IDV Combined DocumentsORDINANCE NO. 21 -S -36 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING THE OFFICIAL ZONING MAP BY REZONING APPROXIMATELY 42 ACRES OF LAND TO PLANNED DEVELOPMENT DISTRICT (PDD), GENERALLY LOCATED 2,500 FEET EAST OF THE INTERSECTION OF HUBERTUS ROAD AND INTERSTATE HIGHWAY 35, ALSO KNOWN AS COMAL COUNTY PROPERTY IDENTIFICATION NUMBES 75290 AND 75369, COMAL COUNTY, TEXAS. WHEREAS, an application to rezone approximately 42 acres of land located 2,500 feet east from the intersection of Hubertus Road and Interstate Highway 35, also known as Comal County Property Identification Numbers 75290 and 75369, and more specifically described in the Exhibit A attached herein (herein, the "Property") has been filed with the City; and WHEREAS, the City's Unified Development Code Section 21.5.4.D. provides for certain criteria to be considered by the Planning and Zoning Commission in making recommendations to City Council and by City Council in considering final action on a requested zone change (the Criteria "); and WHEREAS, on August 25, 2021, the Planning and Zoning Commission conducted a public hearing and, after considering the Criteria, made a recommendation to City Council to approve the requested rezoning to General Business District -2 (GB -2); and WHEREAS, on September 7, 2021, the City Council conducted a public hearing and after considering the Criteria and recommendation by the Planning and Zoning Commission, determined that the requested zoning be approved to Planned Development District (PDD) as provided for herein. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT: Section 1. The Property as shown and more particularly described in the attached Exhibit A, is hereby zoned Planned Development District (PDD) with the development standards as outlined in attached Exhibit `B ". Section 2. The Official Zoning Map of the City of Schertz, described and referred to in Article 2 ofthe Unified Development Code, shall be revised to reflect the above amendment. Section 3. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a part of the judgment and findings of the Council. Section 4. All ordinances and codes, or parts thereof, which are in conflict or inconsistent with any provision of this Ordinance are hereby repealed to the extent of such conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters resolved herein. Section 5. This Ordinance shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 6. If any provision of this Ordinance or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Ordinance and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City hereby declares that this Ordinance would have been enacted without such invalid provision. Section 7. It is officially found, determined, and declared that the meeting at which this Ordinance is adopted was open to the public and public notice ofthe time, place, and subject matter of the public business to be considered at such meeting, including this Ordinance, was given, all as required by Chapter 551, as amended, Texas Government Code. Section 8. This Ordinance shall be effective upon the date of final adoption hereof and any publication required by law. Section 9. This Ordinance shall be cumulative of all other ordinances of the City of Schertz, and this Ordinance shall not operate to repeal or affect any other ordinances of the City of Schertz except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this Ordinance, in which event such conflicting provisions, if any, are hereby repealed. General outdoor storage items shall be completely enclosed or shall be moved to the rear of the structure, but in no event shall general outdoor storage items be visible from public right -of -way, such as trucks and trailers. Tree Size — the minimum size for all required trees shall be 3 caliper inches Section 21.14.3.C.- Landscape Buffer. In addition to the requirements of section 21.9.7 of this UDC for landscaping, a minimum twenty foot (20') wide landscape buffer shall be provided adjacent to any public right -of -way classified as a Principal Arterial or Secondary Arterial in accordance with Sec. 21.14.1. Tress shall be planted at an average density of one (1) tree per forty linear feet (35') of street frontage at 3 caliper size. The landscape buffer shall require an irrigation system and shall be maintained by the property owner. IV. Amendments to the Planned Development District A. Any significant changes from the established standards for the approved PDD, or changes that later the concept of the PDD will cause the plan to be resubmitted for approval by the Planning and Zoning Commission and the City Council, including a new public hearing with applicable fees. A 90 day maintenance period, after acceptance, shall be included in base bid. 11.Trees shall be warrantied 1 y ear from acceptance of owner. Vicinity Map Landscape Requirements & Tabulations Property Description IDV Schertz, Block 1, Lot 1 22867 IH 35 North, Schertz, Texas 78154 Sod Notes 1.Lawn installation shall not begin until the irrigation sy stem has been completed and is operational. 