready to go for final action next week. City Council Regular Meeting 11/27/2007 45 #14 Discussion on the Schertz Parks Foundation. (G. Logan/J. Bierschwale) Mr. George Logan presented the discussion on the creation of the Schertz Parks and Recreation Foundation. He recommended City Council approve the creation of this Foundation. Mr. Spain explained the timeline for filing procedures of a 501 c3 foundation and made some recommendations to City Council on its creation. #15 EXECUTIVE SESSION: Called under Chapter 551 Texas Government Code, Sub-Section 551.072 - Deliberation Regarding Real Property. Council adjourned into executive session at 8: 17 p.m. The Mayor reconvened the meeting into regular session at 8:49 p.m. #16 Action, if any on the subject of the above Executive Session. No action taken. #17 Items by City Manager Taylor and Staff General Announcements . CPS Energy Meeting, Dec 6, 2007 from 9:00-1 :30 . Downed streetlight on Schertz Parkway is on order for replacement . Streetlights that are out have been identified . Mr. Wilenchik has received complaints about Bexar Waste's leaking trucks throughout the City. This issue has been ongoing and the trend is being identi fied. #18 ADJOURNMENT.