2.Before placing of topsoil, all areas shall be cultivated to a depth of four (4") inches, unless otherwise specified, or ordered by the Landscape Architect. Cultivation of the soil may be done by disc, spring tooth harrow, rototiller, or similar equipment. This operation shall be done at right angles to the natural flow of water on the slopes. 3.After the topsoil has been spread to the depth specified, the area shall be mechanically tilled to a depth of 6 inches, then roll raked and dragged to emove all large clods, rocks, debris, and litter over (1") one inch in any dimension which shall be disposed of by the Contractor in a lawful manner at an off site location. 4.The area shall then be rolled in 2 directions; the second shall be done at right angles to the first rolling. The roller shall be of a standard, lightweight, waterfilled ty pe. 5.Rake the area to make it smooth and level. Remove ridges and fill depressions. Add topsoil where necessary , or as directed by the Landscape Architect. 6.The finished grade shall be two (2') inches below all curbs, sidewalks, and/or other appurtenances. 7.Roll the area in one direction. Moisten prepared lawn areas before planting if soil is dry . Allow surface moisture to dry . 8.Lay sod within 24 hours from time of stripping. Do not plant dormant sod. Lay sod to form a solid mass with tightly fitted joints. Butt ends and sides of sod strips; do not overlap. Stagger strips to offset joints in adj acent courses. Work from boards to avoid damage to subgrade or sod. Tamp or roll lightly to ensure contact with subgrade. Work sifted soil into minor cracks between pieces of sod; remove excess to avoid smothering of adj acent grass. 9.Water sod thoroughly within one (1) hour with a fine spray immediately after planting to ensure 4" to 6" penetration of water into the soil. Roll sod with roller to ensure good contact with soil. 10.Continue watering sod similar penetration for ten (10) day s. 11.Erect a barrier of stakes and strings, and post warning signs where necessary , or as directed by the Landscape Architect. 12.Apply water as required to keep the sod damp at all times through germination and initial growth period. 13.Continued maintenance (mowing, fertilization, weeding, etc) of the sodded areas should be provided by a professional landscape maintenance contractor. Hydroseed Notes 1.Hydroseed Works: a. Seed which has become wet, moldy and otherwise damaged in transit, or in storage will not be acceptable. b. All grass seed shall be fresh, re-cleaned grass seed of the latest crop, mixed in the following proportions by weight and meeting the accepted standards of pure live seed content, purity and germination. c. Grass seed shall have the following minimum ration: Summer Mix: Cy nodon Dacty lon (Hulled Common Bermuda Grass) 85% pure live seed @ 75lbs Pure Live Seed (PLS) per acre. Bed Prep- Immediately after the finished grade has been approved, begin the hy droseeding operation to reduce excessive weed growth and erosion. c. Apply seed, fertilizer, and mulch by spray ing them on the previously prepared seedbeds in the form of an aqueous mixture and by using the methods and equipment described herin. d. Particular care shall be exercised by the contractor to insure that the application is made uniformly and at the prescribed rate and to guard against miss and overlapped areas. e. Where slope of areas to be grassed exceed a 3:1 H:V; an erosion control fabric shall be installed prior to the hy droseeding process. 4.Maintenance: a. Maintenance shall consist of weeding, fertilizing, insect control, watering, replanting, mowing, maintaining of existing grades and repair of any erosion damages. b. Guarantee growth and coverage of hy droseed planting shall be a minimum on ninety five percent (95%) of the area planted will be covered with specified planting after sixty (60) day s with no bare spots visible. c. Watering-Coordinate with the Owner to properly operate irrigation sy stem to assure a regular deep watering program. 5.Inspection and Final Acceptance: a. Final acceptance of the lawn establishment shall mean that hy droseed areas are ninety five (95%) uniform coverage of grass in excess of one inch height. No bare spots shall be acceptable.
